Taylor Borough Regular Monthly Meeting February 12, 2020 The Taylor Borough Council held its regular monthly meeting on Wednesday, February 12, 2020 at 7:00 P.M. at the Taylor Municipal Building, 122 Union Street, Taylor, Pennsylvania. On Roll Call: Councilman Naro, Yes; Councilman DeAngelo, Yes; Councilman Fallon, Yes; Councilman Tigue, Yes; Councilman Digwood, Yes; Councilman McKeel, Yes; President Mickavicz, Yes; Mayor Praschak, Yes. President Mickavicz asked the Public if they had any comments or concerns regarding the Agenda. There were none. President Mickavicz stated that everyone had the opportunity to read and review the January 6, 2020 Reorganization Meeting Minutes, January 8, 2020 Regular Meeting Minutes and the January 22, 2020 Special Meeting Minutes, which were held at the Taylor Municipal Building, 122 Union Street, Taylor, PA 18517 and asked if there were any corrections, additions or deletions. None noted. A Motion to accept by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called and all Council Members were in favor. The motion passed. The meeting minutes were approved as presented. An Executive Session was held on Monday, February 10, 2020 immediately following the 7:00 PM Work Session to discuss personnel and legal matter. Next, President Mickavicz entertained a motion to accept the resignation from Officer Timothy McHale as a Part-Time Police Officer, effective immediately. Mr. Zeleniak read the letter dated 1/18/2020 from Mr. McHale. A motion to accept by Councilman McKeel and seconded by Councilman Digwood. A voice vote was called and all Council Members were in favor. The motion passed. Next, President Mickavicz entertained a motion to adopt Resolution # 1 of 2020 confirming and acknowledging its control and maintenance of a right-of- way within the Borough known as Middle Street and verifies that it receives and/or collects liquid fuels funds as a result of said ownership. A motion to accept by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called and all Council Members were in favor. Resolution # 1 of 2020 was adopted. Next, President Mickavicz entertained a motion to consider a Resolution # 2 of 2020 authorizing PennEastern Engineers, LLC (Agent) to apply for Highway Occupancy Permit(s) on Taylor Borough’s behalf. A motion to accept was made by Councilman Tigue and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. Resolution # 2 of 2020 was adopted. Next, President Mickavicz entertained a motion to consider a Resolution # 3 of 2020 authorizing Reilly Associates to submit to PennDOT an Application on behalf of Taylor Borough for a local road Highway Occupancy Permit for Middle Street with Solicitor Jones recommendation language known as the caveat. (Subject to appropriate Agreement(s), if any, on such terms and conditions as negotiated and approved by the President of Council, as he deems necessary. The Borough officers are authorized to execute such agreements). A motion was made by Councilman Tigue and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. Resolution # 3 of 2020 was adopted. No comments from the Public. Next, President Mickavicz entertained a motion to consider a Resolution # 4 of 2020 authorizing Reilly Associates to submit to PennDOT an Application on behalf of Taylor Borough for a stormwater connection Highway Occupancy Permit with the same caveat stated previously by Solicitor. A motion was made to accept by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called and all Council Members were in favor. Resolution # 4 of 2020 was adopted. No Comments from the Public. Next, President Mickavicz entertained a motion to consider a Resolution # 5 of 2020 authorizing Reilly Associates to submit to PennDOT an Application on behalf of Taylor Borough for a sanitary sewer connection Highway Occupancy Permit with the same caveat stated previously by Solicitor Jones. A motion to accept was made by Councilman Tigue and seconded by Councilman Fallon. A voice vote was called and all Council Members were in favor. Resolution # 5 of 2020 was adopted. Next, President Mickavicz entertained a motion to consider a Resolution # 6 of 2020 authorizing the submission of a Traffic Signal Approval Application to PennDOT with the same caveat stated previously by Solicitor Jones. A motion was made by Councilman Tigue and seconded by Councilman Fallon. A voice vote was called and all Council Members were in favor. Resolution # 6 was adopted. No comment from the Public. Next, President Mickavicz entertained a motion to consider a motion to approve a Memorandum of Understanding between the Lackawanna County Conservation District and Taylor Borough. Mr. Zeleniak gave a brief discussion. A motion was made by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called and all Council Members were in agreement. The motion passed. Next, President Mickavicz entertained a motion to authorize the Council President and any other Borough Officials to execute any required forms for the application for eligibility to receive Federal Surplus Property. A motion to accept was made by Councilman Tigue and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in agreement. The motion passed. Next, President Mickavicz entertained a motion to consider a Resolution # 7 of 2020, authorizing the Council President and any other Borough Officials to execute any required documents to purchase/lease a 2020 Chevrolet Silverado SSV 4 x 4 for Police Department. (Truck amount $36,895.00, Police upfit amount $11,002.95 for a total amount of $47,897.95) The Lease will be through Community Leasing Partners for a total of four (4) years with yearly payments of $13,327.24, Lease # 63676. Costars # 013-153 (Kovatch) and Costars # 014-1414 (Bonner Chevrolet). A motion to accept was made by Councilman Tigue and seconded by Councilman Digwood. A voice vote was called and all Council Members were in agreement. Resolution # 7 of 2020 was adopted. Next, President Mickavicz entertained a motion to appoint Tina L. McGovern as a third-party consultant/grant writer at the rate of $30.00 per hour subject to agreement as to the terms and conditions as are acceptable to the Borough. Terms and Conditions are: The undersigned acknowledges her status as an Independent Contractor at the rate of $30.00 per hour with no other benefits. The appointment is at will and may be terminated at any time. The consultant must secure written approval of the Borough Council prior to making application for any grant, program or otherwise undertake any action on behalf of the Borough with the fee, expense and charges preapproved in writing by the Borough, before applying for any grant or incurring liability of the Borough. All Fees and hourly charges are subject to prior approval by Taylor Borough Council. The President of Council to negotiate the terms thereof and execute such agreement. A motion was made by Councilman McKeel and seconded by Councilman Tigue. A voice vote was called and all Council Members were in Agreement. The motion passed. Next, President Mickavicz entertained a motion to reduce the current Irrevocable Letter of Credit issued by FNCB Bank for Taylor 1, LLC from $125,000.00 to $25,000.00 per the Solicitor’s recommendation. Solicitor Jones gave a brief overview. A motion was made by Councilman McKeel and seconded by Councilman Tigue. A voice vote was called and all Council Members were in agreement. The motion passed. Next, Councilman Tigue read the Approval of Bills for Payment for January 2020. Attached are the list of paid invoices and open invoices. Next, President Mickavicz entertained a motion to pay the January 2020 Payroll in the amount of $123,975.84. January General Fund Paid Bills in the amount of $89,467.90 and January General Fund Open Invoices in the amount of $119,055.34 and January Liquid Fuels Open Invoices in the amount of $18,903.98 - Total Expenditures $351,403.06 when funds are available. A motion was made by Councilman Tigue and seconded by Councilman Fallon. A voice vote was called and all Council Members were in favor. The motion passed. The Mayor advised that the Police Department responded to 401 calls for service, 7 criminal complaints filed, 6 traffic citations issued, 3 non-traffic citations issued, 3 parking tickets Issued, and 21 motor vehicle accidents investigated. Revenues received for the month of January 2020: Police Reports, $165.00; Magisterial District Court Fines, $1,477.74; Judicial Fines, $242.96; Parking Tickets, $80.00; Roving Patrol, $296.28; Drug Take Back Reimbursement $134.88 - Totaling $2,396.86. The Mayor’s report was placed on file. Next, President Mickavicz asked Council if there were any further comments. Councilman Tigue spoke briefly on Land Sales and 10-year plan.
