The Regular Meeting of the Common Council was called to order by President Nick Ledin at 6:30 p.m.
in the Government Center, Board Room 201.

and carried.

MOTION to approve, by Councilor Ludwig, was seconded by Councilor
Graskey and carried.

8.1.1 Tourism Development Commission (Meeting held August 7, 2023)
Report from Councilor Graskey.
RECOMMENDATIONS:
1. Approve an amendment to the Professional Services Agreement between the City of
Superior and Swim Creative, LLC for a tourism media buy not to exceed $80,000 during
the time period of November 2023 through February 2024.

MOTION to approve, by Councilor Graskey, was seconded by Councilor Johnson,
and carried.
8.1.2 Plan Commission (Meeting held August 16, 2023)
Report from Mayor Paine.
RECOMMENDATIONS:
1. Approve R23-13657, a resolution introduced by the Plan Commission authorizing a
special use permit for residential development in an M1 district at 1209 39th Avenue
East.
MOTION to approve, by Councilor Graskey, was seconded by Councilor Ludwig,
and carried.
2. Approve land sale procedures be waived for city-owned property located at 2920 N 21st
Street and that City staff be allowed to execute the transfer by quit claim deed
immediately to Aftin Hughes as outlined in the Vacant to Value: New Construction
Program.
MOTION to approve, by Councilor Herrick, was seconded by Councilor Sweeney,
and carried.
3. Approve an amendment to Small Business Grant development agreement with Eddie’s
Restaurant, Inc. (SBGP 22-06).
MOTION to approve, by Councilor Fennessey, was seconded by Councilor
Graskey, and carried.

9. OLD BUSINESS
10. NEW BUSINESS
10.1 MAYOR PAINE is recommending approval of the 2023 Superior BID Operating Plan and
Budget.
MOTION to approve, by Councilor Sweeney, was seconded by Councilor Elm.
MOTION TO AMEND, by Councilor Fennessey to only approve operations plan
without budget at this time, was seconded by Elm.

MOTION approved as amended.
10.2 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK is
recommending approval of an agreement with the DNR to reimburse the City up to
$25,000.00 for the purpose of correcting drainage issues at the closed Wisconsin Point
landfill that arose during the Howards Bay Remediation Project.
MOTION to approve, by Councilor Fennessey, was seconded by Councilor Johnson
and carried.
10.3 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK is
recommending the adoption of the City of Superior’s and Duluth Transit Authority’s 2023-
2025 Title VI Plan for Transit.
MOTION to approve, by Councilor Van Sickle, was seconded by Councilor Fennessey
and carried.
10.4 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK is
recommending approval of R23-13658, a resolution to submit the Elkhorn Industries Dock
Rehabilitation Project for Harbor Assistance Grant Funding in the amount of $14,380,000
from the Wisconsin Department of Transportation.
MOTION to approve, by Councilor Elm, was seconded by Councilor Fennessey and
carried.
10.5 PUBLIC WORKS DIRECTOR JANIGO is recommending approval of R23-13659, a
resolution setting a public hearing on September 19, 2023, for adoption of a final resolution
to pave the alleys in 2024 and assess costs to abutting property owners.
MOTION to approve, by Councilor Herrick, was seconded by Councilor Elm and
carried.
10.6 CITY CLERK BLUNT is recommending approval of an Amend the Premise application for
Dodgies East End Tavern located at 2114 East 5th Street, (Agent: Mike Dodge) for the event
“Savoy/Flynn Benefit” on September 10, 2023.
MOTION to approve, by Councilor Johnson, was seconded by Councilor Sweeney and
carried.
10.7 CITY CLERK BLUNT is recommending approval of an Amend the Premise application
including a one-day Cabaret license for Hudy’s Bar, LLC located at 2126 East 5th Street,
(Agent: James Ronning) for the event “East End Family Fun Days” on September 16, 2023.
MOTION to approve, by Councilor Johnson, was seconded by Councilor Herrick and
carried. Councilor Graskey abstains.
10.8 CITY CLERK BLUNT is recommending approval of a Temporary Class “B” Beer License
for Border Town Betties (President Rebecca Scherf, 1628 Hughitt Ave., Superior, WI
54880) for “Emo Prom” which will be held at 1401 Tower Ave on October 7, 2023.
