Olive Ave., Sunnyvale, CA 94086 CALL TO ORDER The meeting was called to order at 7:00 pm. SALUTE TO THE FLAG Chair Srivastava led the salute to the flag. There were no public annoucements. Chair Srivastava closed the public hearing. CONSENT CALENDAR 1 Draft Minutes of the Sustainability Commission Meeting of June 16, 2014 Commissioner Hafeman moved and Commissioner Glaser seconded the motion to approve the meeting minutes of June 16, 2014, as amended. There were no public comments. Chair Srivastava closed the public hearing. PUBLIC HEARINGS/GENERAL BUSINESS 2 Adopt a Resolution to Update the Green Building Program for Residential Projects, Non-Residential Projects and Public Facilities Commissioner Fukumoto left the meeting at 9:00 pm. Chair Srivastava opened the meeting to public comments. Dennis Martin, representing both the Commercial Real Estate Development Association (NAIOP) and Building Industry Association (BIA), commented on the staff report. Mr. Martin commended staff for performing additional outreach and addressing the concerns raised by the builders during the May 2014 Council meeting that prompted staff to perform additional outreach. Mr. Martin commented positively regarding the effort staff took to involve experts in LEED and green building to understand the issues previously raised. Mr. Martin commented that the builders associations could support the staff recommendation and that staff had addressed their concerns. Chair Srivastava closed the public hearing. Commissioner Glaser made a motion and Commissioner Paton seconded to recommend Alternative 2: Recommend that City Council Adopt the Resolution in Attachment 1 to Update the Green Building Tables for Residential Buildings, Non-Residential Projects, and Public Facilities with the following changes: City of Sunnyvale Page 2 Sustainability Commission Meeting Minutes - Final July 21, 2014 -at any permit extension point, whatever standards are in place at the time the extension is requested will apply to the project -incentives will be awarded for building performance rather than for increased verification requirements Friendly amendment: Commissioner Glaser offered a friendly amendment to the motion and Commissioner Paton accepted to eliminate all incentives from the entire code. The motion failed by the following vote: Yes: 1 - Commissioner Glaser No: 4 - Chair Srivastava Commissioner Hafeman Commissioner Kisyova Commissioner Paton Absent: 1 - Commissioner Fukumoto Commissioner Kisyova made a motion to recommend Alternative 2: Recommend that City Council Adopt the Resolution in Attachment 1 to Update the Green Building Tables for Residential Buildings, Non-Residential Projects, and Public Facilities with the following changes: -at any permit extension point, whatever standards are in place at the time the extension is requested will apply to the project -residential requirements will remain as recommended -USGBC certification is required for all commercial projects greater than 100,000 square feet The motion died for lack of a second. Commissioner Hafeman made a motion to recommend Alternative 2: Recommend that City Council Adopt the Resolution in Attachment 1 to Update the Green Building Tables for Residential Buildings, Non-Residential Projects, and Public Facilities 2 with the following changes: -at any permit extension point, whatever standards are in place at the time the extension is requested will apply to the project -for the additional 15 percent FAR incentive, LEED Platinum would be the required standard to be met City of Sunnyvale Page 3 Sustainability Commission Meeting Minutes - Final July 21, 2014 The motion died for lack of a second. Commissioner Glaser made a motion and Commissioner Paton seconded to recommend Alternative 2: Recommend that City Council Adopt the Resolution in Attachment 1 to Update the Green Building Tables for Residential Buildings, Non-Residential Projects, and Public Facilities with the following changes: -at any permit extension point, whatever standards are in place at the time the extension is requested will apply to the project -remove all incentive options except the 10% additional density only in Moffett Park provided the project meets LEED Gold with USGBC certification and approval of a Moffett Park Special Development Permit Friendly amendment: Commissioner Hafeman proposed and Commissioner Glaser accepted a friendly amendment that the 15 percent / 20 percent incentive options in Moffett Park would be removed under that option, as well as the additional 10% incentive City-wide, unless staff can create a performance distinction ensuring buildings that used the incentives are significantly improved over what would have been had they not taken advantage of the incentive. Friendly amendment: Commissioner Kisyova proposed and Commissioner Glaser accepted a friendly amendment that any nonresidential project greater than 100,000 square feet be USGBC certified. The final approved motion was to recommend Alternative 2: Recommend that City Council Adopt the Resolution in Attachment 1 to Update the Green Building Tables for Residential Buildings, Non-Residential Projects, and Public Facilities with the following changes: a) at any permit extension point, whatever standards are in place at the time the extension is requested will apply to the project b) remove the 15 percent / 20 percent incentive options in Moffett Park under that option, as well as the additional 10% incentive City-wide, unless staff can create a performance distinction ensuring buildings that used the incentives are significantly improved over what would have been had they not taken advantage of the incentive. c) any nonresidential project greater than 100,000 square feet shall be USGBC certified. Commissioner Paton nominated Commissioner Srivastava as the Sustainability Commission Chair Commissioner Paton was confirmed as Commission Chair by the following vote: Yes: 3 - Commissioner Glaser Commissioner Hafeman Commissioner Paton No: 0 Absent: 1 - Commissioner Fukumoto Abstain: 2 - Chair Srivastava Commissioner Kisyova Commissioner Glaser nominated Commissioner Srivastava for Vice Chair. Commissioner Srivastava nominated Commissioner Fukumoto for Vice Chair. No action was taken. NON-AGENDA ITEMS & COMMENTS -Commissioner Comments Commissioner Glaser commented that he attended the Stanford Precourt Conference. Commissioner Kisyova commented on a traffic synchronization concept called a green wave and if staff can give a presentation regarding the City's traffic light timing and synchronization. -Staff Comments ADJOURNMENT The meeting adjourned at 10:00 p.m. City of Sunnyvale Page 6
