City of Sunnyvale Meeting Minutes Zoning Administrator Hearing Wednesday, November 14, 2018 3:00 PM Lobby Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086 CALL TO ORDER Gerri Caruso, Zoning Administrator, called the meeting to order at 3:01 p.m. PUBLIC HEARINGS 1 File #: 2018-7761 Location: 1208 and 1214 Apollo Way. (APN: 216-35-017) Applicant / Owner: Marigold Indian Restaurant / Gahrahmat Fam Ltd Part I, LP Proposed Project: USE PERMIT: A request to upgrade beer and wine sales to all types of alcohol in conjunction with an existing restaurant and banquet facility. Reason for Permit: A Use Permit is required for restaurants and fast food restaurants that have on sale general alcohol beverage service. Project Planner: Cindy Hom, 408-730-7411, chom@sunnyvale.ca.gov Issues: Noise and Public Safety Recommendation: Approve with conditions Ms. Caruso inquired if Cindy Hom, project planner, had any comments or changes to the staff report. Ms. Home stated Condition of Approval GC-6 should be revised to state the project is approved to all types of liquor, and not to restricted to just beer and wine. Ms. Caruso opened the hearing to the applicant and ask if he had read the staff report. Upinder Ahluwalia, applicant, stated he has read the staff report and had no further comments or questions. Seeing no members of the public present, Ms. Caruso closed the hearing. City of Sunnyvale Page 1 Zoning Administrator Hearing Meeting Minutes November 14, 2018 ACTION: Approved subject to the findings and conditions of approval located in the staff report with the following changes: 1) Conditions of Approval GC-6 to state as approved for all types of liquor. 2 File #: 2018-7787 Location: 631 Torrington Dr. (APN: 202-09-004) Applicant / Owner: Victoria Regala LLC / Swordfish Homes LLC Et Al Proposed Project: USE PERMIT to increase the number of residents in a residential care facility for the elderly from six to seven. Reason for Permit: A Use Permit is required for residential care facilities over six residents. Environmental Determination: A Categorical Exemption Class 1 relieves this project from CEQA provisions. Project Planner: Mary Jeyaprakash, (408) 730-7449, mjeyaprakash@sunnyvale.ca.gov Issues: Neighborhood Compatibility and Parking Recommendation: Approve with Conditions Ms. Caruso inquired with Mary Jeyaprakash, project planner, had any comments or changes to the staff report. Mrs. Jeyaprakash proceeded to summarize the project and stated she received one comment from a neighbor inquiring if staff would review room size requirements when considering the project. This oversight is at a state level, thus staff does not consider it for the building and planning review. Ms. Caruso opened the hearing to the applicant. Victoria Regala, applicant, stated she is the owner and administrator for the care facility and is licensed by the state for 6 residents. She has been in the industry for 15 years and the main purpose of increasing the number of residents from 6 to 7 residents is to serve the community and to increase the facility finances. There will be no building changes and the facility is equipped with the required fire sprinklers. She has not received any calls or complaints from neighbors. Ms. Caruso inquired if the applicant has read the staff report and conditions of approval. Ms. Regala stated she has read the report and had no further comments.
