PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, February 6, 2024 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Nick Ledin, Jenny Van Sickle, Garner Moffat, Jack Sweeney, Brent Fennessey, Tylor Elm, Ruth Ludwig, Mike Herrick, Mark Johnson, Lindsey Graskey - 10 Also Present: Mayor Paine, City Attorney Prell, City Clerk Blunt, Deputy City Clerk Bacon, Chief of Staff Scherf, City Clerk Assistant Lang 3. PRESENTATIONS AND PUBLIC HEARINGS 3.1 Superior Public Museums Presentation Megan Meyer, Executive Director; Brittany Plachecki, Museum Manager; Katelyn Baumann, Board President 4. APPROVAL OF MINUTES 4.1 January 16, 2024 - Regular Council Meeting MOTION to approve, by Councilor Elm, was seconded by Councilor Herrick and carried. 5. CORRESPONDENCE TO BE FILED (No action) 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (Meeting held January 22, 2024) Report from Councilor Ludwig. RECOMMENDATIONS: 1. Approve request to fill 2 new Light Equipment Operator-Parks, Recreation & Forestry positions to assist with landscape maintenance on the Tower and Belknap corridors. These are regular, full-time, benefited positions that are included in the 2024 budget. 112 Regular Council Meeting February 6, 2024 MOTION to approve, by Councilor Ludwig, was seconded by Councilor Graskey and carried. 2. Approve request to fill 3 new Seasonal Laborer-Parks, Recreation & Forestry positions to assist with landscape maintenance on the Tower and Belknap corridors. These are seasonal, non-benefited positions that are included in the 2024 budget. MOTION to approve, by Councilor Ludwig, was seconded by Councilor Elm and carried. 7.2 Public Works Committee (No meeting to report) 7.3 Finance Committee (Meeting held January 11, 2024) Report from Councilor Sweeney. RECOMMENDATIONS: 1. Approve the 2024 Liability Insurance Fund Budget. MOTION to approve, by Councilor Herrick, was seconded by Councilor Johnson (Councilor Van Sickle abstained) and carried. 2. Approve the 2023 Non-Profit Grant Application for Douglas County Historical Society in the amount of $20,000. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Herrick (Councilors Moffat and Graskey abstained) and carried. 7.4 Licenses and Fees Committee (No meeting to report) 7.5 Public Safety Committee (Meeting held January 18, 2024) Report from Councilor Ledin. RECOMMENDATIONS: 1. Approve a Professional Engineering Services Agreement with OPN Architects, Inc. in the amount of $79,900.00 to develop a set of construction documents for the Fire Station 3 Remodel Project. MOTION to approve, by Councilor Ledin, was seconded by Councilor Johnson and carried. 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Plan Commission (Meeting held January 17, 2024) Report from Mayor Paine. 113 Regular Council Meeting February 6, 2024 RECOMMENDATIONS: 1. Approve R24-13679, a resolution introduced by the Plan Commission authorizing a special use permit for a mobile kiosk building to be built and placed at 5701 Tower Avenue. MOTION to approve, by Councilor Ledin, was seconded by Councilor Graskey and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Police and Fire Commission (Meetings held January 10, 2024 and January 30, 2024) No report from the Chair. 8.2.2 Culture, Events & Public Arts Commission (Meeting held January 30, 2024) No report from the Chair. 9. OLD BUSINESS 10. NEW BUSINESS 10.1 CITY CLERK BLUNT recommends approval of miscellaneous licenses. MOTION to approve, by Councilor Herrick, was seconded by Councilor Johnson and carried. 10.2 CITY CLERK BLUNT recommends approval of application by Wal-Mart Stores East, LP, to appoint Kyle Reiss as Agent for the remainder of the license period, expiring June 30, 2024. MOTION to approve, by Councilor Ledin, was seconded by Councilor Ludwig and carried. 10.3 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of the Release of Utility Easements in previously vacated property at 21st Street and Stinson Avenue. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Elm and carried. 10.4 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of R24-13780, a resolution setting a public hearing on February 20, 2024, for adoption of a final resolution on the proposed issuance by the City of Superior of its Multifamily Housing Revenue Notes, Series 2024, to be issued in one or more series of tax- exempt and/or taxable bonds to Royalton Associates 2, LP, in an amount not to exceed $20,000,000 to finance the acquisition, rehabilitation, and equipping of an existing residential rental development known as Royalton Manor Apartments located at 1901 New York Avenue. MOTION to approve, by Councilor Johnson, was seconded by Councilor Moffat. 114 Regular Council Meeting February 6, 2024 MOTION TO AMEND to reflect inserting Public Finance Authority in place of City of Superior by Councilor Fennessey, was seconded by Councilor Johnson. MOTION approved as amended. 10.5 CITY CLERK BLUNT recommends approval of an original Class “A” Beer and “Class A” Liquor (Cider Only) license application for CAPL Retail LLC, dba Joe’s Kwik Marts, located at 311 Belknap Street (Agent: Sandra Pfankuch) for a period beginning on February 9, 2024 and ending on June 30, 2024. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Herrick and carried. 10.6 CITY CLERK BLUNT recommends approval of an original Class “A” Beer and “Class A” Liquor (Cider Only) license application for CAPL Retail LLC, dba Joe’s Kwik Marts, located at 406 Belknap Street (Agent: Sandra Pfankuch) for a period beginning on February 9, 2024 and ending on June 30, 2024. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Graskey and carried. 10.7 CITY CLERK BLUNT recommends approval of a Temporary Class “B” Beer & Class “B” Wine License application for the Richard I Bong Veterans Historical Center located at 305 Harbor View Parkway (Chair: Terry Lundberg) for “Escape the Bong” to be held February 9th through February 11th 2024. MOTION to approve, by Councilor Graskey, was seconded by Councilor Moffat and carried. 11.
