Number of Potential Cases: 1; nothing to report. SPECIAL ORDER OF THE DAY C 21-0011 Ceremonial Oath of Office for Vice Mayor Mayor Klein administered the Oath of Office to Vice Mayor Hendricks. Vice Mayor Hendricks provided remarks. ORAL COMMUNICATIONS Rose Gregorio spoke towards the encampment located at Fair Oaks Park and voiced concerns with the lack of communication with the unhoused population. Mackenzie spoke towards the City’s treatment of the unhoused population at Fair Oaks Park and observed a moment of silence in memory of those lost during the COVID-19 Pandemic. Weijia Cheng shared concerns regarding the City’s plan to remove the unhoused population at Fair Oaks Park without providing alternative housing. Kathryn Hedges communicated concerns regarding the removal of the unhoused population from the encampment located at Fair Oaks Park. City of Sunnyvale Page 4 City Council Meeting Minutes January 12, 2021 Daniella Richie spoke towards the encampment at Fair Oaks Park and shared concerns regarding affordable housing in Sunnyvale. Shawn, Stop Death Coalition requested a stakeholders meeting be held to discuss placement options for the unhoused population at Fair Oaks Park and spoke towards the City’s ability to provide direct support due to its financial stability. Alec Vandenberg voiced concerns with conducting an encampment sweep at Fair Oaks Park. He shared health and safety concerns effecting the unhoused population. Lauren Cordano shared concerns regarding bicycle and pedestrian safety in Sunnyvale and urged Council to consider prioritizing implementation of the Active Transportation Plan at their upcoming Strategic Planning Workshop. A member of the public communicated concerns with sweeping the encampment at Fair Oaks Park. Sandy Perry, Executive Director, Affordable Housing Network of Santa Clara County shared opposition to the sweep of encampments and support for providing alternative housing for the unhoused population at Fair Oaks Park. Wesly Yu spoke towards his property’s zoning and voiced support for Study Issue CDD 21-01 related to allowing expansions/modifications for existing legal non-conforming single-family uses in non-residential zoning. Alyssa communicated opposition to the sweep of the encampment at Fair Oaks Park and support for providing alternative housing. Mariel Gregorio voiced concerns with the sweep of the encampment at Fair Oaks Park. She voiced support for the Centers for Disease Control and Prevention’s (CDC) guidelines of providing encampments with potable water and restroom facilities. Helen Gettinger spoke towards the unhoused population at Fair Oaks Park and inquired on the City’s commitment to find alternative housing. Leah Kennedy urged Council to not displace the unhoused population at the Fair City of Sunnyvale Page 5 City Council Meeting Minutes January 12, 2021 Oaks Park encampment and shared support or the CDC’s encampment guidelines of providing adequate sanitation services. City Manager Kent Steffens shared an overview of the Fair Oaks Park Renovation project including communication and collaboration with non-profit organizations to help identify and provide resources for the unhoused population at the Park. He announced that staff is investigating housing alternatives. Public Hearing opened at 8:23 p.m. John Cordes requested Council consider prioritizing and funding implementation of the Active Transportation Plan (ATP) at the upcoming Council Strategic Planning Workshop. He voiced support for allocating $5 million per year for the next five years towards implementation of the ATP. Mike Serrone, Democratic Club of Sunnyvale communicated concerns with the study and budget issue process and shared recommendations for streamlining the process. Jennifer communicated support for Study Issue CDD 21-01 related to allowing expansions/modifications for existing legal non-conforming single-family uses in non-residential zoning. David Wu shared support for Study Issue CDD 19-04 regarding an update to the historical context statement to include historical contribution made by Asian Americans and others. Ari Feinsmith spoke towards bicycle and pedestrian safety and voiced support for Council to prioritize implementation of the ATP at the upcoming Strategic Planning Workshop. Karl Voelker communicated support for a budget issue to allocate funding towards implementation of the ATP. Richard Mehlinger voiced support for the implementation of the ATP and Study Issues: DPW 21-01, DPW 21-03 and CDD 21-01. He requested Council consider a study issue related to improving the study and budget issue process. Erik Lindskog shared support for Council to prioritize implementation of the ATP at the upcoming Strategic Planning Workshop. Public Hearing closed at 8:45 p.m. Councilmember Fong proposed a study issue to explore a 2022 general election City of Sunnyvale Page 9 City Council Meeting Minutes January 12, 2021 ballot measure to create a general and progressive real property transfer tax with a floor of no less than $3 million and a possible cap. The Measure should tie the tax to a unit of inflation to be determined. The study should include polling on the tax. FRIENDLY AMENDMENT: Councilmember Fong offered a friendly amendment to not separate the Housing and Human Services Commission and instead create a new Human Relations Commission. Councilmember Cisneros accepted the friendly amendment. Councilmembers Fong and Din co-sponsored the study issue. Councilmember Melton announced he formally co-sponsors Councilmember Fong’s proposed study issue at the Jan. 5 Council meeting regarding reviewing the existing housing mitigation fee. Councilmember Melton proposed a study issue to complete the missing gaps of sidewalk on the east side of Poplar Avenue between El Camino Real and Peterson Middle School per Active Transportation Plan pages 208-209. The study would be to complete a conceptual design and develop cost estimates, to do so, a land survey needs to be completed to define right-a-way and drainage issues and to estimate the costs for surveying and conceptual design alternatives and output of the study to provide estimated construction costs. Mayor Klein and Councilmembers Fong, Cisneros and Din co-sponsored the study issue. Councilmember Melton proposed a study issue to fill in the short sidewalk gap (approximately 170 feet) on north side of Marion Way. Consider roadway shoulder improvements or implementation of a permanent sidewalk installation per Active Transportation Plan page 208. The study would be to complete a conceptual design and develop cost estimates, to do so, a land survey needs to be completed to define right-a-way and drainage issues and to estimate the costs for surveying and conceptual design alternatives and output of the study to provide estimated construction costs. Councilmember Melton proposed a study issue to explore establishing a local limit or no limit for council campaign contributions that would supersede the requirements of Assembly Bill 571. Councilmembers Fong and Din co-sponsored the study issue. -City Manager City of Sunnyvale Page 18 City Council Meeting Minutes January 12, 2021 City Manager Kent Steffens acknowledged community volunteers for their work with the COVID-19 testing program and announced that 676 individuals were tested on January 4th at the Murphy Park Building testing site. He shared that staff is preparing an emergency contract with Santa Clara County to provide quarantine services for Sunnyvale residents that are COVID-19 positive. Council will receive a report regarding this contract at the January 26 City Council meeting and consider appropriation of funds supporting the contract.
