in Council Chambers @ 7:00 p.m. May 22, 14
1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of
Thursday, May 22, 2014 to order at 7:00 p.m.
2. PRAYER: Rev. John Schleup, First Congregational Church, Tallmadge.
PLEDGE OF ALLEGIANCE.
3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mrs. Ray – arrived at 7:06 p.m., Mr. Rensel, Mr.
Sisak, Ms. Tricaso – present. Also present were Dir. of Public Service Esler, Ass’t. Dir. of
Finance Gilbride, Dir. of Law Raber, Economic Developer Loughry and Clerk of Council
Burton. Mayor Kline was out of town and Mr. Stalnaker was at the Tallmadge High School
graduation.
4. MINUTES: 5-8-14 Regular Council meeting minutes.
Mr. Sisak moved to adopt the 5-8-14 Regular Council meeting minutes. Seconded Ms.
Tricaso. Voice vote 6-0. The 5-8-14 Regular Council meeting minutes were adopted by
a vote of 5-0.
FINANCIAL REPORTS: None.
5. PUBLIC HEARINGS:
Ordinance 42-2014 At 3rd Reading.
PLANNING & ZONING Amending the zoning map by rezoning the
P.H. ON 5-22-14 @ 7:03 P.M. property of applicant Americana Develop-
P&Z REC. APPROVAL 3-0 ment Inc. (Martin Wheel Division) on behalf
of owner, Americana Development Inc. from
Commerical-4 to Industrial-1 consisting of
approximately 2.014 acres located at 360
West Avenue.
Pres. of Council: It is now 7:03 p.m. and I will call the public hearing for Ord. 42-2014 to
order. Is there anybody here that would like to speak in favor of Ord. 42-2014? No one
responded. Is there anyone who would like to speak against Ord. 42-2014? No one
responded. Again; is there anybody who would like to speak in favor of Ord. 42-2014? You
are welcome to come to the podium if you would like. If you would just give your name and
address.
Mr. Darrell Ruthrauff, General Manager of Martin Wheel Company, 342 West Avenue,
Tallmadge. We are here to have that property rezoned as we showed to the Zoning
Committee several weeks ago so that it will allow us additional expansion of our plant at 342
West Avenue. We will expand to the west. So we made a presentation at that time and we
came basically in case there were any questions or opposition. So if anyone has any
questions, I will be glad to entertain those from Council at this time.
Pres. of Council: Does anybody have any questions? No one responded.
Mr. Ruthrauff: Thank you.
Pres. of Council: For the second time, I would ask if there is anybody who would like to
speak against Ord. 42-2014? No one responded. Third and final time; is there anybody who
would like to speak in favor or against Ord. 42-2014? No one responded. It is now 7:05 p.m.
and I will close the public hearing and turn the meeting over to Mr. Sisak.
Mr. Sisak: I call the Planning & Zoning Committee to order; myself and Ms. Tricaso are
present, or I’m sorry; Mrs. Kilway. Kim Ray is not here. Mrs. Kilway; do you have any thoughts
about this?
Mrs. Kilway: I think we should approve this.
Mr. Sisak: I agree. So the recommendation to City Council would be 2-0 in favor of passing
Ord. 42-2014. I would like to close the committee at this time.
Pres. of Council: It is 7:06 p.m. and I would like to mention that Mrs. Ray is here for the
record.
Mrs. Ray: I apologize for my tardiness.
Mr. Sisak: Mr. Donovan; I move to approve Ord. 42-2014. Seconded Mrs. Kilway. Roll Call:
Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Ms. Tricaso, Mr. Donovan – unanimous. So
Ord. 42-2014 is adopted by a vote of 6-0.
Mr. Rensel: Do you want to explain to them when it becomes effective?
Dir. of Law: Theirs doesn’t take immediate effect. It is a 30-day window before it can be
enacted.
6. COMMUNITY INPUT:
Pres. of Council: City Council meets on the second and fourth Thursday’s of the month and
the preceding Monday is the committee meeting where we discuss the legislation and make
a recommendation. Thursday is our business meeting where we actually vote on the
legislation and we do allow pretty much unlimited community input at the Monday meetings
and a short time at the business meetings. If anybody would like to address Council; you are
welcome to do so at this point. No one responded.
6.A. ANNOUNCEMENTS:
Pres. of Council: I would like to mention two things. Dennis Loughry has been in touch with
the Department of Commerce regarding the liquor application for the Dollar General Store on
Brittain Road. We will keep Council advised as soon as he hears something back.

Next I would like to welcome Boy Scout Troop 412 here this evening. I think we have
somebody here from the Scouts. Thank you for coming. You are working on a “Citizenship
in the Community” badge and if there anything we can do to help with that, please let us know.
7. REPORTS OF SPECIAL COMMITTEES: None.
8. AGENDA ADDITIONS: None.
9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE,
DIRECTOR OF FINANCE, AND DIRECTOR OF LAW.
Dir. of Pub. Service: As John mentioned, don’t forget the Memorial Day Parade on Monday.
The lineup is at the church at 9:30 a.m. and it steps off at 10:00 a.m. Our crews and the
mowing contractor have been working diligently in the cemetery trying to prepare. There are
still areas that they cannot even get into to mow because they are so wet. They are going to
go back in there. They were in there the last three days and they are going to be back in there
on Saturday and hopefully they will get it dried up enough to where they can get it all mowed.
Maca opens next week on Saturday and Sunday is the Food Truck Festival at the Rec
Center.
Paving and pavement marking contracts are currently out for bid.
Summit County will be digging out 1586 Northeast Avenue starting tomorrow and they hope
to be done by Saturday doing sewer repairs so if you get any calls on that; it is not us working
on that; it is Summit County.
Ass’t. Dir. of Finance: I would just like to request 1st Reading adoption of Ord. 58-2014. End
of report.
Dir. of Law: No report this evening.
Economic Developer: I always have a report! I want to give you an update on next door.
I think it is like a mixed blessing that Mr. Testa did not receive OFA funding. Again; another
project was awarded that. But, as he stated, they are still going to proceed and will probably
still build Building 2 before Building 1, but Building 1 Phase I is still going to push ahead and
instead of being senior housing, those two floors will be filled with another use; actually with a
use that will generate much more income tax. So, that is good.
We have a new pizza company coming to town; Domino’s Pizza is going to be moving into
147 Northwest Avenue and I think we have well over 10 pizza places which is good and being
Italian I love that!
Unemployment figures that you have probably already seen in the paper, but nationally it is
5.9% and Ohio is 5.2%; Portage County is 5.0% and Summit County was 5.1% so that is very
good. You know anytime we are down around 5%; that is really, really a good figure.
To give you a housing update; at the price point between $180,000 and $250,000 we only
have 11 homes for sale and the average day on market is 96 days. So what that would tell
you is that we have very low inventory at a certain price point and this time of year especially,
we should have 20 to 25 houses for sale. The low days on the market is telling you how
quickly they are selling.
Also an update on condominiums; when the market was bad on any given day; we would
have 50 condos for sale in Tallmadge. On Tuesday we only had 19 and so that shows you
that that market is rebounding as well.
Lastly, I will give you a JEDD update. Panera will be open hopefully by October 1st. Murphy’s
Oil, which is the gas station next to the Wal-Mart will be open they are hoping before July 1 st
and Klaben Ford is pushing dirt and H&M; the rubber building that was vacant for a couple of
years is under contract and if you remember, at the end of the year, Rubbermaid reported
200 jobs. I was at a seminar on Tuesday and they reported 220 jobs at Brimfield, but what
was more significant to me was that over the last 18 months between Gilchrist Road and
Mogadore and Brimfield; they have hired 536 people and when you look at the price point and
the salary that those individuals make, typically you don’t live more than 15 to 20 minutes
away from your job. You can’t afford it. So what that is telling you is that 536 new people are
spending additional money whether it is shopping, getting their hair cut, lunch or whatever in
our area. So it is all good. So that is the end of my report and I will take any questions.
Mr. Rensel: Dennis, of those 220 jobs; do they tell you how many are full-time and how many
are part-time?
Economic Developer: The 220 that they reported on Tuesday were full-time.
Mr. Rensel: So they have other employees that are part-time?
Economic Developer: Yes. In the report at the end of the year John there were only like 20
of those.

PERSONNEL Amending Ordinance 39-2013 establishing
the number of employees by department
and position pursuant to R.C. 731.08 and
providing for immediate enactment.
Mrs. Kilway moved for the adoption of Ord. 46-2014. Seconded Mr. Rensel. Roll Call: Mrs. Ray, Mr.
Rensel, Mr. Sisak, Ms. Tricaso, Mr. Donovan, Mrs. Kilway – unanimous. Ord. 46-2014 is adopted by
a vote of 6-0.

11. Ordinance 47-2014 At 3rd Reading.
PERSONNEL Creating one full-time position of Deputy
Fire Chief and establishing the pay band
and benefits therefore.
Mrs. Kilway moved for the adoption of Ord. 47-2014. Seconded Mr. Rensel. Roll Call: Mr. Rensel,
Mr. Sisak, Ms. Tricaso, Mr. Donovan, Mrs. Kilway, Mrs. Ray – unanimous. Ord. 47-2014 is adopted
by a vote of 6-0.
12. Ordinance 48-2014 At 3rd Reading.
PERSONNEL Creating one part-time position of Adminis-
trative Clerk/Fire and establishing the pay
band and benefits therefore.
Mrs. Kilway moved for the adoption of Ord. 48-2014. Seconded Mr. Rensel. Roll Call: Mr. Sisak, Ms.
Tricaso, Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel – unanimous. Ord. 48-2014 is adopted by
a vote of 6-0.
13. Ordinance 49-2014 At 3rd Reading.
PERSONNEL Creating one part-time position of Adminis-
trative Clerk/Zoning and establishing the
pay band and benefits therefore.
Mrs. Kilway moved for the adoption of Ord. 49-2014. Seconded Mr. Rensel.
Mr. Rensel: For the benefit of the audience, I would like to point out that Council and the
Administration have discussed this and it was budgeted. The budget was approved last December
and so this pretty much is an administrative detail and the Director of Administration can confirm that.
Dir. of Administration: That is correct.
Roll Call: Ms. Tricaso, Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak – unanimous. Ord.
49-2014 is adopted by a vote of 6-0.
14. Ordinance 54-2014 At 2nd Reading.
PUBLIC SERVICE Authorizing the approval and adoption of
the Summit County Hazard Mitigation Plan
and providing for immediate enactment.
Pres. of Council: Ord. 54-2014 is at 2nd Reading and will remain before the Public Service
Committee.
15. Ordinance 56-2014 At 2nd Reading.
FINANCE Authorizing the Mayor to enter into a five-
year or volume-specific contract with Coca-
Cola Refreshments USA, Inc., a Delaware
Corporation, for the right to advertise and
sell its beverage products in certain City of
Tallmadge owned facilities and providing
for immediate enactment.
Mrs. Ray moved for the adoption of Ord. 56-2014. Seconded Mr. Sisak. Roll Call: Mr. Donovan, Mrs.
Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Ms. Tricaso – unanimous. Ord. 56-2014 is adopted by a
vote of 6-0.
16. Ordinance 57-2014 At 1st Reading.
PUBLIC SERVICE Determining the structure at 1328 South-
east Avenue to be blighted; authorizing the
Mayor to enter into all necessary agree-
ments pursuant to the Moving Ohio For-
ward Grant Program and providing for
immediate enactment.
Pres. of Council: Ord. 57-2014 is at 1st Reading and is assigned to the Public Service Committee.
17. Ordinance 58-2014 At 1st Reading.
FINANCE Authorizing the expenditure of certain sums
for the 2014 Memorial Day Celebration in
the City of Tallmadge and providing for
immediate enactment.
Mrs. Ray moved for the adoption of Ord. 58-2014. Seconded Mr. Sisak.
Dir. of Pub. Service: This is to just help defray some of the costs that the American Legion incurs
for the Memorial Day celebration; the flags that they put on the graves and different things like that.

Mr. Rensel: This is a tradition in Tallmadge and for years and years we have been providing some
stipend to the American Legion to carry out the parade.
