The Planning and Development Committee of Town Council met on July 10, 2023. The meeting was held in the Council
Chambers of Town Hall, 200 S. Main Street, Summerville, SC. Committee members present included Terry Jenkins, Council
District 2; Russ Touchberry, Council District; and. Bob Jackson, Council District 6. Staff members present included Jessi
Shuler, AICP, Director of Planning and other Town staff.
The meeting was called to order at 5:30 PM.
Annexation:
Ms. Shuler introduced the petition by Samuel G. Pennington and Hallie Perkins to annex TMS#130-10-00-018, located at 518
N. Maple Street and totaling approximately 0.58 acres. Currently zoned OI, Office and Institutional District in Dorchester
County and will be zoned UC-MX, Urban Corridor Mixed-Use, upon annexation into the Town of Summerville’s municipal
limits. (Council District 1). She stated that the Planning Commission held a public hearing and made a recommendation for
denial at their meeting on June 19, 2023. Ms. Shuler explained that the denial was primarily based on the zoning district
requested, and the feasibility of the lot for the intended use of car sales. She noted that Benjamin Lafond was there on behalf
of the applicant and could speak more to the request if the Committee would like. Mr. Lafond noted that he researched the
Dorchester County zoning, but the general commercial zoning required a minimum lot size that they couldn’t meet, so an
ordinance amendment would be required in addition to a rezoning in Dorchester County in order to allow a car sales business
on the property, which is why they decided to pursue annexation. He explained that Mr. Pennington has owned a car sales
business in Goose Creek for many years, but the property owner is now selling that lot. He only sells about one to two cars
per month, and he already owned this property, which is near his home in Jedburg, so he thought he could use this property
since it is not viable for residential anymore to keep his motor vehicle sales license. He recognized that the parcel is very
narrow, which limits its functionality. He detailed the existing zoning in the County and Town in this area and noted that this
lot was only three lots away from property zoned GC in the County and UC-MX in the Town. Mr. Jackson asked if the N-MX
zoning would allow for a car lot, and Ms. Shuler confirmed that it would not. Mr. Touchberry asked about the buffers required
for this to be a commercial property, and Ms. Shuler explained that it would require a 15’ buffer on both sides and rear,
although any existing improvements wouldn’t have to meet that buffer requirement. Mr. Jenkins asked if the mobile home
park expressed any concerns. Ms. Shuler stated that no public comment was received at the public hearing, and Mr. Lafond
noted he was told that Mr. Pennington was on good terms with the mobile home park. Mr. Jenkins asserted that his main
concern is what could happen with the property going forward, not necessarily Mr. Pennington’s use. As noted earlier, Mr.
Lafond emphasized that the physical restrictions of the lot would limit any potential uses. Further discussion ensued regarding
the access to the lot and what SCDOT would require for a commercial drive, which Mr. Cornette stated he could provide more
information about prior to the Council meeting on Thursday. Following the discussion, Mr. Jackson made a motion to send
the item to the full Council with no recommendation, and Mr. Touchberry made the second. Mr. Jenkins called for the question,
and the motion passed unanimously.
Following no additional business or discussion, the meeting was adjourned at 5:51 PM on a motion by Mr. Touchberry, and a
second by Mr. Jackson.

a. Presentation of June 2023 Financial Reports
b. Approval to sign contract with Civitas, LLC for assistance with 2023 CDBG
Program Management. All funds to pay for this program come from HUD
funds at no cost to the Town of Summerville. This vendor was selected in a
sealed bid process and was the only bidder.
c. Authorization for the Town Administrator to enter into a contract with CERES
Environmental for on-call disaster debris removal services, once reviewed and
approved by the Town Attorney. This will be the primary contractor. Vendor
was selected by sealed bids.
d. Authorization for the Town Administrator to enter into a contract with CTC
Disaster Response for on-call debris removal services, once reviewed and
approved by the Town Attorney. This will be the secondary contractor.
Vendor was selected by sealed bids.
e. Approval of a purchase order in the amount of $1,829,754.30 to Banks
Construction for roadway resurfacing. $1,755,744.70 will be reimbursed by
Dorchester CTC, $42,719.00 to be funded by CDBG funds and $31,260.60 to
be funded by the Town’s Road Fund.
f. Approval of purchase order(s) in the amount of $66,240 for a Ford Expedition,
plus upfitting and equipment, to replace a Chevy Tahoe that was totaled.
Funds to come from insurance proceeds ($12,000) and Fire Dept. Capital.

ISSUE
The property owner is requesting for the above referenced tract to be annexed into the Town from
Dorchester County. The existing zoning in Dorchester County is OI – Office and Institutional.
BACKGROUND/DISCUSSION
This property is included in the Town’s ‘Mixed Residential’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future
Land Use Map. According to the Dorchester County Assessor’s date, this property is currently being
used as a single-family residence. The annexation application states that the proposed future use of
the property is for retail vehicular sales. The existing zoning district of OI in Dorchester County
allows for more neighborhood-oriented office and institutional uses, which would prohibit retail
vehicular sales. The property is surrounded by the Summervillage Mobile Home Park on the south
and west sides, which is in the Town limits, and single-family residential on the north side, which is in
Dorchester County. The properties across the road, along that section of N. Maple Street are zoned N-
MX, Neighborhood Mixed-Use. No public comment was received at the required public hearing.
RECOMMENDATION
Although UC-MX zoned properties are nearby at the intersection with W. 5th North Street, based on
the Town’s Future Land Use map, the existing zoning in Dorchester County, and the surrounding
residential uses, it appears that the Town’s N-MX zoning would be a more appropriate zoning district
for this property; however, the zoning district would not allow for the stated proposed use of retail
vehicular sales. Planning Commission made a recommendation for denial of the annexation with the
zoning of UC-MX on a 5-0 vote.

Minutes
June 19, 2023
This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and
was attended by Commission Members, Jim Reaves, Chairman; Kevin Carroll; Charlie Stoudenmire; Elaine
Segelken; and Tom Hart. Betty Profit and Jim Bailey were unable to attend. Staff in attendance included
Tim Macholl, Zoning Administrator, and Rhonda Moore, Director of Finance. The public was invited to
attend in person, or they viewed the meeting via live-stream.
Jim Reaves, Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes:
The Chairman asked if there were any edits or additions to the minutes from the meeting on May 15, 2023.
Hearing none the minutes were approved as submitted.
Public Hearings:
The first public hearing opened at 4:01 PM and was for the petition by Samuel G. Pennington and Hallie
Perkins to annex TMS#130-10-00-018, located at 518 N. Maple Street and totaling approximately 0.58
acres. Currently zoned OI, Office and Institutional District in Dorchester County and will be zoned UC-
MX, Urban Corridor Mixed-Use, upon annexation into the Town of Summerville’s municipal limits.
(Council District 1) Mr. Reaves introduced the item. The applicant was not in attendance. Hearing no
other public comment, the public hearing was closed at 4:02 PM.
Old Business
There were no items under Old Business.
New Business:
The first item under New Business was New Street Names. Mr. Macholl stated that they had no street
names for consideration this month.
The second item under New Business was the petition by Samuel G. Pennington and Hallie Perkins to
annex TMS#130-10-00-018, located at 518 N. Maple Street and totaling approximately 0.58 acres.
Currently zoned OI, Office and Institutional District in Dorchester County and will be zoned UC-MX,
Urban Corridor Mixed-Use, upon annexation into the Town of Summerville’s municipal limits. (Council
District 1) Mr. Carroll made a motion to recommend approval of the annexation to Council, and Ms.
Segelken made the second. Mr. Carroll asked for confirmation of the location of his property, and Mr.
Macholl confirmed that it was on the left side of N. Maple Street if you were heading north toward the
interstate from Highway 78. Mr. Reaves stated that he had some misgivings about the requested zoning
of UC-MX as he was concerned that the applicants were zoning shopping. He noted that the surrounding
properties are all residential and the property across the street is Neighborhood Mixed-Use, and it is a
long, skinny lot to use for a car sales business. Mr. Hart agreed that he also had some reservations about
the request. Mr. Carroll noted the number of curb cuts along N. Maple Street and his concerns about
safety. Mr. Reaves called for the question and the motion failed unanimously.
The third item under New Business was an ordinance to amend the Town of Summerville Code of
Ordinances, Chapter 20, Article IV, Sections 20-103(9) and 20-109 (B) and (D), to reduce the eighty
percent (80%) discount of the maximum impact fee allowed to zero percent (0%) so as to apply one
hundred percent (100%) of the maximum allowable Parks and Recreation Impact fee. Town Council gave
first reading at their meeting on June 8, 2023 and will hold a public hearing at their meeting on July 13,
2023. Mr. Carroll made a motion to recommend approval to Council, and Mr. Hart made the second. Mr.
Carroll asked if the revenues from impact fees go into the general fund or a special designated fund. Ms.
Moore responded that the revenues are kept separate. Mr. Carroll then asked if the funds were invested,
and Ms. Moore confirmed that they were. Mr. Hart asked for confirmation that this change would mean
that there would be no discount on the Parks and Recreation fees, and Ms. Moore confirmed that this
would remove the 80% discount on the Parks and Recreation fees. Mr. Hart asked if this would improve
facilities for new and existing residents. Ms. Moore responded that yes it could go to all new
improvements that would benefit both existing and new residents. Further discussion ensued regarding
the different categories for impact fees. Ms. Segelken then asked about the staff recommendation to add
additional language to the proposed amendment. Ms. Moore explained that staff and Council did not
want to change the fees for those projects that were already at a certain stage of development, so the
proposed additional language would address that concern. Mr. Macholl confirmed that the additional
language would prevent the costs from changing mid-stream for those developments that have already
spent a significant amount of time and money based on a certain cost per unit for their pro forma. Mr.
Hart asked how much of the overall impact fee of $6,523 would be from the Parks and Recreation fee,
and Ms. Moore stated that it would be $3,853 for a single-family home, and the remaining fees would be
split between Fire Protection and Municipal Facilities & Equipment, which are already at a 0% discount
rate. Mr. Carroll asked if there was a difference between condos and single-family detached homes, and
Mr. Macholl stated that it appeared that they were each treated as a single-family dwelling unit. Mr.
Stoudenmire emphasized that he felt the most important part of the community is the children and the
schools are slowly going downhill due to funding struggles, and he just needed to point that out. Ms.
Moore stated that she wished that the Town could make a bigger impact there.
Following the discussion, Mr. Reaves called for the question, and the motion passed unanimously.

With no further business for the Commission, Mr. Stoudenmire made a motion to adjourn with Mr. Carroll
making the second. The motion carried and the meeting was adjourned at 4:18 PM.

ADJACENT TO THE BOUNDARY LINE OF THE TOWN, AS DESCRIBED ON THE DEED AND
RECORDED PLAT ATTACHED HERETO AND INCORPORATED BY REFERENCE:
WHEREAS, the owner of the real estate designated as Dorchester County TMS #130-10-00-018, located at
518 N. Maple Street and totaling approximately 0.58 acres, has petitioned the Town Council of the
Town of Summerville to annex into the Town of Summerville.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Members of Town Council duly assembled;
SECTION I. That the described land on the attached deed and recorded plat, contiguous to the boundary of
the Town of Summerville is hereby annexed to, taken into and made a part of the Town of Summerville and
including the public roadway(s) immediately adjacent to the property lines of the parcel for the purposes of
providing public service to the parcel.
SECTION II. That the properties above described and hereby annexed shall be Zoned UC-MX “Urban
Corridor Mixed-Use” and be classified as “Urban Corridor Mixed-Use” under the Zoning Ordinance of the
Town of Summerville.
