MINUTES OF MEETING
INDIAN HILL PLANNING COMMISSION
December 17, 2025
The regular meeting of the Indian Hill Planning Commission was held on December 17,
2025 at 5:30 p.m. in Council Chambers of the Village Administration building.

In the absence of Mrs. Stolper, Mr. McGraw asks for anyone planning to speak this
evening to please stand, raise their right hand, and be sworn in prior to presentation of
the case.
Item Number 1: Minutes and findings from the July 16, 2025 Indian Hill Planning
Commission meeting: Approval was tabled until the next meeting due to Mr.
Rhodenbaugh being the only one present this evening who was also present at the July
16, 2025 meeting.
Item Number 2: Case #25-009: Kathi and Sean Bagnoli are requesting a variance
from Section 73.2 of the Indian Hill Zoning Ordinance to reduce the side yard setback
for the construction of a new detached garage in approximately the same location as
the existing detached garage. The subject property is located at 5570 Miami Road.
Mrs. Kathi Bagnoli, residing at 5570 Miami Road, comes before the Commission and
states that they currently have more of a covered carport than an actual garage. The
concrete floor is sinking and crumbling, and there’s a hole in the back wall. The
deteriorating condition of the structure has become an eyesore.
Mrs. Bagnoli states that the new garage will be in the same general location as the
current structure. She explains that there’s currently a bump out in the back (small
closet), which will not be there once the new garage is constructed.
She adds that the topography of the lot does not allow for the garage to be located in
any other area.

• 1952 – The home and detached garage were constructed.
• 05/21/57 – A variance was granted to reduce the side yard setback for an
addition.
• 05/23/05 – A site clearance permit was issued for additions.
Mr. West describes the subject property as being located on the east side of Miami
Road between Brill Road and Graves Road. The existing home and detached garage
are non-conforming because they do not meet the minimum required setbacks. The
house is 15.2' from the right (south) side lot line and 19.5' from the left (north) side lot
line, where a minimum of 20' is required. The existing detached garage that is
proposed to be razed and replaced with the new detached garage is located 5'-9" from
the left (north) side lot line where a minimum of 15' is required. The property is located
in zoning District “C” – one acre minimum and requires a lot width/frontage of 150'. The
lot is non-conforming because it contains 0.913 acres, and the lot width is 100'.
The new home to the north at 5580 Miami Road received a variance from the Planning
Commission on December 20, 2022 to raze the existing non-conforming home and
construct a new home using the same non-conforming left (north) side yard setback of
9.14', where a minimum of 20' is required per Section 73.1 of the Indian Hill Zoning
Ordinance.
The applicant is requesting variance approval to construct a new 24' x 30' (720 SF)
garage 10' from the left (north) side lot line and in the same general location as the
former 20' x 20' (400 SF) detached garage where 15' minimum is required per Section
73.2 of the Indian Hill Zoning Ordinance. The proposed garage would not worsen the
non-conforming side setback of 5'-9".
The variance application is based on exceptional practical difficulty created by the non-
conforming lot, non-conforming detached garage, and non-conforming home.
Mr. McGraw waives the reading of the four variance review criteria and staff’s response
to each, as they were in the staff report previously distributed to Planning Commission
members and available to those present this evening.
Staff posted the legal notice in the paper and by direct mail prior to the hearing. Staff
has not been contacted by anyone.
After brief discussion, Mr. Rhodenbaugh made a motion to approve the requested
variance. Mrs. Stern seconded, and the motion was approved by a unanimous voice
vote of all those present.
There being no further business to come before the Commission, Mr. McGraw made a
motion to adjourn. Mr. Rhodenbaugh seconded, and the motion was approved by a
unanimous voice vote.
