Motion was made to recess at 7:05pm. So Voted. Motion was made to resume the regular order of business at 7:09pm. So Voted. Opportunity for input by the general public. Pauline Riley, 31 Ocean Avenue, Quincy, stated that she is a volunteer with the United Sovereign Americans. She discussed concerns with the State's voter database and that research conducted by her organization shows that the 2022 may not have been accurate. She stated that they will be presenting a resolution that calls for an end of inaccuracy that plagues elections and a summary of their findings. 2 Sandy Abdelhad, 12 Pine Needle Drive, Mendon, stated that she is a volunteer with the United Sovereign Americans. She read a portion of the Resolution for a Legally Valid 2024 General Election. Pam Coyle, 11 Wagonwheel Way, Mansfield, stated that she is a volunteer with the United Sovereign Americans. She read a portion of the Resolution for a Legally Valid 2024 General Election. Valerie Flaherty, Tanglewood Drive, Attleboro, stated that she is a volunteer with. the United Sovereign Americans. She read a portion of the Resolution for a Legally Valid 2024 General Election. Jeff Cohen, 18 Cobalt Street, Wilmington, stated that he is a volunteer with the United Sovereign Americans. He discussed the importance of voting rights and passing the Resolution. John Rodophele, 8 Jackson Street, Taunton, requested that a stop sign be placed at the intersection of Jackson Street and Washington Street, as well as the intersection of Whittenton Street and Jackson Street. Hearing: Continued Hearing from April 25, 2023: Upon the petition submitted by Taunton Municipal Lighting Plant and Verizon New England, Inc. proposing to relocate multiple jointly owned poles - 69, 70, 73, 74 and to place a new push brace at pole 75, starting at 257 Scaddings Street in the City of Taunton. Motion was made to open the hearing and invite the interested party into the enclosure. So Voted. The Assistant City Clerk stated that a map of the location has been included. The party introduced himself as Ross Bilodeau, representative for Verizon New England. Councilor Borges stated that she spoke with the representative and said that she was going to ask for this hearing to be continued again. She discussed that this was brought to their attention in June of 2023 and there has been no movement with MassDOT District 5. She stated that she spoke with the owner of the property that this could directly affect if the pole is placed in front of the vacant land that he plans to build a house on. She stated that she reached out to MassDOT and she has not heard back from them. She stated that Mr. Bilodeau was under the impression that this had been straightened out, which it has not. She stated that Mr. Comaglia could not be here this evening and did request that the Council continue this hearing for a date certain until they get more answers. Mr. Bilodeau stated that this is a MassDOT project and Verizon would not be moving these poles unless they reached out and asked them to for their project. He stated that there have been no changes to this plan as it was presented last year. Motion was made to continue the hearing until September 10, 2024. So Voted. On discussion, Councilor Duarte asked that someone reach out to MassDOT Municipal Affairs to have them provide something in writing for that hearing. Mayor O'Connell stated that the City Clerk can send this to Mayor's Office and they can take care of it. On the petition submitted by Antonio S. Bairos, Trustee of A.L.E. Realty Trust, P.O. Box 1126, Taunton, MA 02780 for the acceptance of Leona's Lane and Ayla's Circle as public ways in the City of Taunton. Motion was made to open the hearing and invite 3 the interested party into the enclosure. So Voted. The Assistant City Clerk read a communication from the City Engineer stating that he is sending a positive recommendation to the Municipal Council for the acceptances of Leona's Lane and Ayla's Circle as public ways by the City of Taunton. The streets are located off of Somerset Avenue. This project was approved by the Planning Board under its definitive subdivision rules and regulations and was inspected by the outside consultant, Field Engineering. The contractor has met all of the responsibilities of the contract satisfactorily and has submitted all of the required documents. The Assistant City Clerk read a communication from the Chairman of the Taunton Planning Board stating that at their regularly scheduled meeting held on June 6, 2024, the Taunton Planning Board voted to send a positive recommendation to the Municipal Council to accept Leona's Lane and Ayla's Circle as an accepted public way in the City. The Assistant City Clerk stated that a map of the location has been included. Motion was made to make the above listed communications a part of the record. So Voted. The party introduced himself as Antonio Bairos, the builder for the site. He requested that the Council accept these roads as public ways. Motion was made to open public input. So Voted. No one spoke during public input. Motion was made to close public input and grant the petition. So Voted. Communications from the Mayor: Mayor 0' Connell stated that there are community updates listed in the agenda packet, as well as the City's website and Facebook Page. Communications from City Officers: Com. from the City Clerk requesting to pay a prior year bill for the Taunton Daily Gazette in the amount of $476.14. Motion was made to refer to the Committee on Finance and Salaries. So Voted. Com. from the Chief Financial Officer stating that the Finance Department has been contacted by the Golf Commission with interest in establishing a gift account for repairs, upgrades and construction cost at the John F. Parker golf course. Motion was made to refer to the Committee on Finance and Salaries on August 6, 2024. So Voted. Com. from the Executive Director of OECD requesting that a vote be taken by the members of the Council to approve a Tax Increment Exemption for the development to be constructed at 12 Porter Street. Mayor O'Connell invited the interested parties into the enclosure. Mr. Pateakos stated that they are working on the City's first HDIP application and the round deadline is August 9th. Mr. Clymens introduced himself and his partner, Hannah Cassidy, and stated that they are here regarding the 12 Porter Street Development and the HDIP Program. Mr. Clymens discussed that the HDIP Program was created to support the development of market-rate housing and is a tax incentive program. He used a slide presentation to discuss the development plan. Mr. Dello Russo discussed that this project this will increase value to the surrounding abutters, a cost avoidance measure for the City and will be an overall increase in revenue for the City. Councilor Sanders asked whether affordable housing would be included in this project. Mr. Clymens stated that this project will not include affordable housing and that HDIP is designed for market-rate housing only. Councilor Duarte discussed that the City currently collects $7,300.00 in taxes on this property and even with the exemption, it will be increased to $110,000.00 a year for a total increase of $1,100,000.00, which is significant for just one property. 4 Councilor Duarte asked Mr. Pateakos how many other gateway cities have received an HDIP award. Mr. Pateakos stated that he was not sure of the number, however, he believes that Taunton is the only one in the southern area. Motion to approve the Tax Increment Exemption (T.I.E.) and the Resolution as presented. So Voted. Com. from the Chairman of the Taunton Planning Board stating that the Planning Board will meet on August 1, 2024 at 5:30PM on a Roadway Improvement Plan Modification for Maynard, Hunter and Little Street. Motion was made to receive and place on file. So Voted. Com. from the Chairman of the Taunton Planning Board stating that the Planning Board will meet on September 5, 2024 at 5:30PM on the Proposed Zoning Change for property on Lot 29-14 Prince Henry Drive to re-zone from Open Space to the Industrial District. Motion was made to receive and place on file. So Voted. Com. from the Director of the Emergency Management and Election Director stating that the City of Taunton secured $33,444 in federal grant funding from the Southeast Regional Homeland Security Advisory Council (SRAC) to obtain a Variable Message Board and Light Tower to support regional emergency preparedness efforts. Mayor O'Connell expressed gratitude Todd Castro and Marc Pacheco for their efforts. No motion was taken. Com. from Councilor Duarte regarding the sewer project for Oak Hill and Colonial Estates. Councilor Duarte motioned to refer to the Department of Public Works and BETA for a written response within thirty (30) days. On discussion, Councilor McCaul stated that this was a discussion within the Committee on the Department of Public Works about a month ago and they should have an update in October. He stated that there has been $190,000,000.00 worth of upgrades in the infrastructure in that area. Councilor Duarte stated that the $190,000,000.00 that was spent at the Waste Water Treatment Plant has nothing to do with the effluent discharge project. Motion was made to refer to the Department of Public Works and BETA for a written response within thirty (30) days. On a roll call vote, seven (7) Councilors were present, six (6) Councilors voted in favor, Councilor McCaul was opposed. The motion passes. Councilors Pottier and Quintal were absent. Com. from the First Assistant City Solicitor stating that pursuant to the Ordinance regarding Marijuana Establishments (Chapter 222), each Marijuana Establishment must have a Host Community Agreement Waiver. Councilor Sanders motioned to move approval. On discussion, Councilor Duarte questioned if there is a list of the marijuana establishments that require an HCA Waiver. Attorney Gay stated that he does not have that list available, however, Terry in the Law Department and the City Clerk's Office maintain those records so they can provide it. He discussed that the idea would be for it to be a blanket over existing companies that have not received the waiver instead of having to repeatedly put them on the agenda. Mayor O'Connell questioned if any of them were timely. Attorney Gay stated that he did not have that information. Councilor Duarte discussed that the waiver is a proxy HCA and if a certain establishment is not wanted then they would vote against the waiver. He discussed it would be more beneficial to vote on each of them individually. Motion was made to provide HCA waivers to all marijuana establishments that currently have HCA's. On a roll call vote, seven (7) 5 Councilors were present, six (6) Councilors voted in opposition, Councilor Sanders voted in favor. The motion does not pass. Councilors Quintal and Pottier were absent. Motion was made to place a list of the pending HCA's for potential waivers on the agenda for next week. So Voted. Com. from the Fire Chief stating that they are informing them as the appointing authority for the City of Taunton of a change in the Massachusetts Civil Service process for the grading of promotional exams. After consulting with members of the Fire Department command staff, they believe the testing that is best suited for their Department is the Weighted/Graded Assessment Center exam. He proposes that the scoring for the upcoming Deputy Chief Exam be weighed in the following manner: 1. Technical Knowledge 30%; 2. Situational Judgement Test 20%; 3. Assessment Center 30%; 4. Experience, Certifications, Training and Experience 20%. Taunton Fire is currently scheduled to test for the Deputy Chief position in November 2024. He requested the approval to use the percentages listed above and to authorize the City Clerk to inform Mass. Civil Service of this decision. Motion was made to authorize. So Voted. Com. from the City Solicitor stating that the Administration has successfully negotiated with the American Federation of State, County and Municipal Employees, Council 93, AFL-CIO, Local 1701 for a successor collective bargaining agreement covering fiscal years 2025 through 2027. Motion was made to refer to the Committee of the Council as a Whole for an Executive Session. So Voted. Communications from Citizens: NONE. Petitions: Marijuana License - NEW 1. Lunar Xtracts, Inc. located at 144 West Britannia Street, Taunton for a NEW Marijuana Products Manufacturer License. Councilor Postell stated that the Committee on Public Property met today and it was asked that item D regarding moving the property of Map/Lot 63-1-0 to surplus was pulled out and that a roll call vote be taken. Motion was made to approve items A, B, C, E and F, with G being tabled, in the Committee on Public Property. So Voted. Motion was made to approve item D in the Committee on Public Property regarding Map/Lot 63-1-0 being moved to surplus on a roll call vote. SIGNS, SIGNALS AND MARKINGS Section 405-95-C Be it ordained by the Municipal Council of the City of Taunton as follows: That Section 405-95-C of the Revised Ordinances of the City of Taunton, as amended, be and hereby are further amended by adding thereto the following: Located at the intersection of West Britannia Street and Danforth Street, facing Danforth Street at intersection with West Britannia. All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. Motion was made to pass to a second reading. So Voted. Motion by Ms. Borges and seconded by Mr. Martin to approve the payroll warrant in the amount o/$1,548,288.68. So voted. Motion by Ms. Borges and seconded by Mr. Martin to approve the accounts payable warrant in the amount o/$647,874.90. So voted. 3. Meet with the Finance Department to review the Five-Year Forecast. Mr. Dello Russo and Mr. Enos gave a presentation reviewing the five-year forecast. Mr. Dello Russo stated that revenue analysis is based on historical trends. Mr. Enos highlighted the big drivers which are Proposition 2 Yz, new growth of at least $1 Million/year, solar revenue, and debt exclusion for the High School renovation which falls off in 2028. Mr. Dello Russo stated that there are known eventualities which should be planned for. Mr. Enos explained the OPEB (Other Post-Employment Benefits) trust. He stated that there is approximately $4-5 Million in the account. Mr. Dello Russo reviewed the General Government forecast which is on pace to increase about 2 Yz% year over year based on traditional spending habits. In Public Safety he noted that retirement payouts can be "budget 9 busters". He further stated that they are cautious with the SAFER grant and noted that this forecast is a worst case scenario. Mr. Enos covered education and noted that the Agricultural and Regional School projects are included in the forecast. In FY26 the BP project will be at about the full amount. For Taunton Public Schools, 100% funding includes the appropriation and building work. Mr. Dello Russo reviewed the forecast for the Department of Public Works and noted that they believe there could be reductions in this area (exclusive of trash) to offset other areas. He stated that the pay-as-you go model for capital is creating stability in the department outside of the trash pickup budget. Mr. Enos looked at the Enterprise Funds forecasts and stated that the rates have to support the expenses within the enterprise accounts so they will be looking at water and sewer rates. Further, there are looking at a study on indirect charges. Mr. Dello Russo covered the Health and Human Services and Culture and Recreation forecast and thanked the department heads. Mr. Enos covered Fixed Costs and noted that the OPEB pension drops off in FY30. He also reviewed the overall revenue vs. expense slide and said that there is some work to do. Ms. Borges commented on the final revenue vs. expense slide and stated that it seems to be a large deficit. Mr. Dello Russo suggested looking at creative revenue sources. Ms. Borges asked about the school building projects. Mr. Enos stressed that they are buiding the budget to support the construction projects at Bristol-Plymouth and Bristol Aggie. Mr. Martin asked if anything is coming off the debt anytime soon and Mr. Dello Russo stated they have level funded the debt and interest cost so that it is available if the City needs it. Mr. Martin asked if they budget high and Mr. Enos stressed that they use worst case scenarios. Mr. Duarte referenced the Public Safety forecast and asked if this forecast assumes the SAFER grant goes away and Mr. Dello Russo confirmed. Mr. Costa stated that he had reviewed the draft ordinance. He met with Kevin Duquette, Fred Cornaglia, and Joe Federico and subsequently they rearranged and cleaned up some language. Mr. Duarte asked if this complies with the update to the plumbing code and Mr. Costa confirmed. Motion by Mr. Duarte and seconded by Ms. Dooner to send to a.first reading. Mr. Sanders referenced 375-9A which uses the word "contact". Attorney Gay suggested changing this to "hire". Mr. McCaul questioned the backwater valves and when it's not a new home, he wondered who polices the backwater valves. Mr. Costa stated that he does not get a list so he is not sure what would trigger this inspection. Attorney Gay suggested this could be a standard operating procedure where an inspection it is triggered when a home is sold and they get a 13 final water reading. Approve minutes from July 2, 2024. Motion by Mr. Duarte and seconded by Mr. Postell to approve. So voted. 2. Meet to discuss the request to declare lots as surplus: Motion by Mr. Postell and seconded by Mr. Duarte to invite in the interested parties. So voted. a. Map I Lot 92-252 b. Map I Lot 92-248 Mr. Conti explained that these lots are owned by the City but are being used by the owner of 91 Berkley Street. Mr. Duarte asked if there is a structure on each site and Mr. Conti explained that one has a fence and the other has a shed and fence. 15 Mr. Postell asked if there would be any fmes assessed and Mr. Conti said that would be up to the officials. Mr. Postell expressed concern with the risk management issues associated with the shed. Mr. Dello Russo stated that this is an attempt to correct that. Mr. Martin asked what happens if the abutter doesn't want to buy the parcels. Mr. Conti stated that the City could fence it off or Mr. Dello Russo stated that the structure could be taken down. Mr. Postell asked what the process would be and if the structure would need to come down either way. Mr. Conti stated that it would be up to the City Solicitor. Ms. Dooner confirmed that other abutters could potentially purchase the lots. Ms. Borges asked about Mr. Conti's visit to the abutter and Mr. Conti stated that they were not at home but he left information with his card. Ms. Borges suggested that a certified letter be sent. Mr. Duarte asked what the process will be once it is declared surplus and Mr. Sukeforth stated that there will be an RFP that is cordoned off for the abutters. Motion by Mr. Duarte and seconded by Mr. Postell to declare Map 92, Lot 252 and Map 92, Lot 248 surplus. Mr. Postell felt that the abutter needs to be notified and the Law Department should determine if the structure needs to come down as he is concerned about the structure. Mr. Duarte added to his motion to refer to the Law Department to provide some sort of notification to the resident at 91 Berkley Street. So voted. c. Map I Lot 94-200 Mr. Sukeforth stated that this is similar to the previous situation and there is a driveway on the parcel of City land. Motion by Mr. Duarte and seconded by Mr. Postell to declare Map 94, Lot 200 surplus. So voted. d. Map I Lot 63-1-0 Mr. Sukeforth explained that the abutter has reached out to the City and the interested party wants to use this as a buffer. Mr. Martin asked if there was a way to say that it couldn't be built upon and Mr. Conti stated that there could be a deed restriction. Ms. Borges noted that this abuts the Bennett School and perhaps they should think about holding onto this parcel. Motion by Mr. Duarte and seconded by Mr. Postell to surplus 63-1-0 with a deed restriction in perpetuity for conservation. So voted. e. Map 84 I Lot 61 Richmond Street f. Map 71ILot32 Richmond Street Mr. Conti explained that 84-61 is landlocked and is mostly upland. There is interest from an abutter to utilize the property. Mr. Howland stated that they were approached by a party on Route 44 who are looking to develop up on Route 44 but in order to do so they need to replicate wetlands and create some Natural Heritage land. They wish to purchase and then turn it over to the Natural Heritage trust. The additional acreage will help them to do what they want to do. Mr. Duarte asked if a deed restriction would hurt their process. Mr. Howland wanted to confum. Motion by Mr. Duarte and seconded by Mr. Postell to table (84-61 and 71-32). So voted. g. With the support of Mayor O'Connell and Chief Walsh, the City of Taunton secured $33,444 in federal grant funding from the Southeast Regional Homeland Security Advisory Council (SRAC) to obtain a Variable Message Board and Light Tower to support regional emergency preparedness efforts. The Variable Message Board can be rapidly deployed to quickly enable widespread information-sharingto the public whereas the Light Tower will provide nighttime illumination for first responders working in low-light or darkened conditions. Both assets are truly welcomed as TEMA's light tower inventory is dated and the Agency lacked a message board. Additionally, through successful partnership with TEMA, Director of Elections Mark Pacheco has obtained $17,000 from SRAC. This funding will be utilized to train frontline election workers in preparation for the 2024 federal election cycle. Premier subject matter experts in election and public safety industries will educate regional workers in the best practices for de-escalation and situational awareness for a safe and secure election. The training is expected to occur in September and specific details of the training are forthcoming. Both Mark and I would like to thank Mayor O'Connell, Chief Walsh and the members of the Taunton Municipal Council for your ongoing support of our city's Emergency Management and Elections Department.
