REPORT for
July 8, 2024

The Planning and Development Committee of Town Council met on July 8, 2024. The meeting was held in the Council
Chambers of Town Hall, 200 S. Main Street, Summerville, SC. Committee members present included Richard Waring,
Council District 4; Matt Halter, Council District 3; and Bob Jackson, Council District 6. Staff members present included Jessi
Shuler, AICP, Director of Planning and other Town staff.
The meeting was called to order at 5:30 PM by Mr. Waring, Chairman.
Rezoning:
Ms. Shuler introduced the petition by Michael C. Fox, Stefan Colucci, William Colucci, Alice Norton, Kim Colucci Lizzi, and
Robert Colucci to annex TMS# 152-00-00-026, located at 400 Murray Blvd., totaling approximately 12.81 acres. Currently
zoned TRM, Transitional Residential District, in Dorchester County and will be zoned N-R, Neighborhood Residential, upon
annexation into the Town of Summerville’s municipal limits. (Council District 5). She stated that the Planning Commission
held a public hearing and made a recommendation for denial at their meeting on June 17, 2024. Mr. Jackson expressed his
belief that the Planning Commission did a good job analyzing the request, and he would not go against their recommendation,
as he feels this is not appropriate for the neighborhood. Following his comments, Mr. Jackson made a motion to send the
item to the full Council with a recommendation for denial, and Mr. Halter made the second. Mr. Waring asked how many units
were proposed, and Ms. Shuler responded that the conceptual plan showed 58 units. Mr. Waring agreed with Mr. Jackson
that that many units was not in character with the existing neighborhood, but he noted that he would support a more restrictive
residential zoning district that was more in line with the rest of the street. Following the discussion, Mr. Waring called for the
question, and the motion passed unanimously.
Following no additional business or discussion, the meeting was adjourned at 5:33 PM on a motion by Mr. Jackson and a
second by Mr. Halter.

FINANCE COMMITTEE REPORT
July 8, 2024
The Finance Committee met on Monday, July 8, 2024. Present were Mayor Touchberry and
Committee members Bob Jackson, Richard G. Waring, IV, Aaron Brown, Matt Halter, and Kima
Garten-Schmidt. Tiffany Johnson-Wilson was absent. Also present were Town Administrator
Lisa Wallace, Town Attorney G.W. Parker, and Town Clerk Beth Messervy. Other staff members,
members of the press and members of the public were duly notified. The meeting was held in
Council Chambers on the third floor of the Annex Building at 200 S. Main Street and livestreamed
from the Town’s web site.
Welcome Mayor Touchberry called the meeting to order at 5:35pm.
Presentation Finance Director Rhonda Moore presented the June 2024 financial
of Financial statements.
Statements
Financial Mr. Jackson made a motion, seconded by Mr. Brown, to correct a previous
Requisitions authorization of a purchase order to Amick Equipment in the amount of
$313,238 for a streetsweeper to reflect that funds will come from stormwater
funds. The motion carried unanimously.
Mr. Jackson made a motion, seconded by Ms. Garten-Schmidt, to issue a
purchase order to Safe Industries in the amount of $1,100,000 dollars for the
purchase of a KME Pumper with equipment for the Fire Department. Funds
to come from Impact Fees. The motion carried unanimously.
Ms. Garten-Schmidt made a motion, seconded by Mr. Waring, to issue a
purchase order to Municipal Emergency Services in the amount of up to
$65,000 for the purchase of 15 sets of Structural Protective Gear for the Fire
Department. Funds to come from budgeted operating funds. The motion
carried unanimously.
Mr. Brown made a motion, seconded by Mr. Halter, to issue a purchase order
to Stivers Ford, Waukee, Iowa, in the amount of $56,595 each, totaling
$113,190, for two 2024 Ford F-150 Police Responder Pick-up Trucks. They
are on state contract pricing. Funds to come from budgeted general funds.
The motion carried unanimously.
Surplus Mr. Jackson made a motion, seconded by Ms. Garten-Schmidt, to surplus the
Vehicles following SPD vehicles: #311, #328, and #329. The motion carried
unanimously. #311 will be sold. #328 and #329 will be transferred to Parks
and Recreation.
Executive Ms. Garten-Schmidt made a motion, seconded by Mr. Waring, to enter into
Session Executive Session to discuss a personnel matter related to the Town
Finance Committee Report
July 8, 2024

Prosecutor. The motion carried unanimously, and the committee entered
Executive Session at 5:50pm.
The committee reconvened at 5:58pm. Town Attorney GW Parker stated
that the committee met in Executive Session to discuss a personnel matter
related to the Town Prosecutor and that no action was taken.
Other Mr. Waring made a motion, seconded by Mr. Jackson, to authorize the Town
Business Attorney to offer the Town Prosecutor job to Jillian Frederick. The motion
carried unanimously.
Adjourn There being no further business, Mayor Touchberry adjourned the meeting at
5:59pm with a unanimous vote of the Committee.

ITEM 1: Staff report for annexation petition by Michael C. Fox, Stefan Colucci, William
Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci to annex TMS# 152-00-00-026,
located at 400 Murray Blvd., totaling approximately 12.81 acres. Currently zoned TRM,
Transitional Residential District, in Dorchester County and will be zoned N-R, Neighborhood
Residential, upon annexation into the Town of Summerville’s municipal limits. (Council District

ISSUE
The property owners are requesting for the above referenced parcel to be annexed into the Town
with the zoning of N-R, Neighborhood Residential. The existing zoning in Dorchester County is
TRM, Transitional Residential District.
BACKGROUND/DISCUSSION
This property is included in the Town’s ‘Single-Family Residential’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future
Land Use Map, which includes detached single-family uses with a typical density of 2-5 units per
acre. However, this property does fall in the Town Edges area in the growth strategy included in
the Land & Development element of the Comp Plan. The Town Edges growth area “prioritizes
development in areas within existing infrastructure service boundaries to sustainably manage
their capacity while utilizing available space. Prioritization of growth in this area is also intended
to incorporate existing pockets of development in unincorporated areas (i.e. donut holes) and
prevent future developments like these. Prioritization should be given to areas that include
commercial development over solely residential areas.”
The applicant is proposing to construct single-family detached homes with a minimum lot size of
5,000 square feet; however, the N-R zoning district does also allow for 2-4 unit dwellings and
mobile homes. The Town does not have the ability to limit permitted uses within a zoning district
if all the zoning requirements can be met. In addition, the N-R zoning district does not have a
minimum lot size requirement. While the adjacent property within the Town is the Limehouse
Village PUD, with a minimum single-family detached lot size of 4,000 square feet, almost all the

other properties on Murray Blvd. in Dorchester County are zoned TRM, with a minimum lot size
of one acre.
RECOMMENDATION
The requested N-R, Neighborhood Residential, zoning district is not out of compliance with the
single-family residential use specified in the Town’s Comprehensive Plan; however, the character
of the development does not appear to be in line with the surrounding development on that street
within the County. In addition, the Town cannot require contract zoning, so there is no
mechanism in place to require that only detached single-family homes with a minimum lot size of
5,000 square feet are built if the property is successfully annexed and zoned to N-R, unless the
property owner chooses to place deed restrictions on the property.
Planning Commission voted 4-0 to deny the annexation with the requested zoning of N-R, as they
felt the increased density and traffic would detract from the character of the surrounding area and
negatively impact the existing residences on Murray Boulevard.
Staff did not receive any phone calls, emails, or letters concerning this request prior to the
Planning Commission meeting; however, neighbors did show up for the public hearing to speak
out against the request. The draft minutes from the Planning Commission meeting detail the
statements from the neighbors against the requested zoning that were made during the public
hearing.

Minutes
June 17, 2024
This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and
was attended by Commission Members, Jim Reaves, Chairman; Kevin Carroll; Jim Bailey; Charlie
Stoudenmire; and Elaine Segelken. Tom Hart was unable to attend. Staff in attendance included Jessi
Shuler, AICP, Director of Planning. The public was invited to attend in person, or they viewed the meeting
via live-stream.
Jim Reaves, Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes:
The Chairman asked if there were any edits or additions to the minutes from the meeting on May 20, 2024.
Hearing none, the minutes were accepted as presented.
Public Hearings:
The first public hearing opened at 4:02 PM and was for the petition by Michael C. Fox, Stefan Colucci,
William Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci to annex TMS# 152-00-00-026,
located at 400 Murray Blvd., totaling approximately 12.81 acres. Currently zoned TRM, Transitional
Residential District, in Dorchester County and will be zoned N-R, Neighborhood Residential, upon
annexation into the Town of Summerville’s municipal limits. (Council District 5). Mr. Reaves introduced
the item. Ms. Shuler read the staff report into the record and then asked the applicant to present the
request. Mark Matthewson with Center Park Homes provided a conceptual sketch of the development
and confirmed that they would be willing to put in place deed restrictions to only allow single-family
detached homes with a minimum lot size of 5,000 square feet. He explained that they’d looked to the

surrounding in town development of Limehouse Village for the lot size, and they would be proposing
approximately 58 lots. Ms. Segelken asked if he knew the lot sizes of the lots in Summerville Farms, and
Mr. Matthewson responded that he wasn’t sure, but would guess about an acre or half an acre.
Robert Ford of 108 Murray Blvd. noted that his property touches this property. He explained that he had
to sign covenants when he bought his property that required a minimum lot size of one acre, so he doesn’t
know how this property could get around those covenants. He added that he’d bought a house in the
neighborhood for the privacy and the quiet. He opposes the proposed zoning.
Eric Griffin of 10790 Dorchester Rd. explained that this proposed zoning and development would
completely change the landscape of the neighborhood. Eight homes per acre would be a significant
difference from one per acre, which would destroy the look and feel that he bought for. He is also
concerned about the traffic that would be generated, as 58 homes is a lot of homes for a small rural road.
Theresa Halverson stated that she represented the heirs and wanted to speak on their behalf. They would
like to sell the property, and Center Park Homes builds a very good home that is very aesthetically
pleasing. Due to the proximity of Dorchester Road and the need for more affordable housing for
employees, they feel that this is the highest and best use of the property.
Mark Turner of 409 Murray Blvd. noted that he lived directly across the street from the property. He
stressed that this proposal is completely against what the original owners would have wanted. There is
already too much traffic, and there are numerous grand oaks all over the property that are irreplaceable.
Mr. Turner stated that he originally thought that Center Park Homes would be proposing ½ acre to ¾ acre
lots like they are doing in Ridgeville, which he wouldn’t have a problem with, but the existing
infrastructure, roads, and sewage will not support 58 lots. The neighbors have already had to deal with a
storage unit business coming in, and they don’t want this many homes. The road is already falling apart.
Plus, the Town’s ordinances state that the zoning should be as close as possible to the existing zoning,
and the TRM zoning has a minimum lot size of one acre.
Eric Matsko of 103 Murray Blvd. stated that he agreed with his neighbors and only had a couple of
comments to add. He explained that Murray Blvd. is barely a two-lane road with no painted lines, and
there are existing drainage issues in the neighborhood. He would like the lots to stay the way they are
now.
Hearing no public comment, this public hearing was closed at 4:20 PM.
Old Business
There were no items under Old Business.
New Business:
The first item under New Business was New Street Names. Ms. Shuler stated that they did not have any
street names for consideration.
The second item under New Business was the petition by Michael C. Fox, Stefan Colucci, William
Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci to annex TMS# 152-00-00-026, located at
400 Murray Blvd., totaling approximately 12.81 acres. Currently zoned TRM, Transitional Residential
District, in Dorchester County and will be zoned N-R, Neighborhood Residential, upon annexation into
the Town of Summerville’s municipal limits. (Council District 5). Mr. Bailey recused himself from this
agenda item. Mr. Carroll made a motion to recommend approval. Receiving no second, that motion
failed. Ms. Segelken then made a motion to recommend denial of the annexation with a zoning of N-R,
and Mr. Carroll made the second. Mr. Carroll explained that he believes that the density requested is far

beyond what should be there and will support the motion to deny. Ms. Segelken stated that she
appreciates those that showed up to speak, although she wishes that some would not assume they knew
how the Planning Commission would vote. Following the comments, Mr. Reaves then called for the
question and the motion passed 4-0.
Ms. Shuler then explained that this recommendation for denial will now go to the Planning &
Development Committee of Council for a recommendation at their July meeting and then to full Council.
Miscellaneous:
Mr. Reaves reminded the Commission members about their training responsibilities and that staff had sent
out a webinar training opportunity for June 20th.

With no further business for the Commission, Ms. Segelken made a motion to adjourn with Mr. Bailey
making the second. The motion carried and the meeting was adjourned at 4:25 PM.

SUMMERVILLE, THE PARCEL OWNED BY MICHAEL C. FOX, STEFAN COLUCCI, ALICE
NORTON, KIM COLUCCI LIZZI, AND ROBERT COLUCCI, ADJACENT TO THE BOUNDARY LINE
OF THE TOWN, AS DESCRIBED ON THE DEED AND RECORDED PLATS ATTACHED HERETO
AND INCORPORATED BY REFERENCE:
WHEREAS, the owner of the real estate designated as Dorchester County TMS #152-00-00-026, located at
400 Murray Boulevard and totaling approximately 12.81 acres, has petitioned the Town Council of the
Town of Summerville to annex into the Town of Summerville.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Members of Town Council duly assembled;
SECTION I. That the described land on the attached deed and recorded plats, contiguous to the boundary
of the Town of Summerville is hereby annexed to, taken into and made a part of the Town of Summerville
and including the public roadway(s) immediately adjacent to the property lines of the parcel for the purposes
of providing public service to the parcel.
SECTION II. That the properties above described and hereby annexed shall be Zoned N-R “Neighborhood
Residential” and be classified as “Neighborhood Residential” under the Zoning Ordinance of the Town of
Summerville.
