1. Petition by Bryan Thomas and Madelin Miriam Schwitzke to annex Dorchester County TMS# 144-16-02-003
(approximately 0.70 acres) located at 104 King Charles Circle, currently zoned R-1 Single-Family Residential in
Dorchester County and will be zoned R-2 Single-Family Residential upon annexation into the Town of Summerville’s
municipal limits (Council District 5).

The Town of Summerville Planning Commission Meeting
Minutes
April 16, 2018
This meeting of the Town of Summerville Planning Commission was attended by Commission Members,
Jim Reaves, Chairman; Elaine Segelken, Vice Chairman; Charlie Cuzzell; Will Rogan; Margie Pizarro; and
Sarah Bares. Staff in attendance included Jessi Shuler, AICP, Director of Planning and Bonnie Miley,
Assistant Town Engineer.
Jim Reaves, Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes:
The Chairman called for a motion for the approval of the minutes from the meeting on March 19, 2018.
Ms. Segelken made a motion to approve the minutes as presented with Mr. Cuzzell making the second.
Following no discussion the motion carried.
Public Hearings:
The first public hearing opened at 4:01 PM and was for the request to rezone portion of TMS# 144-00-00-
080, Greenwave Boulevard, approximately 2.0 acres, and owned by Commissioner of Public Works for
the Town of Summerville from PL, Public Land to B-3, General Business. Mr. Reaves introduced the
request. Hearing no public comment this public hearing was closed at 4:02 PM.
The second public hearing opened at 4:02 PM and was for the request to rezone TMS# 136-07-02-004,
1225 Central Avenue, approximately 1.58 acres, and owned by Tracy M. Page from R-1, Single-family
Residential to B-2, Neighborhood Business Center. Mr. Reaves introduced the request. Tracy Page, the
owner, explained that she wished to convert the existing house on the property to her dental office and
convert an existing barn/shed in the rear of the property into her home. Hearing no further public
comment this public hearing was closed at 4:03 PM.
The third public hearing opened at 4:04 PM and was for the request to rezone TMS# 130-15-01-007, 701
W. 5th North Street, approximately 0.452 acres, and owned by Catherine A. Strickland from R-2, Single-
family Residential to B-2, Neighborhood Business Center. Mr. Reaves introduced the request. Mike
Strickland, one of the owners, explained that the existing house was between a chiropractor and an auto
repair business, and they would like to move their business office into the building. He stated that it
would only be about five or six people in the office with some technician’s vehicles parked as well.
Bonnie Phelps of 304 Cleveland Street expressed her concerns about traffic at the intersection of
Cleveland and W. 5th North Street and cars possibly parking on Cleveland Street and blocking the sight
lines. She also questioned whether the business planned to have a trash can or a dumpster. Catherine
Strickland addressed her concerns, stating that there was a circular drive that accessed W. 5th North Street,
not Cleveland Street, and they planned to add parking on the side closest to the auto repair shop. She also
confirmed that they did not plan to have a dumpster. Hearing no further public comment this public
hearing was closed at 4:07 PM.
The fourth public hearing opened at 4:07 PM and was for the request to rezone TMS# 130-15-05-001,
801 N. Palmetto Street, approximately 2.27 acres, and owned by Samuel Hiott, Helen Hiott, and Mary
Coker from PUD, Planned Development District to R-2, Single-family Residential. Mr. Reaves
introduced the request. Yeadon Smith of 806 N. Hickory Street inquired as to what the current PUD
zoning would allow on the property. Ms. Shuler responded that this property was annexed into the town
as a part of a larger annexation by election back in the mid to late 1980s, and all of the properties were
then zoned by Town Council following that. She stated that in that zoning, this property was shown as R-
4, which was changed to PUD in 2006, but no approved plan existed for the property, so the only thing
that would be allowed would be single-family and mobile homes as currently existed on the lot. Mr.
Smith then asked what uses would be allowed in the R-2 zoning. Ms. Shuler explained that the R-2
zoning only allowed for detached single-family homes with a minimum lot size of 8,500 square feet. One
of the property owners, Ms. Coker or Ms. Hiott, then questioned why the rezoning was required if
detached single-family homes were already allowed on the property, and Ms. Shuler responded that since
there was no approved plan for the property, in order to allow any subdivision into additional lots, the
property either had to have a PUD approved that specified lot and subdivision requirements or rezone to a
different zoning district with specified lot and subdivision requirements. Hearing no further public
comment this public hearing was closed at 4:10 PM.
The final public hearing was opened at 4:10 PM and was for a petition by Edward Joseph Kirsch and
Brittany Lynn Kirsch to annex Dorchester County TMS# 145-09-02-006 (approximately 0.78 acres)
located at 102 King Charles Court, currently zoned R-1 Single-Family Residential in Dorchester County
and will be zoned R-2 Single-Family Residential upon annexation into the Town of Summerville’s
municipal limits. Ms. Shuler explained that the property owner was unable to attend as he was out of
town, but he planned to build a house on the property, which required the petition for annexation in order
to receive sewer service from SCPW. Ms. Segelken asked for confirmation that this property was
considered contiguous by a single point, and Ms. Shuler confirmed that this was the case. With no further
comment this public hearing was closed at 4:11 PM.
Old Business
There were no items under Old Business.
New Business:
The first item under New Business was New Street Names (as applicable). Ms. Shuler stated that staff did
not have any names for approval.
The second item under New Business was the request to rezone portion of TMS# 144-00-00-080,
Greenwave Boulevard, approximately 2.0 acres, and owned by Commissioner of Public Works for the
Town of Summerville from PL, Public Land to B-3, General Business. Mr. Cuzzell recused himself from
this agenda item as he is employed by the owner. Ms. Segelken made a motion to recommend rezoning
to Town Council, and Mr. Rogan made the second. The motion passed unanimously with Mr. Cuzzell
recusing.
The third item under New Business was the request to rezone TMS# 136-07-02-004, 1225 Central
Avenue, approximately 1.58 acres, and owned by Tracy M. Page from R-1, Single-family Residential to
B-2, Neighborhood Business Center. Ms. Segelken made a motion to recommend rezoning to Town
Council, and Dr. Bares made the second. The motion passed unanimously.
The fourth item under New Business was the request to rezone TMS# 130-15-01-007, 701 W. 5th North
Street, approximately 0.452 acres, and owned by Catherine A. Strickland from R-2, Single-family
Residential to B-2, Neighborhood Business Center. Dr. Bares made a motion to recommend rezoning to
Town Council because the request was consistent with the Town’s Comprehensive Plan, and Mr. Cuzzell
made the second. The motion passed unanimously.
The fifth item under New Business was the request to rezone TMS# 130-15-05-001, 801 N. Palmetto
Street, approximately 2.27 acres, and owned by Samuel Hiott, Helen Hiott, and Mary Coker from PUD,
Planned Development District to R-2, Single-family Residential. Ms. Pizarro recused herself from this
agenda item as she is on the Board of Dorchester Habitat for Humanity, which is planning to purchase a
portion of the land. Dr. Bares made a motion to recommend rezoning to Town Council because the
request is more consistent with the zoning in the surrounding area, and Ms. Segelken made the second.
The motion passed unanimously with Ms. Pizarro recusing.
The final item under New Business was the petition by Edward Joseph Kirsch and Brittany Lynn Kirsch
to annex Dorchester County TMS# 145-09-02-006 (approximately 0.78 acres) located at 102 King
Charles Court, currently zoned R-1 Single-Family Residential in Dorchester County and will be zoned R-
2 Single-Family Residential upon annexation into the Town of Summerville’s municipal limits. Mr.
Cuzzell made a motion to recommend annexation to Town Council, and Mr. Rogan made the second.
The motion passed unanimously.
Miscellaneous:
Ms. Shuler provided a brief update on the timeline for the UDO. She stated that following the public drop-
in that evening from 6:00 – 8:00 PM in Town Council Chambers, the next step would be to work on
revisions to the draft document to produce a final draft before the planned public hearing at the Planning
Commission meeting in June. If the Planning Commission was satisfied with the final draft they would
then recommend it to Town Council. Mr. Reaves inquired as to when the final draft would be ready, and
Ms. Shuler responded that she hoped that it would be ready at least 30 days before the public hearing, but
that the public hearing would not be advertised and notices and letters about the hearing would not be sent
out until the final draft was ready and available on the website for review. The Commission members
expressed their agreement that at least 30 days would be ideal for review prior to the public hearing. Dr.
Bares then addressed the Commission and explained that she still had several overarching concerns about
the UDO that she would like to see addressed, including how and when violations are issued or handled;
how stormwater is handled following construction; the keeping of animals; signs in residential districts;
residential care homes; tree removal provisions; and placing monetary burdens on individual citizens. She
provided staff and the Commission members with a hardcopy of these concerns.
Adjourn
With no further business for the Commission, Mr. Cuzzell made a motion to adjourn with Dr. Bares making
the second, and Mr. Reaves adjourned the meeting at 4:21 PM.
