PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, November 21, 2023 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 7:05 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Nick Ledin, Jenny Van Sickle, Garner Moffat, Jack Sweeney, Brent Fennessey, Tylor Elm, Ruth Ludwig, Mike Herrick, Mark Johnson, Lindsey Graskey - 10 Absent: Also Present: Mayor Paine, City Clerk Blunt, Deputy City Clerk Bacon, Chief of Staff Scherf 3. PRESENTATIONS AND PUBLIC HEARINGS 3.1 PUBLIC HEARING on the approval of R23-13671, a resolution approving the amendment to vacate and discontinue an alley and street near the 800 block of Central Avenue (VAC23- 01). There was no objection to Mayor Paine’s request to open the public hearing. No speakers came forward during the public hearing. MOTION to close public hearing and adopt the resolution by Councilor Ledin, was seconded by Councilor Johnson, and carried. 4. APPROVAL OF MINUTES 4.1 November 7, 2023 - Regular Council Meeting MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Ludwig, and carried. 5. CORRESPONDENCE TO BE FILED (No action) 5.1 CLAIMS referred to the Liability Claims Committee by City Clerk’s Office: 1. Claim No. 23-37 Mark Wilson (Received 11/16/2023). 2. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (No meeting to report) Report from the Chair. 7.2 Public Works Committee (Meeting held November 2, 2023) Report from the Councilor Van Sickle. There was no objection to the request by Councilor Van Sickle to take committee items out of order. RECOMMENDATIONS: 1. Approval of a municipal solid waste (MSW) letter of availability for a Regional MSW Disposal Facility. 2. Approval of a Landfill Gas Purchase Agreement and Land Lease Agreement with Vespene Energy. MOTION TO REFER to the Public Works Committee by Councilor Van Sickle, seconded by Councilor Graskey, and carried. 3. Award ProPrint, Inc to continue mailing services, including printing for the quarterly utility bills, arrears notices, envelopes, and billing inserts at an annual increase of $202.84. 4. Award J&M Displays, Inc. for the 2024 4th of July Independence Day Celebration, and for the 2025 Lake Superior Ice Festival in the amount of $40,000. 5. Approve the motorized trail re-route through the Nemadji Golf Course for the 2023- 2024 season. 6. Award SEH for the preliminary and final engineering design of the East 5th Street Reconstruction Project at a proposed cost of $315,600. 7. Approve Amendment VII with Jack Rabbit Cleaning, LLC through December 31, 2024 with no rate increase. 8. Approve renewal of a five year Fixed-Base Operator Agreement with 100 Octane Aviation to lease the northeast portion of the city owned hanger A-1 at the Richard I. Bong Memorial Airport for a fee of $350 per month. 9. Award Meyer Group Architecture for Phase II of the Municipal Service Building Improvements in the amount of $28,998. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Golf Course Committee (Meeting held October 26, 2023) Report from the Councilor Sweeney. RECOMMENDATIONS: 1. Approve the 2024 proposed rates. 2. Approve continuation of Golf Course Committee for 2024. 3. Approve addition of convenience fee of 3% for transactions exceeding $500 for those paying with a credit card. MOTION TO APPROVE items numbered 1, 2, and 3 by Councilor Ledin, was seconded by Councilor Sweeney, and carried. 8.1.2 Culture, Events & Public Art Commission (Meeting held November 9, 2023) Report from the Councilor Graskey. RECOMMENDATIONS: 1. Approve the Superior Public Art Grant (SPAG) program. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Ludwig, and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Mayor’s Commission on Communities of Color (Meeting held November 13, 2023) No report from the Chair. 8.2.2 Wisconsin Point Committee (Meeting held November 7, 2023) No report from the Chair. 9. OLD BUSINESS 9.1 Approve State and Local Fiscal Recovery Fund (SLFRF) Non-Profit Grants to: 1. Douglas County Historical Society in the amount of $112,121. MOTION TO APPROVE by Councilor Johnson, was seconded by Councilor Elm (Councilor Moffat and Councilor Graskey abstained), and carried. 2. National Alliance on Mental Illness (NAMI) in the amount of $120,000. 88 Regular Council Meeting November 21, 2023  MOTION TO APPROVE by Councilor Ludwig, was seconded by Councilor Ledin, and carried. 3. Our Savior’s Lutheran Church in the amount of $15,732. MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Johnson, and carried. 4. The Center Against Sexual and Domestic Abuse (CASDA) in the amount of $67,499. MOTION TO APPROVE by Councilor Ludwig, was seconded by Councilor Ledin (Councilor Elm abstained), and carried. 5. St. Francis Xavier Church in the amount of $30,000. MOTION TO APPROVE by Councilor Ludwig, was seconded by Councilor Moffat (Councilor Sweeney abstained), and carried. 6. Zion Lutheran Church in the amount of $98,040. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Fennessey, and carried. 7. Nemadji Cemetery in the amount of $57,500. MOTION TO APPROVE by Councilor Moffat, was seconded by Councilor Ludwig, and carried. 8. United Presbyterian in the amount of $127,652. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Elm, and carried. 9. St. Albans Church in the amount of $25,000. No action taken. The Committee of the Whole approved a two-month extension to allow applicant to resubmit materials. Item will be agendized at the next regular meeting of the Common Council following the two-month postponement. 10. Bethel Lutheran Church in the amount of $2,000. No action taken. NEW BUSINESS 10.1 COMMUNITY DEVELOPMENT MANAGER, KRISTA ANDERSON, is recommending the approval of the Memorandum of Understanding between the City of Superior and Northwest Wisconsin Community Services Agency, Inc. to provide referral services for fair housing complaints in accordance with Section 106.50 of the Wisconsin Statutes. 89 Regular Council Meeting November 21, 2023  MOTION TO APPROVE by Councilor Herrick, was seconded by Councilor Elm and carried. 10.2 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK is recommending approval of R23-13672 a resolution setting a public hearing on December 5, 2023, for adoption of a final resolution on the proposed issuance by the City of Superior of its Dock, Wharf, Drydock and Repair Facilities Revenue Bonds Series 2023, to be issued in one or more series of tax-exempt and/or taxable bonds to Fraser Industries LLC in an amount not to exceed $40,000,000. MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Fennessey and carried. 10.3 CITY CLERK BLUNT is recommending approval of an original “Class A” Beer license application for Family Dollar Stores of Wisconsin, LLC, dba Family Dollar Store #23410, located at 110 Belknap Street, (Agent: Steve Lowery) for a period beginning on November 22, 2023 through June 30, 2024. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Moffat and carried. 10.4 CITY CLERK BLUNT is recommending approval of a “Class B” Liquor transfer of license due to new ownership of Wine Seller Winery located at 1409 Belknap Avenue to Nye Eventyr, a limited liability company (Agent: Jodi Hansen) for the current license period through June 30, 2024. MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Graskey and carried. 10.5 MAYOR PAINE is recommending allocating $50,000 of the Public Art Fund to the Superior Public Art Grant program. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Moffat and carried. 11. BUSINESS BY PUBLIC Jeff Monahan addressed the council to express concerns regarding the potential impact of the Blatnik Bridge alignment and interchange plans for Superior.
