City of Sunnyvale Meeting Minutes City Council Tuesday, January 26, 2021 7:00 PM Telepresence Meeting: City Web Stream | AT&T Channel 99 | Comcast Channel 15 Regular Meeting - 7 PM 7 P.M. COUNCIL MEETING CALL TO ORDER Pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on March 17, 2020, the meeting was conducted telephonically. Mayor Klein called the meeting to order at 7:00 p.m. via teleconference. ROLL CALL Present: 7 - Mayor Larry Klein Vice Mayor Glenn Hendricks Councilmember Gustav Larsson Councilmember Russ Melton Councilmember Mason Fong Councilmember Alysa Cisneros Councilmember Omar Din Mayor Klein, Vice Mayor Hendricks and all Councilmembers attended via teleconference. SPECIAL ORDER OF THE DAY A 21-0085 Slavery and Human Trafficking Prevention Month Mayor Klein read a proclamation in honor of Slavery and Human Trafficking Prevention Month. Public Safety Chief Phan Ngo spoke towards the proclamation. ORAL COMMUNICATIONS Vice Mayor Hendricks announced details of the upcoming Sustainability Speaker City of Sunnyvale Page 1 City Council Meeting Minutes January 26, 2021 Series event: Carbon Neutral Portfolio: From Vision to Strategy and COVID-19 testing availability at the Sunnyvale Murphy Park Building along with testing availability via Santa Clara County and the El Camino Healthcare District. He also announced the current recruitment for various Boards and Commissions. City Manager Kent Steffens shared an update regarding the Fair Oaks Park encampment including efforts for developing a transition plan and delaying the deadline to vacate till the end of February. Alec Vandenberg voiced concerns with conducting an encampment sweep at Fair Oaks Park. He also shared information about the Federal Emergency Management Agency’s (FEMA) non-congregate sheltering program and requested City staff research the program for possible assistance. A member of the public communicated concerns with the wash station available at the Fair Oaks Park encampment and inquired why the City has not activated a warming center in response to inclement weather. Richard Mehlinger, Chair, Livable Sunnyvale shared details of an upcoming Livable Sunnyvale meeting, including information on guest speaker Professor Michael Lens and of the upcoming General Membership meeting. He also voiced the Board’s request for Council to consider prioritizing implementation of the Active Transportation Plan (ATP) at their upcoming Strategic Planning Workshop and for Council to agendize a discussion topic about homelessness in Sunnyvale. Ari Feinsmith spoke towards bicycle safety and infrastructure. He voiced support for Council to prioritize implementation of the ATP at the upcoming Strategic Planning Workshop. Helen Gettinger requested Council agendize a discussion topic regarding the unhoused population. CONSENT CALENDAR MOTION: Vice Mayor Hendricks moved and Councilmember Larsson seconded the motion to approve agenda items 1.A through 1.G. The motion carried with the following vote: City of Sunnyvale Page 2 City Council Meeting Minutes January 26, 2021 Yes: 7 - Mayor Klein Vice Mayor Hendricks Councilmember Larsson Councilmember Melton Councilmember Fong Councilmember Cisneros Councilmember Din No: 0 1.A 21-0109 Approve City Council Meeting Minutes of January 12, 2021 Approve the City Council Meeting Minutes of January 12, 2021 as submitted. 1.B 21-0171 Approve the List(s) of Claims and Bills Approved for Payment by the City Manager Approve the list(s) of claims and bills. 1.C 21-0194 Award a Contract to Park Consulting Group for the Project Management of the Implementation of EnerGov Permitting System (F21-100) Take the following actions: - Award a contract in substantially the same form as Attachment 1 to the report in the amount of $433,500, to Park Consulting Group; - Authorize the City Manager to execute the contract when all necessary conditions have been met; and - Approve of a 10% contingency in the amount of $43,350. 1.D 21-0132 Award of Bid No. PW21-06 to Kingdom Pipelines, Inc for Park Buildings - Rehabilitation (Serra and Washington Parks Auxiliary Restrooms) and Finding of CEQA Categorical Exemption Take the following actions: - Make a finding of categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15302; - Award a contract in substantially the same form as Attachment 2 to the report in the amount of $1,671,000 to Kingdom Pipelines, Inc.; - Authorize the City Manager to execute the contract when all necessary conditions have been met; and - Approve a 9% contingency in the amount of $150,390. City of Sunnyvale Page 3 City Council Meeting Minutes January 26, 2021 1.E 21-0133 Award of Bid No. PW21-05 to DeSilva Gates Construction LP for Pavement Rehabilitation 2020 and Finding of California Environmental Quality Act (CEQA) Categorical Exemption Take the following actions: - Make a finding of categorical exemption from the California Environmental Quality Act pursuant to California Environmental Quality Act Guidelines Section 15301(c); - Award a contract in substantially the same form as Attachment 2 to the report in the amount of $2,719,415 to DeSilva Gates Construction LP; - Authorize the City Manager to execute the contract when all necessary conditions have been met; and - Approve a 10% contingency in the amount of $271,941. 1.F 21-0156 Receive a Report of an Emergency Procurement and Execution of Agreement with the County of Santa Clara to provide isolation and quarantine support for low-income COVID-positive residents; and Approve Budget Modification No. 16 in the amount of $134,435 Receive a report of an emergency procurement and execution of agreement with the County of Santa Clara to provide isolation and quarantine support for low-income COVID-positive residents; and approve Budget Modification No. 16 in the amount of $134,435. 1.G 21-0225 Ratify Mayor Klein’s Appointment to the Santa Clara County Recycling and Waste Reduction Commission, SMaRT Station Seat Council ratifies Mayor Klein's Appointment to the Santa Clara County Recycling and Waste Reduction Commission, SMaRT Station Seat. PUBLIC HEARINGS/GENERAL BUSINESS 2 21-0079 Consideration of FY 2020/21 Grant Program Changes and 2021 Community Events and Neighborhood Grant Program Applications Recreation Services Manager Tracey Gott provided the staff report and presentation. Public Hearing closed at 7:44 p.m. MOTION: Councilmember Fong moved and Councilmember Melton seconded the motion to approve Alternatives 1 and 2: 1. Approve the FY 2020/21 grantee modification and date change requests; and 2. Approve the 2021 Community Events and Neighborhood grant applications and funding levels as set forth in the Community and Neighborhood Grant Distribution Subcommittee Report (Attachment 1 to the report). Civilian Fire Marshal Vincent Anderson provided the staff report and presentation. Public Hearing opened at 7:52 p.m. No speakers. Public Hearing closed at 7:52 p.m. MOTION: Councilmember Melton moved and Vice Mayor Hendricks seconded the motion to approve Alternative 1: Introduce an Ordinance amending Chapter 16.52 of the Sunnyvale Municipal Code to adopt by reference the 2019 Intervening California Fire Code and find that the action is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15308, 15305, and 15061. City Clerk David Carnahan read the Ordinance title for the record. City of Sunnyvale Page 5 City Council Meeting Minutes January 26, 2021 The motion carried with the following vote: Yes: 7 - Mayor Klein Vice Mayor Hendricks Councilmember Larsson Councilmember Melton Councilmember Fong Councilmember Cisneros Councilmember Din No: 0 COUNCILMEMBERS REPORTS ON ACTIVITIES FROM INTERGOVERNMENTAL COMMITTEE ASSIGNMENTS Councilmember Fong shared his attendance at a Valley Transportation Authority (VTA) Policy Advisory Committee meeting including details of Metropolitan Transportation Commission's Quick Build application and funding timeline. Councilmember Larsson reported he was elected Chair for Bay Area Water Supply and Conservation Agency (BAWSCA) Board of Directors for 2021 and shared his attendance at a Board meeting including details of the Hetch Hetchy water supply. He also shared his attendance at a Silicon Valley Clean Energy (SVCE) Board of Directors meeting including details of a SVCE customer awareness survey and the Board’s approval to participate in the Arrearage Management Plans program. Vice Mayor Hendricks shared his attendance at a VTA Board of Directors meeting and the resignations by VTA’s general manager/chief executive officer and existing chief financial officer vacancy. He also shared the resignation of San Mateo County Transit District (SamTrans) chief executive officer. NON-AGENDA ITEMS & COMMENTS -Council Councilmember Melton announced he formally co-sponsors the Study Issue sponsored by Councilmember Cisneros regarding creating a human relations commission. -City Manager City Manager Kent Steffens shared details of the upcoming Council Strategic Planning Workshop.
