Hearing:
On the petition submitted by Attorney Adam Braillard, of Prince Lobel Tye, LLP, One
International Place, Suite 3700, Boston, MA 02110, on behalf of his client, Lunar
Xtracts, Inc., 230 Cross Road, Dartmouth, MA 02747 for the issuance of a Special Permit
to allow a 4,260 sq. ft. marijuana manufacturing establishment to be located at 144 West
Britannia Street, Taunton which is located in the Industrial District. Motion was made to
open the hearing and invite the parties into the enclosure. So Voted. On discussion,
Councilor Duarte recused himself from the hearing. Com. from the City Planner
stating that the petition will not require a modification of the existing Site Plan Review
approval. Com. from the Conservation Agent stating there are no conservation concerns
regarding the request for a Special Permit for a marijuana manufacturing establishment at
the address of 144 West Britannia Street. Com. from the City Engineer stating that the
Engineering Office has reviewed the documents and plans submitted as part of the
Special Permit for the property at 144 West Britannia Street for Lunar Xtracts and has no
additional comments at this time. Motion was made to receive the documents. So
Voted. Mayor O'Connell asked the parties to introduce themselves. They introduced
themselves as Adam Braillard, of Prince Lobel Tye, LLP, One International Place, Suite
3700, Boston, MA 02110, on behalf of the applicant, Lunar Xtracts, LLC. He also
introduced Brian Jacobi, who is a consultant for the applicant, and Steven Brabant, the
owner of the applicant, Lunar Xtracts, LLC. Mr. Braillard spoke about how they are here
to discuss a Special Permit in front of the Municipal Council to install, develop and
operate a cannabis product manufacturing establishment located at 144 West Britannia
Street, Unit 5, which is in the basement of the building. He stated that the building is
located within the Industrial Zoning District. He stated that the proposal is to modify
approximately 4,200 sq. ft. of that basement to account for the product manufacturing. He

stated that it will not be open to the public. He stated that there will be two or three
employees at any given time at least for the first year and then will grow from there. He
stated it is completely out of view and that there are no windows. He stated that there will
be state of the art security and 24/7 surveillance that the police department can review at
any given point. He stated that the hours of operation, pursuant to the Council's approval,
are requested to be Monday through Friday, 8:00am to 5:00pm. They will not be open on
the weekends. He stated that in conclusion, they believe any potential adverse effects are
significantly outweighed by the benefits that this will provide to the City. Procedurally,
they met with representatives of the City back in March of 2022. In June and August of
2022, they held community outreach meetings. On October 18, 2022 and October 25,
2022 they met with this Council to discuss and review the Host Community Agreement,
which was then executed on October 28, 2022. On December 15, 2022 they filed their
provisional application with the Cannabis Control Commission. They obtained that
provisional license in early February 2023, and on February 21, 2023 they filed the
Special Permit with the City. He stated that they are here to answer any questions the
Council may have. Councilor Pottier spoke to thank them for wanting to bring their
investment into the City of Taunton. He stated that he appreciates the fact that this is not
the first marijuana operation in that part of town and stated that perhaps they can learn
from each other. He inquired about what types of products they are planning to
manufacture. Mr. Jacobi stated that they are planning to manufacture a variety of
products. He stated that they will be an extract facility, where they will extract cannabis
using butayne and ultimately that creates oils and tinctures that can be used for a variety
of different cannabis products. Councilor Pottier inquired about whether they will be
making their own end products or if they will be planning to generate and then sell that
raw material to other manufacturers to further enhance the product. Mr. Jacobi said that
the benefit for them is that they will have the opportunity to sell to retail and to other
cannabis manufacturers. Councilor Pottier inquired about whether they are anticipating
any concerns with odor. Mr. Jacobi stated that typically odor comes with a large
cultivation and the process of extraction has no odor and with the fact that they will be in
a basement, they do not foresee any odor problems. He stated that they do have a plan if
by some chance there were concerns with odor to mitigate that issue. Councilor Pottier
stated that he wishes them well and thanked them again for investing in the City.
Councilor Borges stated that two weeks ago the parties had come before the Council and
the Council requested information in advance and then thanked the parties for providing
the business plan and other information the next day. She inquired about whether or not
the same person they had mentioned who is an expert in extraction will be the same
person who will be working for them today. Mr. Jacobi confirmed that individual, Jeremy
Patria, will be a part of their business plan. Councilor Borges inquired about how they
will be an active and contributing member of our community. Mr. Jacobi stated that he
and Mr. Brabant have discussed in detail their positive impact on the community but it is
a little premature to have any type of details on how they can do that. He stated that in
charitable fashion, both their time in the community and monetarily, and that they are
committed to this. Councilor Borges stated that if they need any ideas she recommends
reaching out to the Mayor's Office to see their ideas on how they can be a positive impact
on the community. She also stated that when they gave them the Host Community
Agreement, they mentioned they would have two employees, and she is wondering if
those two employees will be residents of the community. Mr. Jacobi stated that initially
the two to three employees they will have for phase one will be himself, Mr. Brabant and
Jeremy Patria. He stated that going forward their goal is to grow aggressively and at that

point to make it a goal to hire from within the City of Taunton. Councilor Borges also
inquired that they will not have to worry about any odor issues with this type of business.
Mr. Jacobi confirmed this. Councilor Coute inquired about what the plan in place is if
odor becomes a concern. Mr. Jacobi stated that there are odor mitigation systems
available, but they do not have a specific system identified. However, their commitment
would be to install that type of system within the facility to ensure there is no odor
getting out. Councilor Coute inquired what Mr. Brabant' s experience is with this type of
operation. Mr. Jacobi stated that their background is mainly recreational users with a vast
amount of experience in cultivation techniques and small batch manufacturing of
products. He stated the real expertise will come with Jeremy Patria who will be the
manager of operations. He stated Mr. Patria been in the industry for over 10 years and has
a vast amount of experience in the legal industry. Councilor Coute inquired about their
timeline if they were to be granted a Special Permit this evening. Mr. Braillard stated that
as soon as they have a Special Permit, they will have the appeal period. The day after the
appeal period they will file a building permit. When the building permit is issued they
will file their architectural review with the Cannabis Control Commission, which usually
takes about another month to obtain. He stated they are not able to start construction until
they have both the building permit and the architectural review, so they would anticipate
starting construction in about sixty (60) days. Councilor Coute inquired about how long
they anticipate the construction to take. Mr. Braillard stated about two (2) months. Mr.
Jacobi stated that the goal is to open in 2023. Councilor Sanders stated that they have not
shared enough in regards to their plan for odor mitigation and inquired about more details
of their plan. Mr. Braillard stated that there are a couple of different options. In a closed
space where there are no windows and they can't vent, they would use an enclosed
carbon filtration system, which would filter the odor in the air, and then they would
change out the cartridges on a regular basis. He stated that this is what they have seen 65-
80% of their clients do in this type of area. He stated from a financial standpoint their
business plan has finances broken down and this would be a part of their operation
expenses. Councilor Sanders wanted to confirm that if the issue of odor presents
unexpectedly, they would have ample cash in reserve to fix the issue promptly. Mr.
Braillard stated that if the odor concern presented and it was determined to be coming
from Lunar Xtracts, they would handle it in a time that is manageable and reasonable for
the Council. Councilor Sanders asked for specification as to what type of products they
will be manufacturing. Mr. Jacobi stated that the extraction process they are going to
perform typically is used to produce specific concentrates and oils. There are only a few
kinds of them, such as oils, distillates, shatters and batters. He stated these products are
used to create other products that are typically purchased in retail stores, such as edibles
and vape cards. He stated that those are the products they will be producing oils and
concentrates for. Councilor Sanders stated they will only be working with the oils and
concentrates and then manufacturers will buy that from them and those manufacturers
will be the ones produce items such as edibles, hand creams and vape cartridges. He
inquired about whether or not they will be producing any retail products. Mr. Jacobi
stated they will be manufacturing retail products that are oil and concentrate based. Mr.
Jacobi stated that within their business plan there is a three phase approach to this project.
At some point, they would expand to making all of the products that were mentioned.
Councilor Sanders stated there are many stories of young children getting into their
parents products and therefore has concerns about packaging of certain items to be clear
they are not for kids, such as gummies. Mr. Jacobi stated that the Cannabis Control
Commission does have strict rules and regulations in regards to packaging and they

would adhere to those. Councilor Coute inquired as to whether they would have an issue
if a condition of the Special Permit was to install the odor control system up front. Mr.
Jacobi stated they would not have an issue, however, he does have a concern. He stated
that they do understand ifthere is an odor concern that it needs to be mitigated, however,
these extraction labs generally do not have an odor. Councilor Coute stated that he does
not have much knowledge on the extractions labs, however, they have had many
discussions with cultivators, manufacturers and retailers and odor is always discussed.
They have made many applicants install the odor mitigation on the front end. Mr. Brabant
inquired about whether or not they have done this for other manufacturers. Councilor
Coute stated that he will need to look this up. Mr. Braillard stated that they would not
have a problem with a condition that in the event there is an odor issue, they would
address it within a certain amount of time and that the Police Department or Building
Department could enforce that. Councilor Coute also wanted to confirm if their company
would be selling retail directly or through a third party. Mr. Jacobi stated they will be
selling wholesale to retail. Motion was made to open public input. So Voted. No one
spoke during public input. Motion was made to close public input and grant the
Special Permit with the condition to address odor control if an issue is reported
within sixty (60) days. On discussion, Councilor Coute stated they would want to have
the condition to address odor control if an issue is reported within ninety (90) days or the
Special Permit is revoked. Mayor O'Connell inquired about whether or not there would
be an inspection by the Board of Health to verify the issue or if it would be based off
concerns from neighbors. Councilor Coute stated that it is typically neighbors who make
these complaints and that is when the Council typically hears about it. Attorney Costa
stated there would be a condition to address and it would be upon a verified issue with
odor. Councilor Coute suggested the condition read that the odor mitigation control is
installed within ninety (90) days of a complaint that is verified by either the Board of
Health or the Building Department. Councilor Borges agreed to this condition. She also
stated that moving forward the Council should think about making this a requirement and
this be a standard condition for every applicant. Motion was made to grant the Special
Permit with the condition that odor mitigation control is installed within ninety (90)
days of a complaint that is verified by either the Board of Health or the Building
Department. So Voted.
Communications from the Mayor:
Mayor O'Connell stated the special election for the Public Safety Facility is on Saturday,
April 29, 2023 from 8:00am to 2:00pm at your regular polling location. She stated there
is also early voting located at City Hall, which begins Monday, April 24, 2023 from
8:00am to 2:00pm, Tuesday, April 25, 2023 from 8:00am to 7:00pm, and Wednesday,
April 26, 2023 from 8:00am to 2:00pm. She stated there will be another public safety info
session at the Baptist Church of All Nations on Monday, April 24, 2023 at 6:00pm. The
public is invited and encouraged to attend. For Portuguese speaking residents, they can
tune into the Portuguese channel, which is channel 93 on Comcast on Monday, April 24,
2023 at 6:00pm. She thanked Councilor Borges, Lieutenant John Nunes, Taunton Fire
Department and Greg DeMelo, School Committee Member, for helping to host this. She
stated the 32nd annual Earth Day will be Saturday, April 22, 2023 and there will be a
citywide cleanup.

Appointments:
Reappointment of Manuel Spencer, Jr., 80 Avalon Drive, Taunton to the Taunton
Redevelopment Authority for a term of five (5) years expiring in February 2028. Motion
was made to approve. So Voted.
Communications (rom City Officers:
Com. from the Fire Chief stating the conditions of employment to the Taunton Fire
Department offered to Marc Charbonneau, Stephen Hutchins and Andrew Trainor have
all been met. They have passed their pre-academy physicals, psychological evaluations
and state mandated PAT. These three (3) individuals are due to start their academy
training in the City of Fall River on Monday, April 24, 2023. He requests that they are
appointed as full time members of the Department before that date. Once they have
completed their recruit training and received the required Firefighter VII certifications, he
will bring them before the Municipal Council to be officially sworn in as members of the
Department. They are scheduled to graduate in early July. Motion was made to appoint
Marc Charbonneau, Stephen Hutchins, and Andrew Trainor. Eight (8) councilors
present, eight (8) councilors voting in favor. Councilor Postell was absent. So Voted.
Com. from the Safety Officer regarding the safe operations at the Taunton Green in
proximity of the post office, specifically pertaining to the crosswalk enforcement. There
was a report of an elderly person being almost struck by a vehicle, and not being yielded
to. Along with the traffic division, he has been monitoring the crosswalk near the post
office, along with the rest of the crosswalks downtown. He believes it was a distracted
driver in the case of the elderly person incident. For the most part motorists do stop for
pedestrians in the crosswalk in the downtown area. They will continue to monitor the
crosswalks downtown. Motion was made to receive and place on file. So Voted.
Com. from the Safety Officer regarding the heavy volume of trash trucks driving through
Bassett Street. Councilor Postell suggested that speed could be an issue. He monitored
traffic on several occasions at different times of the day, and only observed a few trash
trucks using Bassett Street. He did observe several trash hauling trucks enter and exit the
new development that is being built off of Bassett Street/Fremont Street. The
development may be the reason that there seems to be more trash truck traffic. He also
spoke with Waste Management, they have vehicles in Norton near the Myles Standish
Industrial Park. He asked the dispatch to notify the drivers not to use Bassett Street as a
cut through. A speed study was conducted on Bassett Street on September 7th through the
14th, 2022. The speed limit on Bassett Street is 30mph, the average speed recorded was
25mph. The unit recorded 15,705 vehicles during that week. 265 of the vehicles were
single unit trucks which include trash vehicles, delivery vehicles and construction
vehicles. The average speed of the truck was 24mph. He believes that the trash truck
traffic will decrease when the new development is finished. Motion was made to receive
and place on file. So Voted.
Com. from the City Solicitor regarding a storm water runoff issue on Seekell Street that is
impacting the residential property at 616 Seekell Street. The resolution that has been
identified is for the City to acquire an easement within which it will install a drainage line
to redirect and control the storm water from Seekell Street. An easement is an interest in
real estate that must be acquired with the consent of the Municipal Council. Motion was
made to refer to the Committee on Public Property. So Voted.

Com. from the DPW Commissioner stating that on March 28, 2023 additional interviews
were completed for the Superintendent of Buildings COTMA position. He is pleased to
provide you with the recommendations from the hiring committee to move candidate
Christopher Carmichael forward to the DPW sub-committee for review and a potential
referral to the Council of the Whole for approval. Motion was made to Committee of
the Department of Public Works on May 2, 2023. So Voted.
Com. from the Chief Financial Officer requesting the opportunity to present the Quarter
Three Review on budgetary and capital items for the period January 1, 2023 through
March 31, 2023. The Finance team requests to appear before the Finance and Salaries
Committee to discuss this matter further on April 25, 2023. Motion was made to refer
to the Committee on Finance and Salaries. So Voted.

Walker Street that also needs to be looked at. Motion was made to refer to the Safety

Councilor Pottier motioned that for this year's budget hearings, they receive five (5)
years' worth of line items of history from the School Department, specifically
Taunton Public Schools. So Voted.
Councilor Conte motioned to refer to the Committee on Police and License for a no
truck traffic on Lothrop Street and Prospect Hill Street. So Voted.

Present were Councilor Barry Sanders, Chairman and Councilors Dooner and McCaul. Also
present were Attorney Peter Winters and Detective William Rutherford.
The meeting was called to order at 5:47 PM.
1. Meet to discuss the feasibility of establishing buffer zones for temporary and transient
vendors selling similar products to those sold by brick-and-mortar establishments.
Attorney Winters and Detective Rutherford gave some insight on the issue. Detective
Rutherford suggested that since these vendors are often set up on private property he is not sure
what can be done but that many do go through the Planning Board for a Special Permit. He
stated that most temporary fixed vendors are food trucks and most are within 500 feet of another
food establishment and that it would be hard to enforce without putting people out of business.
Attorney Winters indicated that in his research he saw that New Bedford has some regulations
for food trucks but presumed that this is for trucks on the street.
Councilor Dooner asked ifthere could be legal ramifications for trying to do this and Attorney
Winters suggested that enforcement would be difficult. The Police Department would have to go
out with tape measures. Councilor Dooner indicated that she is not sure there is a need for this.
Councilor McCaul recalled that there was a situation where a flower shop had a flower vendor
selling nearby and this was very controversial.
Councilor Sanders stated that brick and mortar businesses have more expense and overhead.
Councilor Borges indicated that she can appreciate businesses who have a problem with these
types of vendors. Brick and mortar businesses pay taxes and donate to the community.
Attorney Winters suggested that there could be restrictions put on licenses. Detective Rutherford
stated that the easiest solution would be to not give temporary fixed vendor licenses.
Councilor Dooner stated that she would prefer to look at this on a case by case basis and evaluate
them as they come before the Council.

Councilor Coute stated that he believes in free enterprise and that the best product for the best
price gets the business and this is ultimately best for the consumer.
Councilor Sanders asked ifthe licensing comes to the Police and License Committee and
Attorney Winters confirmed. He also indicated that some of those that require planning board
approval so do have abutter notifications as part of that process. Mr. Sanders asked if this could

The meeting was called to order at 6:11 PM.
1. Meet to discuss the Taunton Area Vietnam Veterans Association sign and its placement.
Councilor Quintal discussed the best place for the sign and indicated it was determined to be by
Harbor Freights. He explained that a sign has been made that reads "Welcome to Taunton, a
Proud Veterans Community". The sign will be placed near the Entering Taunton sign. After
consulting with the veterans in attendance, Councilor Quintal suggested that the date for
dedication should be Saturday, May 13 at 11 :00 AM.
Councilor Dooner gave her thanks to the veterans and to Councilor Quintal for his work on this.
Councilor McCaul also expressed his thanks and asked ifthe Space Force would be included on
the sign. Councilor Quintal indicated that it will be added eventually.
Karen Pemberton stated that this sign will be a wonderful addition as you drive into Taunton.
Councilor Borges welcomed the new Veterans Agent Ally Rodriguez.
Councilor Quintal confirmed that the dedication date would be Saturday, May 13 at 11 :00 and
people should assemble at the parking lot of Harbor Freight.
MOTION: Approve. So voted.

the road cut in advance of the conclusion of the moratorium but laid out some stipulations.

The conditions of employment to the Taunton Fire Department offered to Marc Charbonneau,
Stephen Hutchins, and Andrew Trainor have all been met. They have passed their pre-academy
physicals, psychological evaluations and State mandated PAT. These 3 individuals are due to
start their academy training in The City of Fall River on Monday April 24, 2023. I ask that you
appoint them as full time members of the Department before that date. Once they have
completed their recruit training and received the required Firefighter I/II certifications, I will
bring them before the Municipal Council to be officially sworn in as members of the
Department. They are scheduled to graduate in early July.

At the March 7ili, 2023 meeting of the Municipal Council a motion was made to refer to
the Safety Officer concerning the safe operations at the Taunton Green in proximity of
the post office, specifically pertaining to the crosswalk enforcement. There was a report
of an elderly person being almost struck by a vehicle, and not being yielded to.
I along with the traffic division have been monitoring the crosswalk near the post office,
along with the rest of the crosswalks downtown. I believe it was a distracted driver in the
case of the elderly person incident.Forthemostpartmotorists do stop for the pedestrians
in the crosswalk in the downtown area. We will continue to monitor the crosswalks
downtown.

At the February 28th meeting of the Municipal Council, a motion was made to refer to the
Safety Officer about the heavy volume of trash trucks driving through Bassett Street.
Councilor Postell suggested that speed could be an issue.
I monitored traffic on several occasions at different times of the day, and only observed a
few trash trucks using Bassett Street. I did observe several trash hauling trucks enter and
exit the new development that is being built off of Bassett Street I Freemont Street. The
development may be the reason that there seems to be more trash truck traffic. I also
spoke with Waste Management, they have vehicles in Norton near the Myles Standish
Industrial park. I asked the dispatch to notify the drives not to use Bassett Street as a cut
through.

The Speed limit on Bassett is 30 MPH, the average speed recorded was 25 MPH. The
unit recorded 15,705 vehicles during that week. 265 of the vehicles were single unit
trucks witch include trash vehicles, delivery vehicles, and construction vehicles. The
average speed of the truck traffic was 24 MPH. I believe that the trash truck traffic will
decrease when the new development is finished

Re: Potential acquisition of drainage easement at 616 Seekell Street
Dear Mayor O'Connell, Council President Dooner and Members of the Municipal Council :
The Law Department has been in discussions with the City Engineer and Department of
Public Works personnel about addressing a storm water runoff issue on Seekell Street that is
impacting the residential property at 616 Seekell Street.
The resolution that has been identified is for the City to acquire an easement within which
it will install a drainage line to redirect and control the storm water from Seekell Street.
An easement is an interest in real estate that must be acquired with the consent of the
Municipal Council.
For the above reasons, the Law Department is respectfully requesting that this matter be
referred to the Committee on Public Property to review the potential acquisition of an easement
as to 616 Seekell Street to address storm water run-off from the Seekell Street public way.

My name is Sarah Viveiros and I am writing to request the installation of sidewalks on
Burt Street. I'm not sure if you're familiar with Burt Street or not, but because it is a cut
through from Route 44 to Tremont Street, it is a very dangerous road. People habitually
speed on this narrow street, it has a disproportionately high number of accidents, and
during my only 6 years living here: a car drove through our wooden fence, a teenage girl
struck a tree and burned to death and just last month a truck demolished our mailbox.
My neighbors who have lived here longer have shared similar stories and say this is a
long-term issue. According to the MassDOT site, there have already been 7 accidents
on Burt Street this year alone, and it is only early April.
On a personal note, I am the mother to a 10-month old baby who loves being outside,
but I am genuinely afraid to bring him for walks near our home because I have been
nearly struck when attempting to do so, sadly more than once. I am able and willing to
help in any way possible.
Please help prevent future tragedies by installing sidewalks along Burt Street, thank
you for your time.
