Communications from the Mayor:
Mayor 0' Connell invited the interested parties into the enclosure for a presentation
regarding the ARPA update. The parties introduced themselves as Gill Enos, Budget
Director, Amy Kazlauskas, Human Resources Director, Patrick Dello Russo, CFO,
Sergeant John Peterson and Detective Daniel McCabe. Mr. Dello Russo used a slide
presentation to discuss the ARPA program allocations, which included less than four
percent of funds being allocated on administrative costs. Sergeant Peterson spoke about
the funds that were allocated to the needs of improvement to public safety training and
equipment. He discussed that the funds allowed them to modernize their fleet, which
allows them to have safer cruisers, as well as save on fuel costs and maintenance costs.
He discussed that the funds allowed them to improve the radio system and invest in
updated technology. Mr. Dello Russo discussed the allocation of the funds for non-profit
and business grants, playgrounds and parks, building and land acquisitions, and health
and human services. Ms. Kazlauskas stated that this year the City hired a Safety Manager,
which they have never had in the past. She discussed the safety improvements made
which include railings being installed at the water treatment facility, increased security
with fobs and the installment of pillars near City Hall for safety. She discussed that
different Councilors have served on the Safety Committee. She discussed that they are
working on a mental healthcare training for City employees, as well as a PPE program.
Mr. Dello Russo discussed that Mayor 0' Connell will be investing into the TPS
Performing Arts Program and that she is bringing a Mural Program to the City. He stated
that the capital spending transferred to CIP and that Taunton continues to be a leading

City. Mayor O'Connell stated that this program has been able to impact many different
groups. She stated that it is wonderful to see how the City has come together over the last
four years. Councilor Pottier stated that it is great to see forward thinking. He expressed
concern about the Flock Program. He referred to the Committee on Police and License
for either an open or closed session, at the discretion of the Chief, to hear more about this
program and where the City is going with it. Sergeant Peterson stated that they are
committed to a responsible use of technology. Motion was made to refer a discussion
on the Flock Program to the Committee on Police and License and the Police Chief
for a later date. So Voted. Councilor Borges expressed gratitude to Karen Pemberton for
her work on the ARPA program.
Mayor O'Connell invited the interested parties into the enclosure for the Mural Program
Presentation. The parties introduced themselves as Jay Pateakos, Executive Director
OECD, Jim Howland, Assistant Director OECD, Karen Pemberton, COVID/ARPA
Coordinator, Patrick Dello Russo, CFO, and Gill Enos, Budget Director. Mr. Pateakos
discussed that Mayor O'Connell developed an idea to have Taunton-area artists create
murals in order to add color across the City. He stated that Ms. Pemberton and the Office
of Economic and Community Development will accept applications until December 15,
2023. Ms. Pemberton discussed that the Mural Program is the final step of the ARPA
program, which is a plan to approach the advancement of Arts, Culture and Tourism in
the City. Mr. Howland stated that if there are no buildings available to paint, artists could
paint other surfaces, such as electrical boxes. He discussed how Boston implemented this
type of program. He stated that their plan is to attach a QR code on each mural that will
direct people to the City's website, where there will be a map of all of the different
murals that have been created. He stated that when people click on a particular mural, it
will provide links to nearby businesses. Ms. Pemberton discussed photo opportunities
with 3D murals and this will provide the opportunity to bring in hospitality and tourism.
Councilor Postell stated that this idea has grown larger than anyone thought. He stated
that he is excited that this will involve local artists. He stated that it would be beneficial
to see the history of the community involved in the mural. Mr. Pateakos stated that they
are working to get the mural on the side of Pistol Pete's in the Weir restored towards the
end of November. Councilor Dooner inquired if the local artists will be donating their art
or if it will be funded. Ms. Pemberton stated that it will be funded and that they met with
local artist, Ryan Jones, to get his insight on this program. Councilor Borges inquired if
they have any plans to work with the Cultural Council. Mr. Howland stated that they have
had a discussion with the Taunton Arts Association regarding the future of when the
ARPA funding runs out. Mr. Howland stated that they have spoken with their new grants
writer regarding collaboration with the Mass Cultural Council. Ms. Pemberton stated that
the Mass Cultural Council offers grants and they have applied before through the
Mayor's Worthy Cause and have been very successful with this. Mr. Dello Russo
discussed that the Taunton Revitalization Fund will also be available to help continue the
program in the future. Councilor Pottier stated that there is a mural inside Coyle Cassidy
that was created by Ryan Jones. He inquired ifthere is any coding for vandalism. He also
suggested that the QR code also link to the artist. Ms. Pemberton stated that they have
also discussed adding a hashtag to the bottom of the murals. Councilor Duarte stated that
he is excited that this program is not just limited to wall murals. He stated that this a great
opportunity for the City to partner with the Old Colony Historic Museum.

Mayor O'Connell stated that the Liberty and Union Festival this past weekend was a
great success.
Mayor O'Connell stated that the Airport Fall Fest will take place on Saturday, October
28, 2023 from 11 :OOam until 4:00pm. This is a free community event and an open house
of the new administration building. There will be live music, touch a truck or plane
opportunities and an airplane candy drop.
Mayor O'Connell stated that the Annual Ben's Chili Bowl Event will take place on
Saturday, October 28, 2023 from 12:00pm until 4:00pm. Tickets will be $20 for adults
and $10 for children. The proceeds from this event will go to the Benjamin T. Mills Fund,
which provides assistance to families with terminally ill children.
Mayor 0' Connell stated that the Trunk or Treat Event will take place on Saturday,
October 28, 2023 from 4:30pm until 8:30pm in the downtown area. This is a free
community event hosted by the Taunton Parks and Rec Department.
Mayor 0' Connell stated that First Parish Church will be having their 5th Annual
Community Block Party on Sunday, October 29, 2023 located at 79 Church Green from
9:00am until 1:OOpm. This is a Halloween-themed party with over fifty vendors.
Appointments:
Reappointment of Lisette Miranda, 1 Pine Ridge Circle, Taunton to the Taunton Cultural
Council for a term of three (3) years expiring October 2026. Motion was made to move
approval. So Voted.
Councilor Borges expressed gratitude to Mayor O'Connell that the following
appointments are all students of Bristol Plymouth Regional High School.
Appointment of Mikayla Mbugua to the Taunton Youth Commission to serve as a youth
member for a term of three (3) years expiring August 2026. Motion was made to
approve. So Voted.
Appointment of Kayla Glynn to the Taunton Youth Commission to serve as a youth
member for a term of one (1) year expiring August 2024. Motion was made to approve.
So Voted.
Appointment of Lyla McEntire to the Taunton Youth Commission to serve as a youth
member for a term of two (2) years expiring August 2025. Motion was made to
approve. So Voted.
Appointment of Genoveva Martins-Furtado to the Taunton Youth Commission to serve
as a youth member for a term of three (3) years expiring August 2026. Motion was made
to approve. So Voted.
Appointment of Luke Piscitelli to the Taunton Youth Commission to serve as a youth
member for a term of one (1) year expiring August 2024. Motion was made to approve.
So Voted.

Communications from City Officers:
Com. from the Safety Officer regarding an assessment of Florence Street to limit parking
to one side of the street. He stated that he does not believe a parking restriction is needed
in this area at this time. Motion was made to receive and place on file. So Voted. On
discussion, Councilor Sanders stated that he continues to receive correspondence
regarding people parking on the sidewalks in this area and requested that the Police
Department step up enforcement of the parking restrictions in this area.
Com. from the Safety Officer regarding concerns in the area of 278 County Street with
several motor vehicle crashes in the last two years. He stated that Billy Leonard from the
DPW has added several chevrons and a double arrow sign on County Street. He stated
that he has met with Councilor McCaul and the property owner, Jessica Schroeder, to
discuss the issue. The property owner would like the guard rail on County Street
extended approximately forty-six feet. He stated that Tony Abreu stated that the request
to extend the guard rail is being reviewed by BETA. Motion was made to refer to the
Committee on the Department of Public Works. So Voted.
Com. from the Chairman, Taunton Planning Board stating that the Taunton Planning
Board has received a Site Plan Review modification for property at 90 Washington Street
(prop. I.D. 55-149 and 55-150) for the mixed use development to reduce the units from
34 to 27 residential units and parking from 78 to 68 spaces. With the commercial space to
remain as previously approved, submitted by Ramesh Izedian. The DIRB will meet to
review this petition on Tuesday, November 14, 2023 at 8:30am in the Taunton Planning
Board Office, 141 Oak Street, and the Taunton Planning Board will meet to review the
petition on Thursday, December 7, 2023 at 5:30pm in the Chester R. Martin Municipal
Council Chambers, 15 Summer Street. Motion was made to receive and place on file.

Com. from the City Solicitor regarding an Xfinity Correspondence dated October·· 10,
2023 regarding changes to Xfinity services. Motion was made to receive and place on
file. So Voted.
Com. from the City Solicitor stating that on July 18, 2023, the Municipal Council voted
to have the Law Department complete a full title examination of Assessor's parcel 29-14
consisting of approximately 28 acres off of Prince Henry Drive. Additionally, the Law
Department is aware that some have questioned whether the land is subject to use
restriction arising out of the circumstances of its acquisition from the Taunton
Development Corporation. Therefore they have also taken initiative to review that issue.
The only use restriction that exists as a matter of record title for this parcel of land is a
limitation to "municipal industrial development purposes, as part of a planned industrial
subdivision to expand the Myles Standish Industrial Park". The only use restriction that
this land is subject to as a matter of record title is the restriction to municipal industrial
development purposes as stated in the deed from the Commonwealth of Massachusetts
dated August 15, 2000 recorded with the Registry of Deeds in Book 8930, Page 146.
Motion was made to refer to the Committee on Public Property. So Voted.
Com. from Mayor O'Connell stating that the Marketable Properties Program continues to
efficiently move City-owned parcels into the hands of developers who will add value to
these properties and ultimately contribute revenue to the City of Taunton. One recent

parcel transfer demonstratives the dynamic impact the MPP can have for the City. Old
Colony Habitat for Humanity was the successful bidder of the request for proposal for 5
Chester Court, which was positioned with social equity and charitable nonprofits in mind.
Habitat for Humanity intends to remove the current structure and build a 3-bedroom, 1 Vi-
bath affordable home for a low income family. The conversion of this property will
permanently increase Taunton's affordable housing inventory, and work is expected to
begin in fall 2024. Motion was made to receive and place on file. So Voted.
Com. from Mayor O'Connell requesting that the Municipal Council accept the donation
of services in the amount of $500 from Ryan Jones for painting the Veteran-Only Parking
Spot in the City Hall Parking Lot. Motion was made to move approval. So Voted.
Mayor O'Connell stated that she would like to personally thank Ryan Jones for his work
and that he does so much for this community. Councilor Coute requested that Ryan Jones
be invited in to be recognized by the Council.
Communications from Citizens:
Com. from the District Highway Director, MassDOT regarding the intersection of Route
44 and Burt Street in the City of Taunton. MassDOT's mission is to provide the highest
quality customer service to residents and visitors, with a focus on safety and efficiency.
Traffic signals installed on State Highway must conform to the requirements specified in
the Federal Manual on Uniform Traffic Control Devices (MUTCD) and the
Massachusetts Amendments to the MUTCD. The MUTCD requires that warranting
criteria must be met to determine if a traffic signal is appropriate. If warrants are met,
improvements of this magnitude require thorough analysis, a design process, and capital
funding to be constructed. During this process, multiple intersection types are evaluated
in an objective and data driven manner through an Intersection Control Evaluation (ICE).
This evaluation may result in an intersection type other than a traffic signal being
identified as the most appropriate design. Motion was made to receive and place on file
with thanks to Councilor Pottier for bringing this matter to MassDOT' s attention. On
discussion, Councilor Postell requested to also refer this matter to the Police Department
so that they are able to continue sending the data needed on the accidents that continue to
happen in this area. Councilor Sanders confirmed with Mayor O'Connell that her office
will continue to work with MassDOT to encourage them to improve this area. Mayor
O'Connell requested to refer this matter to the DPW Commissioner. Councilor Coute
stated that this letter does not indicate that they are going to do a study and inquired as to
how they will follow up that a study will transpire. Mayor O'Connell stated that her
office will work with the DPW Commissioner to determine the intentions of MassDOT.
Motion was made to receive and place on file with thanks to Councilor Pottier for
bringing this matter to MassDOT's attention, refer to the Police Department so that
they are able to continue sending the data needed on the accidents that continue to
happen in this area and refer to the DPW Commissioner. So Voted.
Com. from William & Delores Murray, 125 Sao Paulo Avenue, Taunton requesting to
purchase land from the City of Taunton. Motion was made to refer to the Committee
on Public Property. So Voted.

Petition submitted by Attorney William Rounds, 115 Broadway, Taunton on behalf of his
Client, East Coast Kali, LLC, owner of 354 Winthrop Street, Taunton requesting an
amendment to the City of Taunton Zoning Ordinance to allow Marijuana Establishments
in the Highway Business District (i.e., Amend §440 Marijuana Establishment to read SP2
- Industrial District and Highway Business District, Prohibited Use all other Districts).
Motion was made to refer to the City Clerk to schedule the appropriate hearing., So
Voted.

Order to be ordained on a roll call vote
Ordered That,
The City of Taunton shall establish an Opioid Settlement Stabilization
Fund in accordance with MGL c. 40 §Sb which shall be a separate interest-bearing
account established by the Treasurer. The proceeds from the Opioid Settlement shall be
directly deposited into the stabilization fund without appropriation. The fund will be
assigned its own general ledger number from the City Auditor. The fund will not be
considered general fund receipts.
On a roll call vote, nine (9) Councilors were present, nine (9) Councilors voted in
favor. So Voted.
New Business:
Councilor Borges motioned to refer the issue of no parking on Pine Street in front of
the Pine Street School to the Safety Officer for review. So Voted.
Councilor Borges requested to refer to the DPW Commissioner, MassDOT and
Committee a discussion of handicap spots on Broadway that are missing along Saint
Mary's church. Motion was made to move approval. So Voted.
Councilor Borges requested to meet in the Council of the Whole with the City Solicitor to
discuss the Council appointment of the Councilor representative of the Golf Commission
that currently states the following:
§ 10-36 Appointment; term of office.
A. The Municipal Council shall appoint seven Commissioners with terms as
follows:

(1) The appointment for the position to be filled by a member of the
Municipal Council shall be for one year;
(2) The appointment for the positions to be filled by residents of the greater
Taunton community shall be for two years;
(3) The appointment for the position to be filled by a season pass holder at
John F. Parker Municipal Golf Course shall be for one year.
B. The term for the new Commissioner to be elected at large shall commence
upon the expiration of the term presently held by the Commissioner residing
within 1/4 mile of the golf course. On or before the expiration of each term set
forth herein, with the exception of the Municipal Council member and the
season pass holder, who shall be appointed annually, the Municipal Council
shall appoint a successor for a term of three years. Should a Commissioner
die, resign or otherwise become disqualified to serve before the expiration of
his or her term, the Municipal Council shall appoint someone to serve the
remainder of the vacated term, said appointment to take place in the manner
above provided.
Motion was made to move approval. On discussion, Councilor Borges stated that she will
leave this to the Council President as the purpose of this is that the rules of the Council do
not coincide with the Ordinance. She stated that the Ordinance likely needs to be changed
to two (2) years to reflect this. Motion was made to refer to the Committee of the
Council as a Whole and the Committee on Ordinances and Enrolled Bills. So Voted.
Councilor Pottier stated that early voting begins on Saturday, October 28, 2023. He
expressed gratitude to the administration, the Elections Department and the Election
Commissioners for holding early voting. Mayor O'Connell stated that early voting will
begin on Saturday, October 28, 2023 from 8:00am until 2:00pm at City Hall. She stated
that there will be early voting at City Hall on Monday, October 30, 2023 from 8:00am
until 4:00pm, Tuesday, October 31, 2023 from 8:00am until 7:00pm, Wednesday,
November 1, 2023 from 8:00am until 4:00pm, Thursday, November 2, 2023 from 8:00am
until 4:00pm, and Friday, November 3, 2023 from 8:00am until 12:00pm.

1. Approve minutes from September 19, 2023.
Motion by Mr. McCaul and seconded by Ms. Borges to approve. So voted.
2. Meet with the CFO and Director of Procurement for an update on the Marketable Properties
Program.
Motion by Ms. Borges and seconded by Ms. Dooner to invite in the interested parties. So
voted.
Mr. Sukeforth gave a presentation updating the Committee on the status of various properties
in the Marketable Properties Program and indicated that his intention is to update every few
months. The property on Range Ave., which is 18 acres off of Winthrop Street, went to an
open auction. The highest bid was $320,000. They are still working to complete the
purchase and sale agreement. Ms. Borges asked if there would be any deed restrictions and
Mr. Sukeforth indicated that the land would be difficult to build upon but is not necessarily

For 45 School Street, Mr. Sukeforth indicated that they had estimated $50,000 but they
received $351,000. _The buyers have a good business plan. Ms. Borges ask~d if this should
be discussed in public since they are only under a pending purchase and sale agreement. Mr.

Coute indicated that this was a public process and Mr. Sukeforth stated that this is a very
reputable company.
5 Chester Court was declared surplus about a year ago. This property was targeted for non-
profit organizations. Mr. Sukeforth indicated that this is a good location but a rough house
there and that there will be a 20 year affordable housing restriction on this property. Ms.
Borges requested that the name of the bidder be emailed to the Council.
Mr. Sukeforth reported that Ashleigh Terrace I brought in $155,100 and will have a single
family restriction. He further indicated that the following are being actively marketed: 21
Weir which closes on October 31, and Ashleigh Terrace II, Rachel Drive, and Holloway
Street which close on October 30. He highlighted some properties that need more
background work to prepare but indicated that he expects that those will go at the end of
2023 or early 2024.
Mr. Coute asked Mr. Sukeforth's opinions on the success of the RFP vs. auction. Mr.
Sukeforth thought that RFP seems to be better for people.
Motion by Ms. Borges and seconded by Mr. McCaul that the communications from the Law
Department, Jonathan Gray, and Mayor 0 'Connell related to the property on Prince Henry
Drive be made part of the record So voted.
Mr. Dello Russo reported that OECD now has close to $1 Million to invest back into
community businesses.
Ms. Borges asked that senior and veteran housing possibilities be kept in mind.
Mr. Pottier asked for the total amount raised from those discussed tonight and Mr. Sukeforth
stated it was about $850,000.
Motion by Ms. Borges and seconded by Ms. Dooner to adjourn the meeting at 6:26 PM and
excuse the parties. So voted.

1. Approve minutes from October 17, 2023.
Motion by Mr. Duarte and seconded by Mr. Postell to approve. So voted.
2. Meet to discuss the Memorandum of Agreement with Public Employees Local Union 1144B
(Clerical) for a successor Collective Bargaining Agreement covering the period of July 1,
2022 through June 30, 2025. This discussion may be held in executive session pursuant to
MGL Chapter 30A §21: "To discuss strategy with respect to collective bargaining or
litigation if an open meeting may have a detrimental effect on the bargaining or litigating
position of the public body and the chair so declares".
Motion by Mr. Duarte and seconded by Mr. Coute to enter into executive session. So voted
on a roll call with all Councilors voting in favor.

The City of Taunton shall establish an Opioid Settlement Stabilization
Fund in accordance with MGL c. 40 §Sb which shall be a separate interest-bearing
account established by the Treasurer. The proceeds from the Opioid Settlement shall be
directly deposited into the stabilization fund without appropriation. The fund will be
assigned its own general ledger number from the City Auditor. The fund will not be
considered general fund receipts.
NEW BUSINESS
1. Councilor Borges motioned to refer the issue of no parking on Pine Street in front
of the Pine Street School to the Safety Officer for review.
2. Councilor Borges request to refer to the DPW Commissioner, MassDOT and
Committee a discussion of handicap spots on Broadway that are missing along
Saint Mary's church.
3. Councilor Borges requests to meet in the Council of the Whole with the City
Solicitor to discuss the Council appointment of the Councilor representative of the
Golf Commission that currently states the following:
§ 10-36 Appointment; term of office.
A. The Municipal Council shall appoint seven Commissioners with terms as
follows:
(1) The appointment for the position to be filled by a member of the
Municipal Council shall be for one year;
(2) The appointment for the positions to be filled by residents of the greater
Taunton community shall be for two years;
(3) The appointment for the position to be filled by a season pass holder at
John F. Parker Municipal Golf Course shall be for one year.
B. The term for the new Commissioner to be elected at large shall commence
upon the expiration of the term presently held by the Commissioner residing
within 1/4 mile of the golf course. On or before the expiration of each term set
forth herein, with the exception of the Municipal Council member and the
season pass holder, who shall be appointed annually, the Municipal Council
shall appoint a successor for a term of three years. Should a Commissioner
die, resign or otherwise become disqualified to serve before the expiration of
his or her term, the Municipal Council shall appoint someone to serve the
remainder of the vacated term, said appointment to take place in the manner
above provided.

At the September 26th meeting of the Municipal Council, Councilor Sanders made a
motion to the Safety Officer to assess Florence Street regarding limited parking to one
side of the street.
I have monitored the parking on Florence Street for the last two weeks Street, I have been
in the area at different times during the days and evenings. Since I began monitoring, I
have found that few motorists park on Florence Street. I did issue one parking citation to
a vehicle parked on the sidewalk. At this time I don'tbelievethat a parking restriction is
needed in this area. I will continue to monitor the area.

At the September 19th meeting of the Municipal Council, Councilor Sanders made a
motion to refer to the area of 278 County Street as per the reported citizen concern.
I know that there have been several motor vehicle crashes in that area over the last two
years. The crashes have damaged the fence that separates 278 County Street and 294
County Street several times, a motor vehicle crashed into the building, and another motor
vehicle crashed into the utility pole in front ofthe building. I have spoken with the owner
of294 Conty Street, Patti Santos in the past. As ofthis time Billy Leonard from theDPW
has added several chevrons and a double arrow sign on County Street. This will alert
motorists that there is a curve ahead. I also met with Councilor McCaul and the property
owner Jessica Schroeder to discuss the issue. The property owner would like to see the
guard rail on County Street extended approximately forty-six feet. This would protect
both properties frommotorvehicles damagingthe properties. I spoke with Tony Abreu
from the DPW, and he stated that the request to extend the guard rail is being reviewed
by BETA. I am hoping that we can grant this request. It will keep motorists from further
damaging property at both addresses.

1. Chapter 395 ofthe Ads of 2002 does notrestrict the use efthis parcel. Th~ land
at issue was acquired by the; City from the Taunton Development Corporatioh
(TDC) in order to release a testrfcfion that existed on another parcel of land located
at the site of the former Paul A. Dever State School. Under Chapter 395 ofthe
Acts of 2002, the TDC was able to acquire a 25.2 acre parcel of Jand from· the
CQmmonwealth of Massachusetts at the site of the former D~ver School. Said
25.2 acre :parcel was subjectto the foll0cwing. restriction as .set forth in section .9 of

the above mentioned Speclal Act "This parcel shall be maintained as a
recreational area unless and until the Taunton Development Corporation provides
to the City of Taunton 25.20 acres or more of contiguous, comparable land within
North Taunton, to be approved by a vote of the city council and mayor." Said
quotation from the Special Act does not indicatethat, in the event the TDC provides
Taunton with comparable land, then the land acquired by Taunton would have the
same restriction as the TDCparceL The Special Act only providesthat in order to
release the TDC property from its restriction, TDC would need to provide Taunton
with 25.20 acres of comparable land, Ultimately, the parcel at issue was conveyed
by the TDC to Taunton which allowed the TDC Jand to be released from its
restriction and incorporated into Phase IV and/or Phase Vof the expansion of the
Myle.s Standish Industrial Park. For the reasons stated above, the terms of the
Special Act do not impose a restriction on this parqel of land.
2. The vote .of the Council to acceptthe land did not create a use restriction. The
parcel at issue was referred to as Lot 71E on plans of record and was referred to
as such in pertinent discussions of the City 1s acceptance of it. When the City
acquired this parcel, the motion of the MunicipalC-0uncilwas 1'That the.Cityaccept
Lot 77E from the Taunton .Development Corporation in consideration for the
recreational land identified in the legislation." At the time, TDC's re.creatlonal land
was part of the area to be included in thePhase IV and/or Phase Vexpansion of
the Myles Standish Industrial Park. The ;,recreational land identified in the
legislation"wasthesepar(:lte parcel owned by TDC subject to the recreational use
restriction, notLot 71E. The Councll vote does notimpose arestriction on Lot77E.
Consh~tent with said lnterpretaUonj when. the land was conveyed to the City* the
members of the MunicipaJ Council signed the deed in order to accept it on be.half
of the City, and above their signatures I$ a statement that the land is accepted for
"general municipal purposes".
3. No use restrictions are imposed ln the deedto the City. The Deed of this parcel to
the City, dated November .11 1 2011 .and accepted by the. Municipal Council on
November 15., 2011, specifies that the land was conveyed and accepted by the
City for 11general municipal purposes". This phrase means that the use was not
restricted.
4. The brel11ises .. is subject to a. restriction. of.record···umiting. its use to "municipal
industrial developn1entpurposes''.This parcel is aportion of the.premises thatwas
conveyed to the TOG by the Commonwealth of Massachusetts by deed dated
August 15, 2000, recorded with the. Registry of Deeds in Book 8930, Page 146.
Said deed contains the following restriction: 'The land shall be used for municipal
industtlal . develqpment purposes, including a. plannedlndUstrlal. subdivision .to
expand the Myles .Standish Industrial Park." The deed further states that the
restriction is exe.mPt from. the provisions .of M.G;L. chapter 184, sections ..26
through 30. The significance of said exemption is thatthe restriction is of unlimited
duration. Even though the deed to the City of Taunton did not reference this

restriction; it is a restriction of record that does run with the land and therefore
applies to this property.
S. Zoning classification may be. changed and does not create a use restriction that
runs with the land. Presentlythis parcel is zoned for open space/recreation along
with various other parcels in the City that share said designation as shown on the
City1s zoning map. Zoning classification may be changed at 8ny time by the City
and does not create a restriction that runs With the land itse!f. The open
space/recreation zoning classification does not constitute a dedication of land to
such purposes under Article 97 of the amehdments to the Massachusetts
Constitution.
Based on the above, the only use restriction thatthis land ls subject to as a matter
ofrecord title is the restriction to municipal industrial development purposes as stated in

Dear Council President Dooner and Members of the Taunton Municipal Council,
I am pleased to announce that the Marketable Properties Program continues to efficiently move
City-owned parcels into the hands of developers who will add value to these properties and
ultimately contribute revenue to the City of Taunton.
One recent parcel transfer demonstrates the dynamic impact the MPP can have for our City. Old
Colony Habitat for Humanity was the successful bidder of the request for proposal for 5 Chester
Court, which was positioned with social equity and charitable nonprofits in mind. Habitat for
Humanity intends to remove the current structure and build a 3-bedroom, 1 1/2-bath affordable
home for a low income family. The conversion of this property will permanently increase
Taunton's affordable housing inventory, and work is expected to begin in Fall 2024.
We are excited for the opportunity to support Habitat for Humanity in providing much needed
housing to families . Under the Habitat program, the new homeowner will pay a modest mortgage
while achieving stability and self-reliance.
Thank you to the City of Taunton Finance Team for conducting the important work of the MPP
and for crafting this impactful partnership with Habitat for Humanity.

SUBJECT: Route 44 and Burt Street Intersection

Dear Ms. Leger,
MassDOT is responding to your letter regarding the intersection of Route 44 and Burt Street in the City of
Taunton. MassDOT's mission is to provide the highest quality customer service to residents and visitors,
with a focus on safety and efficiency.
Traffic signals installed on State Highway must conform to the requirements specified in the Federal
Manual on Uniform Traffic Control Devices (MUTCD) and the Massachusetts Amendments to the
MUTCD. The MUTCD requires that warranting criteria must be met to determine if a traffic signal is
appropriate.
If warrants are met, improvements of this magnitude require thorough analysis, a design process, and
capital funding to be constructed. During this process, multiple intersection types are evaluated in an
objective and data driven manner through an Intersection Control Evaluation (ICE). This evaluation may
result in an intersection type other than a traffic signal being identified as the most appropriate design.

Dear members of the City Council:
We are writing this letter on behalf of the property we currently own identified above. We
bought this property two years ago and would like to put up a garage on our property. After
having surveyor's come out it was identified that there is a small section of land that was
separated with the thought of a playground being built at the end of the cul-de-sac, the house
was built in 1992. It was explained to us that did not happen as another contractor came in
bought the remaining land and added on.
After reaching out to several areas at City Hall, Shannon from legal suggested that we submit a
letter requesting to purchase this small piece of property squaring off our land from the city of
Taunton. In addition to that Shannon also suggested we reach out to the city's engineers
department to verify if there was any known reason why the city might not be able to sell the
land back. I spoke with Mike Patneaude who told me he did not see any reason for the city to
hold on to this land as he did not see any red flag upon his review. Mr. Patneaude also
explained that this would be a process and that members of City Council would be reaching out
to his department after receiving my letter.
I am including a picture of the GIS in hopes that this will help facilitate the process. Thank you
