PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, December 19, 2023 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. Claim No. 23-40, Artisan and Truckers Casualty Company A/S/O Gudowski, Derick (Received 12/12/2023). 6. MAYOR’S REPORT 6.1 Report from Mayor Paine. Mayor Paine reported on the Holocaust training, “Slippery Slope” for law enforcement and local officials. Several department heads attended the training and Mayor Paine invites Councilors to attend the next opportunity December 20, 2023 at Yellow Jacket Union 8:30 – 11:30am or 2pm to 5pm. 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (No meeting to report) 1 Regular Council Meeting December 19, 2023 7.2 Public Works Committee (Meeting held December 7, 2023) Report from Councilor Van Sickle. Directionality of Stop Signs noted in the minutes may be opposite and needs to be amended. RECOMMENDATIONS: 1. Request approval of a Landfill Gas Purchase Agreement and Land Lease Agreement with Vespene Energy. 2. Request approval of the Electronic Waste Handling and Collection Agreement with MRM. 3. Recommendation to approve Amendment I with Liberty Tire Services LLC for tire recycling in 2024 at a rate of $305.00 per ton. 4. Recommendation to award Short Elliot Hendrickson for the Landfill Consultant Contract for an amount not to exceed $50,0000. 5. Request approval for a renewal of Joint Powers Agreement with WLSSD for Household Hazardous Waste in the estimated amount of $30,000 per year. 6. Recommendation to waive the bidding requirements and approve the purchase of a 2024 John Deere 4075R Compact Utility Tractor in the amount of $82,564.87, and a 2024 John Deere 3039R Compact Utility Tractor in the amount of $56,299.77 from Northland Lawn & Sport. 7. Recommendation to renew a Professional Services Agreement with AMI Consulting Engineers. 8. Recommendation to approve a Construction Oversight Agreement with Weyandt, LLC for the Woodstock Bay Improvements in the amount of $27,952.00, and for engineering plan changes not to exceed $12,000. 9. Recommendation to approve a Construction Agreement with Parsons Electric for upgrades to Dock G at the Barker’s Island Marina in the amount of $368,033.00, plus the hourly fee of $140.00 for repairs to dock frames as deemed necessary. 10. Request approval to enter into an Aid Agreement with (WDNR), for the City of Superior to be reimbursed up to $60,000 over three years for the visitor use assessment component of the Wisconsin Point Coastal Restoration & Resiliency Project. 11. Approve O23-4328, an ordinance amending City Code Chapter 112, Traffic Code, Article III Parking; Schedule J, Accessible Parking Zones, Add Do Not Block Sidewalk at 1601 North 16th Street. MOTION TO APPROVE items numbered 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 by Councilor Van Sickle, was seconded by Councilor Johnson, and carried. NEW BUSINESS 10.1 CITY CLERK BLUNT is recommending approval of an original “Class B” Beer and Liquor license application for The Original Louis Café, LLC. located at 4927 E. 2nd Street (Pablo Munoz, Agent) for a period beginning January 1, 2024 through June 30, 2024. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Johnson, and carried. 10.2 CITY CLERK BLUNT is recommending approval of an original “Class B” Beer and Liquor license application for Choo Choo Bar & Grill, LLC. located at 5002 E. 3rd Street (James Hugdahl, Agent) for a period beginning January 1, 2024 through June 30, 2024. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Herrick, and carried. 10.3 CITY CLERK BLUNT is recommending approval of miscellaneous licenses. MOTION TO APPROVE by Councilor Graskey, was seconded by Councilor Fennessey, and carried. 3 Regular Council Meeting December 19, 2023  10.4 CITY CLERK BLUNT is recommending approval of the updated election inspector roster for the 2024-2025 election cycle. MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Graskey, and carried. 10.5 FINANCE DIRECTOR RHINEHART is recommending approval of R23-13676, a resolution Authorizing the Issuance and Sale of Up to $1,880,617 Sewerage System Revenue Bonds, Series 2024A, and Providing for Other Details and Covenants with Respect Thereto. MOTION TO APPROVE by Councilor Johnson, was seconded by Councilor Fennessey, and carried. Councilor Sweeney inquired about the interest rate. Director Rhinehart confirmed the interest rate and gave an overview of the project and loan. 10.6 HOUSING COORDINATOR & PLANNER SKRENES is recommending approval of the sale of 1211 North 13th Street to Clifton Holliday for the price of $3,500 with an expected completion date of eighteen months from the date of closing. MOTION TO APPROVE by Councilor Fennessey, was seconded by Councilor Elm, and carried. Housing Coordinator & Planner Skrenes gave an overview and update of the task force and renovation program. Councilor Sweeney requested a written report at the end of the year/quarter. Mr. Skrenes will provide a report. Councilor Herrick inquired about the City’s interest in the property once sold. Mr. Skrenes responds that there are no further ties with the City once a property is sold, but a good faith deposit is made. Fees may be assessed if the project is not completed within the specified times. Councilor Fennessey inquired about the property taxes. The property taxes have been paid. Councilor Van Sickle inquired about whether the property is slated to be a rental property and if the City had input on how much will be charged. Yes, it is to be a rental property and the City has no say in the rent cost. Mayor Paine proposed adjournment of the City Council until January 16, 2024. MOTION TO APPROVE by Councilor Elm, was seconded by Councilor Herrick, and carried. 11.
