The roll was called by Mr. Mills and the Chairman was informed that a quorum was present. APPROVAL OF MINUTES: The minutes of the previous meeting were approved as written. FAMILY TRANSFER PLAT: FAMILY TRANSFER SUBDIVISION PLAT FT8-13, submitted by Dorothy V. Price, property owner, requesting a family transfer subdivision pursuant to Section 31- 1 514 of the Unified Development Ordinance. The affected property is identified as Zoning Map 74*25, Whaleyville Voting Borough, zoned A, Agricultural Zoning District. The first item of business was introduced by the Chairman followed by a staff report presented by David Parks, Planner II. Mr. Parks stated that this application is to subdivide a 1 acre parcel, which is to be conveyed to Thomas Price. A plat and deed of gift have been provided with a restrictive covenant that prohibits the transfer of the property within ten (10) years of its receipt by the Grantee. A letter from the Health Department approving the well and septic system has been provided. The Grantor and Grantee have acknowledged by the sworn affidavit that: 1) The purpose of this subdivision is to gift this parcel from Dorothy Price to her natural defined son, Thomas Price, who is over the age of 18 and has not previously received a parcel of land under the family transfer ordinance. 2) The recipient has acknowledged that title to the property must be held for 10 years from the date of receipt, other than to jointly hold title with his spouse, and that the family transfer parcel may not be sold, subdivided or otherwise conveyed during that 10 year holding period. 3) This parcel was created to provide a place of residence for the Grantee separate from the Grantor in order to keep the property in the immediate family. With these findings-of-fact, staff found that the applicant’s request meets the criteria for a family transfer subdivision and recommended approval of this application. 2 Commissioner Perry made a motion to approve this application, seconded by Commissioner Vacalis and passed by a voice vote of 8 to 0. PRELIMINARY SUBDIVISION PLAT: PRELIMINARY SUBDIVISION PLAT, PS02-14, Centerpoint Intermodal Center, submitted by David Andrea, L.S., applicant, on behalf of Brian Hollings for Centerpoint Properties Trust, a Maryland Real Estate Trust, property owner, in accordance with Section(s) 31-308 and 31-508 of the Unified Development Ordinance, to approve a Preliminary Subdivision Plat to create thirty-one (31) industrial and commercial parcels and associated right-of-way, on property located at 1005 Kenyon Court, Zoning Map 32B, Parcel(s) 3. The affected area is further identified as being located in the Holy Neck Voting Borough, zoned O-I, Office-Institutional zoning district; M-1, Light Industrial zoning district; and M-2, Heavy Industrial zoning district. The 2026 Comprehensive Plan designates this area as a part of the Central Suburban/ Urban Growth Area, Suburban development district. The next item of business was introduced by the Chairman followed by a staff report presented by Shanda Davenport, Principal Planner. Mrs. Davenport stated that the proposed preliminary subdivision plat represents the subdivision of Zoning Map 32B, Parcel 3 into the thirty-one (31) industrial and commercial parcels and associated public right-of-ways for the CenterPoint Intermodal Center. The preliminary plat is consistent with the conceptual site plan. The preliminary plat for the proposed subdivision complies with the lot layout and design standards of the UDO. The site is currently served by City sewer. Significant upgrades and infrastructure additions have already been completed by the developer for this project which allows the infrastructure to meet the needs of this project. The site is currently served by City 3 water. The change in street alignment will also allow for a significant water connection to be accomplished along the Kenyon Connector right-of-way. This water distribution linkage will significantly improve water pressures and allow greater fire protection. A traffic impact analysis was not required with the submission of this preliminary plat. Future right-of-way locations and easements associated with the widening of Holland Road are shown on the preliminary plat. At the time of final plat approval, these rights-of-way will be dedicated by the developer. A condition of approval is recommended to address this requirement. As proposed, the CenterPoint Intermodal Center will have three points of access; one on Kenyon Road and two on Holland Road. The first access point is CenterPoint West approximately 2,300 feet west of the existing Holland Road/Manning Bridge Road intersection. The third and final access point will be the Kenyon Road entrance, presently known as Kenyon Court. This preliminary plat connects Kenyon Court to CenterPoint East to form the Kenyon Connector. The Kenyon Connector will connect Kenyon Court and the existing portion of CenterPoint Drive East to provide enhanced connectivity of the street system and to provide for a truck route which will remove truck traffic from the portion of Kenyon Road from Kenyon Court south to the intersection with Holland Road. A cross-access connection to Zoning Map 32B Parcel 33B is a condition of zoning, per RZ2013-12, for this property. While not explicitly shown on the proposed 4 plat; this condition will still need to be provided on any final plat which is adjacent to that parcel. The proposed preliminary plat is in compliance with the minimum design standards of the UDO and the Comprehensive Plan; therefore, staff recommended approval of this preliminary plat with the conditions noted in the staff report. Commissioner Savage made a motion to approve this application with the conditions, seconded by Commissioner Singleton and passed by a voice vote of 8 to 0. PRELIMINARY SUBDIVISION PLAT REQUEST, PS03-14, Harbourview Station West: submitted by Thomas Vincent of Halvorsen Development Group, applicant, on behalf of Gary E. Ittner of HVS West, LLC, property owner, in accordance with Section(s) 31-308 and 31-508 of the Unified Development Ordinance, to approve a Preliminary Subdivision Plat to create nine (9) commercial parcels and associated rights-of-way, on property located at 5850 Harbour View Boulevard, Zoning Map 6, Parcel(s) 3A*2C. The affected area is further identified as being located in the Nansemond Voting Borough, zoned MUD, Mixed Use Development zoning district. The 2026 Comprehensive Plan designates this area as part of the Northern Suburban / Urban Growth Area, Mixed Use Core development district. The next item of business was introduced by the Chairman followed by a staff report presented by Brian Alperin, Principal Planner. Mr. Alperin stated that this application is to subdivide a 58.8 acre parcel. The preliminary plat will create nine (9) parcels for mixed use development ranging in size from 1 to 18.3 acres. The subdivision plat also identifies the location of future public rights-of-ways that will subdivide the land to form a pattern of blocks for development. The layout defines the future street grid for Harbour View Station and is consistent with the street network plan that was proffered 5 with the conditional zoning of the property. Three new public streets are planned to serve the development. In addition, the right-of-way for Bon Secours Drive will be dedicated up to the existing roundabout at the intersection of Bon Secours Drive and Harbour Town Parkway will be extended up to the northern property line in order to connect the two sections of this roadway to the north and south that have already been constructed. A minimum 10’ and a maximum 20’ setback will ensure that buildings frame the street. The parcels that front on Harbour View Boulevard will be required to comply with the front Special Corridor Overlay District setback along Harbour View Boulevard. City water and sewer are available in the area on Harbour Towne Parkway, Bon Secours Drive and Harbour View Boulevard. The Master Traffic Impact Analysis was reviewed and approved during the rezoning process. Specific roadway improvements have been proffered by the developer that address levels of service for surrounding streets. The property is located within a CBPA and development must comply with the stormwater management standards for both water quality and water quantity of stormwater runoff. Two parcels (8 & 9) have been designated for stormwater management facilities. Wetlands and floodplain are located on proposed parcels 1, 4, 5 and 8. There is a possibility that an RPA buffer exists adjacent to the wetland system located on the property. This will need to be clarified prior to approval of plans for development. The preliminary subdivision plat is consistent with the 6 requirements of the MUD Overlay District and conditional zoning of the property; therefore, staff recommended approval of this application. Commissioner Rountree made a motion to approve this application, seconded by Commissioner Goodman and passed by a voice vote of 8 to 0. PUBLLIC HEARINGS: REZONING REQUEST, RZ02-14, (Conditional), Ricky’s Custom Carts: submitted by R and K Properties, LLC, applicant and property owner, to rezone and amend the official zoning map of the City of Suffolk to change the zoning from B-1, Neighborhood Commercial zoning district, to B-2, General Commercial zoning district, for properties located at 106 Grove Avenue, Zoning Map 33A, Parcel(s) M34 and 1574 Holland Road, Zoning Map 33A, Parcel(s) BT*35 and BT*36. The affected areas are further identified as being located in the Holy Neck Voting Borough, zoned B-1, Neighborhood Commercial zoning district. The 2026 Comprehensive Plan designates this area as part of the Central Suburban / Urban Growth Area, Suburban development district. The next item of business was introduced by the Chairman followed by a staff report presented by Thomas Jordan, Planner II. Mr. Jordan stated that the applicant requested to rezone three parcels of land from B-1, Neighborhood Commercial District to B-2, General Commercial District. The rezoning will permit the expansion of the new and used customized golf carts sales and service business by allowing dry storage of golf cart and parts. The rezoning of 1574 Holland Road will serve to bring the parcels under a consistent zoning district with the adjacent commercial parcels. Existing off- street parking spaces are located both in front of and to the rear of the multi-tenant building. The parcel will be able to accommodate the minimum required parking after 7 the construction of the proposed storage building. The applicant proffered conditions on the rezoning request which control the use, design and construction of the proposed storage building. The storage building will only be utilized for inventory storage associated with Ricky’s Custom Carts. The metal building will utilize beige wall panels with concealed fasteners and a galvanized metal roof. The applicant also proffered a 20’ street setback from Grove Avenue, in place of the minimum 10’ street setback in the B2, zoning district. The subject properties are located within the Central Suburban/Urban Growth Area. City water and sewer are currently available to the subject parcels. However, the storage building is not proposed to utilize water or sewer service. The Department of Public Works, Traffic Engineering Division, reviewed the application and recommended approval. A preliminary design for the Holland Road widening project indicated that driveway access to the subject properties will no longer be provided directly from Holland Road. As currently planned, future access will be from Grove Avenue. The Department of Public Works reviewed the application and noted the proposed building will result in a net increase in impervious area on the site. A Site Plan, addressing all applicable stormwater regulations and a land disturbing permit will be required to be approved prior to commencement of construction. In addition, the area to be rezoned will expand the existing B-2, General Commercial zoning already in place along Holland Road with little impact to 8 residential areas. Staff recommended approval of this conditional rezoning request as proffered. The public hearing was opened and speaking in favor of this application was Ricky Johnson, applicant. He stated that this rezoning is for the expansion of his business and asked for the Commission’s approval of this application. Speaking in opposition was Ray Bennett, 107 Northbrook Avenue, Suffolk, VA. He stated that Mr. Johnson has done a wonderful job cleaning up the property. He is just opposed of a metal building being at the back of his property. There being no more speakers, the public hearing was closed. Commissioner Rountree made a motion to approve this application with the proffers, seconded by Commissioner Perry and passed by a recorded vote of 7 to 1. CONDITIONAL USE PERMIT REQUEST, C07-14, 3909 Nansemond Parkway: submitted by Jason R. Fawcett and Roger W. Fawcett of Fawcett’s Properties, LLC, agents, on behalf of Mike Finks, Finks Auto Wreckers Service, applicant, on behalf of James R. Rountree, property owner, in accordance with Section(s) 31-306 and 31-406 of the Unified Development Ordinance, to grant a Conditional Use Permit to establish an automobile storage lot including vehicle tow yard, on property located at 3909 Nansemond Parkway, Zoning Map 19, Parcel(s) 46*3. The affected area is further identified as being located in the Cypress Voting Borough, zoned M-2, Heavy Industrial zoning district. The 2026 Comprehensive Plan designates this area as part of the Northern Suburban/ Urban Growth Area, Suburban development district. The next item of business was introduced by the Chairman followed by a staff report presented by David Parks, Planner II. Mr. Parks stated that the applicant proposed to 9 utilize a 40x90 space within the existing work yard that will be used to store the towed cars by Finks Auto Wrecker Service. The applicant proposed to operate the storage yard with an administrative office that will be open eight hours a day to provide owners or insurance companies access to the vehicles. There will be no more than 15 vehicles stored within the yard at any time and the vehicles will not remain on site longer than 30 days. After 30 days, the vehicles will be removed and transported to an auction facility or salvage yard for disposal. There will be no automobile repair on the site. The applicant will provide an eight foot chain link fence around the perimeter of the storage yard. The proposed automobile storage yard will be located within the existing work yard of Elizabeth River Landscape Management Company. This proposed use will not have a need for any public utilities. The existing surface of the lot is crushed and compacted gravel. There is no proposed land disturbance or increase in impervious area. The parcel has two driveways that provide access off of Nansemond Parkway. The proposed automobile storage yard will utilize the northern driveway for access to the tow lot. Traffic Engineering stated that they do not have any concerns with this proposed use and existing configuration is adequate. There are no improvements or modifications needed for this request. As required by the UDO, there are a set of standards that must be complied with when considering approval of a conditional use permit. Staff reviewed the criteria for this proposed project and this 10 request will conform to the required criteria as described in the staff report. Therefore, staff recommended approval of this application with the conditions noted in the staff report. The public hearing was opened and speaking in favor of this application was Roger Fawcett, property owner. He asked for the Commission’s approval of this application. There being no speakers in opposition, the public hearing was closed. Commissioner Vacalis made a motion to approve this application with the conditions, seconded by Commissioner Goodman and passed by a recorded vote of 7 to 0 to 1. (Commissioner Rountree abstained.) EXCEPTION REQUEST, EX01-14, submitted by Brian Layne of Parrish-Layne Design Group, applicant, on behalf of Carl B. Price, property owner, to grant an after- the-fact Exception to the development criteria and buffer area requirements of the Chesapeake Bay Preservation Area to permit a variety of existing accessory structures and other impervious cover to encroach into the 100-foot Resource Protection Area. The affected property is located at 2913 Pinewood Circle and is further identified as Zoning Map 11B, Parcel 32, Sleepy Hole Voting Borough, zoned RL, Residential Low Density Zoning District. The 2026 Comprehensive Plan designates this as a part of the Northern Suburban/ Urban Development Area (Suburban). The next item of business was introduced by the Chairman. Mr. Mills stated that at the Commission’s meeting of April 15th, the Commission tabled this application for thirty (30) days to give the applicants and staff time to research documentation related to handicap accessibility within the CBPA Overlay District. Staff did re-review Section 31-415 of the UDO and it allows driveway to encroach into the RPA when no 11 alternative route exist. Given the topography of the lot and the documentation provided by the application, it appears that the current location and configuration of the driveway is the only place on the lot to safely provide access to the downstairs portion of the house which is where their handicapped son resides. In that regard, staff recommended approval of this application with the conditions noted in the staff report. The public hearing was opened and speaking in favor of this application was Brian Layne, Parrish Layne Design Group. Also, speaking in favor of this application was Mrs. Price, 2913 Pinewood Circle, Suffolk, VA. She asked for the Commission’s approval of this application. There being no speakers in opposition, the public hearing was closed. Commissioner Rountree made a motion to approve this application with the conditions, seconded by Commissioner Savage and passed by a recorded vote of 8 to 0. STATUS REPORT: Mr. Mills gave the results of the April 16, 2014 City Council meeting. OTHER BUSINESS: Commissioner Singleton made a motion to initiate an ordinance text amendment in reference to Animal Pounds/Animal Shelters. This motion was seconded by Commissioner Rountree and passed by a voice vote of 8 to 0. 12 Commissioner Singleton made a motion to initiate an ordinance text amendment in reference to changes to the State Code during the 2014 General Assembly session. This motion was seconded by Commissioner Rountree and passed by a voice vote of 8 to 0. Robert Dwyer, II Management for Harvel One, LLC, Harvel Two, LLC and Harvel Three, LLC, and City National Bank, Successor through merger to Community Bank, applicants and property owners, for the purpose of creating two (2) commercial parcels totaling approximately 3.825 acres. APPLICANT: H. Robert Dwyer, II Management for Harvel One, LLC, Harvel Two, LLC and Harvel Three, LLC, and City National Bank, Successor through merger to Community Bank, applicants and property owners. LOCATION: The affected property is located at 1055 Centerbrooke Lane and is further identified as Zoning Map 25N, Parcel 4B. PRESENT ZONING: The property is currently zoned OI, Office Institutional District. EXISTING LAND USE: The site is partially developed with an office building and related parking located on the western portion of the property. PROPOSED LAND USE: The property is proposed for commercial development. The plat proposes to create a separate parcel for commercial development. SURROUNDING LAND USES: North – Vacant commercial parcel, (zoned OI). South – Church (zoned OI). COMPREHENSIVE PLAN: The City’s 2026 Comprehensive Plan identifies this property as being located within the Central Suburban/Urban Growth Area (Suburban District). The proposed subdivision is consistent with this designation. CHESAPEAKE BAY PRESERVATION AREA DESIGNATION: The property is located within the City’s Chesapeake Bay Preservation Area Overlay District and is designated as a Resource Management Area (RMA). CASE HISTORY: Lot 4 was first created by the final plat (FS2003-14) for Centerbrooke Village, approved October 3, 2003. Lot 4 was then subdivided into Lot 4A and Lot 4B as well as the dedication of the Romans Road right-of-way via FS2006-03. MS2007-51 vacated the lot line between Lot4A and Lot 4B, combining the two lots into the existing subject parcel, Lot 4B. In October of 2012, the Planning Commission approved PS02-12, which proposed the same subdivision as is presently under consideration. The preliminary subdivision PS02-12 expired prior to submission of a final plat. Consequently, the owners have submitted this request for consideration. Planning Commission June 17, 2014 Page 2 STAFF ANALYSIS The subdivision plat proposes to subdivide a 3.825 acre parcel located within Centerbrooke Village. The site was initially approved, and partially developed, as a single office park consisting of 3 buildings in a condominium form of ownership. The plat would create two (2) parcels for commercial development which can be held under separate ownership. Parcel 4B is partially developed with an office building and associated parking. The proposed subdivision would create two conforming lots for the existing development, Lots 4-B-1 and 4-B-2, while allowing future development of lot 4-B-2 to occur. A revised site plan addressing the conditions of the previously approved preliminary plat has been submitted and is currently under review. CONSIDERATIONS 1. DESIGN ISSUES The lots proposed for this subdivision, Lot 4-B-1 and Lot 4-B-2, both are conforming and will meet all of the dimensional standards required for the OI zoning district. Each parcel contains adequate area and frontage for this district. The existing building meets all existing and proposed setbacks. 2. PUBLIC UTILITIES The site is served by public sewer and portions of the utility infrastructure are completed. Per the Department of Public Utilities, the segment of existing gravity sewer within the proposed variable width public utility easement will need to be inspected and approved prior to City approval of the final plat. Public water is available to the site. Each of the proposed parcels must have individual water service lines and meters for both domestic and irrigation service. The on-site water system serving both parcels must be physically disconnected from each other. A site plan has been submitted to the City for review and approval that identifies the proposed public utility easements and modifications required to the existing water system. A new domestic water service and meter is shown for Parcel 4-B-1. Since the water meter location shown on the preliminary subdivision plat is outside the existing right of way along Centerbrooke Lane, a 10’ by 15’ City of Suffolk public utility easement needs to be called out at the location of the proposed water meter. 3 STREETS/TRAFFIC IMPACTS The City Traffic Engineer has reviewed the subdivision plat and does not have any concerns at this time. A new entrance off of Centerbrooke Lane is proposed to service the existing development on proposed Parcel 4-B-1. Traffic Engineering has advised that this new entrance will be allowed. Planning Commission June 17, 2014 Page 3 4. ENVIRONMENTAL/STORMWATER The Stormwater Master Plan for Centerbrooke Village indicates that Lot 4-B was designed to not exceed 62% imperviousness. The developer must ensure that the development for both parcels maintains this designed imperviousness or a revision of the Master Plan will be required. Any revisions to the previously approved Master Plan could result in further review under the new Virginia Stormwater Regulations. The subject property is located within the Resource Management Area (RMA) under the Chesapeake Bay Preservation Area Overlay District. There are wetlands located on the property. Any proposed development will have to comply with the requirements of the Chesapeake Bay Preservation Area Overlay District. RECOMMENDATION The proposed preliminary plat is in compliance with the minimum design standards of the Unified Development Ordinance and is consistent with the 2026 Comprehensive Plan, which identifies the property as being within the Central Suburban/Urban Growth Area with a ‘suburban’ district designation. In this regard, staff recommends approval of the preliminary subdivision plat.
