PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, October 3, 2023 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. Claim No. 23-24, Lester C. Lockhart (Received 09/28/2023). 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 6.2 Approval of the 2024 Budget (Budget Book to be distributed at Council Meeting 10/03/2023). MOTION TO APPROVE, by Councilor Sweeney, was seconded by Councilor Graskey. MOTION TO POSTPONE to the next regular scheduled meeting, by Councilor Fennessey, was seconded by Councilor Sweeney and carried. 1 Regular Council Meeting October 3, 2023  There was no objection to a request to take a 5-minute recess at 7:45 p.m. The meeting resumed at 7:50 p.m. 6.3 Recommending approval of a grant agreement with Faith United Methodist Church, dba Harbor House Crisis Shelter. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Ledin and carried. 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (Meeting held September 18, 2023) Report from Councilor Ludwig. RECOMMENDATIONS: 1. Approve request to fill a new full-time Building Inspector position. 2. Approve an exception to the take home vehicle residency distance requirement. 3. Approve paying wage step 10 for temporary part-time Working Foreman for ESD Operations position. 4. Approve the updated Equal Employment Opportunity Program and Affirmative Action Plan Policy. MOTION TO APPROVE items 1, 2, 3, and 4, by Councilor Ludwig, was seconded by Councilor Van Sickle and carried. 7.2 Public Works Committee (No meeting to report) 7.3 Finance Committee (Meeting held September 14, 2023) Report from Councilor Sweeney. RECOMMENDATIONS: 1. Approve the Amended 2023 General Fund Budget 2. Approve the purchase of a golf simulator for the Nemadji Golf Course from Ace Indoor Golf in the amount of $37,673.48. 3. Approve the 2024 Health and Dental insurance rates, the 2024 Health and Dental insurance budget and funding of the HAS/HRA deductibles for 2024. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Plan Commission (Meeting held September 20, 2023) Report from Mayor Paine. RECOMMENDATIONS: 1. Approve R23-13664, a resolution setting a public hearing to vacate an alley on the 800 block of Central Avenue (VAC 23-01). 2. Approve a Small Business Grant application and development agreement for Schultz’s Sports Bar (SBGP23-09). 3. Approve a Small Business Grant application and development agreement for Pudges Tavern LLC (SBGP23-10). MOTION TO APPROVE items 1, 2, & 3, by Councilor Fennessey, was seconded by Councilor Herrick and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Historic Preservation Committee (Meeting held September 13, 2023) No report from the Chair. 9. OLD BUSINESS 10. NEW BUSINESS 10.1 CITY CLERK BLUNT recommends approval of miscellaneous licenses. MOTION TO APPROVE, by Councilor Johnson, was seconded by Councilor Moffat and carried. 10.2 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of R23-13665, a resolution introduced by the Community Development Division to set a public hearing for the 2024 Community Development Block Grant Action Plan. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Herrick and carried. 3 Regular Council Meeting October 3, 2023  10.3 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of R23-13666, a resolution authorizing the purchase of real property from Bunge North America, Inc. and authorizing execution of a purchase and sale agreement and related documents in connection therewith. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Ledin and carried. 10.4 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of the Superior Housing Authority’s Request to Partially Release an Easement Granted to the City of Superior for the Purposes of Financing its Catlin Courts Apartment Rehabilitation Project. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Moffat and carried. 10.5 INFORMATION & TECHNOLOGY DIRECTOR SHEA recommends approval of R23- 13667, a resolution to set a public hearing for the creation of a Broadband Utility. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Moffat and carried. 10.6 PUBLIC WORKS DIRECTOR JANIGO recommends approval of O23-4324, an ordinance amending City Code Chapter 112 - Traffic Code, Schedule J, Accessible Parking Zones, to add accessible parking signs to 1809 Banks Avenue, on both sides. MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Elm and carried. 10.7 CITY CLERK BLUNT recommends approval of a renewal Class “B” Beer and “Class B” Liquor license application for Superior Curling Club Incorporated, located at 4700 Tower Avenue (Agent: John Gunnon) for a period beginning on October 15, 2023 and ending on April 14, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Ledin and carried. 10.8 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of waiving the land sale process for 5 properties near East 4th Street and 53rd Avenue East on Block 18, Itasca Division and allow staff to transfer properties via quit claim at no cost to the adjacent property owners. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Elm and carried. 11.
