RESOLUTION NO. 2165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, REVISING SECTION II ATTENDANCE POLICY OF THE CITY FACILITIES NAMING COMMITTEE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, City Councils in the State of Texas possess the responsibility of designating names of streets, municipal buildings, parks, trails, lakes and other facilities under the municipality's jurisdiction; and WHEREAS, the Terrell City Council recognizes the importance of a reliable, efficient and open process for creating new names that reinforce respect for the history of Terrell, foster appreciation for the various contributions of the people and neighborhoods of Terrell, establish a positive identity consistent with the brand of Terrell, promote civic pride in Terrell and communicate clearly to visitors and emergency response personnel; and WHEREAS, the Terrell City Council adopted Resolution No. 636 on June 16, 2009, governing the naming or renaming of City facilities, streets, and park land; and WHEREAS, the Terrell City Council adopted Ordinance No. 2717, the current Comprehensive Plan, on January 2, 2018, which included recommendations from both the Park Plan and the Downtown Plan as adopted in May, 2018; and WHEREAS, the Terrell City Council adopted Resolution No. 1011 in February, 2021, establishing a Facilities Naming Committee and placing a temporary hold on new honorary names to allow the City Facilities Naming Committee due time for deliberations; and WHEREAS, the Terrell City Council wishes to be responsive to changes in planning documents, growth trends and community input which have occurred since Resolution No. 636 and Resolution No. 1011 were adopted. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, THAT: Section I. A City Facilities Naming Committee is hereby established as a temporary advisory board to provide recommendations and input to the Terrell City Council based on the recitals herein. The Committee shall have nine (9) total members; with two (2) representatives appointed by each of the four (4) members of the City Council and one (1) representative appointed by the Mayor, with membership on the Committee to be subject to an affirmative vote of the full City Council. All members of the Committee shall be residents of the City of Terrell. The members of the Committee shall serve without remuneration for their service. The City Secretary is directed to create an application for members of the community wishing to serve on the Committee and to make it available to the City Council and on the City website. Page 11 of 30 ITEM 6.1. Section II. A Chairperson and Vice-Chairperson of the City Facilities Naming Committee shall be elected by a majority of the members of the Committee at the beginning of the first meeting. The Chairperson of the Committee shall preside over all meetings of the Committee and generally perform all duties associated with the office. In the absence of the Chairperson, the Vice-Chairperson shall assume and perform the duties of the office. All appointments to the City Facilities Naming Committee shall be for a term of one (1) year. All Committee members must meet the policy guidelines established by the City Council for all Board members of the City. The City Facilities Naming Committee shall meet as needed with notice being given in accordance with the Texas Open Meetings Act, as amended. Additional meetings may be called at the request of the City Manager, Chairperson or upon written request of three (3) members. Absence. An excused absence must be noted by the Chair of the Board or acting Chair at the meeting or at the following meeting by stating the Member and the justification. The only acceptable instances of excused absences shall be major personal or family health events and required travel for employment. The Chair or acting Chair must receive documentation of such prior to stating for the record that the absence shall be considered excused. Members with two (2) consecutive unexcused absences or three (3) for any reason per rolling 12 month period from regular or posted meetings shall automatically forfeit the unexpired portion of their term and shall not be eligible for reinstatement to any City Board or Commission for a two (2) year period. Members with extenuating circumstances may request City Council act to suspend their service for a designated period of time with a temporary replacement. Section III. The City Facilities Naming Committee shall meet at times to be established by the City Manager after all nine (9) members have been assigned by the City Council. Five (5) members of the Committee shall constitute a quorum and any action taken at a meeting shall require the affirmative vote of a majority of the members present. The City Facilities Naming Committee shall operate under Roberts Rules of Order, shall select its own Chairperson at its first meeting, shall meet as needed with meetings to be scheduled by the City Manager to make due consideration of a full range on City naming issues. The Committee shall have full authorization to consider nonbinding recommendations to the City Council related to naming policies, naming processes and names of individual facilities and properties under the City's jurisdiction. Section IV. The City Facilities Naming Committee shall make its recommendations by a majority vote of the nine (9) members of the Committee, shall provide a spokesperson to report to the City Council Page 12 of 30 ITEM 6.1. and, in the case of specific facilities, may provide either a single recommendation or a short list of options. Section V. All elements in Resolution No. 636 related to new and honorary names are hereby suspended until such time as the Naming Committee recommends updated procedures in the form of an updated Naming Resolution and such new Resolution is approved by City Council. Any street toppers already under consideration by the Planning and Zoning Commission shall be considered exempt from this suspension. Section VI. To ensure communication between the Committee and City Council, prior to considering any individual facility name or renaming, the Committee shall provide a list of facilities which it recommends be considered to the City Council. The Committee shall then only consider facilities for which the City Council has directed the Committee to exercise its deliberative authority. Section VII. This Resolution shall become effective immediately upon its passage. CITY OF TERRELL, TEXAS RESOLUTION NO. 2168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, AMENDING A POLICY GOVERNING THE NAMING OR RENAMING OF CITY FACILITIES, STREETS, AND PARK LAND. WHEREAS, the Terrell City Council desires that naming or renaming facilities, streets and park land shall be made in accordance with written policies approved by the governing body; and WHEREAS, naming policies must be consistent, provide clear directions, address 911 emergency service issues, preserve historic names, recognize and honor individuals who have made significant contributions to the conununity and provide for public input; and WHEREAS, the Terrell City Council created the City Facilities Naming Conunittee and appointed members of the conununity to serve on the committee; and WHEREAS, the City Facilities Naming Conunittee has reviewed and proposed modifications to the Policy for the Naming or Renaming of City Facilities, Streets, and Park Land ; and WHEREAS, the City of Terrell City Council finds that the Policy for the Naming or Renaming of City Facilities, Streets, and Park Land attached hereto (Exhibit "A") is in the best interest of the citizens, property owners, businesses and visitors of the City of Terre ll. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: Section 1. The Terrell City Council hereby adopts Exhibit "A" attached hereto as the official policy which shall govern the naming or renaming of City facilities, streets, or park land. Section 2. If any portion of this Resolution shall, for any reason, be declared invalid by any court of competent j urisdiction, such invalidity shall not affect the remaining provisions hereof and the City Council hereby determines that it would have adopted this Resolution without the invalid provision. Section 3. This Resolution shall be in full force and effect from and after its passage, and it is accordingly so resolved. Page 14 of 30 ITEM 6.1. EXHIBIT "A" CITY OF TERRELL Policy for the Naming or Renaming of City Facilities, Streets, and Park Land PURPOSE: To establish guidelines for the naming or renaming of City facilities, streets and park land. DEFINITIONS: Facility: Any street, park land, park amenity, building, portion of a building, or other location or structure identified by the City Council that is owned and maintained by the City of Terrell. PROCESS: To initiate the application of this policy, a need will be identified and a written request shall be submitted to City Administration for review. City staffwill prepare a report and present the request to the City Council, which will consider if the facility is to be added to the City Naming Facility charge. Upon receiving a recommendation from the City Facility Naming Committee, the City Council will consider the recommendation and will conduct a vote to: 1. Accept the recommendation. 2. Reject the recommendation and retum the facility back to the City Facility Naming Committee for addition consideration and a modified recommendation. 3. Reject the recommendation and remove the facility from naming consideration. The City Facility Naming Committee will utilize the following criteria in consider of its recommendations: Part One: City facilities or park land shall be named in the following manner: 1. - In honor of individuals who donate land for park space or donate a major part of the funds required to construct or renovate a facility. A minimum of fifty percent (50%) or more of the necessary funds is necessary to constitute a major portion . 2. In honor of individuals who have made significant contributions to the community through public service as a local or national leader, volunteerism or private sector achievement (see Part Four for criteria). 3. In relation to predominant characteristics or physical features of the land such as streams, rivers, plant species, etc . 4. In relation to a street or streets adjacent to the facility. 5. In relation to asubdivision that houses the facility. 6. The Parks Board will be notified of requests under this section and shall be afforded an opportunity to provide input as part of the public input process. Page 16 of 30 ITEM 6.1. Part Two: Streets shall be named or renamed in the following manner: I. Streets in newly platted subdivisions or streets that have not been developed are exempt from this policy and shall follow the naming procedures outlined in the city's Subdivision Ordinance except that developers will be encouraged to utilize names from a list of preferred new street names provided by the City Councilor if in honor of an individual in accordance with Part Four below. 2. In the event a street name conflict occurs because of an annexation or other issue which may cause delays or confusion in the delivery of 9-1-1 emergency services, city staff will evaluate the need for a street name change and process the proposed street name change as follows: a. Written notice will be mailed to all property owners affected by the proposed changes not less than 15 days prior to the Planning and Zoning Commission meeting in which the proposed changes will be heard. b. City staff shall prepare a report with associated maps, public comments and other exhibits with a recommendation to the Planning and Zoning Commission for the proposed name change and who shall then forward a recommendation to the City Council. 3. A request from a private entity, group or individual to rename a public street shall comply with the following requirements : a. Proposed names will be in accordance with the City of Terrell Subdivision Regulations and/or if in honor of an individual in accordance with Part Four below. b. A written request shall be submitted with a notarized petition with the concurrence from a minimum of seventy-five percent (75%) of the owner-occupied households and/or active businesses abutting the proposed street and maps showing the location and quantity of proposed signs affected. c. The request will verify that the interested parties will defray the cost of installing signs and other expenses (i.e . updating maps, plats, 9-1-1, etc.) . d. The request will be considered by the City Facilities Naming Committee in accordance with its policy and processes. If approved, the Committee will refer the request and its recommendation to the Planning and Zoning Commission. e. City staff shall send written notice to all property owners affected by the proposed changes not less than 15 days prior to the Planning and Zoning Commission meeting in which the proposed changes will be heard. f. City staff shall prepare a report with associated maps, public comments and other exhibits with a recommendation to the Planning and Zoning Commission for the proposed name change and who shall then forward a recommendation to the City Council. Page 17 of 30 ITEM 6.1. Part Three: Recognized historic neighborhood or honorary street designations shall be named in the following manner: 1. An ornamental sign cap (topper) may be placed on top of existing street signs in designated areas such as a historic neighborhood, place, or in honor of an individual after approval by the City Council in accordance with the following criteria: a. Proposed names will be in accordance with the City of Terrell Subdivision Regulations and/or ifin honor of an individual in accordance with Part Four below. b. A written request shall be submitted with a notarized petition with the concurrence from a minimum of seventy-five percent (75%) of the owner-occupied households and/or active businesses abutting the proposed street and a statement that the fabrication and installation costs will be paid by the applicants. c. The written request shall be submitted with the design of the proposed sign cap, detailed maps showing the location and quantity of proposed sign caps that are to be installed. d. The request will be considered by the City Facilities Naming Committee in accordance with its policy and processes. If approved, the Committee will refer the request and its recommendation to the Planning and Zoning Commission. e. City staff shall send written notice to all property owners affected by the proposed changes not less than IS days prior to the Planning and Zoning Commission meeting in which the proposed changes will be heard. f. City staff shall prepare a report with associated maps, public comments and other exhibits with a recommendation to the Planning and Zoning Commission for the proposed name change and who shall then forward a recommendation to the City Council. g. Recognized historic neighborhoods shall have a defined boundary in which historic structures, events or other attractions in that area are designated with signage that would benefit residents, visitors or tourists. Part Four: Qualifications for Honorees in which a park, facility or street is to be named: 1. In honor of military, police or fire service men and women who died in the line of duty or in honor of veterans of the above services who have been honored for their heroism or valor in the line of duty. 2. In honor of individuals with significant achievements. They must have been born in Terrell, a long-time resident or attended Terrell schools and have received nationally or internationally recognized awards for their achievements in the arts, sciences or industry. 3. In honor of deceased national or state leaders. Deceased national or state leader must have directly impacted the citizens of Terrell and have been deceased for a minimum of three (3) years. 4. In honor of local community leaders or volunteers who have provided outstanding personal service such as in education, business, public service, civic organizations, non-profit organizations, hospitals or churches, etc. that has resulted in a significant and enduring contribution to the community. a. If deceased, the person must have served for a minimum of twenty (20) years and must have been deceased for a minimum of three (3) years; or Page 18 of 30 ITEM 6.1. b. If living, the person must have served for a minimum of thirty (30) years; or c. The individual has provided outstanding service in more than one area such as an elected official and volunteer for a civic organization whose cumulative service in the various organizations meets or exceeds the above minimum criteria. d. The City Facilities Naming Committee may, by a vote of two-thirds of the total number of committee members, reduce or suspend the number of years of service required for consideration. The result of this vote and the deviation from the standard policy are required to be highlighted during the presentation of the recommendation to the City Council. City Council is not under any obligation to consider a recommendation that falls outside of this policy's standard parameters. e. The City Facilities Naming Committee may, by a vote of two-thirds of the total number of committee members, reduce the number of years an individual must be deceased before being eligible for consideration. The result of this vote and the deviation from the standard policy are required to be highlighted during the presentation of the recommendation to the City Council. City Council is not under any obligation to consider a recommendation that falls outside of this policy's standard parameters. COMMUNITY ENGAGEMENT: It is the responsibility of the City Facilities Naming Committee to seek opportunities to receive information and feedback from individuals, groups of individuals, or organizations potentially impacted by the naming of City facilities. To this end, the Committee or a member of staff on its behalf shall: 1. Place notice in a newspaper of general circulation at least twice, occurring during two separate weeks, prior to the Committee taking action on a recommendation item on its agenda. This notice is not required interior rooms of City owned facility. 2. Cause notice to be provided through the United States Postal Service to those homes or businesses located within 200 feet of the perimeter of the facility to be named. This notice is not required interior rooms of City owned facility. 3. Cause notice to be placed in an appropriate location on the City of Terrell website. 4. Endeavor to identify and engage members of the community that may have an interest in the naming of a City facility. NAME RESERVE LIST: The City Facilities Naming Committee or a member of City staff, on their behalf, may maintain a list of names to identify important members of the community for future naming consideration. This list will be developed and maintained to ensure continuity as Committee membership changes with new appointments. This list shall include the criteria outlined in Part Four and will identify which of these criteria the individual does or does not satisfy. An individual can be added to this by a simple majority vote of those members present at the meeting during which the vote is taken. RESOLUTION NO. 2262 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, EXPANDING THE INITIAL CHARGE FROM THE CITY COUNCIL TO THE CITY FACILITIES NAMING COMMITTEE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, City Councils in the State of Texas possess the responsibility of designating names of streets, municipal buildings, parks, trails, lakes, and other facilities under the municipality’s jurisdiction; and WHEREAS, the Terrell City Council recognizes the importance of a reliable, efficient and open process for creating new names that reinforce respect for the history of Terrell, foster appreciation for the various contributions of the people and neighborhoods of Terrell, establish a positive identity consistent with the brand of Terrell, promote civic pride in Terrell and communicate clearly to visitors and emergency response personnel; and WHEREAS, the Terrell City Council adopted Resolution No. 636 on June 16, 2009, governing the naming or renaming of City facilities, streets, and park land; and WHEREAS, the Terrell City Council adopted Ordinance No. 2717, the current Comprehensive Plan, on January 2, 2018, which included recommendations from both the Park Plan and the Downtown Plan as adopted in May, 2018; and WHEREAS, the Terrell City Council adopted Resolution No. 1011 in February, 2021, establishing a Facilities Naming Committee and placing a temporary hold on new and honorary names until such time as the City Facilities Naming Committee recommends updated procedures in the form of an updated Naming Resolution and such new Resolution is approved by the City Council; and WHEREAS, the Terrell City Council adopted Resolution No. 2106 in October, 2023, modifying the City Facilities Naming Committee by increasing the number of members from five (5) to nine (9), establishing a residency requirement, defining the committee officers to include a Chairperson and a Vice-Chairperson, defining the committee member term of service as one (1) year, defining a quorum, and placing a temporary hold on new and honorary names until such time as the City Facilities Naming Committee recommends updated procedures in the form of an updated Naming Resolution and such new Resolution is approved by the City Council; and WHEREAS, the Terrell City Council desires to issue an initial charge to the City Facilities Naming Committee. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TERRELL: Page 28 of 30 ITEM 6.4. SECTION 1: The Terrell City Council directs the City Facilities Naming Committee to consider the naming of the specific facilities or properties and making recommendations for City Council consideration and approval, set forth below. 1. Renaming West University Street (South Park Street to South Adelaide Street) to Rose Hill Road. 2. “No Name” Road (Bethlehem Street to New Hope Street), located south of the City maintained cemetery. 3. Facilities and amenities located at Ben Gill Park. 4. Facilities and amenities located at Arlie White Park. 5. Facilities and amenities located at Breezy Hill Park. 6. Honorary street topper for Frances Street. SECTION 2: The City Facilities Naming Committee shall consider the initial list of facilities identified by the City Council. The Committee shall have full authorization to consider and present nonbinding recommendations to the City Council for individual facilities and properties under the City's jurisdiction. The Committee will make its recommendations by a majority vote of the nine (9) members of the Committee, shall provide a spokesperson to report to the City Council and may provide either a single recommendation or a short list of options for each facility to be named. SECTION 3: This Resolution shall become effective immediately upon its passage.
