Taylor Borough Council Hearing November 13, 2019 The Taylor Borough Council held a Public Hearing on Wednesday, November 13, 2019 at 7:00 P.M. at the Taylor Municipal Building, 122 Union Street, Taylor, Pennsylvania. On Roll Call, Councilman DeAngelo, Yes; Councilman Fallon, Yes; Councilman Tigue, Yes; Councilman Derenick, No; Councilman Digwood, Yes; Councilman McKeel, Yes; Councilman Mickavicz, No; Mayor Praschak, Yes. Councilman McKeel chaired the meeting. First, Councilman McKeel introduced Bill Jones, Solicitor, for further explanation. Next, Solicitor Jones informed the Public that the Hearing was to consider and take testimony and receive comments and recommendations concerning the adoption of an Ordinance under the Local Economic Revitalization Tax Assistance Act (the “LERTA Statute”) for property comprising approximately 8.25 acres site that is located on Oak Street identified as PIN # 16607-030-00101 Lackawanna County Recorder of Deeds Office Instrument No. 201804059 and further to amend Ordinance No. 10 of 2016. Taylor Borough Council to restrict the boundary of the LERTA Parcel. By way of Background - We adopted Original Ordinance No. 10 of 2016 which allowed LERTA on an approximate 25.43 acre parcel given by Development Authority for the Borough of Taylor (DABT) to Taylor 1, LLC. Subsequent to the adoption, Taylor Borough was approached by Taylor 1, LLC to adopt a tax increment financing (TIF) district. We did this in conjunction with Lackawanna County, Riverside School District and the Borough of Taylor which resulted in a TIF district for the 16.84 acres. Out of the original 25 acre piece, there was a Clover Parcel which Taylor Borough is restricting the LERTA to. However, with regard to the TIF District, the Manager was approached by Lackawanna County they issued various bonds with FNCB Bank and how the bonds are to be paid is with the tax revenues from the remaining parcels which would be the 16.84 acres. If Taylor Borough were to let LERTA remain on the 16.84 acres there wouldn’t be any tax revenue to pay off the bonds and Taylor 1 would be in default. Mr. Zeleniak was in contact with Taylor 1 regarding the hearing. The County advised to adopt this to restrict the LERTA to the Clover Parcel. This will ensure all three taxing bodies are on the same page. The LERTA is on the 8.25 and the TIF is on the 16.84 acres. Next, Dan Zeleniak, Borough Manager, announced Copy of Notice of Public Hearing & Meeting was advertised on October 29, 2019 and November 5, 2019 in the Scranton Times. Next, the Solicitor asked if there were any comments or questions from the public. There were none. The Councilman entertained a motion to adjourn the Hearing. Motion to adjourn was made by Councilman Tigue and seconded by Councilman Fallon. Evans, Borough Secretary  Taylor Borough Regular Monthly Meeting November 13, 2019 The Taylor Borough Council held its regular monthly meeting on Wednesday, November 13, 2019 at 7:30 P.M. at the Taylor Municipal Building, 122 Union Street, Taylor, Pennsylvania. On Roll Call, Councilman DeAngelo, Yes; Councilman Fallon, Yes; Councilman Tigue, Yes; Councilman Derenick, No; Councilman Digwood, Yes; Councilman McKeel, Yes; President Mickavicz, No; Mayor Praschak, Yes. Vice President McKeel chaired the meeting. Vice President McKeel asked the Public if they had any comments or concerns regarding the Agenda. There were none. Vice President McKeel stated that everyone had the opportunity to read and review the October 9, 2019 Regular Meeting Minutes, which was held at the Taylor Municipal Building, 122 Union Street, Taylor, PA 18517 and asked if there were any corrections, additions or deletions. None noted. A Motion to accept by Councilman Tigue and seconded by Councilman Digwood. A voice vote was called and all Council Members were in favor. The motion passed. The meeting minutes were approved as presented. Under Old Business, Vice President McKeel announced to the Public that Executive Sessions were held on Tuesday, October 22, 2019, Tuesday, November 12, 2019, Monday, October 28, 2019 and Monday, November 11, 2019 at the Taylor Municipal Building, 122 Union Street, Taylor, immediately following the 7:30 P.M. Work Sessions to discuss Personnel Contractual Matters. Next, Vice President McKeel entertained a motion to consider a Resolution # 14 of 2019, authorizing the Board of Commissioners of Lackawanna County to submit an application for Federal Fiscal Year 2019 Community Development Block Grant Program Funds in the amount of $113,048.00 on behalf of the Borough of Taylor, and also, to authorize the President to sign a certification of Community Development Plan. Also, to authorize the President and any other Borough Officials to sign the necessary documentation. A Motion to approve by Councilman Tigue and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. Resolution # 14 was adopted. Next, Vice President McKeel entertained a motion to consider a Resolution # 15 of 2019, to enter into an equipment lease/purchase agreement for financing for four (4) In-Car Cameras, ten (10) Body Cameras, one (1) Building Camera System and related equipment in the amount of $39,107.80 for the Police Department - Co-Stars Number 4400021721. Also, to authorize the President and any other Borough Officials to sign the necessary documentation. A motion by Councilman Tigue and seconded by Councilman Fallon. A voice vote was called and all Council Members were in favor. Resolution # 15 was adopted. Next, Vice President McKeel entertained a motion to consider an Ordinance # 6 of 2019, amending Ordinance #10 of 2016 with a LERTA with a boundary restriction to 8.25 acres. Also, to authorize the President and any other Borough Officials to sign the necessary documentation. A motion to approve by Councilman Tigue and seconded by Councilman DeAngelo. A roll call was conducted – Councilman DeAngelo, Yes; Councilman Fallon, Yes; Councilman Tigue, Yes; Councilman Digwood, Yes; Councilman McKeel, Yes; Having a unanimous vote Ordinance # 6 of 2019 passed. Next, Vice President McKeel entertained a motion to consider adopting the 2020 tentative budget. There is no tax increase, $3.5 million dollar budget, $440,677.00 Liquid Fuels Budget. A motion by Councilman Tigue and seconded by Councilman Digwood. A voice vote was called and all Council Members were in favor. The 2020 Tentative Budget passed. Next, Councilman Tigue read the Approval of Bills for Payment for October 2019. Attached are the list of paid invoices and open invoices. Next, Vice President McKeel entertained a motion to pay the October 2019 Payroll in the amount of $113,856.49. October General Fund Paid Bills in the amount of $105,795.70 and October General Fund Open Invoices in the amount of $27,560.63 and October Liquid Fuels Open Invoices $7,602.12. Total Expenditures $254,814.94 when funds are available. A motion was made by Councilman Tigue and seconded by Councilman Fallon. A voice vote was called and all Council Members were in favor. The Mayor advised that the Police Department responded to 374 calls for service, 11 criminal complaints filed, 16 traffic citations issued, 1 non-traffic citations issued and 4 parking tickets Issued. There was a total of 22 motor vehicle accidents investigated. The Motor Carrier Safety Assistance Program Unit conducted 7 commercial vehicle inspections for the month of October - Three (3) of the vehicles were placed out of service. There was a total of 6 Quality of Life Violations investigated. Revenues received for the month of October 2019: Police Reports, $375.00; Magisterial District Court Fines, $2,380.64; Judicial Fines, $426.71; Parking Tickets, $55.00; - Totaling $3,237.35. The Mayor’s report was placed on file. Next, Vice President McKeel asked Council if there were any further comments. There were none. Next, Vice President McKeel asked the Public if there were any questions or concerns. Ralph Caputo addressed the council relating to the parking restrictions that the new Sheetz project will bring upon the area along Main Street. A brief discussion followed.
