PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, November 2, 2021 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Nick Ledin, Jenny Van Sickle, Warren Bender, Jack Sweeney, Brent Fennessey, Tylor Elm, Ruth Ludwig, Craig Sutherland (via teleconference), Keith Kern, Lindsey Graskey – 10 Also Present: Mayor Paine, City Attorney Prell, City Clerk Ramos 3. APPROVAL OF MINUTES 3.1 October 19, 2021 - Regular Council Meeting. MOTION by Councilor Bender, seconded by Councilor Elm and carried, to approve. 4. PRESENTATIONS AND PUBLIC HEARINGS 4.1 PUBLIC HEARING to approve R21-13578, a resolution authorizing the City to pave an updated 2022 alley project (Alley #3) and assess the costs to abutting property owners. MOTION by Councilor Bender, seconded by Councilor Elm and carried, to approve. 4.2 PUBLIC HEARING to approve adding the properties located at 1011 Weeks Ave & 2113-2115 Ogden Ave to the Municipal Register of Historic Places. MOTION by Councilor Bender, seconded by Councilor Ludwig and carried, to approve. 4.3 PUBLIC HEARING to formally approve the 2022 General Fund budget. MOTION by Councilor Elm, seconded by Councilor Ledin and carried, to approve. 5. CORRESPONDENCE TO BE FILED (No action) 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 6.2 Committee Appointment Recommendation TOURISM DEVELOPMENT COMMISSION: 1. Appoint Pattie Soliday for a one (1) year term, expiring November 2022. 74 Regular Council Meeting November 2, 2021 Mayor Paine confirmed that the total number of commissioners would not be changing—still 6—and that Commissioner Soliday would be filling the seat Steve Knauss was unable to accept. MOTION by Councilor Bender, seconded by Councilor Sweeney and carried, to approve. 7. STANDING COMMITTEE REPORTS 7.1 Human Resource Committee (Meeting held October 18, 2021) Report from Councilor Ludwig. 7.2 Public Works Committee (No meeting to report) 7.3 Finance Committee (Meeting held October 14, 2021) Report from Councilor Sweeney. RECOMMENDATIONS: 1. Approve reducing the $211.68 late monthly lodging revenue tax filing fee and penalties in half for Mark and Shirley Pinney of Shalom Place, a vacation rental property located at 906 E 7th Street, for a reduced fee of $105.84. 2. Approve the 2022 Lake Superior Ice Festival Budget. 3. Approve the Advertising Agreement between the City of Superior and Positively Superior. 4. Approve the 2022 Information Technology Budget. 5. Approve the 2022 Liability Insurance Budget. 6. Approve the additional Top Value procedures eligible for the High Value Network’s Travel Benefit. Councilor Van Sickle abstained. MOTION by Councilor Elm, seconded by Councilor Ledin and carried, to approve all six recommendations. 7.4 Licensing and Fees Committee (Meeting held October 20, 2021) Report from Councilor Sutherland. RECOMMENDATIONS: 1. Adopt O21-4258, implementing a late fee schedule for renewable annual miscellaneous licenses issued by the City Clerk’s Office. MOTION by Councilor Sweeney, seconded by Councilor Bender and carried, to approve. 7.5 Public Safety Committee (Meeting held October 20, 2021) Report from Councilor Sutherland. 75 Regular Council Meeting November 2, 2021 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 Mayor’s Commission on Disabilities (Meeting held October 18, 2021) No report from the Chair. 8.2 Barker’s Island Review Committee (Meeting held October 20, 2021) Report from Mayor Paine. RECOMMENDATIONS: 1. Approve committee mission statement. 2. Approve changing committee name to Marina Committee. MOTION by Councilor Bender, seconded by Councilor Sweeney and carried, to approve both recommendations. 8.3 Human Trafficking Task Force Commission (Meeting held October 15, 2021) Report from Councilor Elm. 8.4 Plan Commission (Meeting held October 20, 2021) Report from Mayor Paine. 8.5 Tourism Development Commission (Meetings held October 15, 2021 & October 22, 2021) No report from the Chair. 9. OLD BUSINESS 10. NEW BUSINESS 10.1 CITY CLERK RAMOS recommending approval of miscellaneous licenses. MOTION by Councilor Bender, seconded by Councilor Elm and carried, to approve. 10.2 ECONOMIC DEVELOPMENT, PLANNING & PORT DIRECTOR SERCK recommending approval of the amended Development Agreement with DMB Morales LLC, dba Bucktales Cantina & Grill at 1015 Tower Avenue. MOTION by Councilor Elm, seconded by Councilor Ludwig and carried, to approve. 10.3 R21-13579 Resolution of the City of Superior, Wisconsin, supporting the submittal of a Neighborhood Investment Fund Program (NIFP) grant application to the Wisconsin Department of Administration which would aid in the Development Association’s purchase of the old post office located at 1401 Tower Avenue. Councilor Elm abstained. 76 Regular Council Meeting November 2, 2021 MOTION by Councilor Ludwig, seconded by Councilor Bender and carried, to approve. 10.4 R21-13580 Resolution of the City of Superior, Wisconsin, supporting the submittal of a Neighborhood Investment Fund Program (NIFP) grant application to the Wisconsin Department of Administration which would aid in the rehabilitation of the former Carnegie Library located at 1201 Hammond Avenue. Mayor Paine explained that while the NIFP grant program is new, the projects themselves have been in the works for quite some time and both came to mind fairly quickly when the City was looking for shovel-ready projects that qualified for the grant. MOTION by Councilor Elm, seconded by Councilor Ludwig and carried, to approve. 11.
