PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, December 6, 2022 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. There was no objection to Mayor Paine’s request to consider Item 10.4 out of order. 10.4 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK is recommending approval of R22-13630, a resolution of the City of Superior, Wisconsin Identifying Blighted Property and Providing Approval to the Redevelopment Authority of the City of Superior, Wisconsin to Assist in the Private Acquisition, Improvement and Development of Blighted Property. MOTION to approve, by Councilor Herrick, seconded by Councilor Johnson, and carried. 5. MAYOR’S REPORT 6.1 Report from Mayor Paine 6.2 Committee Appointment Recommendation: 1. To the SUPERIOR BUSINESS IMPROVEMENT DISTRICT BOARD OF DIRECTORS, appoint Raya Horst for a 3-year term, expiring December 2025. MOTION to approve, by Councilor Graskey, was seconded by Councilor Ludwig and carried. 2. To the CULTURE, EVENT, AND PUBLIC ART COMMISSION, appoint Kelly Peterson for a 3-year term, expiring December 2025. MOTION to approve, by Councilor Elm, was seconded by Councilor Fennessey and carried. 3. To the LIBRARY BOARD, appoint Jim Paine to fill the vacancy created by resignation of Warren Bender, expiring April 2023. MOTION to approve, by Councilor Ludwig, was seconded by Councilor Elm and carried. 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (Meetings held November 17, 2022 and November 21, 2022) Report from Councilor Ludwig. RECOMMENDATIONS: 1. Approve reducing the number of ESD Engineering Technician staff (from four to three full-time) upon a January retirement. 2. Approve increasing workweek hours (from 37.5 to 40 hours) for three ESD Environmental Engineering Technician staff and two ESD Civil Engineering Technician staff. 3. Approve adding two annual 12-week Engineering Student Worker/Intern positions for ESD. 4. Approve adjusting equipment operator levels in Street and Parks, Rec & Forestry Divisions. 5. Approve a three-year agreement for online application, training and onboarding software with NEOGOV, which is scheduled to begin on January 1, 2023. RECOMMENDATIONS: 1. Approve O22-4293, an ordinance amending City Code Chapter 112, Traffic Code, Article II, Schedule L, Permit Parking on City Streets-Section 2, Business and Residential Areas, to remove permit parking from the following areas:  North 30th Street from Ogden Avenue to John Avenue  North 31st Street from Ogden Avenue to John Avenue  Ogden Avenue on the east side only between North 29th Street to North 31st Street  Ogden Avenue between North 31st Street and North 32nd Street 2. Approve O22-4294, an ordinance amending City Code Chapter 112 - Traffic Code, Article III, Parking, Schedule D, to exclude North 19th Street between Wyoming and Missouri Avenue. 3. Approve O22-4295, an ordinance amending City Code Chapter 112 – Traffic Code, Article VII, Schedule I, Streets Excluded from Calendar Parking, to add North 19th Street (Wyoming Avenue to Missouri Avenue). MOTION to approve all three recommendations, by Councilor Ledin, was seconded by Councilor Johnson and carried. There was no objection to waive the reading of the second and third recommendations. 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Historic Preservation Committee (Meetings held November 9, 2022 and November 28, 2022) Report from Housing Coordinator & Planner Skrenes. RECOMMENDATIONS: 1. Approve R22-13631, a resolution of the City of Superior, Wisconsin, supporting the submittal of an application to the Wisconsin State Historic Preservation Office (SHPO) for Certified Local Government Status. MOTION to approve, by Councilor Elm, was seconded by Councilor Fennessey and carried. 3 Regular Council Meeting December 6, 2022  8.1.2 Urban Forestry Tree Board (Meeting held November 17, 2022) Report from Councilor Ludwig. RECOMMENDATIONS: 1. Approve the updated Tree Permit/Policy for planting private trees on public property. MOTION to approve, by Councilor Ludwig, was seconded by Councilor Herrick and carried. 2. Approve the Davey Tree Management Plan. MOTION to approve, by Councilor Ludwig, was seconded by Councilor Graskey and carried. 3. Approve securing a new Holiday tree (preferably a 5-6’ tall balsam fir) from the Superior Municipal Forest. OLD BUSINESS 4 Regular Council Meeting December 6, 2022 10. NEW BUSINESS 10.1 CITY CLERK RAMOS recommends approval of miscellaneous licenses. MOTION to approve, by Councilor Fennessey, seconded by Councilor Johnson, and carried. 10.2 CITY CLERK RAMOS recommending approval of an original “Class B” Liquor and Class “B” Beer alcohol license application for JJ’s Palace LLC, dba JJ’s Bar, located at 1108 Tower Avenue (Agent: Jordan Wheat) for a period beginning on December 7, 2022 and ending on June 30, 2023. Agent Wheat spoke in favor of approving the license. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Johnson. MOTION to postpone until December 20th Regular Council Meeting, by Councilor Fennessey, was seconded by Councilor Johnson and failed via roll call vote: AYE – 2 Fennessey, Johnson NO – 7 Ledin, Van Sickle, Sweeney, Elm, Ludwig, Herrick, Graskey Main motion failed via roll call vote: AYE – 2 Fennessey, Johnson NO – 7 Ledin, Van Sickle, Sweeney, Elm, Ludwig, Herrick, Graskey 10.3 CITY CLERK RAMOS recommending approval of an original “Class B” Liquor alcohol license application for a partnership between Kimberly Moen and Donna Lorenz, dba Wine Beginnings, located at 1413 Tower Avenue, for a period beginning on January 1, 2023 and ending on June 30, 2023. MOTION to approve, by Councilor Elm, was seconded by Councilor Graskey and carried. 10.4 Item considered after Item 4.2. 10.5 CITY CLERK RAMOS recommends approval of a Temporary Class “B” Beer License for Douglas County Historical Society (President Valerie Burke, 1101 John Avenue, Superior, WI 54880), for the Christmas Musicale, which will be held on December 15, 2022. MOTION to approve, by Councilor Graskey, was seconded by Councilor Johnson and carried. 5 Regular Council Meeting December 6, 2022 10.6 FINANCE DIRECTOR RHINEHART recommends approval of R22-13632, a resolution appropriating the necessary funds for the Operation of the General City Government, and the Administration of the City of Superior, Wisconsin, for the year 2023, and authorizing and directing a tax levy to be spread on the tax roll of the City of Superior, Wisconsin, for the year 2022. MOTION to approve, by Councilor Elm, was seconded by Councilor Fennessey and carried. 11.
