Opportunity for input by the general public. Motion was made to open public input.

JP Marcoux, 40 Summer Street, said the owner of Benjamins Restaurant, Ted Benjamin
died last week. He also spoke about the light on Broadway that keeps flashing, the senior
citizen discount for Taunton trash bags and issues with potholes.
Charles Wright, 20 Chestnut Street, Taunton, spoke about his complaints regarding the
Airport Commission. He feels there has been no changes and the situation is getting
worse in his opinion since he started corning to the Municipal Council meetings over the
last year and a half. Specifically, he is complaining about the outrageousness of the
Airport Commission conducting a public meeting this month at the new terminal building
but was not open to the public. He feels this is discrimination against him. He also
complained about a no trespass notice that was filed against him and explained his
complaint about another tenant at the Airport who he feels was subjected to wrongful use
of power by the Airport Commission. He has initiated complaints against the Airport
Chairman for allegedly misrepresenting his position as Airport Manager. He also spoke
about the Airport Chairman and the former Airport Chairman going to court for charges
regarding "allegedly" hunting at the Airport. He continued to explain his frustrations.
Motion was made to close public input. So voted.

Mayor 0' Connell said they want to thank Congressman Auchincloss for hosting a virtual
community round table meeting yesterday. He was kind enough to give us an update
about what's going on in Washington D.C. and also really listened to people which he is
really good at. His office has always been very good to Taunton and very responsive to

our community. They also wanted to thank True Diversity and Taunton Diversity
Network for all of their work and efforts this past month which is Black History Month.
They really brought our community together. They had a lot of great events that
highlighted art, music, culture and also educational forums here in the community. They
thanked them for all the work they did and along with all of the members of their
organizations as well. The Southeastern Regional Planning & Economic Development
District, otherwise known as SRPEDD, is working with the City of Taunton to produce a
plan to revitalize Route 140 from the Taunton Green to Industrial Drive, which is the
future commuter rail site. SRPEDD needs your input regarding changes that you would
like to see in this area around economic development, multimodal transportation (like
biking and walking) and housing. You can visit SRPEDD.org/140 to take a brief survey,
use the interactive map and learn more about the plan. Paper surveys are available at the
City Clerk's office and at SRPEDD's office which is located at 88 Broadway. Community
feedback is really critical to this study and SRPEDD values hearing from the community
and incorporating great ideas and suggestions that everyone has. They hope that people
will really take advantage of this opportunity for their input. They are hosting a
community information session on the proposed Safety Facility on Monday, March 13th
at 6:00 p.m. right here at City Hall. They hope to have a lot of people join them to learn
about the new proposed Public Safety Facility. You'll see sketches and drawings of the
proposed building, meet the project manager, the architects and also learn about the costs
and financing of the project. Also, the Police Chief and Fire Chief will also be there to
speak with people as well. The public is welcome and encouraged to attend this session.

Communications from Citv Officers:
Com. from the Director of Technology of the IT Department requesting disposition of old
equipment. The items for disposal were provided. Motion was made to approve. So
voted.
Com. from the Chairman of the Taunton Planning Board notifying of a Public Hearing.
The Taunton Planning Board is in receipt of a Form J Plan - Waiver of Frontage
Requirements for the property at 73 Fremont Street, Taunton that was submitted by
Joshua Cabral and Brooke Benjamin. The Taunton Planning Board will hold a Public
Hearing on this proposal on Thursday, April 6, 2023 at 5:30 p.m. at City Hall located at
15 Summer Street. Motion was made to receive and place on file. So voted.
Com. from the City Solicitor regarding a response to the Municipal Council's vote on
February 21, 2023 inquiring as to whether or not the Council has authority to remove
airport commissioners. Airport commissioners are appointed by the Mayor with the
approval of the Council pursuant to M.G.L. c. 90 §51E. Therefore, the Mayor is the
appointing authority. Said statue does not establish a process to remove commissioners.
The Municipal Council has no authority to remove airport commissioners. Motion was
made to receive and place on file and thank the City Solicitor for this information.
So voted. Councilor Borges thinks it's important that the public know that the Council
has no authority to remove an airport commissioner.

Com. from the Chief Financial Officer providing a response in regards to purchase orders
and quotes for a period of time starting August 1, 2022 through the first week of February
2023. The Finance Department confirms the existence of 288 City side purchase orders
with a value of $1 Ok or greater. Many of these purchase orders are exempt from Chapter
30b and/or are part of state contracts or local consortiums. Bid documents associated with
purchase orders vary in size based on scope of project or service. Those "specs" and
history are generally kept by the requesting Departments in most cases. The Finance
Department would like the Council to be aware that each purchase order is expensed
through vouchers. Each voucher contains a minimum of four pages and the maximum is
generally 25-30 pages for each voucher. Several vouchers may be utilized to fulfill each
purchase order and can range from one voucher to hundreds. This would be thousands of
pieces of paper to pull together based on the amount of purchase orders just on the City
side. The Finance Department, after reviewing the request, is informing Council that the
minimum amount of time required to satisfy the motion passed would be: 3-hrs. to make
pdf copies of Purchase order listing, 200-hrs. of research with various department
directors, 40-hrs. of review of research and 20-hrs. of follow-up time. If the Council's
request includes the School Department purchase orders, bid and quotation history, the
estimated listed time needed would be tripled. Mayor O'Connell said the CFO requested
that this be possibly referred to the Committee on Finance and Salaries so the Finance
team can come in and explain their process and get more of an understanding of what the
request is for. Councilor Coute said he doesn't view the Council as an investigative body,
he feels that's why we have the Auditor's office. He thinks the appropriate action would
be to meet with the CFO, more specifically the Auditor, and to ask the Auditor for their
opinion on this memo and have the person in the City who is responsible to review
purchases and make sure they comply with all the Mass General Laws. Motion was
made to refer to the Committee on Finance and Salaries and meet with the Auditor
and the CFO. So voted. On discussion, Councilor Borges said she respectfully disagrees
with Councilor Coute regarding the City Council not really having any involvement. She
said using Dr. Croteau's line that "we work for the people that put us in these seats". She
feels it's their responsibility to protect our taxpayer's dollars. She completely respects
that the CFO has requested a more narrow scope. She talked to the City Auditor who has
already completed the list of purchase orders and she'd be happy to just get that list of
purchase orders to the Council so they can review this unanimous vote that took place
last week, minus Councilor Coute who wasn't present to get this information. She thinks
it's important that they have this information so they can look at the list that the Auditor
has put together and decide which ones they want to dig a little bit deeper into. She does
feel it is their job to protect the tax payer's dollars. Again, that's why they were put in
these seats. Unfortunately, it's not the popular thing and it requires work. All this letter
proves to her is the inefficiencies within our City that they can't at a click or a button, put
something on a flash drive and provide it to the Council. Again, she knows it's a lot of
work and a work in progress. They are not the only community that doesn't have
everything uploaded on pdf s that has shared google docs that are live in time but she
does feel it is a work in progress and something they need to do. If anything, her motion
has really been eye opening for the reasons why they need to become more efficient with
our Departments. Discussion continued. Councilor Coute said he does believe the
Council's job is to protect the tax payers but through legislation not through executive
functions. They are not an investigative body. That's not what a City Council does. They
meet with people who do investigations and maybe chat with them if they have issues but
to say that their not there to protect the tax payers is definitely not accurate. He explained

we have a legislative body which is Council, an executive body which is the Mayor and
the Administration and that's the way its setup. He does think that it should be referred to
the Committee on Finance and Salaries to meet with the Auditor who performs these
reviews and investigations. Councilor Dooner said she agrees with Councilor Coute. She
thinks the proper channel is to go through the Committee on Finance and Salaries given
this is something concerning to the Finance Department. She doesn't feel there is a
discrepancy given that the Committee on Finance and Salaries is going to meet with the
Auditor Department and the necessary parties. Councilor Borges said she doesn't
disagree that it should go to the Committee on Finance and Salaries. She is the one who
made the motion and once again, was unanimously voted on last week to send it to the
Auditor and within four-days, the Auditor had 80% of the purchase orders done. They are
100% complete this evening. Councilor Sanders made a motion that the Auditor
make whatever they have available in regards to purchase orders, available to any
Councilor who wants to review this list in preparation for the meeting with the
Committee on Finance and Salaries. So voted. On discussion, Councilor Borges said
that's all she was looking for was the list, not the actual purchase orders themselves.
Communications from Citizens:
Com. from Attorney Brennan, Jr., 174 Dean St., Unit B, Taunton regarding the Union
Block Project, 1, 15-31 Main Street and 22 Merchants Lane, Taunton that the Planning
Board approved a site plan review on January 13, 2022. A condition of the approval
required certain reciprocal easements between the developer and the City of Taunton.
Refer to condition # 10 on the attached Planning Board decision that was provided.
Motion was made to refer to the Committee on Public Property. So voted.
Com. from Joshua Freeman, 15 Michael Rd., Raynham requesting for consideration of
putting a U.S. Space Force Flag up at the Veteran's Memorial on Church Green. Motion
was made to refer to the Committee on Military & Veterans Affairs. So voted.

Special Permit
Petition submitted by Adam Braillard, Prince Lobel Tye, LLP, One International Place,
Suite 3700, Boston on behalf of his client, Lunar Xtracts, Inc., 230 Cross Road,
Dartmouth for a special permit for a 4,260 sq. ft. marijuana manufacturing establishment
at 144 West Britannia Street located in the Industrial District. Motion was made to refer
to the City Clerk to schedule a public hearing. So voted.

damages to his automobile from hitting a pothole near 545 Middleboro Ave., Taunton
after taking right tum coming from O'Connor St. (Already referred to the City Solicitor

Unfinished Business:
Councilor Borges requested an update from the Mayor's office regarding a unanimous
vote that the City Council had on an external audit of the airport. Motion was made to
refer to the Mayor's Office. So voted.
Councilor McCaul made a motion to refer the concerns about the traffic light on
Broadway to the DPW. So voted.
Councilor Coute made a motion to refer the concerns of the Taunton Airport that
were expressed at Public Input to the Law Department. So voted.

AN ORDINANCE
CHAPTER 337 PEDDLERS, SOLICITORS AND VENDORS
Be it ordained by the Municipal Council of the City of Taunton as follows:
That Chapter 337 of the Revised Ordinances of the City of Taunton, as
amended, be and hereby are further amended by replacing sections 337-4 and 337-5
with a new section numbered 337-1 and by renumbering the remaining sections as
set forth below:
Section 337-1 Temporary and Transient Vendors

A. Definitions. The following words shall, for the purpose of this section, have the
following meanings, unless the context requires otherwise:
LICENSING AUTHORITY
The Municipal Council for the City of Taunton.
TEMPORARY FIXED-LOCATION BUSINESS
The exhibition and sale of goods, merchandise or food from vehicles, stands or
otherwise displayed, which is not carried on in any tent, booth, building or other
structure or shelter. The term shall also be applicable to any exhibition and sale of
goods and merchandise from vehicles, stands or otherwise displayed which does
not come within the definition of hawker and peddler or transient vendor.
TEMPORARY FIXED-LOCATION VENDOR
Includes any person, either principal or agent, who engages in a temporary
business in the City selling goods, merchandise or food from vehicles, stands or
otherwise displayed and who is not required to be licensed as a transient vendor or
hawker and peddler under MGL c. 101.
TEMPORARY OR TRANSIENT BUSINESS
The exhibition and sale of goods or merchandise from any tent, booth, building
or other structure, unless such place is anticipated to be open for business during
usual business hours for a period of at least 12 consecutive months. The term shall
also be applicable to any exhibition and sale of goods, wares or merchandise from
vehicles, or stands, or otherwise displayed, which does not come within the
definition of hawker and peddler.
TRANSIENT OR TEMPORARY VENDOR
Any person, either principal or agent, who engages in a temporary or transient
business in the City of Taunton selling goods, wares or merchandise, either in one
locality or in travelling from place to place.
B. Transient Vendor or Transient Business License
1. Application, investigation and fees. Every transient vendor, before making any
sales of goods, wares or merchandise in the City of Taunton, shall make
application to the licensing authority for the issuance of a license to conduct a
temporary or transient business within the City. Said application and a processing
fee shall thereafter be forwarded to the Chief of Police for investigation and to the
Planning Department for zoning review with the results submitted to the licensing
authority. Thereupon, ifthe application is approved, the licensing authority shall
authorize the City Clerk, upon payment by the applicant of a fee of $200, to issue
a license authorizing the sale of such goods and merchandise within the City. The
licensing authority may, in lieu of a fixed license fee, require the applicant to file
with the licensing authority a sworn statement of the average quantity and value
of the stock of goods and merchandise kept or intended to be kept for sale. Said
licensing authority shall submit such statement to the Assessors of the City, who
shall determine such average quantity and value and shall transmit a certificate
thereof to said licensing authority. In lieu of a fixed fee, the applicant shall pay to

the City Clerk a fee equal to the taxes assessable in the City of Taunton under the
last preceding tax levy therein upon an amount of property of the same valuation.
Said license shall remain in force until the first day of May next ensuing after the
date of its issuance unless sooner revoked.
2. Fines. Any transient vendor who sells, or exposes for sale, at public or private
sale, any goods, wares or merchandise without a license therefor, or any transient
vendor who neglects or refuses to file the statement previously described, if
required by the licensing authority, or makes a false or fraudulent representation
therein, shall be punished by a fine of not less than $100 nor more than $200 for
each day on which he/she keeps or exposes for sale any goods or merchandise.
3. Prohibited sales. The sale by transient vendors of jewelry, furs, cell phones,
earbuds, earphones, small electronic devices, gold, silver, or other precious metals
is prohibited.
4. False Statements. Filing applications with false statements prohibited. No person
shall either as principal or by agent file any application, original or
supplementary, containing any false or misleading statement.
5. Authority to arrest. A police officer shall have the authority to arrest without a
warrant a hawker and peddler or transient vendor or any other person the officer
has a probable cause to believe is violating any provision of this section.
6. Violations. Any violation of Subsection 3 or 4 of this section shall be punishable
as provided in§ 1-5 of these Revised Ordinances.
C. Temporary Fixed-Location Businesses or Vendors License
1. Application, investigation and fees. Every temporary fixed-location vendor,
before making any sales of goods, wares, merchandise or food in the City, shall
make application to the licensing authority for the issuance of a license to conduct
a temporary fixed-location business within the City. Said application and
processing fee shall thereafter be forwarded to the Chief of Police for
investigation and the Planning Department for zoning review, with the results
submitted to the licensing authority. Thereupon, ifthe application is approved, the
licensing authority shall authorize the City Clerk, upon payment by the applicant
of a fee of $250, to issue a license authorizing the sale of such goods, wares,
merchandise or food kept or intended to be kept or exposed by him/her for sale.
The licensing authority may, in lieu of a fixed license fee, require the applicant to
file with the licensing authority a sworn statement of the average quantity and
value of the stock of goods, and merchandise kept or intended to be kept for sale.
Such licensing authority shall submit the statement to the Assessors of the City
who shall determine such average quantity and value and shall forthwith transmit
a certificate thereof to the licensing authority. In lieu of a fixed fee, the applicant
shall pay to the City Clerk a fee equal to the taxes assessable in the City under the
last preceding tax levy therein upon an amount of property of the same valuation.
The license shall be at all times prominently displayed and shall remain in force
until the first day of May next ensuing after the date of its issuance unless sooner

revoked. Such license shall not be transferable. It shall not authorize more than
one person or entity to sell goods, merchandise or food as a temporary fixed-
location vendor either by agent or clerk or in any way other than his/her own
proper person, but a licensee may have the assistance of one or more persons in
conducting the business who may aid but not act for or without him/her.
2. Prerequisite for issuance. No person shall be licensed as a temporary fixed-
location vendor under the provisions of this section until he/she obtains the
following:
a. A certificate from the Board of Health stating that the vehicle, receptacles and
utensils are in sanitary condition.
b. A license for the sale of milk from the Board of Health.
c. A license as a common victualer from the Board of License Commissioners.
3. Fines. Any temporary fixed-location vendor who sells or exposes for sale any
goods, wares, merchandise or food without a license therefor, or any temporary
fixed-location vendor who neglects or refuses to file the statement previously
described, if required by the licensing authority, or makes false or fraudulent
representation therein, shall be punished by a fine of not less than $100 nor more
than $200 for each day on which he/she keeps or exposes for sale any goods,
wares, merchandise, or food.
4. Prohibited sales. The sale by temporary fixed-location vendors of jewelry, cell
phones, earbuds, earphones, small electronic devices, furs, gold, silver or other
precious metals, wines or spirituous liquors, small artificial flowers or miniature
flags is prohibited.
5. False Statements. Filing application with false statements prohibited. No person
shall either as principal or by agent file any application, original or
supplementary, containing any false statement
6. Authority to arrest. A police officer shall have the authority to arrest without a
warrant a temporary fixed-location vendor or any other person the officer has a
probable cause to believe is violating any provision of this section.
7. Violations. Any violation of Subsection 4 or 5 of this section shall be punishable
as provided in § 1-5 of these Revised Ordinances.

Councilor Coute made a motion to refer to the Council of the Whole to meet with
the City Planner and the Building Commissioner regarding topics related to 144
West Britannia Street. He sees there is another individual coming for a special
permit for marijuana so he would like to get an update of how many operations are
there and what's up and running because they lose track. Especially, at this facility.
So voted.
Councilor Borges made a motion to request the Airport Enterprise Account from
the City Treasurer to be provided to the Council. So voted.
Councilor Borges made a motion to have the City Auditor provide to the Council all
payments made on behalf of the Airport for fiscal year 2022 & 2023. So voted.
Councilor Borges made a motion to have the City Auditor provide to the Council all
of the expenditures and what accounts they came from for the Law Offices of
Anderson & Kreiger. So voted.

Present were Councilor Barry Sanders, Chairman, and Councilors Dooner and McCaul. CFO
Patrick Della Russo, City Solicitor Matt Costa, and Director of Human Resources Amy
Kazlauskas were also present.
The meeting was called to order at 5 :41 PM.
1. Meet with the CFO to discuss the proposed title change from "Chief Procurement
· Officer" to "Director of Procurement" under Chapter 96 "Procurement Department".
Councilor Sanders explained that he had placed a call to the Inspector General's office and had,
therefore, requested that this topic be tabled last week to give him time to receive a return call.
He indicated tj:iatthe Inspector General's office pointed him to M. G. L. c. 30b § 19 which
indicates that only the Chief Procurement Officer can delegate responsibilities of the CPO to
somebody else. Now, this will be the Director of Procurement, who will have all the
expectations of the CPO, so his understanding is that there is no significant change. Councilor
Sanders also referenced M. G. L. c. 41 § 103 which refers to the "purchasing agent" and
expressed his understanding that the purchasing agent will now be the Director of Procurement
who will have the purchasing agent responsibilities . He asked if the form required by the
Inspector General's office designating the Director of Procurement as the City's CPO would be
completed and he was informed that it would be. He further requested, when the job description
is sent to the Councilors, that both the old and new job descriptions be forwarded.
MOTION: Approve and move to a first reading. So voted.

The meeting was called to order at 5:50 PM.
1. Meet with members of the ADA Commission and Kevin Scanlon to discuss the znd
Quart()r Transition Report and implementation updates.
Donna DiCorpo, the Commission Chairperson, gave the Councilors an update on the transition
report and indicated that much has been completed. She expressed her wish to reformat the
report to better reflect what is left to be done since some buildings are no longer being used and
some departments have moved. She indicated that some departments have not reported anything
and she would like to understand why and believes it would help to see the report showing what
is still outstanding. Ms. DiCorpo also emphasized that, while some items come off the list, other
items go back onto the list and it is a fluid document.
Councilor McCaul questioned why some departments have not complied and Mr. Scanlon
explained that in some cases it is a large, expensive project that is needed. At the Animal
Shelter, for example, extensive renovations to the entryway and bathroom are needed. He
further explained that the funding goes through the Building Department and they address
projects throughout the City. Ms. DiCorpo suggested that the Building Department needs more
money to address ADA issues. Mr. Scanlon indicated that he could revamp the spreadsheet and
agreed that sometimes things previously fixed need to go back on the list. He used the example
of the ADA parking at the Friedman School which was fine but now is degraded and needs
attention.
Nancilee LeMaire spoke about snow that is dumped in the Trescott Lot and ends up falling into
the handicapped parking area. Dumping is also an issue at that lot.
Ms. DiCorpo reported that Officer Arsenio Chaves has been great at helping particularly with
issues related to handicapped parking. She emphasized that the sign that is required for
handicapped parking by ISO standards is the person in a wheelchair sign, not the racing
wheelchair sign.

Councilor Sanders moved: MOTION: Handicapped parking signs that do not have the
appropriate ISO symbol be replaced with signs with the appropriate ISO symbol. So voted.
Ms. LeMaire reported that at Planet Petroleum cars are parked on the sidewalk so there is no
accessibility within that area.
Councilor Quintal moved: MOTION: Contact the Safety Officer to look into the matter. So
voted.
Councilor Sanders clarified the budgeting for work to be completed. Mr. Scanlon explained that
$100,000 each goes into the Building Department, DPW, and Park and Rec budgets for ADA
improvements. These are the main funding sources. For example, the Animal Shelter does not
have its own funding for ADA improvements. Councilor Sanders also clarified that the Building
Department would prioritize projects and Mr. Scanlon agreed that, by and large, the Building
Department does since the $100,000 is not earmarked for a specific project. Mr. Scanlon pointed
out that man-power is another issue. Councilor Sanders suggested that the TCID share their
priorities with the Council, if they desired. Mr. Scanlon indicated that the Commission is already
prioritizing and the Golf Course is one area that needs attention. Councilor Sanders asked if the
Commission has been involved with the design for the new Public Safety Building and, while
Mr. Scanlon has been involved, Ms. DiCorpo suggested she would like to also be involved and
thinks that it would be helpful to look at things ahead of time.
Councilor Sanders moved: MOTION: The City Council request that the Mayor include two
representatives ofthe TCID on the Public Safety Building Committee.
Councilor Dooner, who has attended the committee meetings, indicated that Mr. Scanlon has
been very forthcoming. She expressed her belief that they are not at the design phase yet.
Councilor Postell wondered what the City has learned from past experiences and Mr. Scanlon
suggested that the process used at the Mulcahey School and City Hall be duplicated and that he
and Ms. DiCorpo were very involved. Councilor Postell asked what continuity of operations are
in place and Ms. DiCorpo stated that AAB regulations and ADA standards must be followed
and, where there is a conflict, the stricter rule must be followed.
So Voted.
Councilor Coute shared that with new buildings an architect draws and stamps the plans
confirming that they meet ADA codes, the project manager reviews, and the City building
inspectors enforce the building code.

CHAPTER 337 PEDDLERS, SOLICITORS AND VENDORS
Be it ordained by the Municipal Council of the City o/Taunton as follows:
That Chapter 337 of the Revised Ordinances of the City of Taunton, as
amended, be and hereby are further amended by replacing sections 337-4 and 337-5
with a new section numbered 337-1 and by renumbering the remaining sections as
set forth below:
Section 337-1 Temporary and Transient Vendors
A. Definitions. The following words shall, for the purpose of this section, have the
following meanings, unless the context requires otherwise:
LICENSING AUTHORITY
The Municipal Council for the City of Taunton.
TEMPORARY FIXED-LOCATION BUSINESS
The exhibition and sale of goods, merchandise or food from vehicles, stands or
otherwise displayed, which is not carried on in any tent, booth, building or other
structure or shelter. The term shall also be applicable to any exhibition and sale of
goods and merchandise from vehicles, stands or otherwise displayed which does
not come within the definition of hawker and peddler or transient vendor.
TEMPORARY FIXED-LOCATION VENDOR
Includes any person, either principal or agent, who engages in a temporary
business in the City selling goods, merchandise or food from vehicles, stands or
otherwise displayed and who is not required to be licensed as a transient vendor or
hawker and peddler under MGL c. 101.
TEMPORARY OR TRANSIENT BUSINESS
The exhibition and sale of goods or merchandise from any tent, booth, building
or other structure, unless such place is anticipated to be open for business during
usual business hours for a period of at least 12 consecutive months. The term shall
also be applicable to any exhibition and sale of goods, wares or merchandise from
vehicles, or stands, or otherwise displayed, which does not come within the
definition of hawker and peddler.
TRANSIENT OR TEMPORARY VENDOR
Any person, either principal or agent, who engages in a temporary or transient
business in the City of Taunton selling goods, wares or merchandise, either in one
locality or in travelling from place to place.
B. Transient Vendor or Transient Business License
1. Application, investigation and fees. Every transient vendor, before making any
sales of goods, wares or merchandise in the City of Taunton, shall make
application to the licensing authority for the issuance of a license to conduct a
temporary or transient business within the City. Said application and a processing
fee shall thereafter be forwarded to the Chief of Police for investigation and to the
Planning Department for zoning review with the results submitted to the licensing
authority. Thereupon, if the application is approved, the licensing authority shall
authorize the City Clerk, upon payment by the applicant of a fee of $200, to issue
a license authorizing the sale of such goods and merchandise within the City. The
licensing authority may, in lieu of a fixed license fee, require the applicant to file
with the licensing authority a sworn statement of the average quantity and value
of the stock of goods and merchandise kept or intended to be kept for sale. Said
licensing authority shall submit such statement to the Assessors of the City, who
shall determine such average quantity and value and shall transmit a certificate
thereof to said licensing authority. In lieu of a fixed fee, the applicant shall pay to
the City Clerk a fee equal to the taxes assessable in the City of Taunton under the
last preceding tax levy therein upon an amount of property of the same valuation.
Said license shall remain in force until the first day of May next ensuing after the
date of its issuance unless sooner revoked.
2. Fines. Any transient vendor who sells, or exposes for sale, at public or private
sale, any goods, wares or merchandise without a license therefor, or any transient
vendor who neglects or refuses to file the statement previously described, if
required by the licensing authority, or makes a false or fraudulent representation
therein, shall be punished by a fine of not less than $100 nor more than $200 for
each day on which he/she keeps or exposes for sale any goods or merchandise.
3. Prohibited sales. The sale by transient vendors of jewelry, furs, cell phones,
earbuds, earphones, small electronic devices, gold, silver, or other precious metals
is prohibited.
4. False Statements. Filing applications with false statements prohibited. No person
shall either as principal or by agent file any application, original or
supplementary, containing any false or misleading statement.
5. Authority to arrest. A police officer shall have the authority to arrest without a
warrant a hawker and peddler or transient vendor or any other person the officer
has a probable cause to believe is violating any provision of this section.
6. Violations. Any violation of Subsection 3 or 4 of this section shall be punishable
as provided in§ 1-5 of these Revised Ordinances.
C. Temporary Fixed-Location Businesses or Vendors License
1. Application, investigation and fees. Every temporary fixed-location vendor,
before making any sales of goods, wares, merchandise or food in the City, shall
make application to the licensing authority for the issuance of a license to conduct
a temporary fixed-location business within the City. Said application and
processing fee shall thereafter be forwarded to the Chief of Police for
investigation and the Planning Department for zoning review, with the results
submitted to the licensing authority. Thereupon, ifthe application is approved, the

who shall determine such average quantity and value and shall forthwith transmit
a certificate thereof to the licensing authority. In lieu of a fixed fee, the applicant
shall pay to the City Clerk a fee equal to the taxes assessable in the City under the

The license shall be at all times prominently displayed and shall remain in force

location vendor either by agent or clerk or in any way other than his/her own
proper person, but a licensee may have the assistance of one or more persons in
conducting the business who may aid but not act for or without him/her.
2. Prerequisite for issuance. No person shall be licensed as a temporary fixed-
location vendor under the provisions of this section until he/she obtains the
following:
a. A certificate from the Board of Health stating that the vehicle, receptacles and
utensils are in sanitary condition.
b. A license for the sale of milk from the Board of Health.
c. A license as a common victualer from the Board of License Commissioners.
3. Fines. Any temporary fixed-location vendor who sells or exposes for sale any
goods, wares, merchandise or food without a license therefor, or any temporary
fixed-location vendor who neglects or refuses to file the statement previously
described, if required by the licensing authority, or makes false or fraudulent
representation therein, shall be punished by a fine of not less than $100 nor more
than $200 for each day on which he/she keeps or exposes for sale any goods,
wares, merchandise, or food.

This communication is in response to the Municipal Council's vote of February
21, 2023, inquiring as to whether or not the Council has authority to remove airport
commissioners.
Airport commissioners are appointed by the Mayor with approval of the Council
pursuant to M.G.L. c. 90 §51 E. Therefore, the Mayor is the appointing authority. Said
statute does not establish a process to remove commissioners. The Municipal Council
has no authority to remove airport commissioners.

Dear Council President Dooner and Members of the Municipal Council,
The Finance Department is offering a response to the Municipal Council on its request to provide
documents related to purchase orders and quotes for a period of time starting August 1, 2022 through
the first week of February 2023.
The Finance Department confirms the existence of288 City side purchase orders with a value of $10k
or greater. Many of these purchase orders are exempt from Chapter 30b and/or are part of state
contracts or local consortiums. Bid documents associated with purchase orders vary in size based on
scope of project or service. Those "specs" and history are generally kept by the requesting Departments
in most cases.
The Finance Department would like the Council to be aware that each purchase order is expensed
through vouchers. Each voucher contains a minimum of four pages and the maximum is generally 25-
30 pages for each voucher. Several vouchers may be utilized to fulfill each purchase order and can
range from one voucher to hundreds. This would be thousands of pieces of paper to pull together based
on the amount of purchase orders just on the City side.
The Finance Department, after reviewing the request, is informing Council that the minimum amount
of time required to satisfy the motion passed would be:
• 3 hours to make PDF copies of Purchase order listing
• 200 hours of research with various Department Directors
• 40 hours of review of research
• 20 hours of follow up time
Should the Council's request include the School Department purchase order, bid, and quotation history,
the estimates above would be tripled in time. Therefore, the Finance Department, being mindful of
employee workload and judicious use of staff time and resources is requesting a narrower scope of this
request. The team is able to provide information, however, we ask that specifics be provided such as a
project or a service that this information pertains to so as to more efficiently fulfill this request.

On January 13, 2022, the Taunton Planning Board approved a site plan for the Union
Block Project, 1, 15-31 Main Street and 22 Merchants Lane, Taunton. A condition of the
approval required certain reciprocal easements between the developer and the City of Taunton.
See Condition 10 on the attached Planning Board Decision.

One easement from the City to the developer will have to be signed on behalf of the City
after a vote of Municipal Council, and the other will require a vote by the Council to accept the

On December 14, 2021 the petitioner filed a Site Plan Review for 38 residential units in conjunction with
the commercial units on the first floor at 1, 15-31 Main Street and 22 Merchant's Lane, Taunton, Ma. As
required by the Zoning Ordinance, copies of the petition and plans submitted therewith were submitted
to the applicable City Boards and Departments. On January 6, 2022 a public meeting was held by the
Taunton Planning Board, after proper notice as required by Massachusetts General Laws Chapter 40A,
Section 11 and the City's Zoning Ordinance. In considering the petition, the Planning Board
familiarized itself with the premises and examined the location, layout and other characteristics. After
reviewing the petition~ plans and testimony, the Planning Board finds that the petition was formally
sufficient and submitted and reviewed in accordance with the procedures set forth in the Zoning
Ordinance and that proper notice was given by the Taunton Planning Board, having made motion to
Grant the Site Plan Review, based on the submitted plans and accompanying materials and above
mentioned reasons, and the Taunton Planning Board having voted 6 members in favor, 1 member
absent, of said motion, hereby Grants the petition for a Site Plan Review with the following conditions

Condition #1) That the plans dated December 10, 2021 shall govern with the following additional
conditions:
Condition #2) Lighting shall not illuminate any portion of abutting properties
Condition #3) The site shall be kept dean and clear of debris
Condition #4) Two set of as-builts shall be submitted upon occupancy for all work on site and shall include
design engineer and land SUJ'Veyor cel'tification notes stating the development has been built according to
the approved plans. Plans will show all construction of buildings, utilities, grades, setbacks etc
Condition #5) Two sets of updated plans shall be provided that conforms to this decision prior to Building
permit
Condition #6) Dumpster shall be located on a concrete pad, be enclosed with a six foot stockade fence, be
kept closed at all times and be emptied regularly
Condition #7) Survey information shall be added to the plans
Condition #8) The parcel numbers shall be added to the plans
Condition #9) A confirmatory deed shall be filed for the parcels
Condition #10) The sidewalk encroaches on the public way and the travel way encroaches on the abutting
parcel. Mutual easements must be agreed upon and recorded prior to building permits
Condition #11) The sewer shall have a CCTV inspection and a set of as builts shall be submitted prior to
building permits
Note #1) Plans are required and need to be submitted to DPW for water services, fire service line, gate
valves and curb stops. Permits are required for City Licensed Contractor, road opening and trench
Note #2) DPW specifications apply including pressure testing, materials, installation, new water meter with
an updated radio frequency unit, inspection and app1·oval. Any backflow devices must be inspected by the
Plumbing inspector and prior notice is required before any city water work is to be performed and
inspections are required prior to backfilling
