Motion was made to approve. On a roll call vote, seven (7) Councilors were present,
seven (7) Councilors voted to appoint Casey Wellman, Michael Perrotta and
Thomas M. Richardi. So Voted. Councilors Quintal and Borges were absent. Mayor
O'Connell congratulated them and thanked them for serving the community. The City
Clerk swore in Casey Wellman, Michael Perrotta and Thomas M. Richardi as permanent,
full-time firefighters.
Motion was made to go out of the regular order of business to item #9 of the agenda.
So Voted.
Com. from the Assistant City Solicitor stating that the Law Department, together with the
Office of the Mayor and the Chief Financial Officer, intend to negotiate with William
Smith, the owner of the property located at 62 County Street (Parcel 67-10-0) in Taunton

for the potential acquisition of said property, in connection with the project at 90 County
Street. The first step in proceeding with this potential purchase is a Determination of
Uniqueness required by M.G.L. c.30B, Section 16(e) to alleviate the requirement of a
request for proposals. He has attached a Determination of Uniqueness that he has asked
the Council to review and approve so that it can be filed at the Central Register, which is
required by the statute. This filing must be at least thirty (30) days before the signing of a
final contract to purchase. The parties intend to sign the contract for purchase as soon as
the thirty (30) day posting period has expired. Councilor Pottier stated that he would like
to refer this matter to the Public Property Chair, Councilor Coute, for comment.
Councilor Coute stated that they had a meeting in executive session this evening to
discuss the uniqueness of the property. He stated that there was a positive
recommendation and a unanimous vote by the three (3) members of the Committee on
Public Property, which include himself, Councilor Dooner and Councilor McCaul, and
now has been brought in front of the full Council for ratification on a roll call vote.
Motion was made to approve on a roll call vote. On a roll call vote, seven (7)
Councilors were present, seven (7) Councilors voted in favor. So Voted. Councilors
Borges and Quintal were absent.
Motion was made to revert to the regular order of business. So Voted.
Hearing:
Continued Hearing: To discuss the possible revocation of the Tow Service Contract
between the City of Taunton and Scott Souza, Tony's Auto Wrecking located at 303
Broadway, Taunton under Section 2 of said contract. Motion was made to reopen the
hearing and invite the interested parties into the enclosure. So Voted. Mr. Souza
stated that he would like to request a continuance due to his counsel not being available
due to a surgical procedure until next Tuesday. Motion was made to continue the
hearing until Tuesday, December 19, 2023. So Voted. Councilor Dooner was
opposed.
Communications from the Mayor:
Mayor O'Connell stated that on Wednesday, December 13, 2023 from 6:00pm until
7:30pm the Taunton Veterans Department will have the "Santa Visits the Vets" Event in
the City Hall Council Chambers. Veterans and their families are invited to meet Santa and
enjoy food and holiday music.
Mayor 0' Connell stated that they will be having the Taunton Municipal Airport
Administration Building ribbon cutting on Monday, December 18, 2023 at 1:OOpm at the
Airport in collaboration with Mass DOT. The public is invited to attend.
Communications from City Officers:
Com. from the Chief Financial Officer stating that the Finance Department and Public
Safety Project Team respectfully request a transfer of an amount not to exceed $375,000
from the sale of real estate account to potentially purchase a property that directly abuts
the Public Safety Complex location. Motion was made to refer to the Committee on
Finance and Salaries. So Voted.

Com. from the Safety Officer regarding parking issues on Forest Street closest to Weir
Street. He stated that he has monitored Forest Street for the past few weeks at different
times of the day and evenings in order to determine if there is a parking issue on Forest
Street. He noted that during the evening hours, vehicle street parking was much greater.
He issued four parking citations for vehicles parking too close to the intersection,
however, he did not observe any other issue. He will continue to monitor this area for
parking violations. Motion was made to receive and place on file with thanks to the
Safety Officer. So Voted.
Com. from the Safety Officer regarding the intersection of Liberty Street, Middleboro
Avenue and Old Colony Avenue. He stated that the intersection of Middleboro Avenue,
Liberty Street and Old Colony Avenue is offset. Crossing Middleboro Avenue from
Liberty Street to Old Colony Avenue the motor vehicle operator must veer slightly to the
right and then turn left. All three streets are posted 30mph. The crash history at this
intersection revealed seven crashes in 2022 and ten cashes in 2023. Motion was made to
receive and place on file, refer to the Committee on Police and License and the
Police Chief. So Voted.
Com. from the Assistant Executive Director of Retirement notifying of the retirement for
superannuation of Gregory Galligan, an employee of the Taunton Fire Department on
December 16, 2023 under the provisions set forth in Section #5 of the Chapter 32 of the
General Laws of Massachusetts. Motion was made to approve and send the
appropriate scroll. So Voted.
Com. from John Parsons, Esq., Executive Director, PERAC regarding the amount to be
appropriated for the retirement system for the Fiscal Year 2025, which commences July
1, 2024. The appropriation amount is $20,943,987. The allocation by governmental unit
was developed by Buck as part of their January 1, 2022 actuarial valuation. The current
schedule is due to be updated by Fiscal Year 2025. Motion was made to receive and
place on file. So Voted.
Com. from the Executive Director of Retirement stating that as governed under the
provisions of Chapter 306 of the Acts of 1996, which amended section 22 of chapter 32
of the Mass. General Laws, the Taunton Retirement Board hereby submits its Calendar
Year 2024 Retirement Expense Budget for informational purposes. Motion was made to
receive and place on file. So Voted.

Ordinance to be ordained on a roll call vote
AN ORDINANCE REGARDING WAGES FOR SPECIAL POLICE OFFICERS
Chapter 19 - Police Department
Be it ordained by the Municipal Council of the City of Taunton and by authority of the
same as follows:
That a new section shall be added to Article I of Chapter 19, immediately following § 19-
27 "Civilian Traffic Control Officers", as follows:
§19-28- Wages for Special Police Officers
1) Retired employees appointed as special police officers pursuant to Chapter 150, of
the Acts of2017 shall be compensated as follows:
a. For "detail" work, the same rate of pay, including any stipends,
minimum hours or overtime detail pay that an active police officer
working under the Taunton Police Patrolmen's Association collective
bargaining agreement would receive.
b. For court and other non-detail work, the rate of pay that would be
applicable under the current collective bargaining agreement for the rank
and step that the special police officer retired at, if that officer was still
an active police officer and subject to the appropriate collective
bargaining agreement based on their rank. There shall be a three-hour
minimum pay for all work up to three hours; thereafter, work shall be
compensated in quarter-hour minimum increments.
That all numbered sections following the above new section shall be renumbered so as to
sequentially number all sections of Chapter 19.
That all ordinances or parts thereof inconsistent are hereby repealed. This ordinance shall
become effective immediately upon passage.

Motion was made to approve. On a roll call vote, seven (7) Councilors were present,
seven (7) Councilors voted in favor. The motion passes. Councilors Quintal and
Borges were absent.

AN ORDINANCE
ARTICLE III. STOPPING, STANDING AND PARKING
Sec 405-53. Prohibited parking places.
Be it ordained by the Municipal Council of the City of Taunton as follows:
That Section 405-53 of the Revised Ordinances of the City of Taunton, as amended,
be and hereby are further amended by adding thereto the following:
Howard Street, the South Side (right side) for its entire length.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.
Motion was made to approve. On a roll call vote, seven (7) Councilors were present,
seven (7) Councilors voted in favor. The motion passes. Councilors Borges and
Quintal were absent.
Order (or a first reading to be passed to a second reading
Ordered That,
The City of Taunton appropriates the sum of Twelve Million Dollars
($12,000,000) for the purpose of funding the Taunton Municipal Lighting Plant's Project
1218 to replace the existing 116KV to 13.8 double-ended substation to Cleary off the
generator bus to a new location situated on County Street in Taunton, and all costs
incidental and related to such project; and to meet this appropriation, $200,000 for
Preliminary Engineering & Permitting, $8,300,000 for Major Equipment Costs (2 Power
Transformers, Five-Year Extended Warranty of Transformers, Spare Parts and
Accessories, and Switchgear), and $3,500,000 for Construction Costs. The Treasurer,
with the approval of the Mayor is authorized to borrow $12,000,000 for Project 1218 and
issue bonds or notes therefore under Chapter 44 of General Laws or any other enabling
authority; and that the Mayor is authorized to take any other action necessary to carry out
this project.
Further, that any premium received by the City upon the sale of any bonds or notes
approved by this order, less any such premium applied to the payment of the costs of
issuance of such bonds or notes, may be applied to the payment of costs of the project
authorized by this order in accordance with Chapter 44, Section 20 of the General Laws,
thereby reducing the amount authorized to be borrowed to pay such costs by a like
amount.
Motion was made to pass to a second reading. So Voted.

New Business:
Councilor Borges requested to refer to the Council of the Whole to invite the Director of
the Animal Shelter to discuss Class I and Class II Kennel Licenses. Motion was made to
move approval. So Voted.

The meeting was called to order at 5 :34 PM.
1. Approve the minutes from December 5, 2023
Motion by Mr. McCaul and seconded by Mr. Pottier to approve. So voted.
2. Meet to review the weekly vouchers and payroll for City departments.
Motion by Mr. Pottier and seconded by Mr. McCaul to approve the payroll warrant in the
amount of $4,348,403.47. So voted.
Motion by Mr. Pottier and seconded by Mr. McCaul to approve the accounts payable
warrant in the amount o/$4,614,111.94. So voted.
3. Meet with the Finance Department for an update on Free Cash and retained earnings.
Motion by Mr. Pottier and seconded by Mr. McCaul to invite in the interested parties. So
voted.
The team gave a brief presentation on free cash and retained earnings. Mr. Fortes reviewed
the year end process and explained the process for certifying free cash. He showed the free

cash amounts over the years starting with 2010 and reported that the certified free cash
amount for 2023 was $20,767,285. Mr. Della Russo noted that to improve the free cash
number they had installed strict financial policies and collaborated with the other department
managers to see this result. However, he cautioned that there will be ebbs and flows with
free cash as there are things that cannot be controlled. Ms. Nunes discussed water and sewer
retained earnings and explained how revenue and expenses for these areas live within these
enterprise funds. She noted that for water there was $9.7 Million in certified retained
earnings this year. For sewer she explained that there was lot of planning that went into
setting the rates over the past years to cover the expense of the upgrades at the waste water
treatment plant. Retained earnings for sewer were $2.8 Million this past year. Mr. Enos
stated that free cash is a snapshot in time and that those savings are then put into a
stabilization fund. Ms. Clymens indicated that any interest earned in stabilization funds stay
with the funds and they are currently experiencing a 5 .24% yield on investments.
Mr. Pottier asked how much is in stabilization and Mr. Della Russo stated that it is
approximately $34.5 - $35 Million. Mr. Della Russo explained that the free cash numbers
can be attributed to eliminating recuITing deficits and working to close out tailings. Mr.
Pottier asked for the source of the variances that contribute to free cash and Mr. Enos stated
that it is in large part due to interest income.
Mr. Duarte asked for an explanation of tailings and Ms. Clymens stated that tailings are
uncashed checks over 1 year old.
4. Meet with the Finance Department to review the updated Consolidated Financial Policy and
Procedure.
Mr. Della Russo stated they had updated the policies. There is a new general investment
policy, improved procurement policy, and a new cash management policy. Ms. Clymens
explained that the OPEB policy was tweaked as well as the general investment policy to
consider safety, liquidity, and yield. Mr. Sukeforth indicated that for the procurement policy,
he had put together best practices, applicable forms, and so forth. Ms. Clymens stated that
for the cash management policy, they focused on lower borrowing costs and improved safety
of municipal funds. Mr. Della Russo stated that they are looking for a confirmatory vote on
the updated financial policies from the Council.
Mr. Pottier clarified that this is a policy, not an ordinance or a mandate and Mr. Della Russo
stated that policies are living, breathing documents but he'd like a vote to add emphasis. Mr.
Pottier stated that while he appreciates the best intentions, things can sometimes turn and
difficult decisions need to be made.
Motion by Mr. Pottier that the Committee endorse the policies as presented.
Mr. McCaul questioned the section on reducing other employee benefit costs and Mr. Della
Russo stated that this is a goal and that it would need to be bargained. A policy .doesn't
supersede a collective bargaining agreement.

Mr. McCaul seconded the motion.
Mr. Sanders questioned the change to the benefit contribution and Mr. Dello Russo indicated
that it is just a guide and would be a bargaining issue. Ms. Clymens stated that she had
looked at the policies of many Cities and this is seen in many. Mr. Sanders indicated that a
60/40 split might make sense financially but it's a complex process to get there.
Mr. Duarte asked if these policies are public record and Mr. Dello Russo confirmed and
stated that they will be posted online.
On the motion, so voted.
Motion by Mr. Pottier and seconded by Mr. McCaul to adjourn at 6: 10 P.M So voted.

Motion by Mr. Duarte and seconded by Mr. Postell to invite in the parties. So voted.
Mr. Duarte asked if the building is already constructed. Mr. Kennedy confirmed and
indicated that they have passed site plan review and they will be doing the interior fit up. Mr.
Duarte expressed concern with parking.
Mr. McCaul is interested in learning about the hours of operation, security, and the number
of employees.
Mr. Coute requested information on fmancial impact, dollars invested in the City, jobs, and
neighbor outreach.
Mr. Sanders asked that any information or presentation be sent in advance and requested that
the applicant provide documentation of his status with the Cannabis Control Commission.

The meeting was called to order at 6:40 PM.
1. Meet in an executive session for discussion on potential property acquisition and/or potential
litigation related to the same. This meeting will be held in executive session pursuant to
MGL Chapter 30A §21: "To consider the purchase, exchange, lease or value ofreal property
if the chair declares that an open meeting may have a detrimental effect on the negotiating
position of the body" and/or "To discuss strategy with respect to collective bargaining or
litigation if an open meeting may have a detrimental effect on the bargaining or litigating
position of the public body and the chair so declares".
Motion by Ms. Dooner and seconded by Mr. McCaul to enter into executive session. So
voted on a roll call.
Motion by Ms. Dooner and seconded by Mr. McCaul to come out of executive session. So
voted on a roll call.
Mr. Coute reported that one vote was taken in executive session to declare a property on
County Street unique and that vote will be ratified in the full Council.
Motion by Ms. Dooner and seconded by Mr. McCaul to adjourn the meeting at 7:12 PM and
excuse the parties. So voted.

AN ORDINANCE REGARDING WAGES FOR SPECIAL POLICE OFFICERS
Chapter 19 - Police Department
Be it ordained by the Municipal Council of the City of Taunton and by authority of the same
as follows:
That a new section shall be added to Article I of Chapter 19, immediately following §19-27
"Civilian Traffic Control Officers", as follows:
§19-28 - Wages for Special Police Officers
1) Retired employees appointed as special police officers pursuant to Chapter 150, of
the Acts of2017 shall be compensated as follows:
a. For "detail" work, the same rate of pay, including any stipends, minimum
hours or overtime detail pay that an active police officer working under the
Taunton Police Patrolmen's Association collective bargaining agreement
would receive.
b. For court and other non-detail work, the rate of pay that would be
applicable under the current collective bargaining agreement for the rank
and step that the special police officer retired at, if that officer was still an
active police officer and subject to the appropriate collective bargaining
agreement based on their rank. There shall be a three-hour minimum pay
for all work up to three hours; thereafter, work shall be compensated in
quarter-hour minimum increments.
That all numbered sections following the above new section shall be renumbered so as to
sequentially number all sections of Chapter 19.
That all ordinances or parts thereof inconsistent are hereby repealed. This ordinance shall
become effective immediately upon passage.

AN ORDINANCE
ARTICLE III. STOPPING, STANDING AND PARKING
Sec 405-53. Prohibited parking places.
Be it ordained by the Municipal Council of the City of Taunton as follows:
That Section 405-53 of the Revised Ordinances of the City of Taunton, as amended, be
and hereby are further amended by adding thereto the following:
Howard Street, the South Side (right side) for its entire length.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

Ordered That,
The City of Taunton appropriates the sum of Twelve Million Dollars ($12,000,000)
for the purpose of funding the Taunton Municipal Lighting Plant's Project 1218 to replace
the existing 116KV to 13.8 double-ended substation to Cleary off the generator bus to a new
location situated on County Street in Taunton, and all costs incidental and related to such
project; and to meet this appropriation, $200,000 for Preliminary Engineering & Permitting,
$8,300,000 for Major Equipment Costs (2 Power Transformers, Five-Year Extended
Warranty of Transformers, Spare Parts and Accessories, and Switchgear), and $3,500,000
for Construction Costs. The Treasurer, with the approval of the Mayor is authorized to
borrow $12,000,000 for Project 1218 and issue bonds or notes therefore under Chapter 44 of
General Laws or any other enabling authority; and that the Mayor is authorized to take any
other action necessary to carry out this project.
Further, that any premium received by the City upon the sale of any bonds or notes
approved by this order, less any such premium applied to the payment of the costs of
issuance of such bonds or notes, may be applied to the payment of costs of the project
authorized by this order in accordance with Chapter 44, Section 20 of the General Laws,
thereby reducing the amount authorized to be borrowed to pay such costs by a like amount.
NEW BUSINESS
1. Councilor Borges requests to refer to the Council of the Whole to invite the Director
of the Animal Shelter to discuss Class I and Class II Kennel Licenses.

At the October 17th meeting of the Municipal Council, Councilor Postell referred to the
Safety Officer for a review of parking issues on Forest Street closest to Weir Street end
for a report.
I have monitoring Forest Street for the past few weeks at different times of the day and
evenings in order to determine if there is a parking issue on Forest Street. I did notice that
there were fewer cars during the daytime parking. During the evening hours vehicle street
parking was much greater. I issued four parking citations for vehicles parking too close to
the intersection, but other than those vehicles, I did not observe any other issues. I will
continue to monitor this area for parking violations.

At the October 10th meeting of the Municipal Council, Councilor Pottier requested to
refer to the Safety Officer the intersection of Liberty Street, Middleboro Avenue and Old
Colony Avenue.
The intersection ofMiddleboro Avenue, Liberty Street and Old Colony Avenue is offset.
Crossing Middleboro A venue from Liberty Street to Old Colony A venue the motor
vehicle operator must veer slightly to the right, and then turn left. All three streets are
posted 3 0 MPH. The crash history at this intersection revealed seven crashes in 2022 and
ten crashes in 2023.

Re: Determination of Uniqueness Pursuant to M.G.L. c. 308, §16(e)
Purchase of property by the City from William Smith
Located at 62 County Street (Parcel 67-10-0) Taunton, MA
Dear Mayor O'Connell and Members of the Municipal Council:
The Law Department together with the office of the Mayor and Chief Financial Officer
intends to negotiate with William Smith, the owner of the property located at 62 County Street
(Parcel 67-10-0) Taunton for the potential acquisition of said property, in connection with the
project at 90 County Street. Such acquisition would be subject to Council approval. The first
step in proceeding with this potential purchase is a Determination of Uniqueness required by
M.G.L. c. 308, §16(e) to alleviate the requirement of a request for proposals.
I therefore attach a Determination of Uniqueness Statement that I would ask the Council
to review and approve so that it can be filed at the Central Register which is required by the
statute. This filing must be filed at least 30 days before the signing of a final contract to
purchase. The parties intend to sign the contract for purchase as soon as the 30 day posting
period has expired .

DETERMINATION OF UNIQUENESS
PURSUANT TO M.G.L. c. 30B, §16{e)
The Municipal Council of the City of Taunton with a principal place of business at City Hall, 15
Summer Street, Taunton, Bristol County, Massachusetts, hereby determines that advertising
pursuant to M.G.L. c. 30B, §16{e), will not benefit the local jurisdiction because of the unique
qualities or locations needed, with respect to the following described real property to be
acquired by the City of Taunton pursuant to a Letter of Intent to Purchase.
Property to be Acquired: The Property Location is 62 County Street (Parcel 67-10-0) Taunton,
MA. An approximately .71 acre parcel with a 1,613 s.f. single family home which directly abuts
City property to be re-developed into a Public Safety Complex to be conveyed from present
owner, William Smith.
Said property satisfies the unique requirements of the local jurisdiction because (a) the size and
location of the parcel which directly abuts the site to be redeveloped into the Public Safety
Complex as well as the property directly abuts the proposed entrance to the Public Safety
complex and provides additional frontage on County Street as well as providing a buffer to
wetlands on the property; (2) use of this particular property when combined with the property
presently owned by the City will advance the City's goal to obtain this parcel for its Public Safety
Complex which is a direct benefit to the public welfare of the City; (3) the unique location, size,
quality and characteristics of the parcel which directly abuts property to be re-developed and
located with frontage on County Street abutting the entrance to existing City property serves a
unique public purpose.
It is clear that the best interests of the City are served by purchasing this particular parcel
because of its size, quality, location and abutting City owned land.
The owners of the subject property are William Smith. No other owner of record exists.

property if the chair declares that an open meeting may have a detrimental effect on the
negotiating position of the body" and/or "To discuss strategy with respect to collective
bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or
litigating position of the public body and the chair so declares"

Winthrop Street, Taunton located in the Highway Business District.
