REGULAR MEETING in Council Chambers @ 7:00 p.m. June 26, 14 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, June 26, 2014 to order at 7:00 p.m. 2. PRAYER: Silent prayer PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Dir. of Finance Shanafelt, Dir. of Law Raber, Economic Developer Loughry and Clerk of Council Burton. 4. MINUTES: 6-12-13 Regular Council meeting minutes. Mr. Sisak moved to adopt the 6-12-14 Regular Council meeting minutes. Seconded Mrs. Kilway. Voice vote 7-0. The 6-12-14 Regular Council meeting minutes were adopted by a vote of 7-0. FINANCIAL REPORTS: None. 5. PUBLIC HEARINGS: None 6. COMMUNITY INPUT: Pres. of Council: We have no one in the audience this evening. 6.A. ANNOUNCEMENTS: None. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: Ord. 64-2014 will become Item 15.A. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, AND DIRECTOR OF LAW. Mayor: Thank you Mr. Chairman. I will be brief tonight. A little update on Maca Pool. Obviously the weather plays into this; it has been extremely busy there. The staff has been working very hard and it has just been phenomenal the amount of folks that are going to Maca Pool. Obviously the weather plays a good part and Eastwood closing down is a big player in that too, but hats off to that staff. Also the summer camp program that is ran through the Rec Center; they are extremely busy also out at Lions Park and that program is going very well. I am happy to announce through the help of the Finance Director and also the Law Director, that 26 Nottingham; that title is in our name. We just received the notification of that. We do not have the deed yet in our hands, but if you go on Summit County PAWS and look up 26 Nottingham; it says that the owner is the City of Tallmadge. So it has been transferred to us and now the next step is to at least get it demoed. We will start working on that and so we will work with . . . because there are items inside that house and during the demo program the house has to be empty. So therefore, working with Habitat for Humanity who has a program where they go out and clean out unwanted homes to recycle anything that they can and so we are going to work with that program to get them to take anything out of that house that they can. End of report. Mr. Stalnaker: Be sure to tell Linda Poinar that 26 Nottingham is up. Mrs. Ray: She will be very happy. Mayor: Linda was the first one to know; or the second one to know after myself and Steve came down and told me it was all done or at least that part of it. When the wrecking ball is there, Linda will be there! Mrs. Ray: I have a feeling that she is going to want to take the first swing! Mayor: I am going to let her! Then the neighbors will take the second! Pres. of Council: Next up is Dir. of Public Service. Dir. of Pub. Service: Yes, thank you. As the Mayor mentioned, Maca Park is doing very well and we are still getting memberships every day; sometimes four or five a day and we have exceeded the number of memberships that we had last year at this time. The new water meters are being installed. They started installing them on Monday. They are putting in about 100 a day and so we expect that to be complete sometime in September. We have sent the notice to proceed to Tallmadge Asphalt for the paving program. We will be bidding the work for Tallmadge Woods next week. End of report. Dir. of Finance: Thank you Mr. President. I will be brief as well. I just wanted to let Council know that the CAFR, our Comprehensive Annual Financial Report is complete and it is on its way to Columbus to be certified and once it is certified, then copies will be available. Also, our audit showed no significant findings and so once again, we were able to opt out of the post audit meeting and they claimed that it was a clean audit. I also wanted to let you know that we will be receiving some money from RITA. They charge us 3% for collection of the taxes and they are a non-profit and so when, or the Council of Governments is non-profit, and so when they reach the end of their year and find that there is extra money, they send it back to the participants. So this year . . . let’s see, collections in Tallmadge were a little over $9.1 million and we were charged $266,669 and we will be refunded $124,587 for a total cost of 1.55%. The Brimfield JEDD collected $925,000, almost $926,000 and we were billed $27,000 and we will be refunded $14,386 for a total cost of 1.36% for the collection. End of report. Pres. of Council: Congratulations on a clean audit. Mr. Sisak: Mr. Shanafelt, I think last year we had to do an ordinance so we could opt out?  REGULAR MEETING in Council Chambers @ 7:00 p.m. June 26, 14 Dir. of Finance: Last year what happened was that we had a letter from the Auditor and it was requested that all of Council sign it and this year it was the Mayor, myself, and the Chair of the Finance Committee who signed it and so that has been handled and that went with the packet to Columbus. Mr. Sisak: OK. Thank you. Dir. of Law: Thank you. I have no report this evening. Economic Developer: I have no report, but I will take questions. Other than I will tell you that Murphy’s Oil, which is the gas station affiliated with Wal-Mart, will open on July 28th. Panera is on schedule. Everything else is status quo in the City. Mrs. Ray: I was going to ask if you could provide us with an update on next door if there is any? Economic Developer: Actually the Mayor and I had a few conversations with Mr. Testa just as late as last week. Even though they did not receive OHFA funding, they are planning to continue to move ahead. Obviously the scope of the first building will change on those middle two floors. They have not determined what that will be yet, but we expect that they will do the second building first. They are negotiating heavily with medical and are just waiting to get signed letters of intent. 10. Ordinance 57-2014 At 3rd Reading. PUBLIC SERVICE Determining the structure at 1328 South ADOPT 3-0 east Avenue to be blighted; authorizing the Mayor to enter into all necessary agree- ments pursuant to the Moving Ohio For- ward Grant Program and providing for immediate enactment. Mr. Stalnaker moved for the adoption of Ord. 57-2014. Seconded Mrs. Kilway. Roll Call: Ms. Tricaso, Mrs. Kilway, Mrs. Ray, Mr. Sisak, Mr. Stalnaker, Mr. Donovan, Mr. Rensel – unanimous. Ord. 57- 2014 is adopted by a vote of 7-0. 11. Ordinance 59-2014 At 2nd Reading. PLANNING & ZONING Authorizing the creation and acceptance of GIVE 2nd READING 2-0 a cross easement for access and utilities between the City of Tallmadge and West Avenue Family Practice Land LLC for adjacent properties including 125 West Avenue and providing for immediate enact- ment. Pres. of Council: Ord. 59-2014 is at 2nd Reading and will remain before the Planning & Zoning Committee. 12. Ordinance 60-2014 At 2nd Reading. COMMUNITY ISSUES/SAFETY Authorizing the Mayor to enter into a GIVE 2nd READING 2-0 memorandum of Understanding between the City of Tallmadge, City of Munroe Falls and Learning for Life for the creation of a Law Enforcement Career Exploring Pro- gram and providing for immediate enact- ment. Ord. 63-2014 is amended by a vote of 7-0 and will remain before the Planning & Zoning Committee. 15.A. Ordinance 64-2014 At 1st Reading. FINANCE Authorizing the appropriation and advance of money for purposes of the Community Development Block Grant (CDBG) and providing for immediate enactment. Pres. of Council: Ord. 64-2014 is at 1st Reading and is assigned to the Finance Committee. Mayor: Mr. Chairman, it is OK to just give this a 1st Reading. Just to let you know what this is is it is a CDBG Grant that we did receive, but we have to expend the money up front and when we did the appropriation budget, we actually just appropriated out money that was part of the matching of it and so this money; we have to appropriate and send a bill to the company or to the County and then they will reimburse us so we can put it back into the fund. Just to give you an update of that program that is going on, the applications are just rolling in . . . unfortunately, better than I thought it would which means that people are very much in need that are out there and there are such sad stories that are coming in here. I feel bad. We will run out of the money; this $65,000 plus the matching $65,000 and I am sitting here listening that RITA is sending us back $125,000 that is really money that was extra and we didn’t even expect it coming and looking at the applications, I may entice Council to maybe appropriate more money once we see the applications come in, but we will have to close it off at some time. We just need a 1st Reading. Thank you. 16. Resolution 13-2014 At 2nd Reading. COMMUNITY ISSUES/SAFETY A resolution declaring the month of August ADOPT 3-0 2014 Summit Kids Month in the City of Tallmadge and encouraging the citizens of the City of Tallmadge to join in this acknowledgement, and providing for imme- diate enactment. Mr. Stalnaker moved for the adoption of Res. 13-2014. Seconded Mr. Sisak. Voice vote 7-0. Res. 13-2014 is adopted by a vote of 7-0. 17. Resolution 14-2014 At 2nd Reading. PERSONNEL Expressing the appreciation of the Council ADOPT 3-0 and Administration to Sandy Ziegler upon her retirement from service with the City of Tallmadge and providing for immediate enactment. Mr. Stalnaker moved for the adoption of Res. 14-2014. Seconded Mr. Rensel. Dir. of Finance: I just would like to express the fact that we miss Sandy. She was an excellent co- worker; knew her job and did it well. The nice part about it was that she was very pleasant to work and always had a smile on her face. I guess that is one of the things that I miss . . . I don’t walk into a grumpy office; don’t get me wrong, but I wish the best for Sandy and Fred in their retirement. Part of their plans for this summer; they are going to head to France around the middle of July starting in Paris and they are going to run a southerly route and end up in Nice I guess and they are also expecting I think it is their fourth grandchild and they are hoping obviously that the grandchild will obviously will be born before the middle of July! I wish she and Fred the best and really appreciate her service at the City. Mayor: I would like to also echo some of that stuff. I have known Sandy for quite a few years here. I knew her back when I was on Council and then when I was the Service Director, she helped my department extremely well. She kept you very much in line when it came to a purchase order or a utility bill that was not properly done, but she was very good to detail and she will be very missed around here, but there is still a great staff, but Sandy was an extremely great employee and she liked to tell me every day about the heating and air conditioning at the Rec Center. “That aerobics room was too cold or too hot!” So, I miss that, but she was a great employee. We know where she lives. Mr. Rensel: Just to echo some of the other comments. Sandy was a consummate professional here at the City of Tallmadge and a mother and now a grandmother and I hope her as everyone else does wish her very well and enjoy the retirement that she deserves. Voice vote 7-0. Res. 14-2014 is adopted by a vote of 7-0. 3  REGULAR MEETING in Council Chambers @ 7:00 p.m. June 26, 14 18. ADDITIONAL ITEMS: None. Mayor: I just have one that I would like to talk about, but I didn’t want to talk about it under Item 17. Roger Lyons’ last day of work was today. He is formally retired from the City of Tallmadge. He will be very well missed. As much as Roger was Roger and his little red pens; he had the knowledge of the Code that none of us have now. We will struggle through it. Mr. Loughry is going to step in and help us with the Planning & Zoning portion and Pat Sauner will do the BZA and I will continue to do the Heritage Commission. Then with his staff downstairs in the Zoning Department with Adam who is doing a great job with the guidance from Bryan who knows a lot down there and so I am very confident that we will get through this. There will be some bumps in the road, but we will get through it. Roger was here for 25 years. Today if you see Roger, well you won’t see him here! You will see him on the golf course! 19.
