APPROVAL OF MINUTES 2.1. Public Safety Committee (Meeting held January 19, 2023) MOTION by by Elm, second by Johnson, and carried to approve the minutes from the January 19, 2023 meeting. 3. OLD BUSINESS 3.1. Discussion on Overnight Camping at Boat Launch Director Cadotte and Chief Alexander will meet with City Attorney Prell to add/edit language to current ordinance. They will present this next month to the Public Safety Committee. 4. NEW BUSINESS 4.1. Tow Fee Increase Local tow companies request a rate increase on the towing contract due to inflation over the last few years. The last increase was in 2012. Councilors would like more time to research prices in other municipalities. MOTION by Tylor Elm, second by Mark Johnson, and carried hold the tow fee increase until next month so more research can be done. 4.2. Parking – Add No Parking Odd Side – N 11th St from Catlin Ave East to Dead End MOTION by Mark Johnson, second by Tylor Elm, and carried to add no parking odd side – N 11th St from Catlin Ave East to Dead End 4.3. Recommendation from Parks and Rec Commission regarding the Leash Law Director Cadotte discussed some recommendations the Parks and Rec Commission made pertaining to the recent Leash Law edits. There was further discussion on editing a few of the recommendations made by Parks and Rec. 1 Public Safety Committee – 02/16/23 Meeting (Meets monthly on the 3rd Thursday) MOTION by Mark Johnson, second by Tylor Elm, to approve the Ordinance. MOTION by Mark Johnson, second by Tylor Elm, to amend the approval and strike out WI Point under Off Leash Areas, Under Restraint #1 change to “Within the confines of the owner’s property, by a fence, leash, tie out line, electric fence, or effective owner’s command, language for #3 Under Restraint remains “Within a vehicle that is sufficiently enclosed so as to prevent the animal from exiting the vehicle”. MOTION by Mark Johnson, second by Tylor Elm, and approved edits to send to City Council. 4.4. Fire Department Solar Project Chief Vollbrecht is requesting approval for the Solar Project at Headquarters, to be completed by Cedar Creek Energy. The department received 5 bids. It is estimated this project would save the City of Superior $16,293.00 per year in electricity costs. MOTION by Mark Johnson, second by Tylor Elm, to approve the Solar Project to be completed by Cedar Creek Energy. 5. RECURRING BUSINESS 5.1. Police and Fire Department Updates Chief Alexander of the Police Department states the Citizens Academy will start up again in the Fall of 2023. The Police Department placed a new fleet order last year which was canceled due to production issues; there is possibility the department will receive 7 new fleet sometime in 2023. Pathways to Hope program is doing well; they are seeing an increase in the number of people in the program. Chief Vollbrecht of the Fire Department talked about the two recent fires in our community. He also talked about upcoming trainings the department is doing. The Fire Department will be visiting Superior Middle School to teach CPR and AED use to students. They are now running the electric F150 for medical calls. 6. ADJOURNMENT at 7:40 PM. Submitted by Nikki Holmberg 2 Public Safety Committee – 02/16/23 Meeting (Meets monthly on the 3rd Thursday) Sec. 30-5. City boat ramp use fees. (a) No person shall use the following city boat ramp facilities without paying the applicable fee and such other landing charges as designated and posted with appropriate notices: (1) Arrowhead Pier; (2) Barker's Island; (3) Billings Park; and (4) Loons Foot Landing. (b) For a Wisconsin resident desiring to pay on an annual basis, the fee shall be $25.00. For an out of state resident desiring to pay on an annual basis, the fee shall be $30.00. The annual fee for city residents 65 years of age and over and for military/veterans shall be $20.00. The annual fee for nonresidents 65 years of age and over and for nonresident military/veterans shall be $25.00. The daily fee shall be $5.00 regardless of residency, age or military/veteran status. A hanging permit issued for persons paying on an annual basis must be displayed on the rear view mirror each time the boat is launched and the vehicle is parked at the launch site. The daily permit must be displayed (print side up) on the dashboard of the vehicle, visible to others and the date and license plate number of the vehicle must be filled in on the envelope. Proper identification is required when purchasing annual permits. (c) Camping prohibited. Lawful use of the city boat ramp facilities does not include camping. Camping is defined as (1) Occupying, pitching or otherwise using a tent or temporary structure other than duck blinds; (2) Sleeping; or (3) Occupying the living or sleeping quarters of any trailer, camper, van, truck or recreation vehicle. Exception: Unoccupied vehicle with a boat trailer and a current daily or annual launch pass may be in the boat ramp parking lot(s) overnight. (d) Any person who violates this section shall be subject to the general penalties provided in section 1-15. (ed) The owner of a vehicle involved in a violation of the provisions from which this chapter was derived shall be liable for the violation. It shall be no defense to a violation of the provisions from which this chapter was derived that the owner was not operating the vehicle at the time of violation. SPECIFIC RECREATIONAL AREAS ARTICLE II. SPECIFIC RECREATIONAL AREAS DIVISION 1. GENERALLY Sec. 90-21. Loitering in city parks. Except for the Superior Skate Park, which shall close at 10:00 p.m., no person, besides authorized employees of the city parks, recreation and forestry department or the police department shall stand, sit, loiter in or occupy any city park area including parking lots, between the hours of 10:30 p.m. and 5:30 a.m. This section shall not apply in the following areas: (1) Club house and parking area for Nemadji Municipal Golf Course. (2) Wisconsin Point. (Ord. No. O17-4024, § 1, 8-15-2017) Secs. 90-22—90-45. Reserved. DIVISION 2. BARKER'S ISLAND Sec. 90-46. Watercraft regulations. (a) Reckless operation of a watercraft. No person shall operate a watercraft in a reckless or grossly negligent manner to endanger persons or property. (b) Reasonable and prudent speed. No person shall operate a motorboat at a speed greater than is reasonable and prudent under the conditions and having regard for the actual and potential hazards then existing. The speed of a motorboat shall be so controlled as to avoid collisions or near collisions with any object in or on the water or with any person, boat or any conveyance in or on the water. (c) Maximum speeds. No person shall operate a motor operated watercraft on the following described area at a speed in excess of five miles per hour or at a speed which results in more than a minimum wake, whichever is less: All that area bounded as follows: Beginning at the point which is the intersection of the extended centerline of M Street, now Seventh Avenue East, with the northeasterly line of the right-of-way of the Northern Pacific Railway Company; thence northeasterly on the centerline of said M Street, now Seventh Avenue East, to the intersection of the southwesterly shoreline of Barker's Island; thence easterly along said shore line of Barker's Superior, Wisconsin, Code of Ordinances Created: 2023-02-02 18:53:51 [EST] (Supp. No. 31) Page 1 of 7  Island to its intersection with the westerly right-of-way line of Nineteenth Avenue East; thence southwesterly on said right-of-way line to its intersection with the northeast line of the right-of-way of the Northern Pacific Railway Company; thence northwesterly along said right-of-way line to the place of beginning. (d) Minimum wake defined. For the purpose of this section, a minimum wake is the wave moving out from a watercraft and trailing behind it in a widening "V" of insufficient size to affect other watercraft or the shoreline. (e) Posting. The department of parks, recreation and forestry shall place signs in such areas as are covered by maximum speeds. (Ord. No. O06-3598, § 1, adopted August 15, 2006, repealed § 90-47, which pertained to declaration as bird sanctuary. See also the Code Comparative Table. Sec. 90-48. Loitering and camping prohibited. (a) Loitering. Between the hours of 10:30 p.m. and 5:30 a.m., no one other than authorized city employees shall stand, walk, loiter in or occupy that area of Barker's Island described as follows: (1) Commencing at a point on the centerline of the causeway road and the center of Barker's Island bridge, thence northeasterly a distance of 300 feet to the place of beginning; thence continuing northeasterly a distance of 425 feet to the easterly shoreline of Barker's Island; thence in a southeasterly direction along the easterly shoreline a distance of 1,690.0 feet to a point; thence southwesterly at right angles a distance of 580 feet to the westerly shore line of Barker's Island (which line lies on the north end of the hotel parking lot); thence in a northwesterly direction along the westerly shoreline a distance of 1,760.0 feet more or less to the point of beginning. (2) Provided, however, that this section shall not prohibit any person from walking, riding or driving over the paved public roadway running through the above-described area. (b) Camping. No person shall camp on Barker's Island without the written approval of the parks, recreation and forestry director. For the purpose of this subsection camping shall have the meaning set forth in section 90-76 except that the term recreation vehicle shall not be interpreted as including any boat which is occupying a slip in the Barker's Island Marina. The above provisions notwithstanding, persons may camp on the Barker's Island Marina parking lot upon the prior written approval of the marina manager. (Ord. (a) No person shall operate any motor vehicle upon any portion of Barker's Island except on paved roadways and paved parking lots. For purpose of this section, the term motor vehicle means any vehicle which is self-propelled, including off-road vehicles and snowmobiles, ATVs, UTVs, dirt bikes and mopeds. (b) This section shall not apply to equipment owned by the city or to vehicles operating with the specific written approval of the parks, recreation and forestry director. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-50. Swimming on Barker's Island. (a) Swimming only in designated swimming area. Swimming on or near the area of Barker's Island shall be allowed only at that designated swimming area on the marina side. The designated swimming area will be clearly marked as such. (b) Signage. The parks, recreation and forestry department is directed and authorized to procure, erect and maintain appropriate signage, buoys and/or markers which shall designate the appropriate swimming area, as well as, signage, buoys and/or markers which will alert the public to dangerous water conditions. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-51. Penalties. Penalties for violation of this section shall be in accordance with section 1-14. (Ord. No. O17-4024, § 1, 8-15-2017) Secs. 90-52—90-73. Reserved. DIVISION 3. WISCONSIN POINT Sec. 90-74. Wisconsin Point defined. For the purpose of this division, Wisconsin Point is defined as that parcel of land above water level bounded by: the east line of Section 34, Township 49, Range 13 west, northwesterly to the mouth of the St. Louis River (otherwise known as the Superior Entry) and includes all portions of the peninsula or sand spit on both sides of the existing roadway (known as Peninsula Avenue) between Allouez Bay, Lake Superior and all other municipally owned parcels abutting Lake Superior (including docks, piers and retaining walls) and including parcels # 118110701200, 118110701300 [owned by the Board of Regents of State Universities] and Created: 2023-02-02 18:53:50 [EST] (Supp. No. 31) Page 3 of 7 parcels # 118110701100 and 118110700200 [owned by Douglas County]. No person shall engage in the construction of any structure for use industrially, commercially or as a residential dwelling. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-75. Motor vehicles restricted. (a) No person shall operate any motor vehicle (including snowmobiles ATVs, UTVs, dirt bikes and mopeds) upon any portion of Wisconsin Point, except on paved or improved roadways, trails designated by posted signs, or parking areas designated by signs as open for vehicular parking. (b) This section shall not apply to equipment owned by the city engaged in authorized public projects. (c) Any persons, firm or corporation violating any provision of this section shall, upon conviction, forfeit a fine of not less than $100.00 nor more than $500.00 together with the costs of prosecution or, in default of payment of such fine and costs of prosecution, shall be imprisoned in the county jail until payment of the forfeiture and costs of prosecution, but not to exceed 60 days. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-76. Camping. (a) Defined. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Camping means: (1) Occupying, pitching or otherwise using a tent or temporary structure other than duck blinds; (2) Sleeping; or (3) Occupying the living or sleeping quarters of any trailer, camper, van, truck or recreation vehicle. (b) Prohibited. No person shall camp on Wisconsin Point between the hours of 10:00 p.m. and 4:00 a.m. except during the spring smelt run season as such season is defined by the parks, recreation and forestry department. No person shall intentionally cut, carve, saw, transplant or remove any tree or attach any rope, wire, nails, advertising posters or other contrivance to any tree on Wisconsin Point. No person shall intentionally remove, cut, transplant or otherwise damage any plant life on Wisconsin Point. No person shall start any fire or use any combustible material in such manner as to damage or threaten plant life. No person shall start a bonfire, cooking fire or camp fire closer than ten feet from the nearest plant life. No person shall start a bonfire, cooking fire or camp fire on the Allouez Bay side of Wisconsin Point Road. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-78. Removal of sand. No person shall intentionally remove sand from Wisconsin Point, except as authorized in advance by the director of parks, recreation and forestry as part of an approved city project. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-79. Destruction of signs, barriers and public improvements. Any person who shall intentionally destroy, break, remove, throw down, paint over, shoot at or damage any public sign or plaque, any barrier, post, fence or barricade, garbage receptacles, latrines or any public structure or improvements whatsoever on Wisconsin Point shall be guilty of an offense under this section. It shall be unlawful for any person to place, throw, leave, or permit to remain, any rubbish, garbage, paper, cans, wastes of any sort, boxes, food scraps, plastic, foil or other debris at any location on Wisconsin Point except in such garbage receptacles as are placed there by the city for public use. The parks, recreation and forestry department shall post signs at appropriate locations informing the public of the provisions of this division. (Ord. It shall be illegal for any person to transport any glass beverage container onto Wisconsin Point or to possess any glass beverage container while on Wisconsin Point. The provisions of this section shall not apply to thermos jugs, canteens and other such containers which are generally sold empty. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-83. Access and parking. (a) Motor vehicles. Motor vehicle traffic and parking is prohibited between the hours of 11:00 p.m. and 4:00 a.m. on that portion of Wisconsin Point Road, including any parking areas, beyond Lot #1, and also all of Moccasin Mike Road and Lakeshore Drive, except during the spring melt run season as such season is defined by the parks, recreation and forestry department. This section does not apply to property owners along Wisconsin Point Road, Moccasin Mike Road and Lakeshore Drive. (b) Pedestrians. Pedestrian traffic is permitted at all times on Wisconsin Point Road, Moccasin Mike Road, Lakeshore Drive and Wisconsin Point. (c) Parking. On all of Wisconsin Point Road, parking is permitted only in designated parking areas/lots. Parking on either side of Wisconsin Point Road is prohibited. (Ord. No. O17-4024, § 1, 8-15-2017; Ord. No. O19-4160, § 1, 8-6-2019) Sec. 90-84. Penalties. Penalties for violation of this section shall be in accordance with sections 1-14 and 1-15. (Ord. No. O17-4024, § 1, 8-15-2017) Sec. 90-85. Wisconsin Point Committee. Composition. The Wisconsin Point Committee shall consist of one member appointed by each of the following entities: Superior City Council—one member and one alternate; Douglas County Board of Supervisors—one member and one alternate, Wisconsin Department of Natural Resources; Lake Superior National Estuarine Research Reserve; University of Wisconsin- Superior; and Fond du Lac Band of Lake Superior Chippewa. In addition, one citizen representative shall be appointed by the mayor for a three-year term. Duties. The Wisconsin Point Committee will serve as the primary entity overseeing implementation of the Wisconsin Point Area Management Plan and responsible for implementation of management plan directives, policy development and monitoring.
