Authorize the Town Administrator to enter into a contract with GEL for Professional Services for the Summerville Ashley River Preserve up to the amount of $234,535. Funds to come from fund balance and be reimbursed with Oakbrook TIF bond proceeds. Request from the Parks and Recreation Department. 12. Authorization to issue a purchase order to STI Turf Care in the amount of $41,085.86 for two SCAG zero-turn mowers. This is on state contract. Funds to come from Hospitality Funds. Previously approved purchase order #22-5094 in the amount of $22,730.58 for one mower was voided due to non-delivery of ordered equipment. Request from the Parks and Recreation Department. 13. Authorization to issue a purchase order in the amount of $48,500 to Brannen Motor Company for the purchase of 1500 Chevrolet Pick-up truck from ARPA. Request from Fire and Rescue. Authorization to issue a purchase order in the amount of $44,960.06 to Rhinehart Fire Service for the purchase of 4 Air packs with spare cylinders from ARPA. Request from Fire and Rescue. Authorization to issue a purchase order for $1,993,275.96 for Banks Construction Company for the pavement reconstruction of Midland Parkway. Funds will be reimbursed from the Dorchester County Transportation Committee for $850,000 and reimbursed from Dorchester County for $1,143,275.96 contingent on the approval of an Intergovernmental Agreement with Dorchester County. Authorization to issue a purchase order for $184,279.66 for Infrastructure Consulting & Engineering for Construction Engineering Inspection Services for the Midland Parkway Project. Funds will be reimbursed from Dorchester County for $184,279.66 contingent on the approval of an Intergovernmental Agreement with Dorchester County. Request from Public Works Department. c. Parker Kima Garten-Schmidt William McIntosh Memorandum To: Planning & Development Committee From: Jessi Shuler, Director of Planning Date: March 6, 2023 Subject 1: Staff Report for Amendment to Chapter 3, Section 3.3 and 3.4 – Use Provisions ________________________________________________________________ ISSUE The requested amendment is proposed by staff to address the absence of an event venue use (for smaller events) in the UDO. BACKGROUND/DISCUSSION The amendment adds the use to the use chart and adds conditions for it where it is a conditional use or a special exception in certain zoning districts. Staff attempted to account for and address all impacts that could result from this type of use. The definition is included in amendments to Chapter 15 (listed separately). No public comment was received at the required public hearing. RECOMMENDATION Planning Commission made a recommendation for approval of the amendment on a unanimous vote. Subject 2: Staff Report for Amendment to Chapter 13, Section 13.3.5 – Design Review Board ________________________________________________________________ ISSUE The requested amendment is proposed by Town Council to change the composition of the DRB. BACKGROUND/DISCUSSION Currently two architects are required on the seven-member board, and this amendment would reduce that to one architect and increase the two at-large seats to three. In addition, it would add a landscape contractor to the seat that currently requires a landscape architect, landscape designer, or urban designer. This amendment received first reading at the January 12th Council meeting. A second architect was 200 South Main Street, Summerville, SC 29483-6000 * 843.871.6000, Fax: 843.871.6954 www.SummervilleSC.gov added to the composition of the DRB when the UDO was adopted with the reasoning being to provide more than one architect’s viewpoint on the Board. This amendment would go back to having one architect on the DRB and three at-large members. No public comment was received at the required public hearing. RECOMMENDATION Planning Commission made a recommendation for approval of the amendment on a unanimous vote. Subject 3: Staff Report for Amendment to Chapter 13, Section 13.8.2(A)(4) – Certificate of Appropriateness (Major) ________________________________________________________________ ISSUE The requested amendment is proposed by staff to correct a contradiction within the existing ordinance. BACKGROUND/DISCUSSION Section 13.8.1 includes language that allows staff to approve the demolition of a non-contributing accessory structure in the Historic District; however, the current language in this section contradicts that and requires all demolition be approved by the BAR. This amendment would remove that contradiction by referencing Section 13.8.1, which would avoid confusion over the process. No public comment was received at the required public hearing. RECOMMENDATION Planning Commission made a recommendation for approval of the amendment on a unanimous vote. Subject 4: Staff Report for Amendment to Chapter 15, Definitions ________________________________________________________________ ISSUE The requested amendment is proposed by staff to add the definition for an Event Venue and correct the definition for Utility Pole. BACKGROUND/DISCUSSION With the proposed amendment to add the Event Venue Use, the use definition needs to be added to the definitions. In error, Utility Pole is currently defined the same as Unincorporated Areas. No public comment was received at the required public hearing. RECOMMENDATION Planning Commission made a recommendation for approval of the amendment on a unanimous vote. 200 South Main Street, Summerville, SC 29483-6000 * 843.871.6000, Fax: 843.871.6954 www.SummervilleSC.gov AN ORDINANCE TO AMEND THE SUMMERVILLE UNIFIED DEVELOPMENT ORDINANCE CHAPTER 3 – USE PROVISIONS SECTION 3.3 – TABLE OF PERMITTED USES; SECTION 3.4 – CONDITIONAL USE PROVISIONS BE IT ORDAINED by the Mayor and Council members of the Town of Summerville, in Council assembled, that the Summerville Unified Development Ordinance, Chapter 3 – Use Provisions, Section 3.3 – Table of Permitted Uses and Section 3.4 – Conditional Use Provisions, are amended as follows: 3.3 TABLE OF PERMITTED USES Under Commercial/Entertainment, add Event Venue permitted as follows: N-R N-MX D-MX UC-MX GR-2 GR-3 GR-5 MF-R MH-R N-B G-B L-I H-I AC PL Event Venue --- C P P SE SE SE SE SE C P P --- SE P 3.4.5 COMMERCIAL/ENTERTAINMENT B. Event Venue (N-MX, GR-2, GR-3, GR-5, MF-R, MH-R, N-B, AC) 1. Accessory Use in Residential Districts: This use may only be allowed in GR-2, GR-3, GR-5, MF- R, MH-R, and AC districts as an accessory use to a lawful principal use with an approved Special Exception by the BZA, and in those districts no more than six events may occur annually. a. Owner-Occupancy Required: In GR-2, GR-3, and GR-5 districts the Event Venue shall be owned and operated by at least fifty percent (50%) of the record ownership of the real property upon which the Event Venue is located and said owner(s) shall be a resident(s) of the subject property. For purposes of this Zoning Ordinance, to qualify as a resident(s) of a property, the person(s) shall use that property as their legal voting address, South Carolina driver’s license address or South Carolina Identification Card address and four percent (4%) homeowners assessment ratio address, and shall actually reside on the property at least 183 days each year and be on site at any time an event is occurring. If an Event Venue is owned by a Limited Liability Corporation (LLC), Corporation or any other type of business entity, at least fifty percent (50%) of the ownership of said LLC, corporation or other type of business entity shall be by the resident(s) as described above together with the same restrictions and qualifications set forth. 2. Minimum Lot Size Required: Any lot for which an Event Venue is proposed shall be a minimum of one (1) acre in size. 3. Separation Required: Any building or outdoor areas associated with the use must be at least 100 feet from all dwelling units not located on the same parcel as the venue and all undeveloped residentially zoned properties. 4. Screening: Such use must have existing or proposed screening of buffering, in terms of type, dimensions, and character to eliminate or reduce substantial, adverse nuisance, sight, or noise impacts on adjacent and nearby properties containing less intensive uses. 5. Operational Plan Required: An operational plan shall be submitted describing generally how the facility will operate. Substantive changes to the operational plan shall require additional approval. The operational plan shall include, at a minimum, the following items: a. A scaled site plan illustrating proposed uses, structures, drive aisles, access points, and off- street parking. b. Maximum capacity of the facility, based on building code, fire code, and/or parking requirements. c. The name and contact information for the on-site manager. An on-site manager shall be present and available for the duration of all events occurring at the venue. Up-to-date contact information for the on-site manager shall be included in the venue’s advertising materials and in the venue’s operations plan. Updated contact information for the on-site manager shall be provided to Town Staff any time the on-site manager’s contact information changes. d. Duration of time that the event venue will be operational (seasonal or year-round) and daily hours of operation. e. Types and number of events anticipated and/or marketed. f. A solid waste management plan indicating how solid waste will be disposed of and managed. g. A noise control plan demonstrating how the standards in Town Code Chapter 12, Article II – Noise will be met. 6. Parking: Parking shall meet requirements of Section 7.3 and 7.6, and all parking shall be contained on-site to meet a minimum requirement of one space for every four occupants permitted by applicable building code or fire code requirements. 7. Vehicular Access: Vehicular access to the site shall be adequate in terms of width, vertical clearance, and construction to support emergency vehicles, and shall meet all applicable provisions of the adopted Fire Code. 8. Hours of Operation: The venue shall only operate between the hours of 8:00 a.m. and 10:00 p.m. In residential districts, the BZA may further limit the hours of operation if it finds it necessary to mitigate adverse impacts to adjoining uses and retain neighborhood compatibility. 9. Operational Impacts: At all times, the venue shall comply with Town Code Chapter 12, Article II – Noise. 10. Compliance: The venue shall meet all tax (including business licenses), fire and building code, Americans with Disabilities Act (ADA) accessibility regulations, South Carolina Department of Health and Environmental Control (SCDHEC), zoning and development, stormwater management, and applicable local, state, and/or federal requirements prior to the commencement of operations and at all time thereafter. 11. Insurance Required: Valid liability insurance is required for the Owner, Property Management Company, or any other entity. 12. Safety Inspection: An initial safety inspection shall be conducted by the Town. Additional inspections for compliance with the regulations in this section may be performed by the Town if deemed necessary and with 24-hour notice to the permit holder/property manager. 13. The conditional use or special exception permit shall be limited to the applicant, or a legal entity authorized to be represented by the applicant, and shall not be transferrable. All of the subsequent subsections in 3.4.5 will be re-lettered based on the addition of Event Venue as Letter B. Ratified this day of , 2023 A.D. Applicability (Major): A Certificate of Appropriateness from the Board of Architectural Review (BAR) shall be required prior to the issuance of a building permit for any construction activity in any historic district or for individually-listed landmarks outside of a historic district, including: 1. New structures; 2. Modification or expansion of existing structures; 3. Relocation of any existing structure; and 4. Demolition or partial demolition of any structure, except as detailed in Section 13.8.1.A.6. 5. However, this section shall not prevent the construction, modification, repair, moving or demolition of any structure under a permit issued by the building department under the prior ordinance. An Event Venue may be comprised of a permanent structure(s), temporary structure(s), uncovered outdoor gathering areas(s), or any combination thereof. This definition does not include community facilities, cultural facilities, religious institutions, conference/convention centers, commercial lodging (hotel/extended stay), or publicly-owned facilities. Utility Pole: A pole or similar structure that is used in whole or in part for the purpose of carrying electric distribution lines or cables or wires for telecommunications, cable, or electric service, or for lighting, traffic control devices, traffic control or directional signage, or a similar function regardless of ownership, including city-owned poles.
