Ordinance for a first reading to be passed to a second reading AN ORDINANCE ARTICLE II. Excavation and Obstructions  Sec 383-20 (I). Restrictions upon issuance of permit. Be it ordained by the Municipal Council of the City of Taunton as follows: That Section 383-20 (I) of the Revised Ordinances of the City of Taunton, as amended, be and hereby are further amended by removing section 383-20 (I) and replacing it with the following: No permits will be issued between November 1 and April 1 except in cases of emergency or as approved by the Commissioner of Public Works or its designee. All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. Ordinance for a first reading to be passed to a second reading Chapter 191 ANIMALS Be it ordained by the Municipal Council of the City of Taunton and by authority of the same as follows: SECTION 1: Article 1, Section 191-8 of Chapter 191 of the Revised Ordinances of the City of Taunton, as amended, is hereby further amended by deleting said existing Section and replacing the same with the following:- § 191-8 Kennels. A. Definition. For purposes of this section, the word "kennel" shall mean one pack or collection of dogs on a single lot, whether maintained for breeding, boarding, sale, training, hunting, or other purposes, and including any shop where dogs are on sale, and also including every pack or collection of dogs three months old or over owned or kept on a single lot irrespective of the purpose for which they are maintained. B. A public hearing before the Municipal Council shall be required prior to the issuance of a new Class I, Class II or Class III kennel license subject to MGL c. 140, § 13 7A. Annual renewals are also subject to a public hearing but may have the public hearing waived by majority vote of the Municipal Council. The owner of the property must be the petitioner for the kennel license. C. Kennel licenses shall be classified as Class I for keeping four to six dogs, Class II for keeping seven to 12 dogs, and Class III for keeping more than 12 dogs. D. The Municipal Council may authorize the issuance of a Class I license after public hearing and upon the applicant's written certification of the following: (1) A fence shall be maintained on the property of sufficient height to keep all dogs on property and in conformance with all City Ordinances.  (2) That each dog to be kept on the premises has received all required shots and/or vaccinations. (3) That each dog subject to the license is disease-free, adequately nourished and otherwise in good health. (4) That the keeper of the dogs subject to the license will obey the leash law. (5) That the keeper of the dogs under the license will obey the laws relating to excessively barking dogs. (6) That the dogs will be housed or sheltered a minimum of 100 feet from the nearest residential dwelling. (7) That the premises upon which the dogs are to be kept shall be open to inspection by the Chief of Police or the Animal Control Officer at any time in accordance with MGL c. 140, § 137C. (8) That the premises upon which the dogs are to be kept is subject to a special permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440, Zoning, only if used for a commercial purpose. (9) If dogs are to be housed outside, they must be appropriately housed in a structure that complies with this section as well as all other City Ordinances and any applicable state or local building codes. E. The Municipal Council may authorize the issuance of a Class II license after public hearing and upon the applicant's written certification of the following: ( 1) A fence shall be maintained on the property of sufficient height to keep all dogs on property and in conformance with all City Ordinances. (2) That each dog to be kept on the premises has received all required shots and/or vaccinations. (3) That each dog subject to the license is disease-free, adequately nourished and otherwise in good health. (4) That the keeper of the dogs subject to the license will obey the leash law. (5) That the keeper of the dogs under the license will obey the laws relating to excessively barking dogs. (6) That the dogs will be housed or sheltered a minimum of250 feet from the nearest residential dwelling. (7) That the premises upon which the dogs are to be kept shall be open to inspection by the Chief of Police or the Animal Control Officer at any time in accordance with MGL c. 140, § 137C. (8) That the premises upon which the dogs are to be kept is subject to a special permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440, Zoning. (9) That each dog shall have a shelter or dog house. (10) That he or she will notify the Animal Control Officer in writing of any change in the number of dogs kept on the premises. (11) That he or she will certify that all dogs shall be kept in shelter from 9:00 p.m. to 7:00 a.m.  (12) That a kennel structure constructed in accordance with applicable building codes shall be erected or presently exists on the premises sufficient to house the number of dogs to be kept under the license. The structure shall: (a) Have running water. (b) Have shelter for each dog. (c) Be located a minimum of250 feet from any residential dwelling. (d) Have a washable, disease- and water-resistant floor. G. The Animal Control Officer may suspend any kennel license issued hereunder ifthe licensee fails to comply with any item required under this section. The Municipal Council may suspend, revoke, or reinstate any kennel license, at a hearing for due process, if the licensee fails to comply with any item required under this section. H. Keeping of more dogs than are permitted under any class kennel license shall be grounds for revocation of the license. I. The Municipal Council may combine the special permit required in § 440-502 of Chapter 440, Zoning, the site plan review required under Article XV of Chapter 440, Zoning, and the license hearing. J. The application fee shall be $50 for a new Class I, $100 for a new Class II, and $150 for a new Class III kennel license. The annual renewal fee shall be 1/2 the application fee for a new kennel license. The fee for the required zoning special permit and site plan review is included in the application fee. The petitioner shall be responsible for the newspaper advertising costs in addition to the filing file in the event of a public hearing. K. In addition to the foregoing provisions regarding revocation and/or suspension of a kennel license, this section may be enforced by the Animal Control Officer pursuant to the provisions of§ 191-4. Maintenance of any class kennel upon unlicensed premises or premises for which a kennel license has been issued but subsequently revoked shall constitute a violation, the fine for which shall be $150 for the first offense and $250 for each subsequent offense. Each day the violation continues shall constitute a separate offense. L. The requirements stipulated in Subsections D, E and F may be waived or reduced by a two-thirds vote of the Municipal Council upon a: finding that the waiver or reduction will not be detrimental to the public health, safety, and welfare. SECTION 2: All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. I have received several calls from Jessica Shroeder and Patti Santos asking that the guard rail at the intersection of County Street and Johnson Street be extended. The guard rail is located in front of 294 County Street. Both parties believe that if the guard rail is extended it will help decrease the property damage that has occurred in the past. The DPW had BETA assess the area to see if extending the guard rail would help with reducing the property damage. BETA reported that it would reduce the property damage suffered by the property owners of the two properties. I am asking that the city council approve the extension of the guard rail on County Street. As you know, .the Safety Program was created to improve the safety, security and wellness of our employees. The City has made incredible strides in safety following a comprehensive job haza!'d analysis. Among other achievements, we created a safety manual, placed safety guardrails at the Water Treatment Plant, implemented the Hi-Vis Personal Protective Equipment (PPE) Program fo1· City laborers, and celebrated Safety Week, an entire week dedicated to the wellness of City employees. Fmther, the Safety Program is making an impact on workers compensation premiums, due to out continuous improvements, completion of projects and new initiatives. These are just a few reasons why we have received a notewo1thy reduction to our wo1·kers compensation premiums. The City's Safety Program focuses on employee safety across all City departments and has reduced work- related incidents by 20%. The reduction is a direct result of !raining, safety audits with corrective actions, and proactive mitigation strategies citywide. As the Safety Chair and Manager of Workers Compensation Program, I believed it was imp011ant to notify our insurance underwriter of the City's safety accomplishments during our insurance renewal process. Moreover, a request was made to the unde1writers to re-evaluate this year's premium total costs in light of the City's demonstrable commitment to safety. The insurance carder provided a reconsideration which resulted in a cost savings of approximately 5%. This equates to a reduction of approximately $15,000.00 of premium costs to the City. As the Director of Human Resources, Safety Chai!', and Manager of Workers Compensation, I would like to extend my appreciation to Mayor O'Connell and the Municipal Council fo1· your unwavering support in keeping City employees safe, secure and well. In considering the petition, the Municipal Council familiarized itself with the premises and examined the location, layout and other characteristics. After reviewing the petition, plans and testimony, the Municipal Council finds that the petition was formally sufficient and submitted and reviewed in accordance with the procedures set forth in the Zoning Ordinance ·and that proper notice was given . . In reviewing the petition, the Municipal Council determined that this site is appropriate for this proposal and that locating said facility on this site as proposed would not be detrimental to the neighborhood and surrounding area. The Municipal Council considered whether or not the proposed use was in harmony with the general purpose and intent of the zoning ordinance. The Municipal Council took into consideration the needs of the community, the effect of the development upon the neighborhood and the community, in terms of socioeconomic impacts, odor, utilities, traffic, landscaping, and the health and welfare of the inhabitants. The Municipal Council determined that the development is in the best interest of the City The Municipal Council, on a motion to Grant the special permit, based on the submitted plans and accompanying materials and above mentioned reasons, and the Municipal Council, having voted Eight (8) in favor, none (0) opposed, none (0) abstaining and one (1) absent of said motion, hereby Grants the petition for the Special Permit as presented with the following conditions: Condition #1) sewer extension plan will be required to connect to the existing sewer system Condition #2) correct the top and bottom of curb elevations which are mislabeled Condition #3) Drainage flow is being directed towards Winter Street. Collection and treatment on site should be considered and the existing catchbasin in the southerly driveway opening will need to be addressed Condition #4) DPW permits are required including city licensed contractor, road opening and trench permits. Greater Goods is excitedly pursuing an opening day at its proposed Adult-Use Microbusiness establishment at445 Myles Standish Blvd. in Taunton (the "Site"). I am writing today to respectfully ask for an extension of Greater Goods' Host Community Agreement ("HCA") for an additional term of one (1) year. Greater Goods holds an HCA to operate its establishment which is currently set to expire on June 30. 2024. Greater Goods would request an extension of that HCA's term through June 30, 2025. A copy of that agreement (including amendments) is attached for your reference. By way of update, Greater Goods has been actively developing this site. Currently, Greater Goods has: (1) Completed demolition work; (2) Completed framing work; (3) Completed insulation installation; (4) Hung drywall; (5) Begun work on plumbing, including installation of irrigation lines into each grow room; (6) Begun work on HVAC systems, including installation of HVAC cassette and condensers; (7) Begun work on electrical systems, including installation of wiring and with installation of lighting to begin soon; and (8) Ordered and received most necessary equipment. Greater Goods is estimating that construction will complete around Sept. or Oct. of this year, and that the business will proceed through local and state inspections as quickly as possible after work completes. The Cannabis Control Commission has recently published a "Model Host Community Agreement" which was created to assist cities and adult-use cannabis operators to readily comply with updated state law and regulations. Greater Goods would propose that the City and Greater Goods negotiate an extension to its HCA on the Model HCA form (attached). However, Greater Goods is willing to defer to the city and its counsel on the form of this requested extension. Greater Goods respectfully requests authorization to negotiate an extension to its Host Community Agreement for an additional term of one-year, or to attend a hearing with the Municipal Council regarding this request as appropriate.
