President of Council Kilway called the Virtual Regular Council meeting of Thursday, January 14, 2021 to order at 7:00 p.m. This is a virtual meeting due to the State of Emergency. 2. Mr. Donovan will be a little late this evening. 4. MINUTES: 12-10-20 Virtual Regular Council Meeting minutes. Mr. Sisak: I move to accept the 12-10-20 Regular Council Meeting minutes as presented. Seconded Mr. Bollas. Voice vote 6-0. The 12-10-20 Regular Council meeting minutes were accepted by a vote of 6-0. 5. PUBLIC HEARINGS: None. 7. COMMUNITY INPUT: 8. ANNOUNCEMENTS: • Select member of Council to serve on the Community Reinvestment Housing Committee. This term is for 3 years. Jim Donovan is already on and his term expires on 12-31-21 and we need one more Council member. Due to previous Councilman Carano, his term ended at the end of 2020 and so we do need to select a member of Council to serve on this. Matt Springer; do you want to say a little bit about what this committee is and then we can see if anyone has a real big desire in wanting to be on this committee. Otherwise, I will just select a number. Mr. Springer: Yes, so Madame Chair, you had just mentioned that it is a 7-member board and these are three-year rotating terms. The way that this has been set up is they handle the tax abatements that are approved throughout the City and Council has two appointments to this board and so with Mr. Carano’s term expiring; we are asking for a replacement. Pres. of Council: Does anybody have a great desire to be on this committee? OK. I’m just going to make an appointment at this point in time and it has to be someone who has some flexibility that is able to come to City Council during the day that does not have work commitments; is that right Mr. Springer? Mr. Springer: That’s correct. Pres. of Council: OK, thank you very much. Mr. Grimm: Mrs. Kilway, I think you described me as having nothing better to do. Pres. of Council: I was just going to ask if you would be interested in doing this. Mr. Grimm: Sure, that would be great. Pres. of Council: So, Mr. Chris Grimm will be the second Council member that will serve this next 3-year term. Thank you very much Mr. Grimm. • Accept 2021 meeting dates for Council. Pres. of Council: We are also in receipt of the dates for the Council meetings for the year 2021. As previously, we do have a spring break the week of March 25th and Council has historically had two weeks of vacation during the summer which would be July 22nd and August 12th and then we also have our Thanksgiving break which is on November 25th and December 23rd is our Christmas break. The last two years we have elected not to take the second week of vacation just because it is a long time off with Council and with things going on in the City that it’s kind of is a little bit . . . it  VIRTUAL REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 21 Pres. of Council: doesn’t help that we are off for that extended period of time especially with Planning & Zoning issues. So, does anyone else have any type of feedback on foregoing the August 12th summer break or do I have a motion as to whether we want to forego it or do we want to keep it? Mr. Sisak: I would concur, and I would make a motion to forego the 2nd week of the summer break on the 2021 calendar. Seconded Mr. Grimm. Voice vote 7-0. The Council meeting dates are accepted with the exception of August 12th vacation not being taken by a vote of 7-0. Pres. of Council: Susan, if you would get us out the amended meeting dates; that would be great. • Assigning by Pres. of Council of Christopher Grimm to the appropriate committee assignments. Pres. of Council: The next part of my announcements is assigning our newest Council member, Christopher Grimm, to his appropriate committee assignments. Welcome to Council and welcome back to the City Mr. Grimm. I appreciate everything that you are going to be doing for us. I would like you to be the Chair of the Personnel Committee, the Vice-Chair of the Safety Committee and the committee member of the Finance Committee. • Accept Richardson Trust Fund year ending balance for 2020 and agree to the reimbursement of the account in the amount of $2,225. Pres. of Council: Then also immediately following the Council meeting, we are going to have a Richardson Trust meeting and a Firefighters’ Dependents Fund meeting. During the Richardson Trust Fund meeting we will be accepting the ending balance of 2020 and we will agree to the reimbursement for the next year and we will also assign members to the Firefighters’ Dependent Fund at that time. • Assignment of Members to Firefighters’ Dependents Fund. Mayor: I have one other announcement. This is a new format that we are on tonight. For the first time we are on Zoom and the reason the City switched over to Zoom is because it is a little easier for all of the public hearings that are coming up and instead of the Teams meeting, the Zoom meetings seem to make it a little easier. Also, it was brought to my attention that it will be easier if we can do the Zoom or the YouTube simulcast at the same time and so we are doing that. That is effective tonight and so if anybody wishes to go back and look at that meeting; it would be on YouTube as it was in the past. Every time there is a new meeting, the old meeting will be set aside, and they are always available if someone is asking for them, but those meetings will stay up until the next meeting of the same style is there to replace that. So, I just wanted to make that announcement to help people out if you are watching it from the YouTube. 9. I trust that Council you had a great holiday and welcome all of you back. A special welcome to Chris Grimm for being back on Council. It is a pleasure and the institutional knowledge that Chris brings I think will be very helpful for all of us and I see Mr. Donovan is in the meeting now. I’m not sure what time he came in, but it is now 7:15 p.m. and I see Jim’s face, so thank you for being here. We are very busy working on the 2021 Budget. Working on the 2021 Capital Projects; we are putting a booklet together. We will start meeting with the Department Heads to organize that and bring legislation before Council; the ones that require it for all of the Capital Projects that are out there. The Washburn East Avenue Intersection is going extremely well. We did, and I don’t know if I can take that away from Mr. Rorar tonight but, he is out to bid on the poles themselves because it takes up to 30 weeks to get the traffic poles and so Mike is going to be out working on getting those poles ordered so when we start construction at that intersections this June or July, the poles will be here by the time the project is completed. This past Monday night, we had our first Charter Review and that was the Organizational meeting. So, the Charter Review; I am happy to say that Megan Raber was appointed as the Chairperson of the Charter Review and there is a set schedule. I think everyone on Council probably received that information on the schedules. The very next meeting is January 25th and that is the overview of the committee and then they meet on strategic days right after that to get everything to Council by the end of May so you have time to deliberate and have it ready to go for the November ballot and so if you need that schedule, we will make sure that you guys receive that. With that, I know it is a busy agenda tonight. There are a lot of 1st Reading adoptions; mostly housekeeping and so if you have any questions throughout that time, please let me know. Thank you. Dir. of Pub. Service: Good evening. Happy New Year and I am looking forward to working with Council on 2021 and I am going to skip my sideshow report and do it at the next meeting, but a couple of things. Winter shifts started and so that is our plow shift. We have that second shift and that started on Sunday night which was January 10th and that gives us really a true 24-hour coverage throughout the week and this year it also splits up the shift pretty good. We have 8 on nights and 9 on days and because of Covid, that is a nice separation. It is almost an 8-hour window there that they won’t be around each other. Also, the second item is the trash contract has changed. We went from Republic to Kimble and there are a lot of Republic cans out. We are actually going out and gathering them as well to get them off the streets. The key is that they have to be empty though because we can’t pick them up. So, if anybody does have Republic cans and they are full, they have to transfer that into the Kimble can. So, I am thinking that around President’s Day we might be out of this. We will probably have a second wave in April when the snowbirds come back because maybe they aren’t aware of the whole trash scenario change and get the cans out and so that will be a month 3  VIRTUAL REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 21 Dir. of Pub. Servicer (Cont’d.) before we have all of the cans out. That is the end of my report. I would like to request adoption of Ord. 1-2021 through 15-2021 tonight at 1st Reading if that’s possible. Dir. of Administration: Not present. Dir. of Econ. Development: Good evening once again and happy new year. I will echo much of what Mr. Rorar just said. I will keep it very brief, but we do keep it very brief. We do remain busy actively engaging with as many businesses as we can in the community. I think we are starting to see a pretty good project pipeline come through for 2021 and as the Mayor had said, certainly with Summit DD and that repurposing is going to be a great big project this coming year or so. We are starting to put together that ad hoc committee and building out that list. Again, sharing as many grant opportunities that are coming out of the CARES Act funding out of Columbus as possible. We are certainly sharing that news with as many businesses as we can. With that being said, I would be happy to entertain any questions you might have, otherwise, that will complete my report this evening. Pres. of Council: I just have one question if you can expand a little bit on the Beacon Journal article in reference to Midway Plaza? Dir. of Econ. Development: Yes, it is an ongoing matter and as we all know they received some code violations; quite a few in fact, and that property has been reinspected and so we are working internally on the next steps. We certainly want to work with the property owners to rectify these problems. To date, we have received very little to zero correspondence or communication back from them and so that is not to our satisfaction. This needs to be resolved and we need to pursue it. Pres. of Council: Thank you very much. I think we are all in agreement that we don’t want absentee owners that are not going to take care of property. Dir. of Finance: Good evening and happy new year everybody. You all received your year-end financial reports. Despite of all that went on, I was pleased that we were able to collect our income tax so close to what we had previously estimated the year before. That was very helpful and hopefully that will help us weather any future economic downturns that could occur as a result of this in the upcoming years. Our safety services income tax which was new this year generated just over $1 million and we are happy to see that that collection went better than anticipated. I think everyone recognizes that our Recreation Center financially took the largest hit from this pandemic and we continue to monitor that and are prepared to continue to do that through 2021 and make the necessary adjustments as we need to. The CARES Act also was able to help offset some of those losses with those funds and so I am pleased with where we were able to finish the year. I think it will allow us to move forward into 2021 maintaining our services to our citizens and keeping the projects that we have planned through the pipeline in terms of the fire station and the East Avenue improvements and such so I think despite it all, we had a descent financial year, and we are in a good place and I would entertain any questions. Mr. Loughry: Not a question; just a comment and that is that Mrs. Gilbride I really appreciate your year-end report. I thought it was very thorough and it was very helpful to me so thank you. Dir. of Law: Thank you. I also want to wish everyone a happy 2021. This year will be better than the last. We have been busy in my office. We have remained busy. Our court cases did slow somewhat when we hit the purple level. Court has started to continue cases again and so we will start to pick up again here soon I hope as we have been out of that higher level. I have also been asked to just share briefly . . . we received some questions from residents with regard to political signs being up and I just wanted to I guess let people know that we are not able to tell people that they cannot have a political sign. There was a U.S. Supreme Court case Wade vs. Town of Gilbert that came out that basically said that any content . . . that municipalities can’t place stricter limitations on signs based on content and such as political or religious signs than any other sign so they have to comply with the temporary sign regulations for size and height, but we cannot look at the content of the sign and enforce it based on content, so I just wanted to make that clear to everyone. Mr. Grimm: Mrs. Kilway, for the Law Director; how long is the allowance for a temporary sign if this . . . if a political sign is going to fall under a temporary sign; what is the constraint on that? 4  VIRTUAL REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 21 Dir. of Law: There are no time limits for temporary signs. On a residential property you are allowed to have two temporary signs indefinitely. Mr. Grimm: Well then, they aren’t temporary. Dir. of Law: During the political season, we allow for unlimited temporary signs. Mr. Grimm: Then they aren’t really temporary; are they? Dir. of Law: No, that is how our code is created so something like a, you know, go Blue Devil sign could be in somebody’s front yard for the whole year and again we don’t judge that based on what the content of the sign is. Mr. Donovan: I call the Planning & Zoning Committee to order. We have no legislation before us at this time. Mr. Loughry: Mr. Donovan, can we get an update from Mr. Rorar as to when we might see the Zoning Code rewrite? Dir. of Pub. Service: Probably within 30 days we should be getting something out. Dir. of Law: We hope. If I may add to that we have been working very diligently on this. As we get drafts back and forth, we see different things that need to be changed or tweaked and so we are trying to make those adjustments. We are in the final steps of that but it is a large document and so it is natural that as we go back and forth there re going to be additional revisions that need to be made and so we are working as hard as possible to get it done. Mayor: Planning & Zoning met last week and there were three items that were in front of Planning & Zoning. It was the Summit DD site and that was setting a public hearing for February’s meeting. Also, Serpentini Chevrolet is set for a public hearing for rezoning behind Kreeger’s grocery store there and the lot between the substation and that complex. Then out on the old Tallmadge Asphalt site, where that ballfield used to be, that owner there is requesting to put some storage units up there so that is also on the agenda at the next Planning & Zoning meeting. There is no BZA meeting for next month. There were no items. The Heritage deadline was today and there are no Heritage items. Mr. Loughry: So, Mayor, will Serpentini be on the Planning & Zoning Agenda and the Heritage Agenda concurrently? Because isn’t part of that site in the District? Mayor: That is not. It stops at that parcel. Mr. Loughry: If it did, I just did not want Serpentini to have to wait because they had to go through another process they were not planning on. Mayor: Yes, I agree. I was just wondering if there was any update that you would like to provide to Council and the Administration on the Hanna and Washburn easement project for flooding relief? Dir. of Pub. Service: No, there is no report at this time on that. Mr. Bollas: OK. Mr. Loughry: Anyone on the Administration have anything that would fall under this committee? No one responded. Mr. Bollas: We have Ord. 17-2021. We recommend adoption by a vote of 3-0. Anything else for the committee? I just had a quick question, but I wanted to open it up to the committee, council or the administration. Mayor, do you want to expand at all on the organizational evaluation and staffing analysis that was provided? Mayor: I do have the documents. I sent out in an e-mail just highlighting the 29 items that were recommended from the consultant. I do have the complete booklet and Mr. Sisak picked one up but anybody wishing to have a copy of the document; it is pretty lengthy and that is why I am not going to scan it in and e-mail it but you are welcome to pick one up. Of the 21 items the Fire Chief and the Assistant Chief, Dr. Cooper and myself are working on the priority list. He has already started on some of the training items that were on there and some of the items that give us room to make improvements to the Fire Department. So, they are being worked on as we speak. Just one thing, the eastern portion of the West Avenue Serpentini is in the Design Control District. Just that one lot out front along West Avenue. That is and there is not a building design at this point for that, but they will have to go to the Design Control and so that front building only; not the back for Mr. Loughry’s edification. Mr. Loughry: So, the deadline has passed for the Heritage Commission and Serpentini was not aware that they needed to go before that commission. Mayor: Yeah, they are aware. Mr. Loughry: Can we add them and still have the meeting or do they have to wait? Mayor: Helene has been working with them and I just . . . so they know . . they know it. It is still a long way away. It has to come in front of Council and so there is no design of a building complex yet. Mr. Bollas: That’s all for the Safety Committee. I will close committee. e. Mr. Loughry: I do have a question. Who is Prime AE Group and have we ever used them? Dir. of Pub. Service: Councilman, they are an engineering firm and they do mostly traffic engineering and they have been used the last two years. Mayor: Prime is a former URS Aerosmith. That is how you would know them. Mrs. Allman: We also have Ord. 5-2021 and we will recommend adoption by a vote of 3-0. • Ord. 6-2021 – (1st Reading) – Authorizing the Mayor to contract with CT Consultants for engineering and consulting services relating to development and other general engineering services and providing for immediate enactment. Mr. Loughry: Will this contract be tied in any way to the Fire Department? Mayor: No. Mrs. Allman: We also have Ord. 6-2021 and we will recommend adoption by a vote of 3-0. • Ord. 7-2021 – (1st Reading) – Authorizing the Mayor to contract with Burgess and Niple, Inc. for engineering and consulting services relating to water system development, general engineering services, and planning and zoning consulting and providing for immediate enactment. Kenny served in the Police Department for nearly 30 years and when I met him, and he was in charge of all the guns and paraphernalia that came through the Police Department. HE was a true professional and a great Police Officer and he gives a great name to our Police Department.
