Conduct a public hearing to discuss and consider a request for a variance to
Section 19.4 pertaining to, Area Regulations: B. Size of Yards: 1. Minimum Front
Yard- Twenty-Five feet (25’), 2. Minimum Side Yard- Six-feet (6’) for interior side
yard, 3. Minimum Rear Yard- Twenty-five feet (25’) for the main building and any
accessory building(s); twenty-five feet (25’) for rear entry garage. The property is
located at 701 W. Grove Terrell, Texas, described as, Western, Block 94, Lot 1, City
of Terrell, Kaufman County, Texas. The applicant is requesting a variance to allow
for a front yard of twenty (20’) feet, interior side yard of five (5’) feet and a rear yard
of ten (10’) feet. Property is currently zoned Single-Family Residential- 6 (SF-6).
Bobby Phillips- Building Official gave staff notes on the requested variance to the ZBA board
members. Mr. Phillips stated that the requested variance was pertaining to Section 19.4,
Area Regulations: B. Size of Yards: 1. Minimum Front Yard- Twenty-Five Feet, 2. Minimum
Side Yard- Six feet for interior side yard, 3. Minimum Rear Yard- Twenty-five feet for the
main building. Mr. Phillips stated that he applicant was requesting a variance to allow for a
front yard of 20-feet, an interior side yard of 5-feet and a rear yard of 10-feet. Mr. Phillips
advised the board members that the property was an infill lot, the current lot dimensions
make it difficult to build on. The property is zoned SF-6, which requires a minimum dwelling
unit of 1200 square feet. Mr. Phillips stated that granting the variance would allow a new
home to be built on the property.
Chairman Jimmy Cooper opened the public hearing on the requested variance.
No one spoke in favor or opposing the requested variance.
Chairman Jimmy Cooper closed the public hearing and board members discussed the
variance request.

Background:
The applicant is requesting a variance from Section 19.4- A.2. This section pertains to the minimum lot size
requirements. The ordinance calls for a minimum lot width of 60 feet, the variance request is for a lot width of 50
feet.
Section 19.4 – A. Size of Lots:
1. Minimum Lot Area- Six thousand (6,000) square feet.
2. Minimum Lot Width- Sixty Feet (60’) 50-foot
3. Minimum Lot Depth- One hundred feet (100’)
The applicant owns two vacant lots at 1212 S. Rockwall. The lots are twenty-five feet wide each and average one
hundred and forty-three feet deep. Combining the two lots will create a single lot with a width of fifty-feet and a
depth of approximately one hundred and forty-three feet. The lot will be approximately 7,175 square feet and
exceed the minimum square footage by approximately 1,175 square feet.
The granting of this variance would allow a new home to be built on this property. Without the variance, the
property would remain vacant; and be a public nuisance as are numerous vacant lots in the city.
The hardships associated with this property are/would:
• not self-imposed
• not financial in nature
• not have a negative effect on adjacent properties
Note:
The Zoning Ordinance states that in granting a variance, the ZBA must come to a finding of hardship based on the
facts of the application and the following criteria:
1. “That literal enforcement of the ordinance will create an unnecessary hardship in the development of the
property.
2. “That the situation causing the hardship or difficulty is neither financial in nature, self-imposed nor
generally affecting all or most properties in the same zoning district; and
3. “That the relief sought will not injure the permitted use of adjacent conforming property; and
4. “That the granting of a variance will be in harmony with the spirit and purpose of (the zoning) regulations.”

SINGLE-FAMILY RESIDENTIAL-6 (SF-6) DISTRICT
19.1 GENERAL PURPOSE AND DESCRIPTION:
The Single-Family Residential-6 (SF-6) District is intended to provide for development 0 primari
detached.single-family residences on small, compact lots of not less than 6,000 square feet in size i
n
logical neighborhood units. Areas zoned for the SF-6 District shall have, or shall make provision for,
City of Terrell water and sewer services. They shall be designed to adequately accommodate storm
drainage; they shall have paved streets with logical and ef?cient vehicular circulation patterns that
discourage non-local traf?c; they shall be properly buffered from non-residential uses; and they shall
be protected from pollution and undesirable environmental and noise impacts.
192 PERMITTED USES:
A. Those uses listed for the SF-6 district in Section 32 - Use Charts as “P" “S" or “T" are authorized
uses permitted by right, by speci?c use permit (\vhich must be approved utilizing procedures set
forth in Section 31B) or by temporary use pennit (which must be approved utilizing procedures
set forth in Section 38.10).
193 HEIGHT REGULATIONS:
A. Maximum Height:
1. Two and one-half (2.5) stories, and not to exceed thmy-six feet (36'), for the main

orside loaded only unless the lot con?guration renders this infeasible in which case the garage
face shall be located a minimum oftwo feet (2') behind the front facade ofthe house.

which shall be enclosed or covered (carport) with a paved driveway having a minimum length
of twenty feet (20’) as measured from the street or alley right-of-\vay line to the garage door

or support posts. The garage or carport shall be located a minimum of two feet (2')
behind the front facade of the house.

D. Minimum Floor Area per Dwelling Unit —
One thousand two hundred (1,200) square feet of air-
conditioned floor area.
E. Minimum Exterior Construction Standards See Section 37.
F. Required Architectural Features:
1. Minimum roofpitch 6: 12 or greater.
2 Minimum covered porch size shall be 33".; of front facadewidth or a minimum width of twelve
(l2') feet with a minimum depth of eight (8') feet. No portion of the garage shall extend into
the front yard beyond the porch support columns.
The same ?oor plan and elevation shall not be duplicated for live lots on the same side of the
street or for three (3) lots on the opposite side of the street. (Mirror image ?oor plans are
considered duplicates for the purpose of lot spacing)
Chimney must be enclosed in materials matching the surrounding or adjacent facade.
Roof design must include donners or combination hip and gable.
Roof materials shall be architectural grade overlap asphalt shingles, slate, or tile.
All front exterior facades must contain at least one window per story.
G. Required Streetseape Amenities:
1 A minimum four (4‘) feet wide sidewalk shall be required to be located adjacent to the right-
of-\vay (front property line) in a private utility public access casement a minimum of ten (l0’)
feet from the edge of pavement. (sidewalk may meander back and forth across the front
property line provided that no portion of the sidewalk is located within seven (7') feet of the
edge of pavement)
A minimum ofone (1) street tree shall be planted for every ?fty (50’) feet of street frontage
in accordance with Section 34.6.
A minimum oftwo (2) large shade trees shall be planted at the time ofconstruction in the front
yard (care should be exercised in the placement of large shade trees so as not to obscure the
view of the front entryway of the house). Two small ornamental trees may be substituted for
one large shade tree (see “Recommended Plant List" in Section 34).
Mailboxes shall be constructed of masonry materials which match the main residential
structure and located at the edge of pavement in such a way so as not to obscure the vision of
drivers exiting driveways into the street. Addresses shall be placed in a visible location on
both the house and on the mailbox in accordance with the Building Code.
Decorative street lighting shall be provided along residential streets throughout all residential
developments, providing low illumination (“Dark Sky“ compliant see Section 40) with solar
—
controls on decorative poles with a maximum spacing of four hundred (400‘) feet between
lights placed on altemating sides of the street in accordance with the current Street Lighting
Policy administered by the City Engineer. Light poles shall be located within the ?ve (5') feet
landscape zone only (see Section 34 for details).
Street layout and design should include the following elements:
i. A minimum of twenty-five percent (25%) of the street lengths within the subdivision,
excluding major thoroughfares and collectors, should be curvilinear in design.
Computation of percentage shall utilize the centerline lengths of all residential streets in
the subdivision.
ii. Curvilinear design means an offset from the straight section centerline of the street of
not less than three (3 ) degrees and not greater than twenty three (23 ) degrees and shall

195 SPECIAL REQUIREMENTS:
A. Recreational vehicles, travel trailers or motor homes may not be used for on-site dwelling
purposes
Electrical fencing and barbed wire is prohibited as perimeter fencing except for containment of
farm animals on parcels of three (3) or more acres.
Open storage is prohibited (except for materials for the resident's personal use or consumption
such as ?rewood, garden materials, etc., which may only be stored in the side or rear yards and
which shall be screened from view ofpublic streets and neighboring properties).
Single-family homes with side-entry garages where lot frontage is only to one street (not a comer
lot) shall have a minimum of twenty-?ve feet (25‘) from the door face of the garage or carport to
the side property line for maneuvering. The minimum setback from any garage door to a street or

alley right-of-way line shall also be twenty-?ve feet (25')
Carports or other detached accessory structures shall not project beyond the front facadeof the
house and shall be required to match the exterior materials and ?nish of the main structure if
located in the side yard and is visible from the street
Swimming pools Section 42
A Site Plan shall be required for single-family (detached) or two-family residential development
in which the proposed subdivision will include I) a private amenity or facility s
comprised of one
(I) or more buildings (such as a private recreation/swimming facility, clubhouse.etc.), 2) a golf
course, and/or 3) a gated (restricted access) entrance into the subdivision. In these instances.Site
Plan submission and approval will be required for these elements (a Site Plan showing the entirety
of the proposed subdivision is not required). Site Plan submission and approval shall be in
accordance with Section 3l.B.4, but shall not require a public hearing as required by Section
3 l .B.4.E.
Any nonresidential land use which may be permitted in this district shall conform to the “NS"-
Neighborhood Service district standards.

Request: A request for a variance to Section 19.4 pertaining to, Area Regulations: A. Size of lots: 2.
Minimum Lot Width- Sixty feet (60’).The property is located at 1212 S. Rockwall Terrell,
Texas, described as, Phagan, Block 3, Lot 48 & 49, City of Terrell, Kaufman County,
Texas. The applicant is requesting a variance to allow for a lot width of 50 feet. The
applicant proposes to combine two 25-foot lots together to create one with a 50-foot width.
The proposed lot will be 7,175 square feet. Property is currently zoned Single-Family
Residential-6 (SF-6).
The Zoning Board of Adjustment (ZBA) will consider this request at a public hearing to be held:

This notice has been sent to all owners of real property within 200 feet of the area of request based on ownership as it appears on the last
approved city tax roll.
Speakers at the public hearing should limit their comments to three minutes and are asked to speak into the microphone and identify
themselves for the record. Comments of a personal nature directed at the Board or staff are inappropriate.
Persons who are unable to attend the hearing, but would like their view to be part of the public record, may send signed, written comments,
referencing the Variance Request (VR 21-16) number above, prior to the date of the public hearing to: Municipal Development
Department, P.O. Box 310, Terrell, TX 75160. If you choose to attend this hearing, you will be given the opportunity to speak to the
Planning & Zoning Commission in support or opposition to the above request. The City of Terrell will adhere to the current COVID-19
guidelines and only allow a very limited number of citizens into the meeting at a time to speak to the Commission in support or opposition
to the request. All who attend will be given the opportunity to take a turn in the building for purpose of giving comments in person.
Action: The Zoning Board of Adjustment may approve the request if the applicant can demonstrate that the variance is not contrary to the
public interest; that due to special conditions, a literal enforcement of the Ordinance would result in unnecessary hardship; and that the spirit
of the Ordinance will be maintained if the variance is granted.
Agenda: The agenda for the Zoning Board of Adjustment will be posted on the City of Terrell Bulletin Board before 5:00 p.m. on the
Friday prior to the public hearing.
