Opportunity for input by the general public.
Scott Martin, 31 Cardinal Circle, East Taunton, spoke about the letter carrier food drive
coming up on Saturday, May 13, 2023, which is the 31st annual food drive. John Mayer,
introduced himself as a postmaster in Taunton. Mr. Martin stated that all of the food they
collect goes to St. Vincent de Paul in Taunton. He stated that residents should leave the
food donations at their mail boxes by 9:00am as there may be other volunteers picking it
up other than the mail carriers. The typical items that people donate are rice, cereal, pasta,
canned vegetables. He asked that no glass items are left out so they do not shatter when
the carriers are picking them up. He would like to thank Morton Hospital for their support
of the food drive as they are sponsoring the event again this year. Residents will find their
bags in their mail boxes. He also thanked St. Vincent de Paul for their distribution of the
food. He stated that Fr. Fred of St. Anthony's Church will be allowing them to use the
hall this year to break the food down. He stated this year they will be having the Boy
Scout Troop 2~2 out of East Taunton to volunteer, as well as the Taunton Youth
Commission. H~ stated the Taunton High School Audio Visual Program did a commercial
for them which should be out soon. Mr. Mayer stated that the letter carriers do a great job
with this event and that all of the food stays here in Taunton in order to help the residents
of Taunton. He stated that last year, thirty thousand pounds (30,000 lbs) of food was
given to the food bank. He stated they are looking for any local publicity to make this a
bigger event to help the City of Taunton. Councilor Pottier stated they are welcome to
send information on the event to the City Clerk for next week's agenda in order to get
more publicity.

Upon the petition submitted by Taunton Municipal Lighting Plant and Verizon New
England, Inc. proposing to relocate multiple jointly owned poles - 69, 70, 73, 74 and to
place a new push brace at pole 75, starting at 257 Scaddings Street in the City of Taunton.
Motion was made to open the hearing and invite any interested parties in. So Voted.
Ross Bilideau introduced himself as the representative for Verizon New England, Inc. He
stated that Verizon is a maintaining party on this side of Taunton and that is why Verizon
is setting these poles and not T.M.L.P. He stated that they are setting them to allow for the
construction of the Mass D.O.T. project for the Scaddings Street bridge. He stated that
they have worked with T.M.L.P. and Mass D.O.T. and their designers to come up with
these pole moves. He stated that the new poles are going to have conduits off of them to
run through the bridge. He stated that the poles on each side of the bridge will have risers
to get the cables back out. Councilor Postell inquired if this would be in relation to the
proposed construction that is slated to take place at that location or if it will impact any
future growth or development of that bridge. Mr. Bilideau confirmed that these pole
moves are for that project. Motion was made to open the hearing for public input. So
Voted. Mike Comaglia, 255 Scaddings Street, stated he has been a resident on Scaddings
Street for thirty-five (35) years. He stated that he owns the lot where pole 69 and 70 are
located, down to pole 73. He described that his lot extends all the way down to the
bridge. He stated that 260 Scaddings Street is owned by someone else, but he owns to the
comer of their driveway, and then going forward. He stated his concern is that they will
be building a house on the lot that is to the right of 260 Scaddings Street, leading up to
the bridge. He stated that this land has already been surveyed and there are wetland
issues. He stated that he does not have a problem with them moving poles but is
concerned that he has not heard any information on the bridge and is concerned that they
will be blocked in when they put in the safety barriers. He stated that he has called the
D.O.T. in Taunton two or three times and has not gotten a response. He stated that if the
poles are moved back about thirteen (13) feet, they will be cutting down a pristine cedar
tree, which is one of the only trees that are left in that condition on Scaddings Street. He
stated that it is located in the center of the lot in which he will be building on. He stated
that they do not want to lose the tree, and they would also like to have enough room for a
driveway and some frontage. He is requesting that someone come out to walk the
property to discuss this so they can come to a common ground where everyone can be
happy. Motion was made to close public input. So Voted. Councilor Dooner inquired if
Mr. Bilideau had any information on Mr. Comaglia's tree. He stated that he did not have
any information and that Mass D.O.T. does dictate where the poles need to be placed. He
stated as they review these projects, they have a walk through and have had a meeting out
there and then it goes from there. He stated this project has been in the works for a while
and that he did not have any other information. Councilor Borges stated that she would be
comfortable tabling this matter for this evening as she feels the residents have legitimate
concerns. She stated the Council does not have any letter and they have not even seen the
project. She is not comfortable voting to relocate poles and take down trees and interfere
with someone's lot at this point in time until she hears from Mass D.O.T. She stated that
she will be calling tomorrow to find out more about this project. She feels the matter
should be tabled this evening until the Council gets more information. Councilor Postell
spoke about how he also lives in this area and there has been little to no conversation
regarding the status of that project, which is why he asked earlier if this was for that
project. He stated that now knowing the impact this will be having on residents, granted
something does need to be done with the bridge, but because there is a formula that needs
to be followed, he is in support of tabling this until we have more information, as well as

a clearer and concise understanding of what the project will entail and the impact it will
have on people and their property. Councilor Sanders stated that he would recommend an
amendment to the motion to include a referral to the Law Department and the Mayor's
Office to inquire of Mass D.O.T. and Verizon about the concerns that were raised,
specifically the impacts on wetlands, the mentioned tree, and access to the lot for the
property owner. Councilor Quintal expressed gratitude to the residents for being here and
willing to work with this project. He stated that he does have the same concerns as the
other Councilors. He thanked Councilor Borges for doing her research on this project and
that the right Councilor is looking into this to help the residents and to get this project
moving forward. Councilor Pottier stated that he would like to be marked present on this
vote. Motion was made to continue the hearing and to refer to the Law Department
and the Mayor's Office. So Voted.
Communications from the Mayor:
Council President Dooner stated that today is Freedom Day, which is an annual
celebration of the Carnation Revolution, which was a Portuguese Peaceful Military Coup
in 1974 that ended dictatorship in Portugal and brought democracy to their country. As a
result, women were allowed to vote for the first time in 1975, freedom of speech was
granted to Portugal, they had a modem constitution adopted in 1976, and it was the end
of the Portuguese Colonial War in Africa. On this day, we honor the Association of the
Portuguese Armed Forces Movement for their sacrifice for freedom and democracy in
their country. Council President Dooner stated that Mayor O'Connell wanted to thank
everyone who attended the 32nd annual citywide cleanup this past Saturday in recognition
of Earth Day. Council President Dooner stated that the Special Election will be this
Saturday, April 29, 2023 at your regular voting precinct. There is still early voting, which
started this week, and the last day to vote early will be Wednesday, April 26, 2023 from
8:00am to 2:00pm at City Hall. Council President Dooner stated that the Taunton summer
camp expo will be on Thursday, April 27, 2023 at the E. Pole School gym from 5:00pm
to 7:00pm. There will be an Annual City Nature Challenge which will be held this
Saturday, April 29, 2023 from 11 :OOam to 12:30pm at Boyden Wildlife Refuge. This is a
competition going on across the state and the goal of the event is to identify different
species.
Appointments:
Reappointment of Anne Alexander to serve on the Taunton Cultural Council for a term of
three (3) years expiring in October 2025. Motion was made to approve. So Voted.
Reappointment of Patricia Francis to serve on the Taunton Cultural Council for a term of
three (3) years expiring in October 2025. Motion was made to approve. So Voted.
Communications from City Officers:
Com. from the Chief of Police to notify of the resignation of the Patrolman Marc
Charbonneau from the Taunton Police Department. Patrolman Charbonneau was recently
appointed to the Taunton Fire Department. His effective date for resignation is April 23,
2023. Motion was made to receive and place on file. So Voted.
Com. from the First Assistant City Solicitor submitting an amended Host Community
Agreement for Commonwealth Alternative Care for review and approval. The Mayor has
reached an agreement with Commonwealth Alternative Care that maintains the current

HCA payment until such time that as the Cannabis Control Commission promulgates new
regulations that give guidance under the updates to the marijuana law. This agreement
will provide predictability for both parties until such time as there is more concrete
direction. Motion was made to refer to the Committee of the Council as a Whole. So
Voted. On discussion, Councilor Postell requested that if it is appropriate to the City
Solicitor, that what has been modified is highlighted. The City Solicitor stated he is not
sure that would be possible to do within the amendment, but that they can highlight better
on the cover letter as to specifically what sections have been amended.
Com. from the City Solicitor submitting a Comcast change in services dated April 3,
2023. Motion was made to receive and place on file. So Voted.
Com. from the Election Director for the appointment of 2023 Poll Workers. (SEP ARATE
PACKET). The polling locations and work assignments shown in the attachment is for
the April 29, 2023 election and does not necessarily represent permanent placement to be
used for future elections. Motion was made to approve. So Voted.
Com. from Senator Marc R. Pacheco regarding the reuse of the Taunton Nursing Home
for possible veterans housing/assisted living. The last legislature passed a bond bill that
authorized the issuance of $200 million in bonds to increase geographic equity and
accessibility related to the continuum of veterans housing across the state. Southeastern
Massachusetts, our region and that of the Cape and Islands happen to be the most in need
of veterans housing. He had a preliminary conversation with Secretary of Veterans'
Services Jon Santiago relative to the development of veterans housing in Southeastern
Massachusetts at the Taunton Nursing Home site, he has expressed interest in further
conversation on the matter if there is support and interest from the City's elected leaders.
The veteran's housing could be developed in a way that would provide critically needed
housing/wrap around services to veterans in Southeastern Massachusetts. Should the City
be interested in pursuing a dialogue on this issue, he would be happy to arrange a meeting
with Secretary Santiago to discuss this concept. He believes it is important for the City to
be aware that in many instances, the reimbursement rate in the development/construction
federal veterans housing units can be well over 60%. Whether it would be state owned
and operated or a public private partnership working with the Commonwealth in
financing the facility, all are options to be discussed with the Secretary in meeting the
needs of our veteran's community. Motion was made to refer the Committee on Public
Property, the Committee on Military and Veterans Affairs, and the Mayor's Office.

Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1. Chapter 40 of the Revised Ordinances of the City of Taunton, as amended,
is hereby further amended by adding a new section 5.3 to Article VIII, as follows:--
5.3 School Department
5.3.l Fund Name. There shall be a separate fund called the Maintenance and
Supplies Revolving Fund for the use of the School Department.
5.3 .2 Revenues. The City Auditor shall establish the Maintenance and Supplies
Revolving Fund as a separate account and credit to the fund eighty (80%)
percent of the sale proceeds from the sale of surplus School Department
items, equipment, goods and inventory. The remaining twenty (20%)
percent shall be deposited into the City of Taunton miscellaneous non-
recurring revenue account.
5.3.3 Purposes and Expenditures. During each fiscal year, the School
Department may incur liabilities against and spend monies from the
Maintenance and Supplies Revolving Fund for expenses of school
maintenance. Salaries or wages of employees shall not be paid from the
fund.
5.3.4 Reports. Within 10 days of the end of each quarter of the fiscal year, the
Superintendent of Schools, or the Superintendent's designee, must provide
the School Committee and the City Auditor with a report of the revenues
and expenditures of the Maintenance and Supplies Revolving Fund during
the month and fiscal year to date.
5.3.5 Fiscal Years. The Maintenance and Supplies Revolving Fund shall operate
for fiscal years that begin on or after July 1, 2023.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

Fund as a separate account and credit all sums received from Lake
Sabbatia parking lot revenue to said account.
5.4.3 Purposes and Expenditures. During each fiscal year, the City may incur
liabilities against and spend monies from the Lake Sabbatia Revolving
Fund for expenses related to the maintenance, improvement and Lake
Sabbatia initiatives as approved by the Mayor or Mayor's designee.
Salaries or wages of employees shall not be paid from the fund.
5.4.4 Reports. Within 10 days of the end of each quarter of the fiscal year, the
Mayor, or the Mayor's designee, must provide the City Council and the
City Auditor with a report of the revenues and expenditures of the Lake
Sabbatia Revolving Fund during the month and fiscal year to date.
5.4.5 Fiscal Years. The Lake Sabbatia Revolving Fund shall operate for fiscal
years that begin on or after July 1, 2023.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

New Business:
Council Pottier stated that it has been brought to his attention there is a culvert on both
sides of Middleboro Avenue near Holy Family Church that the safety fencing is in
disrepair and is a safety issue. Motion was made to refer to the Department of Public
Works. So Voted.

Present were Councilor Phillip Duarte, Chairman and Councilors Pottier and McCaul. Also
present were CFO Patrick Della Russo and Budget Director Gill Enos.
The meeting was called to order at 6: 15 PM.
1. Meet to review the weekly vouchers and payroll for City departments.
MOTION by Mr. Pottier and seconded by Mr. McCaul to approve the payroll warrant in the
amount o/$1,363,486.15. So voted.
MOTION by Mr. Pottier and seconded by Mr. McCaul to approve the accounts payable warrant
in the amount o/$2,400,277. 75. So voted.
2. Meet with the CFO and Budget Director for the Q3 quarterly financial update.
Mr. Della Russo gave a brief presentation highlighting the City's :financial position as of the
completion of Q3. He noted that ARPA will be broken out into its own update going forward.
He showed that for the Capital hnprovement Plan, $18.8 Million has been encumbered to date.
Road work began on April 18. On revenue, he noted that real estate tax is at 75% collected
which he believes to be a reflection of the strength of local real estate. General government was
at 73% spent and 2% under budget. Public safety at 68% spent and encumbered equating to
$27.6 Million in outlay through Q3. Public Works is at 64% expended through Q3 and Mr.
Della Russo expects that the snow removal cost will be lower once purchase orders are
liquidated. Health and Human Services and Culture and Recreation is at 67% of budget or $4.5
Million. On fixed costs, he noted that health insurance and pensions are key drivers and that he
anticipates a slight turnback. The team plans to close the books by 7/15. He further reported that
a discretionary spending freeze was put in place as of 4/1/23. Overall, $111 Million has been
spent inclusive of enterprise funds.
Councilor Pottier asked if marijuana revenue is broken out separately and Mr. El}.os indicated
that it is included in miscellaneous revenue. Mr. Pottier asked about public safety overtime and
Mr. Enos indicated that it is running in line with similar years. Mr. Pottier suggested he would
like to see water and sewer broken out.

MOTION by Mr. McCaul and seconded by Mr. Pottier to make the presentation part of the
record. So voted.
Councilor Duarte asked how much would be going into retained earnings for the water and sewer
enterprise accounts. Mr. Dello Russo indicated that it is too soon to say.
MOTION by Mr. Pottier and seconded by Mr. McCaul to adjourn the meeting at 6:33 PM So
voted.

The meeting was held at Taunton City Hall, 15 Summer Street, TffiiiitoiiJviA 02780 in the
Chester R. Martin Municipal Council Chambers.
Present were Council President Kelly Dooner, Chairman and Councilors Duarte, Borges,
McCaul, Pottier, Sanders, Quintal, and Postell. Councilor Coute was absent. Also present was
John Desouza of North County Group.
The meeting was called to order at 6:36 PM.
1. Meet for a pre-review on the issuance of a Special Permit upon the petition of Denise
Asack, 96 Sachem Rock Ave., East Bridgewater, MA to allow a modification of an
existing application for a Special Permit for a group home to a mixed use building
consisting of 36 residential units and 1,938 sq. ft. of commercial space with a 9 unit
density bonus and a waiver of parking from 42spacesto11 spaces at 74 Weir Street
located in the Central Business District.
Council President Dooner explained that this is just a pre-review hearing for the Council to ask
questions and that the applicant would return for a further discussion. She indicated that she
would be interested in learning more about the number of ADA accessible units, the cost, and
who would qualify for these units.
Councilor Pottier expressed interest in parking and a schedule of construction.
Councilor Borges indicated that she will be looking for details on the funding process, timelines,
total project cost, how long it will take, if there will be management on site, security, the number
of units, the number of bedrooms, if there is a community space, potential tenants for the
commercial spaces, and if the client is in agreement with the comments from the department
heads.
Councilor Sanders stated that he would be interested in learning if there is any work being done
towards sustainability or environmental work such as low flow showers, toilets, etc.
Councilor Postell would like more information on fire egress from the building since he only
sees one and any information on concerns with the land.
Councilor Quintal stated that he likes what he's seen so far.

Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1. Chapter 40 of the Revised Ordinances of the City of Taunton, as amended,
is hereby further amended by adding a new section 5.3 to Article VIII, as follows:--
5.3 School Department
5.3.1 Fund Name. There shall be a separate fund called the Maintenance and
Supplies Revolving Fund for the use of the School Department.
5.3.2 Revenues. The City Auditor shall establish the Maintenance and Supplies
Revolving Fund as a separate account and credit to the fund eighty (80%)
percent of the sale proceeds from the sale of surplus School Department
items, equipment, goods and inventory. The remaining twenty (20%)
percent shall be deposited into the City of Taunton miscellaneous non-
recurring revenue account.
5.3.3 Purposes and Expenditures. During each fiscal year, the School
Department may incur liabilities against and spend monies from the
Maintenance and Supplies Revolving Fund for expenses of school
maintenance. Salaries or wages of employees shall not be paid from the
fund.
5.3.4 Reports. Within 10 days of the end of each quarter of the fiscal year, the
Superintendent of Schools, or the Superintendent's designee, must provide
the School Committee and the City Auditor with a report of the revenues
and expenditures of the Maintenance and Supplies Revolving Fund during
the month and fiscal year to date.
5.3.5 Fiscal Years. The Maintenance and Supplies Revolving Fund shall operate
for fiscal years that begin on or after July 1, 2023.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

Fund as a separate account and credit all sums received from Lake
Sabbatia parking lot revenue to said account.
5.4.3 Purposes and Expenditures. During each fiscal year, the City may incur
liabilities against and spend monies from the Lake Sabbatia Revolving
Fund for expenses related to the maintenance, improvement and Lake
Sabbatia initiatives as approved by the Mayor or Mayor's designee.
Salaries or wages of employees shall not be paid from the fund.
5.4.4 Reports. Within 10 days of the end of each quarter of the fiscal year, the
Mayor, or the Mayor's designee, must provide the City Council and the
City Auditor with a report of the revenues and expenditures of the Lake
Sabbatia Revolving Fund during the month and fiscal year to date.
5.4.5 Fiscal Years. The Lake Sabbatia Revolving Fund shall operate for fiscal
years that begin on or after July 1, 2023.

SECOND AMENDMENT TO COMMONWEALTH ALTERNATIVE CARE, INC.'S HOST
COMMUNITY AGREEMENT FOR THE SITING OF A MARIJUANA CULTIVATION,
PROCESSING AND DISPENSING FACILITY IN THE CITY OF TAUNTON (MEDICAL)
This Second Amendment is entered into this __ day of April, 2023 by and between
the City of Taunton acting through its Mayor and Municipal Council, with a principal
address of 15 Summer Street, Taunton, Massachusetts (the "City") and Commonwealth
Alternative Care, Inc., a Massachusetts corporation with a place of business at 16 and
30 Mozzone Boulevard, Taunton, Massachusetts (the "Company").
Whereas, the parties entered into a Host Community Agreement (the "HCA") for the
operation of a marijuana cultivation, processing and dispensing facility in the City of
Taunton dated May 11, 2018 and a First Amendment thereto on April 16, 2019, for
medicinal and therapeutic use; and
Whereas, the parties desire to extend the terms of said Agreement and First
Amendment thereto and continue the HCA.
NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged and for mutual covenants the parties agree as follows:
The terms of the HCA and First Amendment shall be amended as follows:
A. The terms of paragraph 1(b) of the original HCA dated May 11, 2018 shall be
amended to read that "The company shall pay the City a sum equal to three
percent (3%) of gross revenue from all of the company's medicinal marijuana
operations in the City for each calendar year or portion thereof the company
operates at the facility; provided however that in no event shall the payment be
less than One Hundred Twenty Five Thousand ($125,000.00) Dollars per year. In
the event that the Cannabis Control Commission promulgates new regulations
affecting the amount, percentage or calculation of HCA payments said rate shall
apply prospectively from the date of enactment and the 3% to all prior accrued
gross revenue. Furthermore, the parties agree to consent to the amendment of
this Agreement to conform the terms with any new HCA payment regulations
from the effective date thereof."
B. The annual payments for each calendar year shall be paid in 3 equal installments
on April 15, May 15 and June 15 of the following year. For examples, payments
for calendar year 2023 shall be paid April 15, 2024, May 15, 2024 and June 15,
2024.
C. If the regulations result in a modification in the calculation of the HCA payment
pursuant to paragraph A above, the company shall also produce revenue

statements for each month and indicate the HCA payment to the City for each
month.
D. This Agreement shall extend the original Agreement to June 30, 2024.
E. All other terms of the HCA dated May 11, 2018 and the First Amendment dated
April 16, 2019, to the extent not inconsistent herewith, shall remain in full force
and effect.
F. This Agreement may be modified by mutual assent, in writing at any time.
In witness whereof, the parties have hereafter set forth their hand as of the date first
above written.

Dear Mayor O'Connell and Members of the Municipal Council:
I am writing today relative to the reuse of the Taunton Nursing Home for possible veterans
housing/assisted living. As you may be aware, last session the legislature passed a bond bill that
authorized the issuance of $200 Million in bonds to increase geographic equity and accessibility
related to the continuum of veterans housing across the state.
Southeastern Massachusetts, our region and that of the Cape and Islands happen to be the most in
need of veterans housing. I have had a preliminary conversation with Secretary of Veterans'
Services Jon Santiago relative to the development of veterans housing in Southeastern
Massachusetts at the Taunton nursing home site, he has expressed interest in further conversation
on the matter if there is support and interest from the city's elected leaders. The veteran's
housing could be developed in a way that would provide critically needed housing/wrap around
services to veterans in Southeastern Massachusetts. While not replicating the Holyoke or Chelsea
Soldiers Homes, these smaller homes would provide critical housing and health care services to
veterans in Southeastern Massachusetts, the Cape, and Islands.
Should the City be interested in pursuing a dialogue on this issue, I would be happy to arrange a
meeting with Secretary Santiago to discuss this concept. I believe it is important for the City to
be aware that in many instances, the reimbursement rate in the development/construction of
federal veterans housing units can be well over 60%. For example, the federal reimbursement
rate to the Commonwealth for the construction of the new Holyoke Soldiers Home is expected to
be approximately 65%. As far as operating costs, the federal subsidies to the Commonwealth for
f o.
Holyoke are in the vicinity of 70%-75%, with other veterans programing contributing to the
bottom line. Whether it would be state owned and operated or a public private partnership
working with the Commonwealth in financing the facility, all are options to be discussed with
the Secretary in meeting the needs of our veteran's community.
I know other reuse proposals have been presented and others are yet to come, however, I wanted
to be sure the City was aware the opportunity does exist to collaborate with the Secretary of
Veterans' Services on a once in a generation opportunity. In addition, and as an option, given the
specific nature of the proposals submitted, there is always the possibility of including more than
one proposal on site.
