This meeting may be called into closed session under WI State Statute Sections 19.85 (1) (c) which cite as follows: ‘Considering employment, promotion, compensation or performance evaluation data for any public employee over which the governmental body has jurisdiction or exercises responsibility’. PUBLIC SAFETY COMMITTEE Minutes April 20, 2023 Regular Meeting The meeting was called to order by Councilor Ledin at 06:01 pm on April 20, 2023 in Government Center Room 204. 1. ROLL CALL PRESENT: Nick Ledin, Tylor Elm, Mark Johnson VIRTUAL: Chief Alexander, Councilor Van Sickle, Director Cadotte, Maria Lockwood CITY STAFF PRESENT: Mayor Paine, Chief Vollbrecht, Lieutenant Trone, Nikki Holmberg OTHERS PRESENT: Darin Lind (Dukes Towing) 2. APPROVAL OF MINUTES 2.1. Public Safety Committee (Meeting held February 16, 2023) MOTION by Johnson, second by Elm, and carried to approve the minutes from the February 16, 2023 meeting. 3. RECURRING BUSINESS 3.1. Police and Fire Department Updates Chief Alexander of the Police Department briefly discussed a Wisconsin Law Enforcement Management conference he attended with Captain Winterscheidt; they did a presentation on our Pathways to Hope program which generated some interest from other communities across the state. Last week there was a social media threat to local infrastructure, this led to Duluth PD taking the suspect into custody. Chief Vollbrecht of the Fire Department discussed some recent and upcoming trainings within the Fire Department including Industrial Firefighter Training outside of the state. The Fire Department will be doing training on 12th street in Superior within the next week which may cause minor road shutdowns. They recently made a couple job offers to candidates which were accepted; these new hires will start within a month or two. 4. OLD BUSINESS 4.1. Tow Fee Increase Local tow companies request a rate increase on the towing contract due to inflation over the last few years. The last increase was in 2012. MOTION by Johnson, second by Ledin, and carried to increase the tow fee to $127.00 and the daily storage fee to $37.00; will send to City Council. 1 Public Safety Committee – 04/20/2023 Meeting (Meets monthly on the 3rd Thursday) 5. NEW BUSINESS 5.1. Ordinance Revision for Boat Launch Ordinance revisions (section 30-5 and 90-21) were made to define camping to prohibit camping at the boat launch. MOTION by Johnson, second by Elm, and carried to approve the ordinance revision for boat launch. 5.2. Discussion on Engine Braking – HWY 2 and 53 Councilor Van Sickle discussed the increased engine braking on HWY 2 and 53. She has received complaints, as well as the Police Department receiving complaints through their online system. Superior Police has increased enforcement which has led to an increase in tickets given. Signs were recently moved to help with this, and Chief Alexander spoke with State Patrol to see how they can help with enforcement. Additional ideas regarding communication to trucking companies were given. MOTION by Elm, second by Johnson, and carried to hold in committee. 6. ADJOURNMENT at 6:53 PM. Submitted by Nikki Holmberg 2 Public Safety Committee – 04/20/2023 Meeting (Meets monthly on the 3rd Thursday) Sec. 112-143. Towing charges. A tow operator who tows a vehicle shall be entitled to collect from the operator or owner of the vehicle towed, and the owner or operator of the vehicle towed shall pay to the tow operator, the following fees: (1) For vehicles with gross weight of 8,000 pounds or less, not more than $98.00 plus applicable sales tax; (2) For vehicles with a gross weight of more than 8,000 pounds, not more than $108.00 plus applicable sales tax; (3) No fee may be charged if the vehicle owner or operator returns to take possession of the vehicle before it has been completely loaded and moved by the towing operator. No. O12-3805, § 1, 6-12-2012) ORDINANCE #O23-- ORDINANCE INTRODUCED BY THE PUBLIC SAFETY COMMITTEE AMENDING CITY CODE CHAPTER 112, TRAFFIC CODE, SECTION 112-143, TOWING CHARGES. The Common Council of the City of Superior, Wisconsin, does ordain as follows: SECTION 1. Section 112-143, Towing Charges of the City Code of Ordinances is hereby amended to read as follows: Sec. 112-143 Towing charges. A tow operator who tows a vehicle shall be entitled to collect from the operator or owner of the vehicle towed, and the owner or operator of the vehicle towed shall pay to the tow operator, the following fees: (1) For vehicles with gross weight of 8,000 pounds or less, not more than $127.00 plus applicable sales tax; (2) For vehicles with a gross weight of more than 8,000 pounds, not more than $127.00 plus applicable sales tax; (3) No fee may be charged if the vehicle owner or operator returns to take possession of the vehicle before it has been completely loaded and moved by the towing operator. SECTION 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence or clause or phrase or portion thereof. SECTION 4. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law. Passed and adopted this 2nd day of May, 2023.
