The Town of Summerville Planning Commission Meeting
Minutes
August 19, 2024
This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and
was attended by Commission Members, Jim Bailey, Vice Chairman; Kevin Carroll; Charlie Stoudenmire;
Tom Hart; and Jill Weatherford. Jim Reaves and Elaine Segelken were unable to attend. Staff in attendance
included Jessi Shuler, AICP, Director of Planning. The public was invited to attend in person, or they
viewed the meeting via live-stream.
Jim Bailey, Vice Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes:
The Vice Chairman asked if there were any edits or additions to the minutes from the meeting on June 17,
2024. Mr. Stoudenmire made a motion for approval, and Mr. Hart made the second. The motion passed
unanimously.
Public Hearings:
The first public hearing opened at 4:01 PM and was for the request to rezone TMS# 145-07-05-055,
located at 122 Pebbles Lane, totaling approximately 4.67 acres, and owned by Pebbles Brunson, from
GR-5, General Residential (5 units/acre), to AC, Agricultural Conservation. (Council District 3). Mr.
Bailey introduced the item. Pebbles Brunson explained that she was a horticulture student, and her father
died in April and left the property to her. She has several ideas for agricultural use of the property.
Hearing no public comment, this public hearing was closed at 4:02 PM.
The second public hearing opened at 4:02 PM and was for the proposed amendments to the Summerville

Unified Development Ordinance (UDO), Chapter 13. Ms. Shuler briefly explained that the proposed
amendments were requested by the Town’s Attorney, as the Town cannot indemnify anyone, and an
appeal cannot go directly to the Master-In-Equity. Hearing no public comment, this public hearing was
closed at 4:04 PM.
The third public hearing opened at 4:04 PM and was for the request to rezone a portion of TMS# 136-11-
07-025, located at White Boulevard, totaling approximately 0.07 acres, and owned by Richard G. and Lea
I. Shoup, from GR-5 to PUD, and a portion of TMS# 136-11-07-040, located at 119 Pamela Lane,
totaling approximately 0.03 acres, and owned by Stephanie L. Bates, from PUD to GR-5, to allow a land
swap. (Council District 1). Ms. Shuler clarified that this rezoning would not change the existing or
intended use of either property but was only needed so that the properties could legally swap small
triangles of land at the rear of each property as shown on the exhibit. Following Ms. Shuler’s
explanation, the member of the public in attendance stated that she did not have any issues with what was
proposed, and the public hearing was closed at 4:07 PM.
Old Business
There were no items under Old Business.
New Business:
The first item under New Business was New Street Names. Ms. Shuler stated that they had street names
in two different developments. The proposed name of Brickell Ave. is for the One at Summerville
Apartments off N. Maple St. Only one street name is needed. Mr. Hart made a motion to approve
Brickell Ave., and Mr. Carroll made the second. The motion passed unanimously.
Ms. Shuler stated that the second set of names is for the Downtown Nexton Apartments, and two names
are needed, but three were provided. Ms. Weatherford made a motion to approve Midsummer Dr. and
Pocket Ln., and Mr. Hart made the second. The motion passed unanimously.
The second item under New Business was the request to rezone TMS# 145-07-05-055, located at 122

UDO AMENDMENTS
STAFF REPORT
PLANNING COMMISSION
September 16, 2024
Proposed amendments to the Unified Development Ordinance, Chapter 13, Administration,
Sections 13.3.4 and 13.3.6
Reason for request: These amendments are being requested from Town Council. In Section
13.3.4, The TPB is the only planning board that does not have seven members, so the number is
being increased from 5 to 7 to allow each Councilmember and the Mayor to have an appointment
to that board. In Section 13.3.6, the change is being made so that a minimum of 5 of the 7
members reside within the Historic District (currently three at-large residents of the Historic
District are required). Since these four seats have other specific qualifications, a caveat was
added to allow less than five if no one can be found that meets both the residency requirement
and the other requirement as long as it is a unanimous vote of Council.
AN ORDINANCE
TO AMEND THE SUMMERVILLE UNIFIED DEVELOPMENT ORDINANCE, CHAPTER
13, SECTION 13.3.4, TREE PROTECTION BOARD, SUBSECTION B, MEMBERSHIP, TO
INCREASE THE MEMBERSHIP FROM FIVE TO SEVEN.
WHEREAS, all Town Boards, Commissions and Committees, with the exception of the Tree
Protection Board, consist of seven members, and
WHEREAS, the Tree Protection Board currently consists of five members, and
WHEREAS, it is the desire of Council to have the membership of the Tree Protection Board
consistent with all other Boards, Commissions and Committees.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council Members of the Town of
Summerville, in Council assembled, that:
1. The above recitals are hereby incorporated herein to the same extent as if set out
verbatim.
2. The Summerville Unified Development Ordinance, Section 13.3.4, Tree Protection
Board, Subsection B, Membership, is amended to read as follows:
13.3.4 TREE PROTECTION BOARD
B. Membership: Five (5) Seven (7) members comprised as follows:
1. One certified arborist (who may or may not be a resident);
2. Four Six (6) citizens of the Town who are knowledgeable in forestry or
horticultural matters.

AN ORDINANCE
TO AMEND THE SUMMERVILLE UNIFIED DEVELOPMENT ORDINANCE,
CHAPTER 13, SECTION 13.3.6, HISTORIC DISTRICT/BOARD OF ARCHITECTURAL
REVIEW, SUBSECTION B, MEMBERSHIP, OF THE TOWN OF SUMMERVILLE
CODE OF ORDINANCES.
BE IT ORDAINED by the Mayor and Council Members of the Town of Summerville, in Council
assembled, that the Summerville Unified Development Ordinance, Section 13.3.6, Historic
District/Board of Architectural Review, Subsection B, Membership, is amended to read as follows:
13.3.4 HISTORIC DISTRICT/BOARD OF ARCHITECTURAL REVIEW
B. Membership: Seven (7) members comprised as follows:
1. One architect or architectural designer or someone knowledgeable in historic
building design and construction;
2. One member of a recognized art association;
3. One member of the Town Preservation Society;
4. One licensed real estate agent or appraiser; and
5. Three (3) residents of the Historic District.
6. Of the four designated seats, at least two of the four, must also be residents of the
Historic District. However, if no residents of the Historic District apply who meet
the qualifications of such seat, a qualified applicant that is not a resident of the
Historic District may be appointed by a unanimous vote of Town Council.
