Erin Allain, 688 Staples Street, East Taunton discussed that substance use disorder is important to her both personally and professionally. She stated that between July 2022 and June 2023 the Bureau of Substance Addiction Services reported that Taunton experienced 32 opioid-related deaths, 216 opioid-related ER visits and 197 opioid-related EMS visits. She stated that all three of these data points are higher than the average rates in Bristol County and the State. She continued to discuss pertinent statistics. She stated that the Opioid Settlement Funds present a unique opportunity for the City to invest in prevention, treatment and recovery programs, as well as harm reduction strategies. She stated that Taunton is the tenth biggest recipient of settlement funds across the State, receiving over $1,060,000.00 between 2022 and 2038, with over $581,000.00 received to date. She stated that according to the Opioid Abatement Partnership's website, Taunton has reportedly spent none of the funds received to date, however, the data dashboard indicates that more community planning efforts are underway, as confirmed by Mayor O'Connell and Councilor Sanders. She stated that her goals are to remind the Council that their constituents are paying attention and they would like to know more about their plans to be good stewards of these funds, to ask for transparency in the planning and implementation process of these funds, and to advocate for the funds to be used to promote harm reduction and criminal justice support.  2 Mayor O'Connell stated that they will be planning a presentation for Council and the community for an update, however, they have been working on a comprehensive action plan that has involved internal and external stakeholders. She stated that they have been doing outreach and have been listening to what people have to say. She stated that they will be collecting more data in September that will take them to their next step. She stated that committees have been formed as well. She stated that they want to focus on having a comprehensive plan that is effective and impactful in the community. She stated that they have spent some of the money to sponsor a summer camp for children and they are now installing opioid emergency boxes containing Narcan around different buildings throughout the City. Hearing: On the petition submitted by the Taunton Municipal Lighting Plant proposing to relocate one (1) new sole electric street light aluminum standard #8; 21.5 feet on Revolutionary Drive, Taunton. Motion was made to open the hearing and invite the interested parties into the enclosure. So Voted. The party introduced himself as Tyler Arruda, Electrical Engineer for T .M.L.P. He stated that they are petitioning for an underground aluminum standard street light that is in the way of the new building being contructed at 150 Revolutionary Drive. He stated that the aluminum standard is in the way of the curb cut, therefore, they will need to move it twenty-one and a half (21.5) feet north. Motion was made to open public input. So Voted. No one spoke during public input. Motion was made to close public input and grant the petition. So Voted. Communications from the Mayor: Mayor O'Connell invited Patrick Dello Russo, Chief Financial Officer, PJ Keating and Fred Cornaglia, DPW Commissioner into the enclosure for a presentation regarding the NAPA award. Mr. Keating expressed gratitude for the partnership they have with the City. He stated that NAPA is the National Asphalt Paving Association, which was started in 1955 and focuses on education, as well as advocacy for industry and research. He stated that the quality in construction award recognizes high quality in asphalt construction and is based on four (4) categories, which include gradation, asphalt content, air voids and density. He stated that each one of these categories is rated by independent engineers. He stated that in 2023, there were 288 QIC awards presented across the country, 10 QIC awards were presented in the State of Massachusetts and 9 QIC awards were presented to P.J. Keating, Co. He discussed the scope of the project on the various roads in Taunton. Mayor 0' Connell stated that the City is proud to work with a company that has such high standards and excellence in all of the work they perform. She stated that they have spent about $30,000,000.00 and paved about forty-four (44) miles of road and they have helped them to accomplish this. She stated that they will be continuing this work in the City as it improves quality of life for the residents and businesses. Mayor O'Connell congratulated Mr. Keating for being the recipient of nine (9) of the awards in Massachusetts and stated that this is a testament to the excellent quality of work they do. Mayor O'Connell stated that there is a list of community updates listed in the agenda packet. Mayor O'Connell stated that City Hall will be closed on June 19, 2024 in observance of Juneteenth.  3 Mayor O'Connell stated that the Taunton Diversity Network will be holding their cultural fair and Juneteenth celebration on Saturday, June 22, 2024 from 2:00pm until 6:00pm at Memorial Park. Mayor O'Connell recognized the Taunton High School Girls Softball Team for being the Division One State Champions for the fourth year in a row. Appointments: NONE. Communications from City Officers: Com. from the City Solicitor stating that on April 30th, the Council voted to request an update regarding the Charter. The Law Department in consultation with the Mayor's Office and pertinent City personnel has been engaged in an internal review of the proposed charter. The intent of this review is to identify and address any substantive issues before presenting it to the Municipal Council, for renewed consideration as a home rule petition to the legislature. They expect this review to be completed in the coming weeks, at which time the proposed charter will be presented to the Council for its consideration, with a full disclosure of all revisions that are being suggested. Motion was made to refer to the Committee of the Council as a Whole. So Voted. Com. from the Department of Public Works Commissioner stating that the appointment of the Water Superintendent expired on April 6, 2024. He requested to nominate Mike Arruda, Water Superintendent, for a term of three (3) years expiring in June of 2027. He is requesting that this matter be referred to the DPW Committee. Motion was made to move approval. On discussion, Councilor McCaul requested to move forward with the appointment of Mike Arruda this evening instead of referring it to the Committee on the Department of Public Works. Com. from the Director of Human Services stating that as indicated in M.G.L. Chapter 44, Section 53 E Yz, it is the obligation of the Department to request that the City Council vote on the limit that can be expended by their Department via the revolving account. She requested that a $15,000.00 limit be placed on their revolving account for Fiscal Year 2025. The purpose of any funds deposited and expended from this account will directly benefit the seniors in the community. Motion was made to approve. So Voted. Com. from the Safety Officer submitting a response regarding the area of Middleboro Avenue, Precinct Street and South Precinct Street, regarding a concern for an increase in the number of motor vehicle accidents. He reviewed the intersection and found that the sightlines to the stop signs are good. He noticed that a stop bar on the pavement at South Precinct Street is missing. He will report the stop line to the DPW. He also looked into the crash history of the intersection. From May 4, 2022 until June 6, 2024, there have been seven crashes. Three of those crashes occurred on Memorial Day weekend this year. There have been no crashes since that weekend. It is not uncommon to have a cluster of crashes at an intersection in a small period of time. He will continue to monitor the intersection. Motion was made to receive and place on file. Com. from the City Solicitor stating that the administration has reached an agreement with the Taunton Police Patrolmen's Association for successor collective bargaining agreements. There are two agreements covering a four-year period. The first agreement covers fiscal year 2024. The second agreement covers fiscal years 2025 through 2027. They are requesting that the Council refer this matter to the Committee of the Council as a Whole for an executive session to review and consider approval of the agreements on Tuesday, June 25th. They will provide copies of the MOAs to the Councilors once they have been ratified by the Union. Motion was made to refer to the Committee of the Council as a Whole for an executive session. Mayor O'Connell stated that they have reached out to Attorney deMello and spoke to him about this matter. She stated that they are assessing the area to get pricing and will work out how it fits into the CIP. She stated that they are looking into any other mitigation they can do in the meantime concerning the vegetation. Restrictions upon issuance of permit. Be it ordained by the Municipal Council of the City of Taunton as follows: That Section 383-20 (I) of the Revised Ordinances of the City of Taunton, as amended, be and hereby are further amended by removing section 383-20 (I) and replacing it with the following:  6 No permits will be issued between November 1 and April 1 except in cases of emergency or as approved by the Commissioner of Public Works or its designee. All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. Motion was made to pass to a third reading. So Voted. Ordinance for a second reading to be passed to a third reading Chapter 191 ANIMALS Be it ordained by the Municipal Council of the City of Taunton and by authority of the same as follows: SECTION 1: Article 1, Section 191-8 of Chapter 191 of the Revised Ordinances of the City of Taunton, as amended, is hereby further amended by deleting said existing Section and replacing the same with the following:- § 191-8 Kennels. A. Definition. For purposes of this section, the word "kennel" shall mean one pack or collection of dogs on a single lot, whether maintained for breeding, boarding, sale, training, hunting, or other purposes, and including any shop where dogs are on sale, and also including every pack or collection of dogs three months old or over owned or kept on a single lot irrespective of the purpose for which they are maintained. B. A public hearing before th.e Municipal Council shall be required prior to the issuance of a new Class I, Class II or Class III kennel license subject to MGL c. 140, § 13 7A. Annual renewals are also subject to a public hearing but may have the public hearing waived by majority vote of the Municipal Council. The owner of the property must be the petitioner for the kennel license. C. Kennel licenses shall be classified as Class I for keeping four to six dogs, Class II for keeping seven to 12 dogs, and Class III for keeping more than 12 dogs. D. The Municipal Council may authorize the issuance of a Class I license after public hearing and upon the applicant's written certification of the following: (1) A fence shall be maintained on the property of sufficient height to keep all dogs on property and in conformance with all City Ordinances. (2) That each dog to be kept on the premises has received all required shots and/or vaccinations. (3) That each dog subject to the license is disease-free, adequately nourished and otherwise in good health. (4) That the keeper of the dogs subject to the license will obey the leash law.  7 (5) That the keeper of the dogs under the license will obey the laws relating to excessively barking dogs. (6) That the dogs will be housed or sheltered a minimum of 100 feet from the nearest residential dwelling. (7) That the premises upon which the dogs are to be kept shall be open to inspection by the Chief of Police or the Animal Control Officer at any time in accordance with MGL c. 140, § 137C. (8) That the premises upon which the dogs are to be kept is subject to a special permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440, Zoning, only if used for a commercial purpose. (9) If dogs are to be housed outside, they must be appropriately housed in a structure that complies with this section as well as all other City Ordinances and any applicable state or local building codes. E. The Municipal Council may authorize the issuance of a Class II license after public hearing and upon the applicant's written certification of the following: (1) A fence shall be maintained on the property of sufficient height to keep all dogs on property and in conformance with all City Ordinances. (2) That each dog to be kept on the premises has received all required shots and/or vaccinations. (3) That each dog subject to the license is disease-free, adequately nourished and otherwise in good health. (4) That the keeper of the dogs subject to the license will obey the leash law. (5) That the keeper of the dogs under the license will obey the laws relating to excessively barking dogs. (6) That the dogs will be housed or sheltered a minimum of 150 feet from the nearest residential dwelling. (7) That the premises upon which the dogs are to be kept shall be open to inspection by the Chief of Police or the Animal Control Officer at any time in accordance with MGL c. 140, § 137C. (3) That each dog subject to the license is disease-free, adequately nourished and otherwise in good health. (4) That the keeper of the dogs subject to the license will obey the leash law. (5) That the keeper of the dogs under the license will obey the laws relating to excessively barking dogs. (6) That the dogs will be housed or sheltered a minimum of 25 0 feet from the nearest residential dwelling. (7) That the premises upon which the dogs are to be kept shall be open to inspection by the Chief of Police or the Animal Control Officer at any time in accordance with MGL c. 140, § 137C. (8) That the premises upon which the dogs are to be kept is subject to a special permit issued by the Municipal Council pursuant to § 440-502 of Chapter 440, Zoning. (9) That each dog shall have a shelter or dog house. (10) That he or she will notify the Animal Control Officer in writing of any change in the number of dogs kept on the premises. (11) That he or she will certify that all dogs shall be kept in shelter from 9:00 p.m. to 7:00 a.m. (12) That a kennel structure constructed in accordance with applicable building codes shall be erected or presently exists on the premises sufficient to house the number of dogs to be kept under the license. The structure shall: (a) Have running water.  9 (b) Have shelter for each dog. (c) Be located a minimum of 250 feet from any residential dwelling. (d) Have a washable, disease- and water-resistant floor. G. The Animal Control Officer may suspend any kennel license issued hereunder if the licensee fails to comply with any item required under this section. The Municipal Council may suspend, revoke, or reinstate any kennel license, at a hearing for due process, if the licensee fails to comply with any item required under this section. H. Keeping of more dogs than are permitted under any class kennel license shall be grounds for revocation of the license. I. The Municipal Council may combine the special permit required in § 440-502 of Chapter 440, Zoning, the site plan review required under Article XV of Chapter 440, Zoning, and the license hearing. J. The application fee shall be $50 for a new Class I, $100 for a new Class II, and $150 for a new Class III kennel license. The annual renewal fee shall be 1/2 the application fee for a new kennel license. The fee for the required zoning special permit and site plan review is included in the application fee. The petitioner shall be responsible for the newspaper advertising costs in addition to the filing file in the event of a public hearing. K. In addition to the foregoing provisions regarding revocation and/or suspension of a kennel license, this section may be enforced by the Animal Control Officer pursuant to the provisions of§ 191-4. Maintenance of any class kennel upon unlicensed premises or premises for which a kennel license has been issued but subsequently revoked shall constitute a violation, the fine for which shall be $150 for the first offense and $250 for each subsequent offense. Each day the violation continues shall constitute a separate offense. L. The requirements stipulated in Subsections D, E and F may be waived or reduced by a two-thirds vote of the Municipal Council upon a finding that the waiver or reduction will not be detrimental to the public health, safety, and welfare. SECTION 2: All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. Motion was made to pass to a third reading. Remarks from the Chair Mr. Pottier commented on the recent championship win of the Taunton girls' softball team. He called the four tiine winners a dynasty in Massachusetts sports. 2. Approve minutes from June 11, 2024. Motion by Ms. Borges and seconded by Mr. McCaul to approve. So voted. 3. Meet to review the re-development plans for the Bacon Felt property. Motion by Mr. McCaul and seconded by Ms. Borges to invite the parties in. So voted.  14 Mr. Dello Russo gave the history of the City's possession of the property at 395 West Water Street and noted that in 2023 it became part of the Marketable Properties Program. He explained that the RFP catered to the City's vision for that area. Mr. Pateakos gave some background on Mr. Holidman and stated that when the Bacon Felt property became available, he jumped on it. Mr. Pateakos noted that Mr. Holidman has already been looking at the surrounding properties. Mr. Holdiman explained his vision for the property and referred to it as "holistic urbanism" and is rooted in the community. He plans to establish a shipping container plaza with 20 stores, a brewery and distillery, an open market, and an amphitheater. He noted that the cost to build out a shipping container store is under $15,000 and he is already 50% full and has a soft commitment on the brewery and distillery. Mr. Pottier asked about his background and Mr. Holdiman explained his Fall River project. Mr. Duarte spoke about the bike path that he has been working on and stated that the area is in need of help. He appreciated Mr. Holidman's approach and asked if there will be any incubator type of projects. Mr. Holidman replied that rent is only going to be about $800 a month so, essentially, all will be incubators. Mr. Sanders asked how the $800/month rent compares to similar size spaces in traditional buildings and Mr. Holidman stated that it would probably be $1200-1800/month. Mr. Sanders noted that small operations typically involve folks who want to be involved in the community. Mr. Holidman stated that he is looking for businesses who will help to build the local economy. Mr. Sanders asked how many applicants there were for this RFP and Mr. Sukeforth stated that there was just the one. Mr. Sanders suggested that they should look at why there was only one applicant. Mr. Pateakos stated that normally they are getting more than one applicant for RFPs but at this site there is concern with brownfield contamination. Mr. Howland noted that with Mr. Holidman's concept there will be minimal impact or disturbance to the ground and creates a lot of green space. Ms. Borges congratulated the finance team, the procurement department, and the economic development team. She said that she loves Mr. Holdiman's vision. She asked if there is enough money available to help with the cleanup and Mr. Howland stated that they are looking for some additional grants. Mr. McCaul asked if it would be more than one level and Mr. Holdiman stated that it would probably stay at one level. Mr. Pottier noted that the site itself has some ullique challenges and recognized the value of being near the waterfront. Motion by Mr. Duarte and seconded by Mr. Sanders to adjourn at 6: 17 PM with the Council's thanks. So voted.
