Tuesday, January 16, 2024
The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in
the Government Center, Board Room 201.

MOTION to approve, by Councilor Elm, was seconded by Councilor Johnson.
MOTION TO AMEND, by Councilor Herrick to correct Roll Call to reflect that
Councilor Herrick attended in person received no objection.
MOTION approved as amended.

5.1 CLAIMS referred to the Liability Claims Committee by City Clerk’s Office:

MOTION TO APPROVE, by Councilor Johnson, was seconded by Councilor
Graskey, and carried.

RECOMMENDATIONS:
1. Approve O24-4331, an ordinance amending City Code Chapter 114, Utilities, Article II,
Sewer Usage, to update Local Limits Changes, Hauled Waste, and Fats, Oils, & Grease.
2. Approve O24-4332, an ordinance amending City Code Chapter 112, Traffic Code,
Article VII Parking, Schedule A, Stops-Section 3 One and Two-Way Stops, Add the
following stops at Maryland Ave and North 16th Street.
3. Approve O24-4333, an ordinance amending City Code Chapter 112, Traffic Code,
Article VII Parking, Schedule A, Stops-Section 3 One and Two-Way Stops, Add the
following stops at Fisher Avenue and North 20th Street.
4. Approve a request from Cenovus Energy Inc to purchase up to 1.5 credits from the City
of Superior Compensatory Wetland Mitigation Bank.
5. Approve renewing the agreement for professional engineering services with Donohue &
Associates, Inc through December 31, 2024.
6. Approve renewing the agreement for professional engineering services with Short Elliot
Hendrickson, Inc. through December 31, 2024.
7. Approve renewing the agreement for professional engineering services with Weyandt,
LLC.
8. Approve the installation of two flashing speed signs, one on East 2nd Street near the
Human Society and another on Belknap Street after exiting the roundabout near Billings
Park.
There was no objection to Councilor Van Sickle’s request to consider
recommendations out of order.
There was no objection to the Mayor Paine’s request to invite Superior High
School students Madilyn Carey and Jaclyn Samarziya to introduce their class
project that resulted in recommendation number 2 on the agenda.
MOTION TO APPROVE item number 2 by Councilor Herrick, was seconded by
Councilor Ludwig, and carried.
MOTION TO APPROVE items numbered 4, 5, 6, 7, and 8 by Councilor Van
Sickle, was seconded by Councilor Ludwig, and carried.

Graskey, and carried.
MOTION TO APPROVE item 3 by Councilor Ludwig, was seconded by Councilor

7.3 Finance Committee (Meeting held December 14, 2023)

RECOMMENDATIONS:
1. Approve Amendment I to the Land Lease Agreement between the City of Superior and
Robert Forrest Jr. for Charter Fishing Dock on Barker’s Island.
2. Approve Amendment I to the Animal Care and Facility Agreement with Humane
Society of Douglas County, Inc. for operations of the City owned Animal Shelter.
3. Approve the 2024 Nemadji Golf Course Budget.
4. Approve the 2024 Urban Tree Fund Budget.
5. Approve the 2024 Municipal Forest Fund Budget
6. Approve the 2024 Hotel Motel Tax Trust Fund Budget
MOTION TO APPROVE items numbered 1, 2, 3, 4, 5, and 6 by Councilor
Sweeney, was seconded by Councilor Elm, and carried.
7.4 Licenses and Fees Committee (Meeting held December 11, 2023)
No report from the Chair.
RECOMMENDATIONS:
1. Approve O24-4330, an ordinance amending City Code Chapter 112 - Traffic Code,
Article VI – Vehicles for Hire Taxicabs/Animal Drawn Vehicles, Division 3 –
Operator’s License, Section 112-313 – Application for license, to remove requirement
for notarized application allowing for electronic form submission.
MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor
Fennessey, and carried.
7.5 Public Safety Committee (Meeting held December 21, 2023)
Report from Councilor Elm.
RECOMMENDATIONS:
1. Approve a Consent Agreement for the Superior Fire Department to be listed as a
Firefighting Resource Provider with T&T Salvage, LLC in accordance with 33 Code of
Federal Regulations Part 155, Salvage and Marine Fire Fighting Requirements.
MOTION TO APPROVE by Councilor Herrick, was seconded by Councilor Elm,
and carried.

RECOMMENDATIONS:
1. Approve O23-4334, an ordinance repealing and reenacting City Code, Chapter 98 –
Planning, Zoning and Development, Article III – Historic Preservation, Sec. 98-90 –
Construction and Alteration, to update the process to the Certificate of Appropriateness.
2. Approve a Small Business Grant application and development agreement for Birds Bar
(SBGP23-11).
3. Approve a Small Business Grant application and development agreement for Lori
Ronchi Agency Inc (SBGP23-14).
4. Approve a Small Business Grant application and development agreement for Strength
Factory (SBGP23-12).
5. Approve a Small Business Grant application and development agreement for Yes,
Cheese LLC (SBGP23-13).

Councilor Moffat, and carried.

10.1 COMMUNITY DEVELOPMENT MANAGER Anderson recommends approval of R24-
13677, a resolution setting a public hearing on February 20, 2024, for comments on
Community Development Needs and Fair Housing Choice.
MOTION TO APPROVE by Councilor Herrick, was seconded by Councilor Elm, and
carried.

10.2 CITY CLERK BLUNT recommends approval of miscellaneous licenses.
MOTION TO APPROVE by Councilor Fennessey, was seconded by Councilor
Graskey, and carried.
10.3 PUBLIC WORKS DIRECTOR JANIGO recommends approval of O24-4329, an ordinance
amending City Code Chapter 112, Traffic Code, Schedule J, Accessible Parking Zones, to
remove accessible parking signs at 1711 Ogden Avenue, on both sides.
MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Ludwig, and
carried.
10.4 FINANCE DIRECTOR RHINEHART recommends approval of R24-13678, a resolution
providing for the prepayment and redemption of a portion of the outstanding $3,240,000
General Obligation Refunding Bonds, Series 2017C.
MOTION TO APPROVE by Councilor Fennessey, was seconded by Councilor
Graskey, and carried.
