MINUTES - May 15, 2019
Attendance
Present at Call to Order: Mayor Johnson, Councilmembers Kima Garten-Schmidt, Bob Jackson,
and Bill McIntosh. Councilmember Christine Czarnik arrived at 2:41pm. Councilmembers
Aaron Brown and Walter Bailey were absent. Also present were Zoning Director Tim Macholl,
Director of Public Works Russ Cornette, Town Administrator Colin Martin, Town Attorney GW
Parker, Town Clerk Beth Messervy, and Assistant Town Engineer Bonnie Miley. Public and
press were duly notified.
Call to Order
The Special Called meeting of Summerville Town Council was called to order at 2:30pm on
Wednesday, May 15, 2019 by Mayor Johnson.
Condemnation Action
Mr. McIntosh made a motion, seconded by Mr. Jackson, to authorize the Town Attorney to
pursue condemnation action on TMS #137-01-00-007 (Tract 6), TMS #130-13-00-024 (Tract
21), and TMS #130-13-00-025 (Tract 74) for the Maple Street project. Some discussion
followed. The motion carried unanimously.
Executive Session: Legal matter
Mayor Johnson explained the topic to be discussed in Executive Session: discussion of
exception to newly adopted Bed and Breakfast ordinance (Chapter 32, Article V, Sec. 32-212 –
Conditional use permits for bed and breakfast establishments.)
Mr. Jackson made a motion, seconded by Ms. Garten-Schmidt, to enter into Executive Session at
2:40pm. The motion carried unanimously.
Action To Be Taken by Council Related to Executive Session:
Council reconvened at 2:57pm. Town Attorney GW Parker explained that no action was taken
on the legal matter related to the discussion of exception to newly adopted Bed and Breakfast
ordinance (Chapter 32, Article V, Sec. 32-212 – Conditional use permits for bed and breakfast
establishments.)

Mr. McIntosh made a motion, seconded by Ms. Czarnik, to approve the minutes of the Special
Called Council Meeting (UDO Workshop #11) held on May 15, 2019. The motion carried
unanimously, and the minutes were accepted into record.
Council/Staff Discussion and Changes:
In Chapter 5, Section 5.8.1 – Street Network Requirements, Item J was added to the end of the
section. Staff was directed by Council to write language for this section regarding road plans
during the construction phase.
In Chapter 5, Section 5.11.1 – Inspection During Construction, “Inspection fees may be
charged at the discretion of Council” was changed to read “Inspection fees may be charged as
referenced in the fee schedule ordinance” at the request of Council.
In Chapter 5, Section 5.11.3 – Building Permits Issued, Council requested that staff reword
Item C to reference permits for definition of adequate conditions.
In Chapter 5, Section 5.11.4 – Warranty Liability Period, the following changes were made at
the request of Council:
Item D was moved up to become the new Item B
Item E was moved up to become the new Item C
These changes made the old Item B the new Item D, and the old Item C the new Item E.
In Chapter 6, Section 6.2 – Dedication & Conservation Requirements, “3 or more lots” was
changed to read “5 or more lots” at the request of Council.

There being no further business, the meeting adjourned at 4:00pm on motion of Mr. McIntosh,
seconded by Mr. Jackson.
