REGULAR MEETING in Council Chambers @ 7:00 p.m. November 10, 16 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Monday, November 10, 2016 to order at 7:00 p.m. 2. PRAYER: Fr. Mike Matusz, Our Lady of Victory Church, Tallmadge. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Dir. of Law Raber, Dir. of Finance Gilbride and Clerk of Council Burton. Dir. of Administration Cooper and Economic Developer Weinberg were absent. 4. MINUTES: 10-24-16 Regular Council meeting minutes. Mrs. Ray moved to approve the 10-24-16 Regular Council Meeting minutes. Seconded Mrs. Kilway. Voice vote 7-0. The 10-24-16 Regular Council meeting minutes were approved by a vote of 7-0. Mrs. Ray moved for the acceptance of the Financial Reports submitted by Dir. of Finance Gilbride. Seconded Mr. Sisak. Voice vote 7-0. The Financial Reports submitted by Dir. of Finance Gilbride were accepted by a vote of 7-0. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: Welcome to the students who are here this evening. More reading; Tallmadge City Council meets on the second and fourth Thursday’s of the month for the Regular Council meetings and the preceding Monday’s are the Council Committee meetings. At the Committee meetings legislation is discussed thoroughly with Council deciding to adopt, amend, reject, hold or table the legislation. We do allow time for community input at this point in the meeting. If anyone would like to address Council, please come forward and state your name and address. We will have to change our little boiler plate here. Would anyone like to address Council? No takers. 6.A. ANNOUNCEMENTS: None. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPMENT DIRECTOR Mayor: Thank you Mr. Chairman. As you can see up on the screen that was this morning about 8:00 a.m. and then this picture was later on this afternoon. That is the same location, so the 10-Minute Lube at the Circle is officially gone. So thanks to the Service Department and Bryan’s help in organizing all of that and Pat Sauner and City Council. The grant that we did receive; we were able to remove that building and then they will move on down to West Avenue to the old Barber’s building down beside Martin Wheel and then move over to Southwest Avenue for . . . Todd Jordan has a section of that building that is coming down. So, I am pretty happy about all of that demo. The other picture is Old Town Hall and those front doors were in pretty bad shape and through the help of the Tallmadge Historical Society and the City, we are replacing those doors back to the original door, so if you . . . I did not get a picture of the doors that are in place now, but that light transit that was in there before . . . that was the door that was in there now and this light transit that is up there; the new doors will go from the ground level up to the top of the wood and that light transit will no longer be there. So I am happy that is going on there. Next door to us here; this picture was this afternoon and as you can see, that building is really starting to come along and they hope to be topped out within the next . . . before the snow flies, which I shouldn’t say that because it should fly this weekend, but still before the bad weather hits. They would like to have that building all sealed in on the east end of the building there you can see that all the windows are in and that’s the roof line and they will continue down. They are starting to work on the third floor which probably by the end of tomorrow you will see walls going up on that and then next week they will do the fourth floor and put the roof on that; put the windows in and move along on that.  REGULAR MEETING in Council Chambers @ 7:00 p.m. November 10, 16 Mayor (Cont’d.) On the energy side of it, I did receive a personal letter from First Energy saying that I no longer have a contract with First Energy; I am with NOPEC, so I talked to the person representing us for the City and Tallmadge is not NOPEC, but yet people are receiving these letters and ironically, I got one at my own house. So, I did make the phone call to them and we are trying to follow up on that. They did offer me a contract moving forward at 6% off shopping credits ending May, 2018. That is exactly the contract that we are into today. So, I will find out more tomorrow. Brenda Fargo, who helps us with this, was shocked to see this too or hear about it. The City of Green customers who are on the same thing that we are, are also starting to receive some of these letters. So, I will keep you posted of what is going on with that. I do have a couple of ordinances there that we would ask for your adoption tonight that were already on the agenda to adopt. Outside of that, tomorrow is Veteran’s Day; the ceremony at the Circle will be at 10:00 a.m. and it should be nice weather. Mr. Rensel: Yes sir; what is the cost per kilowatt hour of that contract that you were referring to? Mayor: Well, it’s 6% off of shopping credits and so if you look at your electric bill right on the edge of it, it will say shopping credit and it fluctuates every month, but right now it is probably in the upper 4’s to low 5 cents per kilowatt. So, you just have to do the calculation if you look at the shopping credit; price to compare times the 6% off and that is what it is and it changes on a monthly basis. Mr. Rensel: We are pleased to see that obviously the bond issues passed. This will change our school system and . . . Mayor: Not only the school system, but I talked about that today with the Tallmadge Express. Look at this picture up on the wall and you have the Bob’s Big Boy site and today we are washing the church and putting on the new door on Old Town Hall and the 10-Minute Lube going down and coming up North Avenue and all of the construction and they were even working on the Bob’s Big site. Mr. Rensel: My purpose just for mentioning that is . . . can the School Board or a representative come to us when they are ready to explain the timing and what is going to happen? Mayor: There will be several meetings. Just because the levy passed, they have to finalize the drawings; they have to finalize the timeframe; there is so much work and they will have plenty . . . which they will ask our input on the design just like they did on the last levy. As soon as the last levy passed and they started those City groups or public groups and then they had work sessions and came up with that design and then built the building. Mr. Rensel: That is all I ask. We supported them and if they could come and keep us updated we would appreciate it. Thank you. Thank you Mayor. Mayor: Very good. End of report. Dir. of Pub. Service: Thank you. The leaf collection continues. The department has already made five complete rounds throughout the City. Of course it is going to slow down a little bit now because the leaves are falling a little more quickly and there are larger piles down there and so it will slow it down, but we expect that we should be able to hit everybody every seven to eight days as we predicted. The North Avenue Project continues. We hope to have surface asphalt down by the end of the month and so we are praying for temperatures in the 50’s at least until the end of the month. We need 50 degree surface temperature on the asphalt and I would like to request 1 st Reading adoption of Item 13, and that is Ord. 86-2016; it is just a housekeeping ordinance allowing us to bid out for the mowing contract for public lands and also Item 14, which is Ord. 87-2016. DLZ is the contractor that is doing all of the inspections on the North Avenue Project and because of all the overtime that they have had to work because they have extended hours by the contractor and everything; their contract is going to be 10% over; more than 10% over what we had originally agreed to and so I would ask for 1 st Reading adoption for that so we can continue to pay them. End of report. Mr. Rensel: Mr. Esler; you are asking for a 1st Reading adoption on the mowing contract. Have the bids been sent out? Dir. of Pub. Service: No, this is just allowing us to bid it. Dir. of Pub. Service: Yes. Mr. Rensel: Fair enough. I was getting a little nervous there. Dir. of Finance: Thank you. Economic Developer: Absent. Pres. of Council: I guess I will make the motion to go into Executive Session regarding land acquisition. Seconded Mrs. Kilway. Council just made a motion to allow us to go back into the back room to talk about a pending land acquisition and so what we will do is go back there and talk a little bit and then we will be right back out. FINANCE Adopting a budget for various funds of P.H. ON 12-8-16 @ 7:03 P.M. the City of Tallmadge, Ohio for current expenses and other expenditures during fiscal year ending December 31, 2017, appropriating the necessary funds for the administration thereof; authorizing transfers between funds, and providing for immediate enactment. Pres. of Council: Ord. 80-2016 is at 2nd Reading and will remain before the Finance Committee and there is also a public hearing scheduled for December 8, 2016 at 7:03 p.m. 11. Ordinance 81-2016 At 2nd Reading. PLANNING & ZONING Accepting the dedication of streets within the Hederson Subdivision for public pur- poses; setting performance and mainte- nance guarantees therefore and providing for immediate enactment. Pres. of Council: Ord. 81-2016 is at 2nd Reading and will remain before the Planning & Zoning Committee. 12. Ordinance 84-2016 At 2nd Reading. FINANCE Appropriating additional amounts and reducing appropriations in various funds and providing for immediate enactment. Mrs. Ray moved for the adoption of Ord. 84-2016. Seconded Mr. Sisak. PUBLIC SERVICE Authorizing the Director of Public Service to advertise for bids and the Mayor to enter into a contract for the mowing and care of public land for the period January 1, 2017, through December 31, 2019, and providing for immediate enactment. Mr. Stalnaker moved for the adoption of Ord. 86-2016. Seconded Mr. Rensel. Roll Call: Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan, Mrs. Kilway, Mrs. Ray – unanimous. Ord. 86- 2016 is adopted by a vote of 7-0. 14. Ordinance 87-2016 At 1st Reading. FINANCE Authorizing the Mayor to exceed a contract with DLZ, Ohio, Inc. in excess of ten per- cent (10%) for construction maintenance services for the North Avenue Project (PID93444) and providing for immediate enactment. Mrs. Ray moved for the adoption of Ord. 87-2016. Seconded Mr. Sisak. Mayor: Mr. Chairman, just so Council understands, you can see in Section 2 that the addition is $41,000. ODOT pays 80% of that. So our portion . . . but we have to contract it all and this is really an ODOT contract that they entered into and so ODOT is in agreement to also pay that 80% of that addition. Pres. of Council: Mr. Rensel; do you have a question? Mr. Rensel: No, I was asking for the Mayor to explain it as he did. Thank you. FINANCE Authorizing the Mayor to enter into an agreement with Power Tool Repair Inc. for a New Jobs Program Grant pursuant to T.C.O. 160.05 and providing for immediate enactment. President of Council: Ord. 88-2016 is at 1st Reading and is assigned to the Finance Committee. 16. Ordinance 89-2016 At 1st Reading. FINANCE Authorizing the Mayor to enter into a con- tract for the purchase of 12 Southwest Avenue, 16 Southwest Avenue and 22 Southwest Avenue from Stiffler Properties, LLC and providing for immediate enact- ment. Mrs. Ray moved for the adoption of Ord. 89-2016. Seconded Mr. Sisak. Mayor: Yes, thank you and thank you Council for your consideration of this. This gives the City’s Economic Department an opportunity to help market that area. It is real close to the Circle. These sites are available to us and so therefore, we think we can put a package together for a developer for that whole zone down in there. I think it is very good. It will also be moving into the CIC and they can still continue to lease those buildings out at this time until we can get with a developer. Thank you. PUBLIC SERVICE Amending Codified Ordinance 1361.01 Per- formance and Maintenance Guarantees for Landscape Improvements, 1361.02 Planting, Trimming and Removal of Trees and Shrubs, and 1361.99 Penalty and providing for immediate enactment. Pres. of Council: Ord. 90-2016 is at 1st Reading and is assigned to the Public Service Committee. 18. Resolution 13-2016 At 1st Reading. Extending the sympathy of the Council and the Administration to Terry L. Bumpas and members of her family in the death of Margaret Bumpas and providing for imme- diate enactment. Mr. Rensel moved for the adoption of Res. 13-2016. Seconded Mr. Stalnaker. Mr. Rensel: Yes, Mrs. Bumpas is the matriarch of the family in the Bumpas family that we have come to know over the years; some of us a little longer than others, but they are a great family; a great lady and we mourn her passing and with this resolution I’m sure her family will appreciate it. Thank you. Voice vote: 7-0. Res. 13-2016 is adopted by a vote of 7-0. 19. ADDITIONAL ITEMS: Pres. of Council: I would like to wish everyone a Happy Thanksgiving and the next meeting of Council will be December 5, 2016. Mayor: Mr. Chairman, just wanted to share that picture with you. That was a selfie that I took with Lindsey Hindel today. Lindsey works up at the Tallmadge Rec Center. That is down at the Football Hall of Fame in Canton. Lindsey and I were on a panel discussion today to talk about disabilities in the work force and they honored Tallmadge for hiring Lindsey up there. You know, Lindsey has been with the Rec Center since the day it opened. She was the first applicant for employment up there. So she is one of the original employees and still working there.
