Tallmadge City Council Regular Business Meeting (2013-2019)

REGULAR MEETING in Council Chambers @ 7:00 p.m. April 23, 15 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, April 23, 2015 to order at 7:00 p.m. 2. PRAYER: Pastor Joshua Deeter, Shephard’s Pasture for All Nations Church, Tallmadge. Economic Developer: Just real quick before Josh leaves, he is our liaison as the new leader with the reformatted ministerial association and so Josh is doing a lot of work bringing churches together and working with us and helping to build our sense of community and was instrumental with the Senior Directory. I wanted to thank him. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Ray, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Dir. of Pub. Service Esler, Dir. of Finance Shanafelt, Dir. of Law Raber, Economic Developer Loughry and Clerk of Council Burton. Mr. Rensel and Mrs. Kilway were excused. Mayor Kline was also excused. 4. MINUTES: 4-9-15 Regular Council meeting minutes. Mrs. Ray moved for the adoption of the 4-9-15 Regular Council Meeting minutes. Seconded Mr. Sisak. Voice vote 5-0. The 4-9-15 Regular Council Meeting minutes were adopted by a vote of 5-0. FINANCIAL REPORTS: None. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: Pres. of Council: I would like to welcome all of the students here this evening. Thanks for coming. Tallmadge City Council meets on the second and fourth Thursday’s of the month for the Regular Council meetings and the preceding Monday’s are the Council Committee meetings. At the Committee meetings, legislation is discussed thoroughly with Council deciding to adopt, amend, reject, hold, or table the legislation. We do allow time for community input at this point in the meeting. If there is anyone who would like to address Council, please come forward and state your name and address. 6.A. ANNOUNCEMENTS: No Board of Control Mtg. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Economic Developer: The Mayor has no report because he is representing the City at another function this evening. Dir. of Pub. Service: We got our recycling report for the first quarter of this year. We recycled 223 tons in this quarter and that is down 22-½ tons from the previous quarter and our solid waste was also down by 310 tons and so we are actually still putting less into the landfills than what we were. We are in the second week of hydrant flushing so if you get any calls about dirty water; that is what it is. If people ask, just run cold water in the lowest portion of your house until it clears up and it will be fine. South Avenue Waterline is out for bid. The bid opening on that will be May 6th. We are in the process of cleaning and re-painting the features of the pool right now. We will be filling that on the 15th of May and it will open on May 30th. The Little League Parade is on Sunday from 5:00 p.m. to 7:00 p.m. West Avenue; they have started work on it. Right now they are in the process of redoing all of the curb ramps. They have until the end of July to actually get the paving done. Once they start, it should be done in about two weeks. We are getting prices on resurfacing the basketball courts at Lions Park and all of the walkways there. Next weekend at the Recreation Center is the Yard Sale. It is on courts 1 and 2 and it will be $15 for a 10 x 10 booth. End of report. Dir. of Finance: No report. Dir. of Law: This evening I just wanted to clarify for you all . . . I believe there was a recommendation in committee on Monday night that Ord. 41-2015 would be adopted this evening. Since that is at 2nd Reading and because you only have five members present, it would not actually go into effect for thirty days from now and so rather than do that, I would recommend that you hold that until the next regularly scheduled Council meeting and then it would be only a two week wait as opposed to a month wait. I believe that Service Director Esler is aware of that and is OK with that recommendation. Additionally, I wanted to clarify that on the Monday Committee meeting I received a question from Councilman Rensel, who is not here this evening, but he was asking about the title and content of Ord. 36-2015. I believe I understood the nature of his question, but actually what he and I had talked about and what Council had amended previously was the companion ordinance that is related to the waterline project; Ord. 27-2015. That had been previously amended at his request to specify that the waterline is from Ferguson Drive to the south corporation limits. That was not included in this particular ordinance, however, since they are companion ordinances, I have prepared an amendment which is before you tonight, which is the memorandum that you received and so you do have an amended ordinance if you would like to pass that tonight so that the tile does match up with the coordinating companion piece of legislation; you could do that tonight if you would like to do that. I would recommend that and that is the conclusion of my report.  REGULAR MEETING in Council Chambers @ 7:00 p.m. April 23, 15 Economic Developer: I will go quickly, but actually I do have quite a bit this evening. We had the Expo last weekend and it was a great event. I want to compliment Jessica Simons who got that facility ready and more astounding, she got it ready top rate the very next day and her staff did a great job. The Chamber and the School District were very grateful. At the event, the City had a nice booth both in the vestibule and then our department’s had individual booths. We were busy all day. It was good to see all of Council there participating and basically Mrs. Raber and Mrs. Gilbride and Mr. Shanafelt did my job during the day. They understand all our projects very well. So that was fun. Projected job creation next door; Mr. Sauner has been working on a grant and there is a mathematical formula for everything and based on the types of jobs created and the amount of square footage that is being developed, you can estimate pretty accurately the number of jobs that are going to be created. On the site next door, we are projecting that there will be between 200 and 250 jobs created and that is significant considering that it is only an 8 acre site. If you contrast that with Rubbermaid, there were about 235 to 250 jobs created on a 30 acre site and so we are pretty pleased with that. We had excellent feedback on the renderings on what is being proposed next door and what is proposed on the Bob’s Big Boy site and what has already been approved next to Rite Air with Danbury. Within a few days, Taco Bell is going to close for about a month and that will be the beginning of the dominos. So anyways; it is going to be crazy for the next two years in the City with construction. In Portage County, this was a long time coming, but the Mayor was appointed a Board position on the Portage Development Board and that is showing the Segway of us being accepted in Portage County and the work that we are doing especially in the JEDD and so that is a good thing. Chipotle is official. They will be going to the Cascades. GameStop, which is next to the GNC store; you guys should all be clapping; GameStop is going to move down and Chipotle is going to go in the suite there in the middle and so they will be up near the front. They are close to getting a letter of intent for a Japanese Steakhouse; a Hibachi-style steakhouse and so anyway, I guess what I would encourage Council and the rest of our community to do is to think of that and to truly embrace it just as if it were on the Circle because in terms of economic development, we have a hundred share agreement with a 100 year option. So for the next 200 years, in terms of economic development, we have almost doubled the footprint of our City in terms of revenue opportunities and so that is huge. So in my mind, we have an Applebee’s; in my mind we are going to have a Chipotle and actually we need to think of that as a community. That is a Segway into our Comprehensive Plan. We have been working on the Comprehensive Plan behind the scenes for a while now. We are getting ready to start having public meetings, but if you just think back, it is almost like technology in that our Comprehensive Plan hasn’t been updated since 1997. I think the phone that I was using in 1997 was about this big! If you look at what has happened; we didn’t have a JEDD in 1997 and so as you folks and us, as Administration, as we are putting together the way our land use is going to look in the future; it could just get tweaked a little bit, but there are all kinds of latitude and opportunity that we will have basically because of the JEDD. So that is all I have. 10. Ordinance 30-2015 At 3rd Reading. PLANNING & ZONING Approving and granting a conditional zoning certificate for special nonresidential development at 1077 East Avenue for construction of a barn and fence to house seven male alpacas. Pres. of Council: Ord. 30-2015 is at 3rd Reading and will remain before the Planning & Zoning Committee. 11. Ordinance 36-2015 At 3rd Reading. PUBLIC UTILITIES Authorizing the Mayor to enter into a cooperative agreement with the Ohio Water Development Authority for planning and financing of the South Avenue Waterline from Ferguson Drive to the south corpora- tion limits and providing for immediate enactment. Mr. Sisak moved to amend Ord. 36-2015. Seconded Mrs. Ray. Roll Call: Mrs. Ray, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan – unanimous. FINANCE Authorizing declarations of official intent under U.S. Treasury regulations with respect to reimbursements from note and bond proceeds of temporary advances made for payments to insurance, and related matters, and providing for imme- diate enactment. Pres. of Council: Ord. 38-2015 is at 2nd Reading and will remain before the Finance Committee. 13. Ordinance 40-2015 At 2nd Reading. FINANCE An ordinance providing for the issuance and sale of bonds in the maximum principal amount of $3,100,000 to advance refund at a lower interest cost certain of the City’s outstanding various purpose bonds, Series 2006, dated March 1, 2006, that were issued for the purpose of paying a portion of the costs of constructing a new recrea- tion facility; authorizing the call for optional redemption of the refunded bonds; autho- rizing execution and delivery of a bond registrar agreement, escrow agreement and bond purchase agreement; and autho- rizing the preparation, use and distribution of preliminary and final official statements and related matters, and providing for immediate enactment. Pres. of Council: Ord. 40-2015 is at 2nd Reading and will remain before the Finance Committee. 14. Ordinance 41-2015 At 2nd Reading. FINANCE Authorizing the appropriation of funds from unappropriated fund balances for an expan- sion of the 2015 Paving Program and pro- viding for immediate enactment. Mrs. Ray: Do you need a motion to hold? Dir. of Law: You don’t need a motion to hold. The recommendation out of committee was to adopt, but you don’t’ have to do that; you don’t have to do that if you want to go back into committee you can discuss that, but it is really . . . you do not have to do that. You can just say, if you would like to add for discussion purposes on the record that it is not being adopted tonight because you have five members of Council and it won’t go into immediate enactment and so I just kind of did that for you! Pres. of Council: Ord. 41-2015 is at 2nd Reading and will remain before the Finance Committee. 15. Ordinance 42-2015 At 2nd Reading. PUBLIC SERVICE Amending T.C.O. 351.03 Prohibited Stand- ding or Parking Places and providing for immediate enactment. Pres. of Council: Ord. 42-2015 is at 2nd Reading and will remain before the Public Service Committee. 16. Ordinance 44-2015 At 1st Reading. FINANCE Authorizing the expenditure of certain sums for the 2015 Memorial Day celebration in the City of Tallmadge and providing for immediate enactment. Pres. of Council: Ord. 44-2015 is at 1st Reading and will be assigned to the Finance Committee. 17. Ordinance 45-2015 At 1st Reading. FINANCE Appropriating additional amounts for the advance refunding of the various purpose bonds, Series 2006 and providing for imme- diate enactment. PUBLIC SERVICE A resolution declaring the month of May 2015 Older Americans Month in the City of Tallmadge and encouraging the citizens of the City of Tallmadge to join in this procla- mation, and providing for immediate enact- ment. Mr. Stalnaker moved for the adoption of Res. 5-2015. Seconded Mrs. Ray. Clerk of Council: Is this a voice vote or roll call vote? Dir. of Law: It is preferably, on ones like this, to go ahead and do a roll call vote actually. Roll Call: Mrs. Ray, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan – unanimous. Res.5-2015 is adopted by a vote of 5-0. Pres. of Council: Just as a clarification for the students that are here; we kind of went through the second part of the meeting pretty fast. Monday’s are our work sessions, or our Committee meetings where we discuss the legislation in depth and then our business meetings are on Thursday and that is where you are at today and that is why everything seems like it goes really fast without much discussion. So, if you want more in-depth; come to a Monday meeting. 19. ADDITIONAL ITEMS: Pres. of Council: The only thing I have here is that again, the Little League Parade starts on Sunday at 5:00 p.m. 20.
