PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN January 21, 2025 6:30 p.m. - Government Center, Board Room 201 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Jenny Van Sickle, Garner Moffat, Jack Sweeney, Brent Fennessey, Tylor Elm, Ruth Ludwig, Mike Herrick, Mark Johnson – 8 Virtual: Nick Ledin, Lindsey Graskey – 2 Absent: Also Present: Mayor Paine, City Attorney Prell, City Clerk Blunt, Deputy City Clerk Bacon 3. PRESENTATIONS AND PUBLIC HEARINGS 3.1 PUBLIC HEARING on the approval of R25-13821, a resolution approving the amendment to vacate and discontinue the East-West alley abutting lots 13 through 17 and the easterly seventeen feet of lot 18 Block 478, West Superior 19th Division. No members of the public came forward to speak at this hearing. MOTION to close the public hearing and approve the resolution by Councilor Van Sickle, was seconded by Councilor Elm, and carried. 4. APPROVAL OF MINUTES 4.1 January 7, 2025 - Regular Council Meeting MOTION to approve by Councilor Herrick, was seconded by Councilor Ludwig, and carried. 5. CORRESPONDENCE TO BE FILED (No action) 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (No meeting to report) 7.2 Public Works Committee (No meeting to report) 1 Regular Council Meeting January 21, 2025 7.3 Finance Committee (No meeting to report) 7.4 Licenses and Fees Committee (Meeting held January 13, 2025) Report from Councilor Fennessey. RECOMMENDATION: 1. Approve O25-4372, an ordinance amending City Code, Chapter 14 – Alcohol Beverages, Article II, License Classifications and Fees, Sec. 14-24 – License Fees, to remove the cost of Health Inspection Fee. MOTION to approve by Councilor Herrick, was seconded by Councilor Fennessey, and carried. 2. Approve O25-4373, an ordinance amending City Code, Chapter 74 – Licenses, Permits and Business Regulations, Article II – Hotels, Motels and Rooming Houses, Sec. 74-30 Application for License; Annual and Pro Rata License Fees, to remove the cost of Health Inspection Fee. MOTION to approve by Councilor Herrick, was seconded by Councilor Moffat, and carried. 3. Approve O25-4374, an ordinance amending City Code, Chapter 78 – Manufactured Homes and Manufactured Home Parks, Sec. 78-16 – License Fees for Manufactured Home Parks, to remove the cost of Health Inspection Fee. MOTION to approve by Councilor Herrick, was seconded by Councilor Moffat, and carried. 4. Approve O25-4375, an ordinance amending City Code, Chapter 74 – Licenses, Permits and Business Regulations, Article IX – Tattoo Establishments, Sec. 74-255 License Fee and License Year; Separate License Required for Each Place of Business; Display of License, to remove the cost of Health Inspection Fee. MOTION to approve by Councilor Herrick, was seconded by Councilor Sweeney, and carried. 7.5 Public Safety Committee (No meeting to report) 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS There was no objection to table item 8.1.1 until after item 10.4.. 8.2 REPORTS SANS RECOMMENDATIONS 2 Regular Council Meeting January 21, 2025 8.2.1 Police & Fire Commission (Meeting held January 8, 2025) No report from the Chair. 9. OLD BUSINESS 10. NEW BUSINESS 10.1 CITY CLERK BLUNT is recommending approval of miscellaneous licenses. MOTION to approve by Councilor Ludwig, was seconded by Councilor Moffat, and carried. 10.2 CITY CLERK BLUNT is recommending approval of an Unlimited Transfer Full-Service Retail Outlet for Earth Rider Brewery (Agent Timothy Nelson), for the Lake Superior Ice Festival located at Barker’s Island, Superior, WI on January 24, 2025, from 4pm to 9pm and January 25, 2025, from 9am to 9pm. MOTION to approve by Councilor Moffat, was seconded by Councilor Fennessey, and carried. 10.3 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of R25-13820, a resolution authorizing staff to submit the Wisconsin Economic Development Corporation (WEDC) Community Development Initiative (CDI) grant application for the redevelopment of 2704 North 21st Street. MOTION to approve by Councilor Moffat, was seconded by Councilor Elm, and carried. 10.4 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends approval of R25-13823, a resolution of the City of Superior, Wisconsin Approving the Project Plan, Establishing District Boundaries and Making Relevant Findings to the Creation of Tax Incremental District No. 19. Shawn Lentz, Financial Advisor, with Ehlers offered a presentation on the creation of TID 19 and answered questions. MOTION to approve by Councilor Fennessey, was seconded by Councilor Herrick, and carried. 8.1.1 Redevelopment Authority (Meeting held January 14, 2025) No report from the Chair. RECOMMENDATIONS: 1. Approve R25-13822, a resolution approving the Report of the Redevelopment Authority of the City of Superior, a Development Agreement and a Cooperation Agreement with the Redevelopment Authority of the City of 3 Regular Council Meeting January 21, 2025 Superior, Wisconsin in connection with the Lake Superior Apartments, LLC Project. There was no objection to pulling item 8.1.1 from the table for discussion. MOTION to approve by Councilor Fennessey, was seconded by Councilor Herrick, and carried. 10.5 ENVIRONMENTAL SERVICES DIRECTOR ROBERTS recommends awarding the engineering contract to Short Elliot Hendrickson, Inc., for Phase 1 of the Blatnik Bridge Sanitary Sewer Relocation Project in the amount of $175,600.00. MOTION to approve by Councilor Van Sickle, was seconded by Councilor Ludwig, and carried. 10.6 PLANNING, ECONOMIC DEVELOPMENT & PORT DIRECTOR SERCK recommends the approval of R25-13824, a resolution supporting the office and laboratory building expansion of the Lake Superior National Estuarine Research Reserve. Deanna Erickson, Director at the National Estuarine Research Reserve, presented an update on the Reserve project and proposal. MOTION to approve by Councilor Elm, was seconded by Councilor Johnson, and carried. 11.
