Record of June 18, 2024 meeting was read by title and approved. So Voted.
Opportunity for input by the general public.
April Funches, 20 Kings Court, Taunton, expressed gratitude to Ligia Madeira and
Attorney Costa, as well as Bob Resendes from BCC, for going above and beyond. She
stated that they had their Cultural Fair and Juneteenth Celebration this past Saturday and
the weather did not cooperate and with their help they were able to move the event
indoors. She also expressed gratitude to the Mayor's Worthy Cause, T.M.L.P. and Bristol
County Savings Bank for sponsoring the event. She stated that they will be having Power
to the Polls Pop-Up Events in the coming weeks. She stated that the first event will take
place on July 16th at Bristol Commons from 3:30pm until 6:30pm. She stated that the
second event will take place on July 23rd at Paul Bunker from 3:30pm until 6:30pm.
Councilor Sanders motioned to have the comments regarding Attorney Costa and
Chief of Staff, Ligia Madeira, summarized and added to their personnel files. So
Voted.
Motion was made to go out of the regular order of business to Communications
from City Officials. So Voted.
Communications from City Officers:
Com. from the City Clerk regarding the appointment of four (4) permanent full-time Fire
Lieutenants. Mayor O'Connell invited Chief Lavigne and Firefighter O'Leary into the
enclosure to discuss the formation of the Ladder Company. Chief Lavigne discussed that
today is a milestone for the Taunton Fire Department. He stated that with these
promotions, they will be creating the first Ladder Company that the Department has seen
in over 100 years. He discussed that the establishment of this Ladder Company will allow
them to face the challenges they are meeting today and those they will face in the future.
He expressed gratitude to the Council, as well as former Councilor Coute, Amy

Kazlauskas, Human Resources Director, Patrick Dello Russo, Chief Financial Officer,
Ligia Madeira, Lieutenant O'Leary and Mayor O'Connell. Lieutenant O'Leary discussed
that over a year ago, Chief Lavigne and himself met with Mayor O'Connell and the
Council to discuss to explain the importance of having a Ladder Company in the City. He
explained that a Ladder Company is a team of firefighters led by a fire officer who
supervises the crew assigned to a particular piece of apparatus. He stated that the City has
also invested in a new ladder truck, which is currently being fabricated. He expressed
gratitude for the support received from the Council, Mayor O'Connell and her staff, as
well as Chief Lavigne. Motion was made to appoint Anthony Burton, David Galante,
Jay Harrington and Marc Faria to full-time, Fire Lieutenants on a roll call vote. On
a roll call vote, eight (8) Councilors were present, eight (8) Councilors voted to
appoint Anthony Burton, David Galante, Jay Harrington and Marc Faria. So
Voted. Councilor Dooner was absent. The Assistant City Clerk swore in Anthony
Burton, David Galante, Jay Harrington and Marc Faria as Fire Lieutenants.
Com. from the City Clerk regarding the appointment of one (1) permanent full-time Fire
Captain. Motion was made to appoint Steven Malcolm to full-time, Fire Captain on a
roll call Vote. On a roll call vote, eight (8) Councilors were present, eight (8)
Councilors voted to appoint Steven Malcolm. So Voted. Councilor Dooner was
absent. The Assistant City Clerk swore in Steven Malcolm as Fire Captain.
Com. from the City Clerk regarding the appointment of one (1) permanent full-time
Deputy Fire Chief. Motion was made to appoint Robert Bastis to full-time, Deputy
Fire Chief on a roll call Vote. On a roll call vote, eight (8) Councilors were present,
eight (8) Councilors voted to appoint Robert Bastis. So Voted. Councilor Dooner
was absent. The Assistant City Clerk swore in Robert Bastis as Deputy Fire Chief.
Motion was made for a five (5) minute recess at 7:32pm. So Voted.
Motion was made to revert to the regular order of business at 7:38pm. So Voted.
Hearing:
On the petition submitted by Tim Johnson, Propane Plus, P.O. Box 38, Rehoboth, MA
02769 on behalf of Taunton Owner, LLC, 303 Peachtree Ctr. Ave., NE #575, Atlanta;
GA 30303 for a new Flammable Storage license to store a total of 8,000 gallons of liquid
propane, 2.1 Class, all to be stored in ASME tanks at the location of 4 Silver City Drive
(Parcel 118-41-0), formerly known as 2 Galleria Mall Drive, East Taunton, MA 02718.
Motion was made to open the hearing and invite the interested parties into the
enclosure. So Voted. The Assistant City Clerk read a communication from the Fire
Inspector stating that it is has been explained to him that the propane storage requested at
4 Silver City Drive. is needed because their local natural gas supplier is unable to supply
the necessary demands of this facility. Therefore, the Taunton Fire Department would
make a positive recommendation for the license approval. The Assistant City Clerk
stated that the plans of the property and the copy of the deed on file have been included.
The party introduced himself as Tim Johnson, owner of Propane Plus in Rehoboth, MA.
Mr. Johnson stated that they were asked to obtain a Flammable Storage license at 4 Silver
City Drive because the natural gas line had been abandoned and they are unable to use it.
He stated that the only alternative they have is to use propane to heat the building to
protect the fire suppression system. He stated that they exceed the 2,000 gallon capacity
and they need 8,000 gallons. Mayor O'Connell questioned what steps would need to be

taken once the license is granted. Mr. Johnson stated that when this passes, they will pour
a concrete slab and have the inspection with the Fire Department. Motion was made to
open the hearing for public input. So Voted. No one spoke during public input.
Motion was made to close public input and grant the petition. So Voted. Mr. Johnson
expressed gratitude to the City Clerk and Assistant City Clerk, along with Jen Souza in
the Assessor's Office, and Deputy Fire Chief Bastis, for their help in this process.
Motion was made to have Mr. Johnson's comments regarding the staff placed in
their personnel files. So Voted.
Communications from the Mayor:
Mayor O'Connell stated that there is a list of community updates listed in the agenda
packet.
Mayor O'Connell stated that City Hall will be closed on Thursday, July 4, 2024 and
Friday, July 5, 2024 in observance oflndependence Day.
Appointments:

Communications from City Officers:
Com from the City Clerk submitting the signed requisition #09929 for two (2) permanent
full-time Police Officers. Motion was made to receive and place on file. So Voted.
Com. from the Assistant Executive Director of Retirement regarding the retirement for
Superannuation of William Rutherford, an employee of the Taunton Police Department
on July 20, 2024. Motion was made to receive and place on file and send Detective
Rutherford the appropriate scroll. So Voted.
Com. from the Chairman of the Taunton Planning Board stating that the Taunton
Planning Board is in receipt of a Site Plan Review for property at 94 Fremont Street (45-
165 & 45-166) to allow automobile sales with 12 display/sales spaces, 10 storage, 11
customer, 1 handicap, and 4 employee spaces in conjunction with the pre-existing legal
non-conforming auto repair use and existing dwelling, submitted by Fremont Realty,
LLC. The Planning Board will review the proposal on Thursday, July 11, 2024 at 5:30pm
at City Hall, 15 Summer Street, 2nd Floor, in the Chester R. Martin Municipal Council
Chambers. Motion was made to receive and place on file. So Voted.
Com. from the Commissioner of Parks, Cemeteries & Public Grounds stating that in
order to comply with Revolving Account procedures established under 53E 1/2, the
Parks, Cemeteries and Public Grounds Department requests the approval of the
Municipal Council to transfer any account balance in the current FY 23/24 Revolving
Account to the FY 24/25 Revolving Account and a dollar limit not to exceed $600,000.00
from July 1, 2024 to June 30, 2025. Councilor Borges motioned to refer to the Committee
on Finance and Salaries. Mayor O'Connell stated that there is a need for a motion to
establish the limits as written this evening. Councilor Duarte confirmed that this needs to
be done before the start of the fiscal year. Councilor Borges withdrew her motion.
Motion was made to establish the limits as written and to approve the transfer. So
Voted.

Com. from the Commissioner of Parks, Cemeteries & Public Grounds stating that they
are in the process of upgrading the South Street Playground to be an ADA Inclusive
Playground for the children to enjoy. He would like to request a meeting with the
Ordinance and Enrolled Bills Sub Committee to discuss the creation of three handicap
parking spots in front of the playground on South Street. Motion was made to refer to
the Committee on Ordinances and Enrolled Bills. So Voted.
Com. from the Chief Financial Officer regarding spending limits on the Board of Health
Revolving Fund Accounts. The Board of Health has asked for the following accounts to
have spending limits established: Health/Septic Eng. Consultant: $146,263.30; Medicare
Program: $11,806.49; Asbestos Permitting: $14,528.49; Health Outreach Program:
$13,414.16. Motion was made to establish the spending limits as requested for the
Board of Health. So Voted.
Com. from the Chairman of the Taunton Planning Board stating that the Taunton
Planning Board is in receipt of a Special Permit from Section 440 Attachment #1 of the
Zoning Ordinance for a 767 sq. ft. Accessory Dwelling Unit at 80 Bluejay Lane, E.
Taunton, MA, submitted by Jonathan & Cynthia Kiessling. The Planning Board will
review this proposal on Thursday, July 11, 2024 at 5:30pm at City Hall, 15 Summer
Street, 2nd Floor, in the Chester R. Martin Municipal Council Chambers. Motion was
made to receive and place on file. So Voted.
Com. from the Chairman of the Taunton Planning Board stating that the Taunton
Planning Board is in receipt of a Special Permit/Site Plan Review from Section 440
Attachment # 1 of the Zoning Ordinance for a mixed use building having seven residential
units and one commercial unit (545 sq. ft.) in the Central Business District submitted by

July 11, 2024 at 5:30pm at City Hall, 15 Summer Street, 2nd Floor, in the Chester R.
Martin Municipal Council Chambers. Motion was made to receive and place on file. So

Com. from Attorney Adam F. Braillard, Prince Lobel Tye, LLP, One International Place,

Britannia Street, Taunton to request a waiver of their Host Community Agreement.
Motion was made to issue a Host Community Agreement waiver to Lunar Xtracts.

Marijuana License - RENEWAL
1. Commonwealth Alternative Care, Inc. located at 30 Mozzone Boulevard, Taunton for

Motion was made to refer to the Committee on Police and Licenses and the
Police Chief to be scheduled for next week and that the City Clerk contact
Commonwealth Alternative Care and have them come in with their Odor
Control Plan. On discussion, Councilor Borges requested that the City Clerk contact
Commonwealth Alternative Care and have them come in with their Odor Control
Plan.
Street Acceptance
Petition submitted by Antonio S. Bairos, Trustee of A.L.E Realty Trust, P.O. Box 1126,
Taunton, MA 02780 requesting approval of Leona's Lane and Ayla's Circle as accepted
streets in the City of Taunton. Motion was made to refer to the City Clerk to schedule
the public hearing. So Voted.

AN ORDINANCE
ARTICLE II. Excavation and Obstructions
Sec 383-20 (I). Restrictions upon issuance of permit.
Be it ordained by the Municipal Council of the City of Taunton as follows:
That Section 383-20 (I) of the Revised Ordinances of the City of Taunton, as
amended, be and hereby are further amended by removing section 383-20 (I) and
replacing it with the following:
No permits will be issued between November 1 and April 1 except in cases of
emergency or as approved by the Commissioner of Public Works or its designee.

All · ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.
Motion was made to ordain on a roll call vote. On a roll call vote, eight (8)
Councilors were present, eight (8) Councilors voted in favor. So Voted. Councilor
Dooner was absent.

Chapter 191
ANIMALS
Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1: Article 1, Section 191-8 of Chapter 191 of the Revised Ordinances of
the City of Taunton, as amended, is hereby further amended by deleting said
existing Section and replacing the same with the following:-
§ 191-8 Kennels.
A. Definition. For purposes of this section, the word "kennel" shall mean one pack or
collection of dogs on a single lot, whether maintained for breeding, boarding, sale,
training, hunting, or other purposes, and including any shop where dogs are on sale,
and also including every pack or collection of dogs three months old or over owned
or kept on a single lot irrespective of the purpose for which they are maintained.
B. A public hearing before the Municipal Council shall be required prior to the
issuance of a new Class I, Class II or Class III kennel license subject to MGL c. 140,
§ 13 7A. Annual renewals are also subject to a public hearing but may have the
public hearing waived by majority vote of the Municipal Council. The owner of the
property must be the petitioner for the kennel license.
C. Kennel licenses shall be classified as Class I for keeping four to six dogs, Class II
for keeping seven to 12 dogs, and Class III for keeping more than 12 dogs.
D. The Municipal Council may authorize the issuance of a Class I license after public
hearing and upon the applicant's written certification of the following:
(1) A fence shall be maintained on the property of sufficient height to keep all dogs
on property and in conformance with all City Ordinances.
(2) That each dog to be kept on the premises has received all required shots and/or
vaccinations.
(3) That each dog subject to the license is disease-free, adequately nourished and
otherwise in good health.
(4) That the keeper of the dogs subject to the license will obey the leash law.
(5) That the keeper of the dogs under the license will obey the laws relating to
excessively barking dogs.

(6) That the dogs will be housed or sheltered a minimum of 100 feet from the
nearest residential dwelling.
(7) That the premises upon which the dogs are to be kept shall be open to
inspection by the Chief of Police or the Animal Control Officer at any time in
accordance with MGL c. 140, § 137C.
(8) That the premises upon which the dogs are to be kept is subject to a special
permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440,
Zoning, only if used for a commercial purpose.
(9) If dogs are to be housed outside, they must be appropriately housed in a
structure that complies with this section as well as all other City Ordinances and
any applicable state or local building codes.
E. The Municipal Council may authorize the issuance of a Class II license after public
hearing and upon the applicant's written certification of the following:
(1) A fence shall be maintained on the property of sufficient height to keep all dogs
on property and in conformance with all City Ordinances.
(2) That each dog to be kept on the premises has received all required shots and/or
vaccinations.
(3) That each dog subject to the license is disease-free, adequately nourished and
otherwise in good health.

nearest residential dwelling.

(8) That the premises upon which the dogs are to be kept is subject to a special
permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440,
Zoning.
(9) That each dog shall have a shelter or dog house.
(10) That he or she will certify that all dogs shall be kept in shelter from 9:00 p.m. to
7:00 a.m.

(11) If dogs are to be housed outside, they must be appropriately housed in a
structure that complies with this section as well as all other City Ordinances and
any applicable state or local building codes.

hearing and upon the applicant's written certification of the following:

nearest residential dwelling.
(7) That the premises upon which the dogs are to be kept shall be open to
inspection by the Chief of Police or the Animal Control Officer at any time in
accordance with MGL c. 140, § 137C.
(8) That the premises upon which the dogs are to be kept is subject to a special
permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440,
Zoning.
(9) That each dog shall have a shelter or dog house.
(10) That he or she will notify the Animal Control Officer in writing of any change
in the number of dogs kept on the premises.
(11) That he or she will certify that all dogs shall be kept in shelter from 9:00 p.m. to
7:00 a.m.
(12) That a kennel structure constructed in accordance with applicable building
codes shall be erected or presently exists on the premises sufficient to house the
number of dogs to be kept under the license. The structure shall:
(a) Have running water.
(b) Have shelter for each dog.
(c) Be located a minimum of250 feet from any residential dwelling.

(d) Have a washable, disease- and water-resistant floor.
G. The Animal Control Officer may suspend any kennel license issued hereunder ifthe
licensee fails to comply with any item required under this section. The Municipal
Council may suspend, revoke, or reinstate any kennel license, at a hearing for due
process, if the licensee fails to comply with any item required under this section.
H. Keeping of more dogs than are permitted under any class kennel license shall be ·
grounds for revocation of the license.
I. The Municipal Council may combine the special permit required in § 440-502 of
Chapter 440, Zoning, the site plan review required under Article XV of Chapter 440,
Zoning, and the license hearing.
J. The application fee shall be $50 for a new Class I, $100 for a new Class II, and $150
for a new Class III kennel license. The annual renewal fee shall be 1/2 the
application fee for a new kennel license. The fee for the required zoning special
permit and site plan review is included in the application fee. The petitioner shall be
responsible for the newspaper advertising costs in addition to the filing file in the
event of a public hearing.
K. In addition to the foregoing provisions regarding revocation and/or suspension of a
kennel license, this section may be enforced by the Animal Control Officer pursuant
to the provisions of§ 191-4. Maintenance of any class kennel upon unlicensed
premises or premises for which a kennel license has been issued but subsequently
revoked shall constitute a violation, the fine for which shall be $150 for the first
offense and $250 for each subsequent offense. Each day the violation continues shall
constitute a separate offense.
L. The requirements stipulated in Subsections D, E and F may be waived or reduced by
a two-thirds vote of the Municipal Council upon a finding that the waiver or
reduction will not be detrimental to the public health, safety, and welfare.
SECTION 2: All ordinances or parts thereof inconsistent herewith are hereby
repealed. This Ordinance shall become effective immediately upon passage.

Councilors were present, eight (8) Councilors voted in favor. So Voted. Councilor
Dooner was absent.
New Business:
Council President Pottier motioned to refer the sections of Lawrence Street and
Whittenton Street to the Safety Officer for a possible stop sign. So Voted.
Councilor Martin motioned for an update from the Department of Public Works
regarding the street line and crosswalk painting for the upcoming summer. So
Voted.
Councilor Postell motioned to refer to the Safety Officer to assess the digital speed
limit sign that was placed on Washington Street as it is not functioning. So Voted.

Mr. Postell asked how much is owed and Detective Rutherford stated that it is a minimal
amount. Ms. Borges asked ifthere is any update on the opening and Mr. Keough stated
that they are anticipating comments from MassDot on the curb cut permit. They are
working towards their Certificate of Occupancy and then will file with the CCC.
Motion by Mr. Quintal and seconded by Ms. Borges to approve pending the payment of

The meeting was called to order at 6:04 PM.
1. Remarks from the Chair
Council President Pottier extended his congratulations to Councilor Kelly Dooner who was
married and wished Mr. and Mrs. Picardi the best.
2. Approve minutes from June 18, 2024.
Motion by Mr. Postell and seconded by Mr. McCaul to approve. So voted.
3. Meet to discuss requests for extensions and amendments to marijuana Host Community
Agreements:
a. Bask, Inc. at 400 Winthrop Street

Mr. Duarte stated that considering the new Ordinance, it would be best to issue waivers
to all applicants who currently have Host Community Agreements and Councilor Sanders
agreed.
Motion by Mr. Duarte and seconded by Mr. Sanders to grant a Host Community
Agreement Waiver. So voted.
b. Greater Goods, LLC at 445 Myles Standish Blvd.
Motion by Ms. Duarte and seconded by Mr. Sanders to grant a Host Community
Agreement Waiver. So voted.

Motion by Ms. Borges and seconded by Mr. Sanders to grant an HCA Waiver. On a roll

Motion by Mr. Quintal and seconded by Mr. Postell to reconsider. On a roll call, all 8
councilors present voted yes.
Motion by Ms. Borges and seconded by Mr. Quintal to grant an HCA Waiver to SAN
Holdings, LLC. On a roll call, Councilors McCaul, Borges, Sanders, Quintal, and
Pottier voted yes. Councilors Martin, Postell, and Duarte voted no. The motion passed
5-3.
4. Meet to discuss the request for a marijuana Host Community Agreement Waiver:
a. Herbal Logic, LLC at 284R Winthrop Street
Motion by Mr. Duarte and seconded by Mr. Sanders to grant an HCA Waiver. On a roll
call, Councilors Postell, Quintal, Sanders, Martin, Borges, McCaul, and Pottier voted
yes. Councilor Duarte voted no. The motion passed 7-1.
5. Meet to review financial data related to benchmarking communities.
Motion by Ms. Borges and seconded by Mr. Sanders to take a briefrecess. So voted.
Mr. Della Russo led a presentation titled Gateway Community Statistical Comparison to
Benchmark Communities which shows how the City lines up relative to its peers.

Mr. Fortes discussed dates when free cash was certified and noted that Taunton was first with
free cash certified on 10/20/23 at 9% of the budget.
Mr. Dello Russo discussed debt to budget where Taunton is at less than 1%. He noted that
this allows the funds to go back to services.
Mr. Enos reported on the Stabilization Fund with a balance of over $34 Million which at
11 % is tops among gateway communities. He also stated that liability pension funding is
approximately 80% funded. Once that is 100% funded there will be significant savings.
Mr. Dello Russo stated that the S & P bond rating of AA+ is the top of gateway communities
and leads to significant savings in interest when borrowing. Mr. Martin asked how many
rating categories there are and Mr. Delio Russo explained the rating levels.
Mr. Conti reported on new growth and described this as a measure of health in a community.
He stated that DOR is very strict on what can be included in new growth.
Mr. Pottier noted that the legislature defines the 26 "gateway communities".
Motion by Mr. Postell and seconded by Mr. McCaul to thank and excuse the parties. So
voted.
6. Meet in executive session to review and consider approval of the Taunton Police Patrolmen's
Association successor collective bargaining agreements. This discussion will be held in
executive session pursuant to MGL Chapter 30A §21: "To discuss strategy with respect to
collective bargaining or litigation if an open meeting may have a detrimental effect on the
bargaining or litigating position of the public body and the chair so declares".
Motion by Mr. Duarte and seconded by Mr. McCaul to go into executive session. On a roll
call, Councilors McCaul, Borges, Martin, Quintal, Postell, Duarte, and Pottier voted yes.
Councilor Sanders voted no. Tlie motion passed 7-1.
Motion by Mr. McCaul and seconded by Ms. Borges to come out of executive session. So
voted on a roll call.
Mr. Pottier reported that two votes were taken in executive session. One was to ratify two
memorandums of agreement with the Taunton Police Patrolmen' s Association for successor
collective bargaining agreements periods of7/l/23 - 6/30/24 and 7/1/24 - 6/30/27. The
second vote was to come out of executive session.
Motion by Mr. Sanders and seconded by Mr. Postell to adjourn at 6:57 PM So voted.

AN ORDINANCE
ARTICLE II. Excavation and Obstructions
Sec 383-20 (I). Restrictions upon issuance of permit.
Be it ordained by the Municipal Council of the City of Taunton as follows:
That Section 383-20 (I) of the Revised Ordinances of the City of Taunton, as
amended, be and hereby are further amended by removing section 383-20 (I) and
replacing it with the following:
No permits will be issued between November 1 and April 1 except in cases of
emergency or as approved by the Commissioner of Public Works or its designee.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

Chapter 191
ANIMALS
Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1: Article 1, Section 191-8 of Chapter 191 of the Revised Ordinances of
the City of Taunton, as amended, is hereby further amended by deleting said
existing Section and replacing the same with the following:-
§ 191-8 Kennels.
A. Definition. For purposes of this section, the word "kennel" shall mean one pack or
collection of dogs on a single lot, whether maintained for breeding, boarding, sale,
training, hunting, or other purposes, and including any shop where dogs are on sale,
and also including every pack or collection of dogs three months old or over owned
or kept on a single lot irrespective of the purpose for which they are maintained.
B. A public hearing before the Municipal Council shall be required prior to the
issuance of a new Class I, Class II or Class III kennel license subject to MGL c. 140,
§ 13 7A. Annual renewals are also subject to a public hearing but may have the
public hearing waived by majority vote of the Municipal Council. The owner of the
property must be the petitioner for the kennel license.
C. Kennel licenses shall be classified as Class I for keeping four to six dogs, Class II
for keeping seven to 12 dogs, and Class III for keeping more than 12 dogs.
D. The Municipal Council may authorize the issuance of a Class I license after public
hearing and upon the applicant's written certification of the following:
(1) A fence shall be maintained on the property of sufficient height to keep all dogs
on property and in conformance with all City Ordinances.
(2) That each dog to be kept on the premises has received all required shots and/or
vaccinations.
(3) That each dog subject to the license is disease-free, adequately nourished and
otherwise in good health.
(4) That the keeper of the dogs subject to the license will obey the leash law.
(5) That the keeper of the dogs under the license will obey the laws relating to
excessively barking dogs.
(6) That the dogs will be housed or sheltered a minimum of 100 feet from the
nearest residential dwelling.
(7) That the premises upon which the dogs are to be kept shall be open to
inspection by the Chief of Police or the Animal Control Officer at any time in
accordance with MGL c. 140, § 137C.
(8) That the premises upon which the dogs are to be kept is subject to a special
permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440,
Zoning, only if used for a commercial purpose.
(9) If dogs are to be housed outside, they must be appropriately housed in a
structure that complies with this section as well as all other City Ordinances and
any applicable state or local building codes.
E. The Municipal Council may authorize the issuance of a Class II license after public
hearing and upon the applicant's written certification of the following:
(1) A fence shall be maintained on the property of sufficient height to keep all dogs
on property and in conformance with all City Ordinances.
(2) That each dog to be kept on the premises has received all required shots and/or
vaccinations.
(3) That each dog subject to the license is disease-free, adequately nourished and
otherwise in good health.

permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440,

(9) That each dog shall have a shelter or dog house.
(10) That he or she will notify the Animal Control Officer in writing of any change
in the number of dogs kept on the premises.
(11) That he or she will certify that all dogs shall be kept in shelter from 9:00 p.m. to
7:00 a.m.
(12) That a kennel structure constructed in accordance with applicable building
codes shall be erected or presently exists on the premises sufficient to house the
number of dogs to be kept under the license. The structure shall:
(a) Have running water.
(b) Have shelter for each dog.
(c) Be located a minimum of 250 feet from any residential dwelling.
(d) Have a washable, disease- and water-resistant floor.
G. The Animal Control Officer may suspend any kennel license issued hereunder ifthe
licensee fails to comply with any item required under this section. The Municipal
Council may suspend, revoke, or reinstate any kennel license, at a hearing for due
process, ifthe licensee fails to comply with any item required under this section.
H. Keeping of more dogs than are permitted under any class kennel license shall be
grounds for revocation of the license.
I. The Municipal Council may combine the special permit required in§ 440-502 of
Chapter 440, Zoning, the site plan review required under Article XV of Chapter 440,
Zoning, and the license hearing.
J. The application fee shall be $50 for a new Class I, $100 for a new Class II, and $150
for a new Class III kennel license. The annual renewal fee shall be 1/2 the
application fee for a new kennel license. The fee for the required zoning special
permit and site plan review is included in the application fee. The petitioner shall be
responsible for the newspaper advertising costs in addition to the filing file in the
event of a public hearing.
K. In addition to the foregoing provisions regarding revocation and/or suspension of a
kennel license, this section may be enforced by the Animal Control Officer pursuant
to the provisions of§ 191-4. Maintenance of any class kennel upon unlicensed
premises or premises for which a kennel license has been issued but subsequently
revoked shall constitute a violation, the fine for which shall be $150 for the first
offense and $250 for each subsequent offense. Each day the violation continues shall
constitute a separate offense.
L. The requirements stipulated in Subsections D, E and F may be waived or reduced by
a two-thirds vote of the Municipal Council upon a finding that the waiver or
reduction will not be detrimental to the public health, safety, and welfare.
SECTION 2: All ordinances or parts thereof inconsistent herewith are hereby
repealed. This Ordinance shall become effective immediately upon passage.

This firm represents Lunar Xtracts, Inc ("Lunar") with its development and operation of a
recreational marijuana production manufacturing establishment at 144 W. Britannia Street (the
"Establishment"). Please allow this letter as a request for the City of Taunton Municipal
Council (the "Council") to review the issue of the compliance of Host Community Agreements
(as further described below) during its next scheduled meeting on Tuesday June 25, 2024.
Lunar has obtained all of the required and necessary approvals from the City of Taunton (the
"City"), including a Host Community Agreement (the "HCA") and a Special Permit from the
Council, to allow for the development and operations ofLunar's Establishment. Moreover,
Lunar has obtained a provisional license from the Massachusetts Cannabis Control Commission
(the "Commission") and has been told by the Commission that Lunar should have its final
licensure to commence operations in July 2024. However, on June 17, 2024, the Commission
notified Lunar that its HCA between Lunar and the City does not comply with the Commission
current regulations. I believe this notice was also sent to the City. Attached, as Exhibit A, is a
copy of the Commission's notice to Lunar for reference.
Within this notice, the Commission provides three (3) options to bring the HCA into
compliance;
(i) the parties can elect to waive the HCA requirement ("HCA Waiver"),
(ii) the parties can sign the Commission's Model HCA (the "Model HCA"), or
(iii) the parties can try and amend the current HCA to comply with the current
regulations.

Lunar requests that the Council consider the first option; to execute an HCA Waiver. Attached,
as Exhibit B, is a copy of the HCA Waiver form that the Commission requests the parties
execute. In the event the Council is not inclined to waive the HCA, Lunar requests that the City
consider the second option, and review and execute the Model HCA, which is also included
with this letter as Exhibit C.
Lunar is very close to obtaining its final licensure and becoming operational and appreciates the
City's ongoing support with Lunar's efforts in doing so, and again requests the Council to
review this HCA compliance issue at its next meeting.
