MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, AUGUST 13, 2015 6:00 P.M. 1.0 The meeting was called to order by Chairman John Ford at 6:00 p.m. Other members present were: Board Member Jarmon Wolfe Board Member Brett Tynes Board Member April Gray Alternate Board Member Michelle Beauvais Excused Absence – Billy Hemby Others present: Community Development Director – Craig Meyers City Planner – Harold Ellis Assistant City Planner – Amelia Vasquez City Attorney – Loren Smith City Engineer – Lori Lakatos 2.0 No Public Comments were received. 3.0 Harold Ellis, City Planner, announced Board Training is scheduled for the September 10, 2015 meeting. 4.0 Motion was made by Board Member Tynes, second by Board Member Gray, to approve the Minutes of Special Board of Adjustments Meeting of July 9, 2015. Motion carried unanimously. 5.0 New Business: 5.1 Consideration to approve BOA Case P15-079: Request by Christopher & Elizabeth Wanner for a variance from Section 50-69(d)(2)(b) of the Code of Ordinances to allow a garage and porte cochere to be 5-feet from the side property line where a 10- foot side building setback is required. The project site is approximately .67 acres, is generally located south of Wildwood Drive between Lost Creek Road and Helen Lane, is zoned Single-Family Estate Residential-20 District, and is legally described as Lot 9, Block 4, Hunterwood Section 1. Applicant, Christopher Wanner (13315 Wildwood Dr.) spoke on behalf of the case. The Public Hearing was opened by Chairman Ford at 6:09 p.m. Hearing no comments, the Public Hearing was closed at 6:09 p.m. Motion was made by Board Member Tynes, second by Alternate Board Member Beauvais, to approve BOA CASE P15-079. Motion carried unanimously. 5.2 Consideration to approve BOA Case P15-080: Request by Craig Swinghammer for a variance from Section 50-69(d)(3) of the Code of Ordinances to allow a single- family residence to be 576 square feet where a minimum of 1,600 square feet is required. The project site is approximately 3.68 acres, is generally located east of South Cherry Street, north of Pine Meadow Street, is zoned Single-Family Estate Residential-20 District, and is legally described as Tract 209A, Tomball Outlots. Harold Ellis, City Planner, presented the staff report and recommendation. Applicant, Craig Swinghammer (1850 S. Cherry) spoke on behalf of the case. The Public Hearing was opened by Chairman Ford at 6:15 p.m. Hearing no comments, the Public Hearing was closed at 6:16 p.m. Motion was made by Board Member Wolfe, second by Board Member Tynes, to approve BOA CASE P15-080. Motion carried unanimously. 6.0 Motion was made by Board Member Tynes, second by Board Member Wolfe, to adjourn. Motion carried unanimously. Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, August 13, 2015 at 6:00 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action. The Board of Adjustments reserve the right to meet in a closed session for consultation with attorney on any agenda item should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code. 1.0 Call to Order 2.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on any matter other than personnel matters or matters under litigation, for length of time not to exceed three minutes.
