Report Community Development Department 25 Chairman Rechtenbach conducted the Briefing Session which convened at 0 00 18 6 0m p Deputy City Recorder Jessica Springer conducted a Roll Call wherein Council Members Barbour Catlin Johnson Rechtenbach and Pratt were present Chairman Rechtenbach called for questions on the Administrative Report for the Community Development Department and there were none Taylorsville City Council Minutes November 16 2011 Page 2 2 Review Agenda 37 Council Member Pratt asked about the amount of revenue generated through building 00 18 permits Community Development Director Mark McGrath explained that building permit and plan review fees typically result in about 300 000 to 350000 per year He agreed to provide more information on exact revenue generated during the previous month 05 Chairman Jerry Rechtenbach reviewed the Agenda 02 18 21 It was noted that Kevyn Smeltzer will not be in attendance at the regular meeting and the 03 18 Quarterly Report for Public Works will be postponed 47 Chairman Rechtenbach referenced the Court Report and stated that it is difficult to read 03 18 when it is scanned in black and white City Council Coordinator Jessica Springer explained that Judge Kwan has been asked to submit his reports in black and white in the future Ms Springer also stated that if a document is scanned in color it produces a very lazge file that is difficult to m e ail 19 and City Attorney John 07 Chairman Rechtenbach asked for clarification on Ordinance 11 09 18 Brems relayed that the proposed ordinance is a moratorium so the City can determine how to regulate the establishments referenced 40 Chairman Rechtenbach asked about an approval given to a tobacco store and whether 10 18 there are ordinances to restrict these types of storesMayor Russ Wall stated that this issue would need to be discussed offline to be able to provide specific details 50 Chairman Rechtenbach proposed moving the Proposed Land Development Code 11 18 discussion to the end of the meeting because it is an extensive chapter All Council Members were in agreement Council Member Johnson requested that for future meetings the Proposed Land Development Code discussion always be scheduled as the last agenda item 35 It was noted that Joan White will be in attendance at the regular City Council Meeting and 13 18 has requested to present Resolution 11 INTRODUCTION AND PRELIMINARY MATTERS 30Chairman Jerry Rechtenbach called the meeting to order at 5 54 18 6 4m p and welcomed those in attendance Deputy City Recorder Jessica Springer conducted a Roll Call wherein Council Members Barbour Catlin Pratt Rechtenbach and Johnson were present 1 Opening Ceremonies Pledge of Allegiance Council Member Johnson 59 Council Member Pratt directed the Pledge of Allegiance 54 18 2 1 Reverence Council Member Johnson Opening Ceremonies For December 7 2011 to be arranged by Youth Council 02 Council Member Johnson offered the Reverence by reading a few comments about 56 18 Thanksgiving 3 1 Citizen Comments 59 Chairman Jerry Rechtenbach reviewed the Citizen Comment Procedures for the audience 57 18 He then called for any citizen comments There were no citizen comments and Chairman Rechtenbach closed the citizen comment period 22 Chairman Rechtenbach recognized scouts in attendance from Troop 1286 Council 00 19 Member Barbour mentioned that she met with these scouts prior to the meeting and they asked tough questions 4 1 Mayor Report s 58 Mayor Wall addressed the Council regarding the Veterans Celebration that was held on 01 19 Friday November 11 2011 Mayor Wall stated that Taylorsville was once again the host of the United Veterans Council Parade and the parade had more entrants this year than previous years He observed that more people attended the event than ever before He relayed that the family of Jared Day who was killed in Afghanistan served as Grand Marshals for the parade along with some World War II veterans The Mayor noted that Governor Herbert was able to attend and spoke in tribute to Veterans Mayor Wall also recognized the volunteers and City staff who helped make this Taylorsville City Council Minutes November 16 2011 Page 5 event possible He cited the joint efforts of staff volunteers businesses and elected officials He relayed that one statue for the Veterans Memorial has been placed and unveiled and the rest of the statues should be completed by Memorial Day 2012 He expressed hope that an official unveiling of the entire monument will be ready to be held on Memorial Day 14 Mayor Wall stated that next year will be the last year that Taylorsville has the honor of 05 19 hosting the Veterans parade so people should plan on attending 42 Chairman Rechtenbach added his compliments to those involved in producing such an 05 19 excellent event that keeps growing larger He compared the event to Taylorsville Dayzz 51 Council Member Johnson asked about getting a copy of the letter that was read at the 05 19 Veterans event Mayor Wall said he will pursue obtaining a copy of the letter for the display case 02 Council Member Pratt stated that he thinks this a great thing the City is doing for Veterans 07 19 and regrets that he was unable to attend this year due to a military funeral at which he was officiating 2 APPOINTMENTS 1 2 Elaine Waegner Taylorsville Dayzz Committee Mayor Russ Wall 33 Mayor Russ Wall stated that it is an honor for the City to recognize Elaine Waegner due to 07 19 her 13 years of employment service with the City He relayed that Ms Waegner has recently retired from her staff position with the City but is now volunteering to serve on the Taylorsville Dayzz Committee The Mayor noted that Ms s Waegner husband Deiter has also been alongtime volunteer with the City 56 Chairman Rechtenbach asked Ms Waegner about her health and whether it will allow her 08 19 to be able to serve Ms Waegner responded that she will be more than able to serve by the time Taylorsville Dayzz occurs 11 Council Member Pratt said he proudly supports Ms s 09 19 Waegner nomination to the Taylorsville Dayzz Committee and MOVED to appoint Elaine Waegner as a member of the Taylorsville Dayzz read a congratulatory letter regarding Elaine Waegner from Keith 09 19 and Renee Sorenson The letter thanked Ms Waegner for her service to the City as a treasured public servant 42 Mayor Wall invited Elaine and Dieter Waegner to come forward and then presented them 10 19 with a plaque from the City in recognition of their many years of service 2 Gregory Poole Economic Development Committee Chairman Rechtenbach 10Chairman Rechtenbach recognized Gregory Poole and nominated him to serve as a 12 19 member of the Economic Development Committee He stated that he has known Mr Poole for many years and gladly recommends him to the committee Council Member Johnson MOVED to appoint Gregory Poole as a member of the Economic Development Committee Council Member Catlin SECONDED the motion Hearings Officers for the City of Taylorsville John Inch Morgan 15 City Administrator John Inch Morgan explained that this is a formality because Gregory J 13 19 Christiansen has already been acting in the position of Administrative Law Judge Mr Morgan relayed that Administration would now like to remove Jeremy D Eveland from the appointment resolution Council Member Barbour MOVED to adopt Resolution No 11 35 Appointing or and Reappointment of Gregory J Christiansen as an Administrative Enforcement Hearings Officer Council Member Catlin SECONDED the motion Chairman Rechtenbach called voted in favor and the motion passed 3 REPORTS 1 3 Jordan River Commission Report Laura Hansen 37Laura Hansen Executive Director of the Jordan River Commission addressed the Council 14 19 She outlined what the Commission has been doing for the past year and what they have planned for Taylorsville City Council Minutes November 16 2011 Page 7 the upcoming year She noted that Taylorsville is currently a member of the Commission so it is important to keep the City involved and updated Ms Hansen then referenced a report that was handed to the Council and reviewed the report in detail 04 Council Member Johnson observed the effectiveness of the weed 19 pulling event and asked whether it will be held each yeaz Ms Hansen responded that the event will absolutely be back each year She relayed that various weed killing methods are being pursued to keep weeds at bay Ms Hansen also stated that there are a lot of young people involved in this event as well as the Taylorsville Police Department who provided patrol for the event 11 Council Member Pratt asked how faz outside the river area the Commission covers Ms 20 19 Hansen stated that they work all azound the river but mostly do work close to the river itself sleadership which has led to a huge improvement in 32 Mayor Wall recognized Ms Hansen 22 19 getting things taken care of around and on the river Mr Wall also stated that the s City money is well spent on this project 2 3 Quarterly Report Sanitation Pam Roberts 51 Pam Roberts addressed the Council regarding sanitation efforts and noted that there is a 23 19 customer survey available on the s department website at sanitation slsShe relayed that orE www a survey will also be mailed out to customers 44 Ms Roberts presented a Sanitation Quarterly Report via Power Point detailing sanitation 24 19 needs in Taylorsville 20 Council Member Barbour stated that there were scouts who previously asked about 25 19 curbside green pickup and if when that would happen Ms Roberts responded that the driving force behind green waste pickup is public will if customers want it then the recommendation can be made to the board for review Ms Roberts referred the scouts and the public to the customer survey specifically the area that refers to green waste 42 Council Member Pratt asked about cleanups that are scheduled and inquired when trailers 29 19 for dumping will be placed in the upcoming year Ms Roberts stated that there is a tentative schedule in place She agreed to m e ail that schedule to Council Coordinator Jessica Springer to be provided to the Council 07 Ms Roberts continued her report by addressing bulk waste disposal Ms Roberts 31 19 discussed the fall leaf bag collection program that is currently in progress 45 Ms Roberts reviewed the first month of weekly recycle collection 32 19 Taylorsville City Council Minutes November 16 2011 Page 8 18 Mayor Wall stated that the City had problems getting more fall leaf bags atone point and 33 19 was told there would be no more bags available He said the City has since received more bags but he questions whether there was indeed a problem with bag availability Ms Roberts stated she t wasn aware there was such a problem Mayor Wall observed that it must be an internal issue 43 Chairman Rechtenbach asked about the increase in recyclables and whether they are a 34 19 little dirtier than usual Ms Roberts responded that the recyclables have been kept pretty clean 51 Council Member Pratt questioned whether a driver can report a damaged can or if they 35 19 wait for residents to report such Ms Roberts stated that a process has been developed for drivers to fill out a form and turn it in at the end of the night to aid in recording these types ofissues 01 Council Member Johnson asked about rules regarding cans that are stacked higher than the 37 19 lid and whether this creates an issue with trash blowing around Ms Roberts answered that with weekly collection this issue has decreased 14 Chairman Rechtenbach made a personal note that this is not our fathers trash collection 38 19 He commended Ms Roberts for doing an excellent job with sanitation services 3 Quarterly Report Public Works vyn Smeltzer 11 It was noted that Kevyn Smeltzer was excused due to illness 39 19 The Public Works Quarterly Report will be rescheduled for a future meeting Council Member Barbour MOVED to table presented a report on court activities during the month of September 39 19 2011 He reviewed statistics for case load traffic cases filings dispositions and other court related items 02 Council Member Johnson asked about plea bargains and whether the numbers provided in 45 19 the report reflect such Judge Kwan confirmed that plea bargains are a part of the process and have been more effective due to better trial negotiations Taylorsville City Council Minutes November 16 2011 Page 9 11 Chairman Rechtenbach asked about the shortfall prediction on revenues 51 19 Judge Kwan answered that the Court is currently below projected expenses for the quarter 02 Council Member Barbour asked about the likelihood of spending the projected increase 53 19 Judge Kwan detailed upcoming expenses and stated that there aren tany large expenses foreseen He under should be able to be retained He observed that most of the under predicted that spending spend amount is due to the lack of one time full employee 4 CONSENT AGENDA 1 4 Minutes RCCM 11 02 45Council Member Barbour MOVED to adopt the Consent Agenda Council Member 54 19 SECONDED the motion Chairman Rechtenbach called for discussion on the Johnson All City Council members present voted in favor and the motion passed 5 PLANNING MATTERS 1 5 Appeal of an Animal Hobby Permit Denial on Property Located at 2666 W Castle Oaks Circle File 3X Mark 11McGrath 41 Community Development Director Mark McGrath relayed that on October 11 2011 the 55 19 Taylorsville Planning Commission heard a conditional use application for an Animal Hobby Permit for four dogs at 2666 West Castle Oaks Circle in Taylorsville He described the four dogs that range in weight from 7 lbs to 701bs Mr McGrath cited neighbors who opposed the application at the hearing and referenced written replies received from neighbors in opposition to the request He said the complaints were mostly based on barking but also included dogs running loose in the neighborhood He said that the Planning Commission denied the Hobby Permit and an appeal was subsequently received based on City Code those appeals are brought to the City Council He listed three options before the Council 1 Uphold the decision ofthe Planning Commission 2 Remand the hearing back to the Planning Commission if new information is brought forward or 3 Schedule apublic hearing to hear the appeal at least 14 days in the future 50 Council Member Pratt asked about the details of the original 57 19 complaint which brought attention to the animals in question Mr McGrath relayed that a complaint regarding barking was received by West Valley Animal Services upon investigating the complaint the officer noticed that there were four dogs on the premises The property owner was subsequently notified that an Animal Hobby Permit issued by the City is required to keep four dogs Taylorsville City Council Minutes November 16 2011 Page l0 25 Mr McGrath affirmed that the dogs are all licensed and explained that a blended family 59 19 situation resulted in four dogs on the property He clarified that the four dogs were not originally licensed at the present address but the dogs aze all licensed under different addresses He confirmed that the ordinance refers to the number of animals at the location and is not based on the number of owners 24Chairman Rechtenbach inquired whether the applicants were in attendance The applicants 59 19 were not present but Mr McGrath affirmed that they were notified of this matter 57Council Member Bazbour observed that there is no new information that would give reason 59 19 to remand the matter back to the Planning Commission 53 Council Member Barbour MOVED to uphold the Planning Commission 59 19 s decision to deny the Animal Hobby Permit Council Member voted to uphold the planning s commission decision there could still be an appeal to the District Court 2 5 Ordinance No 11 Approving the Sale of Certain Real Property Located at 2024 West 6200 South to Salt Lake Valley Habitat for Humanity for Less than Full Fair Market Value Jahn N Brews CityAtlorney 01 John Brews referred the Council to the documents in the packet regarding the subject 20 ordinance and called for any questions 02 Council Member Johnson called for comments from neighbors of the property who were 20 in attendance Mr Carl Readicker responded that the neighborhood has had their concerns addressed and are fine with the project going forward 04 Ed Blake Executive Director for Habitat for Humanity reviewed background issues with 20 the property and described the home that will be built Mr Blake then recognized Marci Valzuel the homeowner who will be living on the property 54 Chairman Rechtenbach thanked Ed Blake for his work on this project not only with the 07 20 City Property Located at 2024 West 6200 South to Salt Lake Valley Habitat for Humanity for Less than Full Fair Market Value Council Member Catlin SECONDED the motion Chairman Rechtenbach called for discussion on the motion 06 Council Member Pratt asked about adding language to the Ordinance regarding making 09 20 sure that the house is built in conformance to the attached drawings as well as to the issues discussed and agreed upon with neighbors Council Member Johnson amended his original motion and MOVED to adopt Ordinance No 11 Approving the Sale of Certain Real Property Located at 2024 with Respect Ordinance No 11 to Reiki Shiatsu and Thai Establishments John N Brems City Attorney 09John Brems presented the temporary zoning ordinance and referenced the massage 11 20 He relayed that the techniques that are practiced in the establishments cited in the subject ordinance techniques have been determined by the Department of Professional Licensing DOPE to not be Mr Brems said that the establishments are massage problematic therefore because they are not licensed or currently governed He described the establishments as being a source of prostitution He stated that the City is proposing a moratorium on these types of businesses until a determination can be made on how to deal with them 28 Mr Brems indicated that there are currently two establishments in the City who are in the 12 20 process of having their City business licenses revoked He clarified that business licenses were issued prior to the City learning of the techniques practiced He said that City Vice Officers uncovered the questionable practices 02 Council Member Pratt asked whether the businesses have any religious affiliation at all 13 20 Mr Brems said that they are considered to be associated with spiritual healing without touching John Inch Morgan clarified that Reiki is considered spiritual massage in Japan Mr Brems also noted that there are legitimate Reiki massage establishments in existence however the City recommends that until appropriate licensing factors can be determined a moratorium should be placed on these types ofbusinesses Taylorsville City Council Minutes November voted in favor and the motion passed 4 5 Discussion of the Proposed Land Development Code Ch 26 Mark McGrath 37 00 Mark McGrath addressed an issue that was previously brought up in Chapter 28 Mr 20 McGrath read his findings and explained how this is applied in Taylorsville 25 Council Member Johnson asked for clarification on fences with commercial properties and 38 20 questioned why barbed wire would be restricted Council Member Johnson said he understands why it would be restricted in a residential area but believes that it is a vital tool for commercial businesses to keep vandals out of properties Mr McGrath suggested making a case for including bazbed wire in purely commercial areas providing they re not adjacent to residential property 05 Mazk McGrath reviewed Chapter 26 outlining the regulations that this Chapter addresses 42 20 specifically signage 02 Council Member Pratt referenced a discussion regarding promoting businesses using 20 45 signage offof the freeway and inquired whether this chapter would affect that issue Mr McGrath stated that there is language that addresses business adjacent to 2 I 15 55 Council Member Johnson asked about advertising on bus benches 45 20 Mr McGrath clarified that there is no agreement in the City with regards to bus benches He noted that they have been so difficult to maintain that the only business that was providing them in Taylorsville has now stopped due to vandalism He said this is why this code has prohibited them 49 Council Member Catlin asked whether this Chapter addresses the people who stand on 47 20 street corners holding signs to advertise businesses Mr McGrath responded that these are not included in this Chapter and are generally considered free speech He noted that temporary signs are covered but are a never ending code enforcement issue Taylorsville City Council Minutes November 16 201 L Page 13 Lengthy discussion ensued regarding signage and outdoor advertising The Council discussed specifics regarding standards for temporary signs news racks and permanent signs pole monument and wall signs Discussion was also held regarding the fine line between supporting businesses and economic development and keeping community aesthetics in check by diminishing clutter 6 FINANCIAL MATTERS 1 6 Public Hearing 6 3 0m p To Receive Public Comment on the Community Development Block Grant CDBG Funds Kathy Rieci 14 CDBG Consultant Kathy Ricci introduced the annual CDBG Needs Hearing and reminded 16 20 the Council that CDBG applications are due by December 5 2011 04 Chairman Rechtenbach opened the public hearing on the CDBG Needs Hearing 17 20 17 Meghan Maughan with The Road Home described shelter services that are provided to 20 communities throughout the Wasatch Front including Taylorsville She relayed that 84 individuals citing Taylorsville as their community were provided shelter last year Ms Maughan stated that a disturbing upward trend in family homelessness is currently being observed in Utah She asked for the continued support of the City of Taylorsville through CDBG funding for The Road Home 42 Roger Borgenicht Director of ASSIST described his organization as profit 19 20 anon community design center of 42 years He cited two major programs that have been strongly supported by Taylorsville in the past 1 Emergency Home Repair and 2 Accessibility Design He said that program objectives are to keep people in their homes despite great financial strains Mr Borgenicht said that 76 home accessibility repairs accommodations were made to Taylorsville homes through the program last year He clarified that a total of 117 Taylorsville residents were served through home jobs He noted that demand this year is even greater 34 Council Members asked questions of Mr Borgenicht and discussed issues surrounding 22 20 meeting specific qualifications for the ASSIST Program 09 There were no further public comments and Chairman Rechtenbach closed the Public 27 20 Comment time 40 Kathy Ricci stated that the next CDBG hearing will be held in mid to late March 27 20 03 Council Member Catlin asked for an opinion on what is likely to be funded through 28 20 CDBG this year Ms Ricci responded that based on what she has read recently it looks like HOME Funds will be severely cut possibly by almost 50 She stated that it seems that 83 of this s year Taylorsville City Administrator John Inch Morgan commented on the potential impact of the Super 31 20 Committee on programs 42 Council Member Pratt asked the Mayor about the Taylorsville Food Pantry 32 20 Mayor for the Taylorsville Bennion Heritage Center in the Amount of 7 4 0032 John Inch Morgan 02 City Administrator John Inch Morgan introduced Joan White Chair of the Historic 34 20 Preservation Committee and asked her to present this agenda item Ms White detailed uses for the ZAP grant award which includes bus transportation for elementary students to come to the s City Museum 11 Council Member Pratt stated that this has been a very successful event He encouraged 35 20 everyone to volunteer and be involved in this project 35 44 Chairman Rechtenbach suggested that Ms White ask the City Council Discussion of the Park at City Center John Inch Morgan 18 John Inch Morgan referenced Council Member s 33 21 Johnson previous request for information on rules for the City Center Park area Mr Morgan relayed that he has drafted some rules and potential fees that the City could use for this azea and is now looking for feedback from the Council regarding these guidelines fees Mr Morgan noted that the fees are fairly high He suggested Taylorsville City Council Minutes November 16 2011 Page 15 however that if the City park area is going to be used only for special events fees should possibly stay high 07 Council Member Barbour asked if the azea can be used for leagues and such 36 21 Mayor Wall answered that because ofthe upkeep the City would prefer it be used for events or festivals rather than regular leagues 35 John Inch Morgan stated that he would also like to include language to restrict the number 2137 of days for a festival as well as how many festivals can be scheduled per yeaz month 15Discussion ensued regarding specific language and possible restrictions on festivals and 38 21 other events 1 41 3 9 Council Member Pratt asked whether the current mass gathering permit restricts events to a maximum number of people He questioned whether due to the size of the property there could be multiple parties allowed on one day 21 41 07 Council Member Barbour cited a resident who previously called and complained regarding the wear and tear to the grass and then called recently to state that the beauty of the grass lifts her spirits every time she passes City Hall 36 Council Member Pratt suggested a little more work on the language because it is currently 42 21 a little vague with too much room for interpretation 09 John Inch Morgan stated that he will work further on the policy put it into ordinance form 43 21 and then bring it back for consideration 50 Council Member Pratt referenced the grassy area next to the museum and stated that there 43 21 have been requests to use that azea for events He suggested that use for that property be regulated as well Mayor Wall agreed that the City will draft something pertaining to that area 8 NEW ITEMS FOR
