The 12-11-14 Regular Council meeting minutes were adopted by a vote of 7-0. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Mayor: I will be very brief. As most of you have heard, the Mindale Farms fire was very tragic for the Mindale Farm community and their family. I did speak with Trina Carter. She was up there today. I was up there for a while with the family and so our hearts go out to them. There was a tragic loss of the horses that were inside the barn. We received the call at 11:28 a.m. and the response was really rapid. They immediately called for mutual aid before they even got to the scene; just based on the amount of smoke that was in the air. Hats off to the Fire Department. They did a great job protecting the surroundings, but it was fully involved by the time the Fire Department got there and so I’m sure we will learn more as the days go on of really what happened. So that is still under investigation. Planning & Zoning did meet on Tuesday night and thanks to the Council folks that were here for that. The presentation was good. I think you should have an amendment on that on your agenda tonight and Planning & Zoning will be very busy in the next several months coming up with a lot of different projects that are coming forward. That is pretty exciting. With that you do have a lot of housekeeping ordinances as we go along if you choose to adopt them; fine and if not; that is fine also. End of report. Dir. of Pub. Service: I guess another big thing on everybody’s mind is the cold. Salt doesn’t work so well on the roads when it is this cold and so we are keeping everything plowed back and we do use some of the liquid stuff after it is plowed. It doesn’t do much good on top of snow really. There are five guys in there right now waiting for the snow to start about 8:00 p.m. and so we have been keeping crews pretty much around the clock right now. Salt; we still have plenty of salt right now. It has been a little bit slow coming in. Today we only have about 25 tons and we are hoping they will bring us about 125 tomorrow and we have another 600 on order after that. We had one water main break this week. You can imagine what it is like for those guys out there working in the water in this cold and so my hats off to them. Water meters; we are getting really close to wrapping those up. The new installations; we have I think only 15 or so outside meters to do and just a little over 70 indoor meters to do and we are going to put door tags out for those people. They are just not responding to all of the letters, our calls or stopping by and so we are going to put door tags on their doors now and put that as a final warning. I would ask that Ord. 18-2015, which is the change in fees for the cemetery, be adopted at 1st Reading. End of report. Dir. of Finance: Thank you Mr. President. We have completed and closed 2014 and as the Mayor indicated at our last meeting, I too would like to recognize my department; the department for their good work. The General Fund collected what was estimated and ended the year with about $4.85 million in the unencumbered balance. Income Tax almost hit $10 million. We were about $50,000 away.  REGULAR MEETING in Council Chambers @ 7:00 p.m. January 8, 15 The Rec Center showed improvement in the profit and loss statement toward the end of the year. We received 111% of the estimated Local Government Funds. The departments did operate within budget and hats off to all of the departments as well for operating well and operating within budget. The Fire Fund balance is at $448,460. The Street Maintenance Repair Fund is at a little over half a million at $528,057. The Sewer balance is $1,329,435. The Water Fund balance is a little over $1.9 million. Storm Water collected $328,349. I also would respectfully ask for the adoption of Res. 1-2015 and Res. 2-2015. These are housekeeping ordinances directing both the Fiscal Officer of Summit County and the Auditor of Portage County to distribute the property taxes that are collected back to the City. End of report unless there are questions. Mr. Rensel: Mr. Shanafelt; do we have an estimate of what that revenue will be? Dir. of Finance: Somewhere in the neighborhood . . . I believe last year it was somewhere in the neighborhood of about $630,000. Somewhere around in there. I can look . . . just a second . . . Mr. Rensel: That gets dispersed into the General Fund right? Dir. of Finance: Yes, that is pooled in the General Fund. Mr. Rensel: OK. Thank you. Dir. of Finance: I apologize; last year it was $693,000. Dir. of Law: Just as an FYI for all of you; I attended a seminar this afternoon along with Ass’t. Finance Director, Molly Gilbride about new House Bill 5, which is a municipal income tax bill and it does create or limit much of the home rule that cities have previously had with regard to municipal income tax. There are some massive changes. It is a massive piece of legislation. RITA actually presented their Chief Legal Counsel, Amy Arrighi, and they are still digesting most of it, but they did present the major points and said that probably every municipality will have to make changes to their municipal ordinances for income tax. So, that does not go into effect until January of 2016, and so we have some time to get our arms around that and so you can expect to see something about that towards the middle to end of next year. Additionally you may have been reading in the newspaper about the issues with the Summit County Jail and some of the space issues and some of the comments that have been made about releasing some people and so on and so forth and so we will feel an impact as a municipality as it relates to our criminal cases. We are trying to get our arms around that as quickly as possible. We are in a better position than many municipalities because we do have contracts with both Cuyahoga Falls and Macedonia. Some municipalities have contracts with only one alternative jail and some with none. So, that is I guess the plus side for a very bad situation. So we are trying to work through that and I will report on that more as we understand more about the full impact. End of report. Mr. Rensel: Ms. Raber; are we limited as a City in dealing with Summit County or may we go to Portage County and say for example; go to Ravenna or go to Kent, Ohio? Dir. of Law: If we enter into contracts, I think that we could expand that beyond the county limits and in addition we do have that small portion of the City of Tallmadge that is in Portage County and so those could be potential options. We would, however, have to look at agreements and entering into a formal agreement and so we would have to explore those possibilities and we will be exploring those in the coming days. Economic Developer: The Mayor and I attended the ground breaking yesterday at Heather Knoll which basically is the start of what we believe is going to be a crazy year. What Council should expect to see in Planning & Zoning along with you; we expect Testa to make application on both project probably simultaneously. Tony Jaber is moving forward on the Big Boy site. We have preliminary approval with Lemmon and Lemmon for 101 beds next to Rite Aid for assisted living and independent living. Taco Bell has already been approved. They are all going to be good things in the end, but it can be a mess traffic-wise and so we are excited, but we are hoping for patience as well. It is just going to be fun from my perspective. We received word yesterday that another company is moving into our JEDD from Aurora that will create initially about 15 jobs, but should be 30 by the end of the year. So the Mayor will give more information in the State of the City speech, but our job count is probably about 400 increase when you combine the JEDD and Tallmadge and so everything is good in economic development. Service: It has been probably 20 years since we have done it internally. We don’t really have the equipment. We used to have pour pods and a kettle that you pretty much melted the stuff in and now they have big machines that you can just walk behind with a wand. Mr. Sisak: I thought for some reason that we did that within our department. Dir. of Pub. Mrs. Ray moved for the adoption of Ord. 18-2015. Seconded Mr. Sisak. Dir. of Pub. Service: Yes, the last time these were reviewed and changed was back in 2009. We did review several municipal cemeteries around and compared rates. Some of these were still under what other ones are plus we had to add rates for the new columbarium. Any questions; I would be happy to answer them. Mrs. Kilway: I do have a quick question; where can I find where the rates are? Clerk of Council: Where it says, “1st Reading” is the link to the attachment. Pres. of Council: The other changes are just for the columbarium? Dir. of Pub. Service: No, there are some . . . Dir. of Law: I was just going to say that the 2009 rates are above in the black and then the 2015 are below in the red. Dir. of Pub. Service: Grave sites have gone up basically $200. Mayor: From $800 to $1,000. Dir. of Pub. Service: For non-residents; it went from $2,000 to $2,200. Grave openings went from $500 to $525. That is both for resident and non-resident. I can go over the columbarium rates if you want. The columbarium has two opposing sides that are double. They are 24” deep and so you can put two urns in them. The other two sides are singles. Singles for a resident are $1,000 and non- residents are $2,200. Double niches are $1,500 for the resident and $3,000 for non-residents. The purchase of those also includes actual inurnment so there is not a separate fee for opening and closing. Pres. of Council: How about the engraving? Dir. of Pub. Service: The engraving will be done by North Hill Marble. They actually have extra plates and so families will go there and they have our rules as to what can be done and what is allowed and what type of lettering is to be used. We will place that one on and remove the blank one and give that back to the memorial company. Pres. of Council: The engraving is additional? Dir. of Pub. Service: The engraving is additional. Res. 2-2015 is adopted by a vote of 7-0. 32. ADDITIONAL ITEMS: Mr. Rensel: I would like to ask the Mayor; with the precipitous drop in price per barrel of oil; is that affecting natural gas? Mayor: Well, for those folks who were on the . . . our City rate is $4.61, but the ones who are on the SCO; the Standard Choice Option are higher than we are right now. The folks here in our office who elected to stay with SCO are at $4.71 and so our contract, which if you get phone calls, the December bill . . . the January bill is reflective of December and it shows $4.64 and not $4.61. We are working out that detail. It is supposed to be 3¢ lower. We are trying to figure that out today. Mr. Rensel: We decided and I think it was prudent to go with a two-year. Mayor: Yes. Mr. Rensel: Now with the price of oil dropping . . . of course you don’t know and no one knows, but . . . Mayor: It is back up today so . . . Mr. Rensel: The price is going to drop significantly on natural gas. Mayor: The nice thing about our program is that it is an option. At least you are locked in at this and if it drops down to $3, I’m baling and I am going to go to the lower rate. So it is an option.
