Record of July 16, 2024 meeting was read by title and approved. So Voted.
Opportunity for input by the general public.
Steve Simmons, 17 Woodlawn Street, East Taunton, stated that it was decided in May that
the house numbers on his street would be changed. He discussed that at that point, they
said they would work with the residents, however, at nine weeks along they are no further
ahead. He discussed that his livelihood depends on the City sending out the packets. He
requested that the packets be sent out as soon as possible. He stated that if this is not
completed by August 25th at 5 :OOpm, this will infringe on his voting rights.
Mayor 0' Connell stated that the packets will be going out, that they are following the
process and that they have spoken to the Director of Elections.
John Rodophele, 8 Jackson Street, Taunton, discussed his concerns with the number of
accidents within the intersection of Washington Street and Jackson Street. He stated that
he has a camera on the intersections at Washington Street and when accidents occur, he
brings it to the attention of the Police Officer, however, they do not seem to be interested.
He also expressed his opposition to changing the house numbers on Woodlawn Street.
April Funches, 20 King's Court, Taunton, stated that the Taunton Diversity Network had
a produce pop-up in Paul Bunker today that was well attended, however, they have extra
produce that they have put in the lobby.
Hearing:
On the petition of Attorney Edmund Brennan, Jr., BSK, LLP, 174 Dean Street, Unit B,
Taunton on behalf of his client, Bristol County Savings Bank, Taunton to amend the City
of Taunton Zoning Map pursuant to City Ordinance §440 105 to change the zoning of
Presbrey Avenue, Leonard Street and School Street; Map 55, Lots 197 and 201; Map 66
lots 26, 27, 28 and 29 from Urban Residential to Central Business District. Motion was
made to open the hearing and invite the interested parties into the enclosure. So
Voted. The City Clerk read a communication from the City Planner recommending that

that the Municipal Council approve the requested change. The City Clerk read a
communication from the Vice Chairman of the Planning Board stating that on July 11,
2024, the Taunton Planning Board held a public hearing on the proposed Zoning Map
Amendment submitted by Bristol County Savings Bank to change the following
properties from Urban Residential District to Central Business District: Map 55, Lot 197
(45 Broadway); Map 55, Lot 201 (School Street); Map 66, Lot 26 (35 Broadway); Map
66, Lot 27 (24 Leonard Street); Map 66, Lot 28 (26 Leonard Street); Map 66, Lot 29 (28
Leonard Street). The Planning Board voted (6 members in favor, 1 member absent) to
forward a positive recommendation to the Municipal Council on the proposed zoning
map amendment. Motion was made to make the above listed communications a part
of the record. So Voted. The parties introduced themselves as Attorney Ed Brennan, 174
Dean Street, Taunton, representing Bristol County Savings Bank and Paul Mattos, Allen
& Major Associates, the site surveyors and engineers for the zoning change. Attorney
Brennan stated that Pat Murray, the CEO of Bristol County Savings Bank, and Paul
Lacey, the Facilities Manager of Bristol County Savings Bank, are also present this
evening. Attorney Brennan stated that the bank front is on Broadway and goes back in the
direction of the east to Presbrey Avenue. He stated that they also own the property on the
west side of Presbrey Avenue, which is on the north side of Leonard Street and on the
west side of School Street. He stated that the property has 230 feet of frontage on
Leonard Street, 219 feet on School Street and 277 feet on Presbrey Avenue. He stated
that the property is currently zoned as Urban Residential. He stated that all of the
buildings have been razed, with the exception of Costa's Service Center, which is no
longer operating and is owned by the bank. He stated that the proposal is to bring this
parcel of land to conformance with the zoning of the existing bank on Broadway, which
is the Central Business District, which would allow this property to be used for parking
purposes. He stated that the bank employees are currently parking on it and within the
last year they have been looking at ways to improve the parking area. He stated that in
order to improve the parking lot, they need to secure the zoning change from the Council
and then a Site Plan Approval from the Planning Board. He stated that they have received
a positive recommendation from the Planning Board to make this change. Mayor
O'Connell confirmed with Attorney Brennan that the entire property will be used for
parking. Attorney Brennan stated that it is anticipated that Costa's Service Center will
come down. Councilor Duarte confirmed with Attorney Brennan that the plan is to raze
Costa's Service Center. Councilor Duarte stated that there is a small portion of green
space in between Costa's and the parking that immediately abuts School Street. He
questioned whether the parking lot would be extended to include that green space.
Attorney Brennan stated that if the zoning change is secured and they submit a Site Plan
to the Planning Board, the parking lot has certain requirements that green space islands
are created within the parking area and that trees are planted of a particular size. He
stated that he is not sure if they will be preserving what is there or creating something
new as the Site Plan has not been designed yet. Councilor Duarte stated that there are
about four of five trees along School Street that he would highly encourage them not to
cut down. Council President Pottier stated that he appreciates the efforts of the petitioner
and expressed his support of the project. Motion was made to open public input. So
Voted. No one spoke during public input. Motion was made to close public input and
grant the petition as stated. So Voted. ·

Continued Hearing from July 9, 2024 (or Reconsideration: On the petition of Attorney
Daniel F. de Abreu, BRCSM, 174 Dean Street, Unit B, Taunton, MA 02780 on behalf of
his client SAN Holdings, LLC, 21 Second Street, Taunton, MA 02780 for the issuance of
a Special Permit to allow a 1,953 sq. ft. Marijuana Retailer at 235 Hart Street (Parcel 94-
215 and 94-152), Taunton located in an Industrial District. Motion was made to reopen
the hearing and invite the interested parties into the enclosure. So Voted. The City
Clerk stated that a Mullen Rule Certification has been included, which states that
Councilor Borges has certified under the pains and penalties of perjury that she is a
member of the Municipal Council and that she missed a hearing session that was
originally held on May 21, 2024 and that she has seen the video record, a transcript of the
missed hearing and the documents included in the agenda packet for said hearing and the
PowerPoint Presentation provided to her by the City Clerk. The City Clerk stated that this
was signed and recorded in her office on July 16, 2024. Motion was made to make this
communication a part of the record. So Voted. The parties introduced themselves as
Daniel de Abreu, 174 Dean Street, Taunton; Jacques Barbour, 21 Second Street, Taunton,
member of SAN Holdings; Sandra Nasrawi, 30 Clarks Cove, South Dartmouth, MA
02748, a member of SAN Holdings; Brian Dunn, Principal of MBL Land Development
and Permitting, located at 5 Bristol Drive, Easton, who are the Civil Engineers and Land
Surveyors for this project; Tracy Duarte, Director of Engineering for MBL Land
Development; Emily Buck, representing Bowman, the traffic engineers for the project.
Attorney de Abreu stated that they are here to request a Special Permit to allow a retail
only marijuana establishment at 235 Hart Street and Parcel 94-215. He stated that the
proposal is to combine these two lots into one lot, which will be a 2.14 acre parcel. He
stated that the establishment would be a total of 1,953 sq. ft., with 1,023 sq. ft. of retail
and 930 sq. ft. of office area. He stated that it is zoned in the Industrial District, which is
appropriate for the proposed use. He stated that this is immediately adjacent to where a
site was previously approved by the Council for a much larger facility at 7,000 sq. ft. for
retail and cultivation use. He stated that in this petition, they are requesting only retail
use. He stated that they did a full presentation previously, however, in summary there
will not be a significant impact to the traffic. He discussed that there are adequate site
lines for people that are exiting the facility. He stated that they have received Site Plan
Approval from the Planning Board and they have received a waiver from the City ofthe
HCA requirement. He stated that the Site Plan shows eleven (11) parking spaces and that
the hours of operation would be from lO:OOam until 7:00pm daily. Council President
Pottier stated that he is in favor of this proposal. Councilor Quintal confirmed with Mr.
Barbour that they are operating by appointment only. Councilor Quintal questioned the
nature of the sign they will advertise. Attorney de Abreu discussed that it will be
aesthetically pleasing and that there will be nothing offensive. Councilor Borges stated
pursuant to M.G.L. Chapter 39, Section 23D, she watched the video, reviewed all of the
documents and all of her questions were answered. She stated that she will be supporting
this petition. Councilor McCaul discussed that he is excited about the opportunity and is
in support of the project. Motion was made to open public input. So Voted. Johp
Rodophele, 8 Jackson Street, Taunton, expressed concern for wet lands in the location, as
well as concern that this is a residential area and not an appropriate location for a
marijuana facility. Motion was made to close public input and grant the petition. On
a roll call vote, nine (9) Councilors were present, six (6) Councilors voted in favor
(Dooner, Quintal, Sanders, Pottier, Borges and McCaul), three (3) Councilors voted
in opposition (Duarte, Postell and Martin). The motion passes. Motion was made to
excuse the parties. So Voted.

Communications from the Mayor:
Mayor 0' Connell stated that there are community updates listed in the agenda packet, as
well as the City's website and Facebook Page.
Appointments:
Reappointment of George Mendros, 116 Davenport Street, Taunton to serve on the Cable
Advisory Commission for a term of five (5) years expiring in July 2029. Motion was
made to approve. So Voted.
Reappointment of Greg Glynn, 112 Bay Street, Taunton to serve on the Cable Advisory
Commission for a term of five (5) years expiring in July 2029. Motion was made to
approve. So Voted.
Reappointment of Steven Turner, 160 Seekell Street, East Taunton to serve on the
License Commission for a term of six (6) years expiring in July 2030. Motion was made
to approve. So Voted.
Communications from Citv Officers:
Com. from the Chief Financial Officer stating that the Finance Department would like the
opportunity to request for surplus three additional abutters that were not included in the
July 2, 2024 surplus declaration hearing. Therefore, they are asking for a discussion and
vote on three additional small lots that currently do not qualify for the City's abutter
program to be taken up on July 30, 2024 in the Committee on Public Property. Motion
was made to refer to the Committee on Public Property on July 30, 2024. So Voted.
On discussion, Council President Pottier stated that he will not be present for the meeting
on July 30, 2024.
Com. from the Treasurer/Collector stating that they would like to present year-end
information on earnings and collections, as well as quick economic forecast to the City
Council. They request that this presentation take place on August 6, 2024 during the
Finance and Salaries Committee meeting. Motion was made to refer to the Committee
on Finance and Salaries. So Voted.
Com. from the City Solicitor stating that in 2022, the Council adopted the Ordinance
authorizing the City to hire Civilian Traffic Control Officers (CTCOs). Given the nature
of the position, it is requested that the Council vote to designate the CTCO position as
"Special Municipal Employee" under the State Ethics Law. Motion was made to
designate Civilian Traffic Control Officers as Special Municipal Employees. So
Voted.
Com. from the Chief of Police stating that the Human Resources Department recently
advertised to fill twenty (20) positions for Traffic Control Officer (TCO) positions within
the City of Taunton. As these positions fall under the control of the Police Department;
the Police Chief serves as the appointing authority for Traffic Control Officers. He has
become aware that his stepson has applied for one of these positions which creates a
conflict of interest for him. He has delegated the actual hiring process to Captain Eric
Nichols. While he has delegated the hiring process to Captain Eric Nichols, this simple
delegation would be considered "participation" from the perspective of the State Ethic
regulations. Because of this conflict, he needs written authorization from his appointing

authority to participate in the hiring process, and if his stepson is selected as a candidate,
provide a conditional offer of employment. This authorization to participate would
require a full vote of the Council. Motion was made to authorize the Police Chief to
participate in the hiring process of the Civilian Traffic Control Officers and provide
a conditional offer employment to his stepson if he is selected as a candidate. So
Voted.
Com. from the Safety Officer regarding the section of Lawrence Street at Whittenton
Street for a possible stop sign. After looking at the intersection, it appears to be a four
way intersection with Fourth Street almost directly across from Lawrence Street. This
may confuse motorists on Lawrence Street and on Fourth Street. At this time he is asking
the Municipal Council for an Ordinance for a stop sign at Lawrence Street at Whittenton
Street and an Ordinance for a stop sign at Fourth Street near Whittenton Street. Motion
was made to refer to the Committee on Ordinances and Enrolled Bills. So Voted.
Com. from the Animal Control Officer stating that they received invoices for June 2024
in the amount of $994.37 from the Taunton Animal Hospital in July. They need approval
to pay these invoices from account #27-121-6707-5599. Motion was made to refer
pages 7 through 13 to the Committee on Finance and Salaries. So Voted.

Flammable Storage License - Transfer of Ownership
Petition submitted by Carolyn Parker, Carolyn A. Parker Consulting, 3 Lorion Avenue,
Worcester, MA 01606 on behalf of her client TK Taunton, LLC, 313 Boston Post Road
West, Suite 120, Marlboro, MA 01752 requesting approval of a change of ownership of
the Flammable Storage License located at 2318 Bay Street, Taunton from D & D Realty
Trust, 2318 Bay Street, Taunton 02780 to TK Taunton, LLC. (DEED ON FILE). Motion
was made to approve. So Voted.

New Business:
Councilors Pottier and McCaul requested to refer to either the Committee on Military and
Veterans Affairs or the Committee of the Council as a Whole the issue of Veteran
Homelessness. Motion was made to refer to the Committee on Military and Veterans
Affairs. So Voted. On discussion, Councilor McCaul stated that he would like to have a

discussion as soon as possible on this issue. Councilor Dooner stated that she will discuss
this with Ally Rodriguez and find a time that will work for her as well as the Committee
and get it on the agenda as soon as possible.
Councilor Pottier requested a discussion with the Mayor and fellow Councilors on the
scheduling of the Council meeting on Tuesday, September 3, 2024, which is the date of
the Massachusetts Primary. Motion was made to schedule the Council meeting for
Tuesday, September 3, 2024 at 7:30AM. So Voted.
Mayor O'Connell stated that there are coupons for the Farmer's Market available at the
Taunton Council on Aging, located at 30 Olney Street, beginning Tuesday, July 23rd at
9:00am. Individuals must be a resident of Taunton and 60 years or older. Any questions
can be directed to the Council on Aging at (508) 821-1425.
Councilor Quintal stated that the tiles on the roof of St. Mary's Church have been sagging
and he is concerned that they are going to come down. He stated that he has been in
communication with Father Fred, however, he is being transferred. He requested that
Chris Carmichael and Bob Pirozzi reach out to him so that he can show him and if the
Law Department can get a letter to the Diocese of Fall River urging them to put up a
temporary construction fence all the way around the perimeter.

Motion by Ms. Borges and seconded by Mr. Martin to approve the payroll warrant in the

3. Meet to discuss the request that any and all permit, building, or connection fees be waived for

Mr. Duarte read a letter from Patrick Delio Russo dated 7/11/24.
Mr. Pateakos explained that Habitat for Humanity won the RFP for this project and this will
be Taunton's first Habitat home. Mr. Delio Russo stated that traditionally fees have been
waived for non-profits and charitable groups.

Mr. McCaul asked what the expenses will total and Mr. Dello Russo stated that he would get
the exact numbers but that he did not believe it would be in excess of $3000. Mr. McCaul
asked where the funding would come from and Mr. Delio Russo stated that they simply
would not collect the fees.
Mr. Duarte asked for the timeline for the completion of the project and Mr. Patealcos stated
he believed it would be within a year.
So voted.
4. Meet to discuss the request to amend the allowable expenses for TRIAD to include food
assistance.
Mr. Duarte read a letter from Patrick Delio Russo dated 7/16/24.
Mr. Delio Russo explained that this would allow for food assistance to be an allowed expense
from the TRIAD account.
Motion by Ms. Borges and seconded by Mr. Martin to amend the expenditure Order to
include food assistance as an allowable expense. So voted.
Motion by Ms. Borges and seconded by Mr. Martin to adjourn at 5:45 P.M So voted.

Mr. Comaglia stated that he spoke to Kevin Duquette and everything looks good.
Mr. Duarte stated that the Committee only received the draft 2 or 3 hours ago so if this were
to move forward, he would suggest that they do so subject to Mr. Costa receiving a copy and
the committee receiving a communication confirming that Mr. Costa has no issues.
Mr. Sanders said he wouldn't mind waiting a week to have adequate time to review.
Ms. Dooner requested that the Law Department send a red-lined version.
Motion by Mr. Duarte and seconded by Ms. Dooner to table for a week. So voted.

The meeting was called to order at 5:58 PM.
1. Approve minutes from March 26, 2024.
Motion by Mr. McCaul and seconded by Ms. Dooner to approve. So voted.
2. Meet to discuss the City's current solid waste curbside collection process, automated
curbside trash collection, and the recent Request for Proposals for land lease for composting
and yard and brush disposal for 3 60 West Britannia Street.
Mr. Duarte read a letter from Fred Comaglia dated July 11, 2024.
Ms. Nunes reviewed different options for trash collection including the potential to move to
trash carts. She stated that the State wants to reduce waste and pushes a pay as you throw
model. Automation is the trend. She noted that a larger cart would disqualify the City from
certain incentive programs and grants. She explained the DEP program and stated that fthe
City were to move away from a 35 gallon container, they would no longer be eligible.
Ms. Dooner asked for the pros and cons of the trash carts. Ms. Nunes explained that the bags
were introduced in 2003 and the fee went from $1 to $2 in 2012. While there is a cost
associated with the carts, it is a one-time cost She noted that there has been lots of feedback
on the quality of the bags and, while the costs are rising, it probably is not realistic to charge

more and still provide the same bag. She stated that carts can be stored outside and the
contents are protected from the elements. Trash companies are encouraging automation and
the cost for collection comes down. Ms. Dooner asked Mr. Delio Russo for his thoughts and
he stated that there already is a trash fee but now it would be a bin fee. He thought the 35
gallon bin would be the most cost effective but noted that the tonnage is really where the City
incurs its costs. Ms. Nunes noted that the City has no assurance that the bag prices won't
rise.
Mr. Postell stated that this is a preliminary discussion and indicated that while the cost of
trash bags has risen, the quality of the bags has diminished and sometimes you can't even
find the bags. He suggested that they consider which option will have the least impact to the
taxpayers. Mr. Postell stated that the challenge will be that carts might work for certain
families but a senior might have less trash than a large family, for example. He did think that
a 35 gallon bag or cart is a reasonable, middle of the road option to consider. Mr. Postell
wondered what would happen if someone wanted to add an additional bin or extra trash bag
beyond the bin and if bags would still be available. He noted concerns with odor but thought
the collection would be more efficient. He asked about flying debris from dumping and also
asked about mechanical issues with current recycling collectors. Ms. Nunes stated that she
hasn't really seen delays due to the recycling truck. Typically, the issues are with the older
trucks.
Mr. Duarte pointed out that since the trash cart would have a flat fee associated with them
based on some average, there is a potential con since now with the pay as you throw you pay
for what you actually throw away, not more and not less. Ms. Nunes stated that there would
be exemptions.
Mr. Sanders asked what percentage of the total cost is covered by the $2 bags and Ms. Nunes
stated that it is about $2.05 Million which equates to less than 50% of the curbside collection
costs. Mr. Sanders wondered ifthe goal would be to have residents cover the cost or to
maintain that split. Ms. Nunes stated that lots of communities have some sort of mix of taxes
and fees. Mr. Sanders stressed that he believes there needs to be some flexibility and options
for residents. For some, the 35 gallon bin won't always be sufficient. He would support
providing the bins but additional bags would be at a cost that is significantly more. Mr.
Sanders suggested that the more that is diverted from the stream, the better.
Mr. McCaul was concerned that seniors might not be able to move a large cart and he would
like to see more information. He suggested that they look at stronger bags.
Mr. Duarte asked ifthere would be no savings on collection in the first year of the trash cart
and Ms. Nunes stated that the increase is with the contract but it would be reevaluated after a
year. Mr. Duarte suggested that the only cart size on the table is 35 gallons since they don't
want to lose Mass DEP incentives. He asked how much the DEP programs are and Ms.
Nunes stated that the dividend program is about $49,000 and the amount rolls over and helps
to support pay as you throw programs. There are different incentive programs to fit DEP's
master plan. She stated that there is a pay-as-you throw grant that they would be pursuing.

Mr. Martin suggested that going with carts might make the City more attractive to other
companies when the time comes to renegotiate.
The Committee discussed the composting RFP. Ms. Nunes stated that the landfill closed, is
now used as the convenience center and so was the perfect location. The successful response
to the RFP was from Black Earth Compost. Mr. Delio Russo stated that they are looking for
a motion to refer this to Public Property for a vote and discussion on a lease agreement with
Black Earth. He noted that this is another way to cut costs and stressed that they are
interested in working with the School Department.
Mr. Duarte stated that not a lot of companies are doing this, particularly the site management
work. He indicated that they asked for a lot in the RFP and Black Earth agreed to it all
including picking up the schools' composting at no cost to the City. Ms. Nunes stressed that
this provides an outlet for the organic waste.
Motion by Mr. Sanders and seconded by Mr. Postell to refer this to the Public Property
Committee. So voted.
Motion by Mr. Postell and seconded by Ms. Dooner to adjourn the meeting at 6:58 PM So
voted.

Re: Designation of Civilian Traffic Control Officer as a Special Municipal Employee
Position
Dear Council President Pottier and Members of the Municipal Council:
In 2022 the Council adopted the Ordinance authorizing the City to hire Civilian
Traffic Control Officers (CTCOs). CTCO is an on-call, per diem position without a set
working schedule and with flexibility in terms of the assignments that are accepted by the
employee.
Given the nature of the position, we are requesting that the Council vote to
designate the CTCO position as "Special Municipal Employee" under the State Ethics
Law. CTCO is appropriate for classification as a Special Municipal Employee position
because it is without a set schedule and can be performed outside of the employee's
normal working hours (such as weekends).
The designation of this position as a Special Municipal Employee position will
provide clarification for State Ethics Law purposes, in order to facilitate compliance with
the restrictions that apply to holding more than one position with the same municipality.
All City employees who are hired as CTCOs will be required to file a State Ethics Law
Disclosure with the City Clerk.
For the reasons explained above we are respectfully requesting that the Council
vote to designate CTCO as a Special Municipal Employee position.

Dear Mayor O'Connell:
The Human Resources Department recently advertised to fill twenty (20) positions for Traffic Control Officer
(TCO) positions within the City of Taunton. As these positions fall under the control of the police department, I
serve as the appointing authority for Traffic Control Officers. I have become aware that my stepson has applied
for one of these positions. This creates a conflict of interest for me in this matter as I serve as the appointing
authority. I have delegated the actual hiring process to Captain Eric Nichols as it falls within his lane as the
Administrative Captain within the police department. While I have delegated the hiring process to Captain Eric
Nichols, this simple delegation would be considered "participation" from the perspective of the State Ethic
regulations. Because of this conflict, I need written authorization from my appointing authority to participate in
the hiring process, and if my stepson is selected as a candidate, provide a conditional offer of employment. This
authorization to participate would require a full vote of the council.

At the June 25th meeting of the Municipal Council, Councilor Pottier referred the section
of Lawrence Street at Whittenton Street to the Safety Officer for a possible stop sign.
After looking at the intersection it appears to be a four way intersection with Fourth
Street almost directly across from Lawrence Street. This may confuse motorists on
Lawrence Street and on Fourth Street. At this time I am asking the Municipal Council for
and ordinance for a stop sign at Lawrence Street at Whittenton Street and an ordinance
for a stop sign at Fourth Street near Whittenton street.
