Communications from the Mayor: Mayor O'Connell invited the Taunton Youth Commission into the enclosure. They introduced themselves as Kaitlyn Johanson, Michaela Callahan, Condoleezza Dwuye, Laylani Silva, Officer Jayson LaPlante, an adult mentor, Stephanie Hoye, Director of Student Services and Transportation for Taunton Public Schools and an adult mentor, and Melissa Oliveira, an adult mentor. Ms. Johanson spoke about the establishment of the Commission and its purpose through a slide presentation. Mayor O'Connell spoke about the progress that the Youth Commission has made this year and expressed gratitude to the adult mentors. Councilor Dooner thanked the Youth Commission for coming in to discuss what they have accomplished. Councilor Dooner also expressed gratitude to Mayor O'Connell for revitalizing the Commission and the positive impact it has had on the community. Council Sanders stated that he is pleased to see this group come together this year. Councilor Sanders confirmed with Ms. Johanson that the schools involved in the Youth Commission are Taunton High School, Bristol-Plymouth Regional Technical High School and Taunton Alternative High School. Councilor Sanders inquired if there would be consideration to include students from other school districts or students that are home- schooled. Ms. Johanson stated that they would be open to that as long as they are residents of Taunton. Councilor McCaul asked each of the students to share their experiences on the board. The students and the mentors spoke about their experiences. Mayor O'Connell stated that the last meeting of the Commission will be this Thursday, June 8, 2023 at 6:00pm. 2 Motion was made to recess at 7:23pm. So Voted. Motion was made to return to the regular order of business at 7:26pm. So Voted. Mayor O'Connell congratulated all of the high school seniors that graduated this past weekend from Taunton High School, Taunton Alternative High School, Bristol-Plymouth Regional Technical High School and Bristol County Agricultural High School. Mayor O'Connell stated that the Whittenton Mural Reveal will be on Thursday, June 8, 2023 from 5:00pm to 8:00pm at the Broken Chains Biker Church located at 370 Bay Street, Taunton. The mural was created by Ryan Jones and the event will be hosted by the Whittenton Community Partnership. Mayor O'Connell stated that Saturday, June 10, 2023 is the Day of Portugal. There will be a Flag Raising Ceremony at City Hall at 12:00pm. There will be refreshments and other festivities. Mayor O'Connell stated that the Taunton Rotary Club will be having a Family Fun Day on Saturday, June 10, 2023. There will be a Pride South Coast Festival on Saturday, June 10, 2023. There will be a Taunton Weir Village Festival on Sunday, June 11, 2023. The City's website and Facebook page has all of the information on these activities. Appointments: NONE. Communications from City Officers: Com. from the City Solicitor responding to a request for information from the Council concerning community events at the airport. The Law Department is not aware of any legal restriction preventing community events from occurring at the Airport. Motion was made to receive and place on file. So Voted. Com. from the Chairman of the License Commission stating that in order to allow businesses that have a Common Victualler License and hold a wine and malt beverage license under M.G.L. Chapter 138, Section 12 and to give the option to new applicants to apply for a license to be given permission to sell cordials and liqueurs in addition to wine and malt beverages, The Board of License Commissioners is requesting the adoption of M.G.L. Chapter 138, Section 12. Motion was made to refer to the Committee on Police and License and the Police Chief. So Voted. Com. from the Chief of Police requesting a certification for five (5) police officers from the new list that will be established on July 1, 2023. Motion was made to move approval. So Voted. Com. from Jared Homer, Guidance Counselor, Taunton High School expressing gratitude to the Human Resources Department for participating in their 2023 Career Exploration Fair on May 18, 2023. Motion was made to receive and place on file. So Voted. On discussion, Mayor O'Connell stated that Amy Kazlauskas, the Human Resources Director, collaborated with the 1144 union, the Parks and Recreation Department, and the 3 Department of Public Works for this event. She stated that this is something they will be doing on a regular basis. Com. from the Water Superintendent requesting that the City Council vote to enact a non-essential water use restriction, per the requirements of Taunton's most recently issued Water Management Act permit. There restrictions are to be in effect between the hours of 9:00am to 5:00pm, seven days per week, and will expire on September 30, 2023. Non-essential outdoor water uses that are subject to mandatory restrictions include (from the WMA permit) the irrigation of lawns via sprinklers or automatic irrigation systems (watering by means of hand-held hoses is permitted); filling swimming pools; washing of vehicles, except in a commercial car wash or as necessary for operator safety; and washing of exterior building surfaces, parking lots, driveways or sidewalks, except as necessary to apply surface treatments such as paint, preservatives, pavement or cement. Motion was made to enact the non-essential water use restriction. So Voted. On discussion, Mayor 0' Connell stated that this is a requirement of the state. Ordinance for a third reading to be ordained on a roll call vote AN ORDINANCE Chapter 105 - Personnel Be it ordained by the Municipal Council of the City of Taunton and by authority of the same as follows: Chapter 105 of the revised Ordinances of the City of Taunton shall be amended to include a new Section as follows: Compensation of Elected and Appointed Board, Committee and Commission Members The Municipal Council shall establish the financial compensation, if any, of all elected and appointed members of committees, boards and commissions. This ordinance shall 6 not apply to salaried or hourly employees of the City. No compensation in addition to the compensation set forth herein shall be paid for serving in those positions subject to this ordinance by the City of Taunton. Any vote to increase the stipend of any committee, board or commission shall become effective on the first day of the calendar year beginning next after the following municipal election. Martin Municipal Council Chambers. Present were Council President Kelly Dooner, Chairman and Councilors Duarte, Borges, McCaul, Pottier, Coute, Sanders, and Postell. Councilor Quintal was absent. Also present were CFO Patrick Delio Russo and Budget Director Gill Enos. The meeting was called to order at 5:50 PM. 1. Meet with the Chief Financial Officer and Budget Director for the fiscal year 2024 budget hearing. Patrick Delio Russo gave a presentation with the FY24 budget. He stated that the process took 100 hours and approximately 50 meetings. He described a budget as a good faith estimate and that the Council's job is to approve or reduce the amounts being requested. Mr. Dello Russo highlighted the five year capital budget that is in place. Further FY23 accomplishments include starting the Helping Hands fund, funding the Memorial Park project, and many other accomplishments. The FY24 budget calls for an expansion in social programs, an increase in school funding, an increase in the 1144A Labor Union contract to be in line with industry standards, and no layoffs. The total budget request is $283,895,593 which includes an increase in DPW staff and added funding for PCPG. There is a 7.5% increase in revenue. · The Council took each department in turn. . 111-Municipal Council Motion by Mr. Sanders and seconded by Mr. Pottier to refer the issue offunding the Parliamentarian position and training to the supplemental budget. So voted. Motion by Mr. Pottier and seconded by Mr. Postell to take the budget under advisement. So voted. 121 - Mayor's Office Councilor Pottier asked about the staffing in the office and suggested it might be helpful to see a FTE count year over year. Councilor Sanders confirmed that the position of Deputy Chief of Staff had been replaced with an executive assistant position. 9 Motion by Ms. Borges and seconded by Mr. Pottier to take the budget for department 121 under advisement. So voted. 132 - Reserve Account Motion by Mr. Pottier and seconded by Mr. Sanders to take the budget for department 132 under advisement. So voted. 135 - Auditor Councilor Borges asked if a clerical position was added and Mr. Dello Russo indicated that there was a shift away from the Office Manager position. There was discussion on the contracted person who is paid by ARP A funds and it was stated that much of this function will be automated with the new software. Motion by Mr. Sanders and seconded by Mr. Pottier to take the budget for department 135 under advisement. So voted. 138 - Procurement Motion by Mr. Sanders and seconded by Mr. Pottier to take the budget for department 138 under advisement. So voted. 145 - Treasurer/Collector Councilor Borges questioned the increase in clerical expense and it was explained that a part time person was hired to handle the towing and detail collections. Committee of the Council as a Whole BUDGET HEARING May JO, 2023 Page2ofl2 10 151-Law Councilor Duarte questioned the posting for an additional Assistant City Solicitor and Mr. Dello Russo suggested that if they find the right candidate the position would be funded by ARPA funds or with a transfer from the reserve fund. Councilor Dooner asked if the Law Department believes that the salary for this position is adequate and Mr. Dello Russo stated that he believes it to be in line with industry standards. Councilor Borges agreed and she thought the salary on the posting was low to attract good candidates. She asked Mr. Dello Russo to explain the contract with Gay and Gay and he explained that their contract would be renegotiated in January so that funding is not included in the budget. Motion by Mr. Duarte and seconded by Ms. Borges to take the budget for department 151 under advisement. So voted. 155-IT Motion by Mr. Sanders and seconded by Mr. Postell to take the budget for department 155 under advisement and to invite the IT Director to the Committee on Economic Development and Technology to come in and talk about the new things he is doing in his department. So voted. 159 - Office Services Motion by Ms. Borges and seconded Mr. Pottier by to take the budget for department 159 under advisement. So voted. 161 - City Clerk Councilor Postell questioned the $17,000 decrease in salary of the City Clerk. Mr. Dello Russo stated that there is an agreed upon contract with the current City Clerk. Councilor Sanders questioned the clerical staffing level and Mr. Enos indicated that the office requested one less. Motion by Mr. Duarte and seconded by Mr. Postell to take the budget for department 161 under advisement. So voted. 162-Election/Registration Motion by Councilor Borges and seconded by Councilor Duarte to take the budget for department 162 under advisement. So voted. 165 - License Commission Motion by Mr. Duarte and seconded by Ms. Borges to take the budget for department 165 under advisement. So voted. So voted. 182-0ECD Councilor Duarte clarified that some salaries are funded by HUD entitlement funds. So voted. 192 - City Hall Maintenance Motion by Ms. Borges and seconded by Mr. Pottier to take the budget for department 192 under advisement. So voted. 193 - Maintenance/Tax Possession Motion by Mr. Pottier and seconded by Mr. Postell to take the budget for department 193 under advisement. So voted. 196 - Environmental Coordinator Motion by Mr. McCaul and seconded by Mr. Postell to take the budget for department 196 under advisement. So voted. 197 - Parking Commission Motion by Ms. Borges and seconded by Mr. Pottier to take the budget for department 197 under advisement. So voted. 210-Police Mr. Dello Russo stated that the Police budget includes 2 new police officers and increases in expenses for training initiatives. Councilor Postell clarified that these two new police officers are new positions and not backfilling open, existing positions. Councilor Sanders questioned the overtime and wondered if there is a plan to shift some of the overtime to the new positions. His concern is not just for money reasons, but for the health and well-being of the officers. Mr. Dello Russo indicated that the additional officers might help to offset overtime but that hiring is difficult. Councilor Dooner expressed her thanks for the hiring of the clinician. Councilor Pottier suggested that FTE counts over several years would be helpful. Councilor Borges questioned the decrease in the educational incentive and Mr. Dello Russo stated that there aren't as many advanced degrees. Ms. Borges also agreed that the hiring of the social worker was great. Councilor Duarte questioned the increase in miscellaneous services and it was clarified that this is all contracts and mostly technology related. There was discussion on upcoming retirements and he stated that the concern is getting qualified candidates and getting seats in the academy. Motion by Mr. Duarte and seconded by Mr. Postell to take the budget for department 210 under advisement. So voted. 220-Fire Mr. Dello Russo highlighted that there are two major building improvements in the works. Councilor Sanders indicated that his concerns with overtime are the same as his concerns with the police overtime. Councilor Borges asked if the Chiefs vehicle would be referred to the supplemental budget and Mr. Enos indicated that it would go through the capital process. There was discussion on new apparatus that is on order. Councilor Postell noted that there has been a significant investment in public safety put forth. With the new public safety building there will be a chance to shift focus to outlying buildings. Motion by Ms. Borges and seconded by Mr. Postell to take the budget for department 220 under advisement. So voted. 244 - Sealer Weights & Measures Motion by Mr. Duarte and seconded by Mr. Postell to take the budget for department 244 under advisement. So voted. 291-TEMA Councilor Sanders expressed his concern with the decision to eliminate the position of Assistant Director. Motion by Mr. Sanders and seconded by Ms. Borges to refer filling the position of the Assistant Director to the supplemental budget. Mr. Dello Russo suggested that the new director should be hired and allowed to determine the best needs for the department. Councilor Postell stated that this is a very important agency for the City and having one person responsible for that department makes it a very stressful situation. However, he agrees that the new director should assess the position. Councilor Sanders suggested that having the money in place sends a message that we value this department. Councilor Duarte indicated that it could take the new person months to decide. So voted. Motion by Mr. Duarte and seconded by Ms. Borges to take the budget of department 291 under advisement. So voted. 390 - Bristol Plymouth Technical High School Mr. Dello Russo suggested that there is no Taunton representative on the BP Building Committee with public construction experience. Councilor Borges indicated that Louis Borges and Bob Pirozzi are on the building committee. Councilor Coute stated that he would support the CFO being on the committee. Councilor Dooner stated that the more representation from Taunton, the better. Mr. Coute indicated that he can't imagine what the argument against that would be .. Motion by Mr. Sanders and seconded by Ms. Borges to take the budget for department 390 under advisement. So voted. 399 - Taunton Public Schools Mr. Dello Russo stated that the Mayor is committed to meeting net school spending requirements. He suggested that a net school spending stabiliziation account may be needed in the future. Councilor Pottier asked if this number is 100% and Mr. Della Russo indicated that yes but they need to wait for the state's numbers. Councilor Sanders asked if this number is different from the request of the superintendent and there was discussion on indirect costs. Councilor Coute expressed thanks to the administration for working to get to I 00% of net school spending. So voted. 410 - Engineering Councilor Borges questioned the GIS specialist position and Mr. Dello Russo indicated that this position was reclassified and should reduce consultant costs. Motion by Mr. Duarte and seconded by Ms. Borges to take the budget for department 410 under advisement. So voted. 421 - Oil and Road Construction Motion by Mr. McCaul and seconded by Ms. Borges to take the budget for department 421 under advisement. So voted. 422 - Streets and Ways Mr. Dello Russo indicated that a new position is carried in this budget. Detective Rutherford stated that outside operations have ceased and that they have met the criteria of the Police Department. Mr. Scanlon that the plan was to go to the Planning Board and they filed on February 7. However, after starting to review, it was realized that more information was needed. This was continued to March and then to April and then to May and most recently to the August Planning Board meeting. The plan was filed today and that will need to be recirculated for review with the departments and then with the Planning Board. This is scheduled for the August 3 meeting. Mr. Pirozzi reported that no building permits have been pulled to date but permits will be needed. Whether or not they accepted any and all the comments made by department heads? In the event the hotel business didn't work, do they have any intentions on having 18 one bedroom units? Will the restaurant be supplying the services for the hotel? Will there be a contracted outside cleaning service? Where will people park? How many employees? Given there is not much traffic in that area, who do they think they will be attracted to the hotel as far as locals, tourists, etc.? What the total square footage of building will be? Councilor Dooner would like to know how long construction will take and when they expect to be operational. Councilor Sanders asked about the expected obstacles and hazards in the area during construction. He is also interested in efforts to work on sustainability. Councilor Postell confirmed that this is a hotel and asked about the check in area. Mr. DeSousa noted that this will be on the first floor. Mr. Postell indicated that he is interested in the additional permits and inspections required for hotels. He would also be interested in knowing more about the standard operating procedures for the hotel. We are aware of no legal restriction preventing community events from occurring at the Airport. Under M.G.L. c. 90, §51 Ethe Airport Commission is vested with the "custody, care and management" of the Airport. Therefore any events to occur at the Airport must be approved by, and are subject to the oversight of, the Airport Commission. We began this program at Taunton High School in the spring of 2015 with eleven guest organizations, and it has been amazing to watch this event grow over the years - thanks entirely to the support of your staff and employees. This year, we were able to host more than 600 students at the event, most of whom are members of our junior and senior class. I appreciate your availability to speak with these young ladies and gentlemen, even for a brief time, to provide a welcome introduction to rewarding career pathways. These restrictions are to be in effect between the hours of 9am and 5pm, seven days per week, and will expire on September 30, 2023. Non-essential outdoor water uses that are subject to mandatory restrictions include (from the WMA permit): • irrigation of lawns via sprinklers or automatic irrigation systems (watering by means of hand-held hoses is permitted); • filling swimming pools; • washing of vehicles, except in a commercial car wash or as necessary for operator safety; and • washing of exterior building surfaces, parking lots, driveways or sidewalks, except as necessary to apply surface treatments such as paint, preservatives, pavement or cement. We are required by MassDEP to enactthese restrictions when local stream flows fall below a designated target. This action is not due to a drought, or other water emergency, but is a standard operating condition of all public water systems withdrawing from the Taunton River watershed. The City and SAN Holdings entered into an two separate HCA's regarding a retail establishment and a cultivation establishment, respectively, at 0 Hart Street (Assessor's Parcel No. 94-215). Both HCA's, as amended, require SAN Holdings to commence operations by June 28, 2023. Will you please extend both agreements so that the date by which operation should commence is on or before June 30, 2024, or a later date in your reasonable judgement. The reason for this request is that SAN Holdings has continued working to move the project forward and has expended considerable resources in pursuit of the project to include engineering and architecutural services. On June 7, 2022, the Municipal Council voted to grant a special permit to SAN Holdings for this project. On June 21, 2022 the written decision, signed by Councillors, was filed with the City Clerk. On August 18, 2022, following the appeal period, SAN Holdings obtained the decision from the City Clerk and recorded it at the Registry of Deeds. The engineer hired by SAN then commenced to design the site and draft the plan. It was a somewhat complicated engineering feat which was successfully accomplished after months of work and site investigation. Challenges included the elevation of the site relative to the road, requiring retaining walls and fill with compaction; and, determining the existence of and border of wetlands as well as determining the existence or non-existence of an intermittent stream, all of which implicated the project. SAN has obtained Site Plan Approval from the Planning Board and an Order of Conditions from the Conservation Commission.
