Roll Call 2. Approve 01/18/2021 Meeting Minutes Motion to approve by Councilor Sutherland, second by Commissioner Nyberg, and approved unanimously. 3. Treasurer’s Report No spending since the previous meeting and account balances are the same. 4. Elect Vice Chair Motion by Councilor Sutherland to elect Jill Nyberg as Vice Chair, second by Commissioner Wilberg, and approved unanimously. 5. Approve Updated Commission By-Laws Motion to approve by Commissioner Leckel, second by Commissioner Perkkio, and approved unanimously. 6. Discuss shopping carts in bus shelters Commissioner Leckel asked to discuss the issue of shopping carts being left in bus shelters – namely those by Walmart. Commissioner Leckel suggested the City consider utilizing the nuisance ordinance and fine Walmart if shopping carts are left in the bus shelter. Commissioner Wilberg thought Walmart may already have an existing policy addressing this issue, but was unsure. Sgt. Trone offered to reach out to Walmart and ask about this policy, and will start the conversation of how to address this issue. Commissioner Leckel also mentioned the high volumes of trash that tend to be left in bus shelters. Commissioner Nyberg mentioned this had been discussed in a previous meeting she attended, and the Duluth Transit Authority will be working to address the problem. 7. Discuss Respite Care Association of Wisconsin information This information was submitted as an FYI from Commissioner Leckel. Commissioner Nyberg will reach out to Aging and Disabilities Resource Center about having the information posted on their pamphlet wall in the Government Center. 8. Next meeting: April 19, 2021 The meeting was adjourned at 12:21pm. The City of Superior complies with the Americans with Disabilities Act of 1990. AGENDA: 1. Roll Call 2. Approve 11/16/2020 Meeting Minutes Commissioner Crass motioned the minutes be updated to reflect “Minutes” where “Agenda” is at the top and the date for the next meeting to be “January 18, 2021” where is currently states “February 15, 2021”. There was a second from Commissioner Sutherland and approved unanimously. A motion from Commissioner Sutherland to approve the minutes as amended, seconded by Commissioner Perkkio, and approved unanimously. 3. Treasurer’s Report $1,640.64 in the checking account and $15.54 in the savings account for a total of $1,656.18. Motion to approve from Commissioner Leckel, seconded by Commissioner Sutherland, and approved unanimously. 4. Review of Commission By-Laws The commission reviewed their by-laws line by line and requested a total of 8 updates and amendments. These will be accurately reflected in a tracked changes version of the by-laws presented at the February 15, 2021 meeting of the commission. 5. Any other business Commissioner Leckel asked that shopping carts in bus shelters be added as an agenda item at the February meeting. It was decided that elections for Chair, Vice Chair, and Treasurer will take place at the next meeting. Commissioner Leckel asked if the by-laws can be made available in braille and other accessible versions. Nick will look into options. Commissioner Perkkio also brought up the topic of signing off on disabled parking zones per ordinance. She asked if they should be discussed at commission meetings, and is it still appropriate she signs off on them. Nick will look into more and bring back information at the next meeting. 6. Next meeting: February 15, 2021 The meeting was adjourned at 1:08pm. 1 BYLAWS 2 CITY OF SUPERIOR 3 MAYOR'S COMMISSION ON DISABILITIES 4 5 ARTICLE I. Establishment of Commission 6 7 1. This organization shall be known as the Mayor's Commission on Disabilities. 8 9 ARTICLE II. Membership 10 11 1. The Commission shall be made up of 50 percent disabled personspeople with 12 disabilities; one-third shall be consumers of services provided for disabled 13 personspeople with disabilities; one-third shall be providers of services for 14 disabled personspeople with disabilities; and there should be at least one 15 representative from the City Council. 16 17 2. Members are appointed by the Mayor and approved by the City Council. 18 19 3. Terms run for a period of three (3) years and may be renewed for additional 20 three (3) year terms. 21 22 4. Any member unable to finish the appointed term should submit a letter of 23 resignation to the Commission. Vacancies shall be filled for the unexpired term 24 in the same manner as the original appointment. 25 26 5. The term of any member of the Commission shall be deemed vacant upon failure 27 to attend three (3) meetings during a given year without an excused 28 absence.After three (3) unexcused absences, the appointment of the member 29 will come under the advisement of the Mayor and the Commission to deem if the 30 appointment should be vacated. Absences will only be excused if contact is made 31 with the Commission Chair, Vice Chair or the Mayor’=s Office. 32 33 34 ARTICLE III. Officers and Administrative Personnel 35 36 1. The officers of the Commission shall include a Cchairperson, a Vvice- 37 Cchairperson and a Treasurer. Administrative personnel shall include a 38 Secretary of Record , t h e Cit y’s Pu blic W ork s Dir e c t or, a nd a r e pr e sentative from 39 the Superior Police Department. and City=s ADA Coordinator. 40 41 2. The Chairperson shall preside at all meetings of the Commission and shall be an 42 ex officio member of all committees. The chairperson's term of office shall not 43 exceed two (2) consecutive years. 44 45 3. The vice-chairperson shall act in the absence of the chairperson. Election of officers shall take place in September every two (2) years on odd 53 years beginning in 2021. 54 55 5.6. The ADA CoordinatorChief of Staff is appointed by the Mayor to serve as a liaison 56 between the Commission and City administration. 57 58 6.7. A sign language interpreter shall be provided at all Commission meetings as 59 needed, with a two (2) week notice prior to the meeting. The interpreter is 60 bound by the Interpreter's Code of Ethics in the provision of services to the 61 Commission. 62 63 ARTICLE IV. Committees 64 65 1. Committees may be formed at the discretion of the Mayor=s Commission, as the 66 need arises. 67 68 ARTICLE V. Meetings 69 70 1. The Commission shall meet a minimum of six (6) times per year with an annual 71 meeting in September. 72 73 2. All meetings shall be conducted according to Roberts Rules of Order. Exceptions 74 from standard format are allowed for speakers or special programs. 75 76 3. Non-Commission members may attend but are not allowed to vote in meetings. 77 If a non-member desires an item be presented or addressed, arrangements must 78 be made through the chairperson or Mayor=s Office in advance of the meeting. 79 80 4. A quorum shall consist of a majority of the members entitled to vote. 81 82 ARTICLE VI. Accountabilities 83 84 1. The Commission shall be accountable to the Mayor and City Council. The 85 Commission shall keep the Mayor and City Council informed of its meetings, 86 actions and recommendations. Copies of minutes and all correspondence will be 87 filed at City Hall, the Office of Record. 88 89 2. If a member of the Commission represent an agency, he or she shall be 90 responsible for being a liaison between that agency and the Commission. 91 92 3. No member or officer can speak on behalf of the Commission independently. A 93 member or officer can speak on behalf of the Commission only when a majority 94 of the membership is in agreement and gives that person the responsibility of being The a spokesperson.
