SPECIAL BOARD OF ADJUSTMENTS MEETING
CITY OF TOMBALL, TEXAS
THURSDAY, NOVEMBER 12, 2015
6:00 P.M.
1.0 The meeting was called to order by Chairman John Ford at 6:33 p.m. Other members present
were:

Board Member Brett Tynes
Board Member Billy Hemby
Board Member April Gray - Absent
Others present:

Assistant City Planner – Amelia Lindley
City Attorney – Loren Smith
City Engineer – Lori Lakatos

2.0 No Public Comments were received.
3.0 No Reports and Announcements were heard.
4.0 Motion was made by Board Member Tynes, second by Board Member Hemby, to approve
the Minutes of Special Board of Adjustments Meeting of September 10, 2015.
Motion carried unanimously.
5.0 New Business:
5.1 Consideration to approve BOA Case P15-110: Request by Long Nguyen on behalf
of Tower Oak Partners LLC, for a special exception from Section 50-82(b) of the
Code of Ordinances to allow a reduction in the required off-street parking spaces. The
project site is approximately 0.9255 acres, generally located on the east side of S.H.
249, north of Zion Rd., zoned Commercial, and is legally described as Reserve C1
Block 4 Tomball Hills Replat.
Harold Ellis, City Planner, presented the staff report and recommendation.
Applicant, Long Nguyen (10703 Woodedge Drive, Houston, TX 77070) spoke on
behalf of the case.

The Public Hearing was opened by Chairman Ford at 6:40 p.m.
Tom Crofoot, (1430 Dale Drive, Tomball, TX 77375) spoke against the applicant’s
appeal.
Eric Hayes, Tenant for Cash America Pawn Shop, (11806 Cypress Place Dr.,
Houston, TX 77065) spoke in favor of applicant’s appeal.
The Public Hearing was closed at 6:47 p.m.
Motion was made by Board Member Tynes, second by Board Member Hemby, to
approve BOA CASE P15-110.

Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday,
November 12, 2015 at 6:00 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the
purpose of considering the following agenda items. All agenda items are subject to action. The
Board of Adjustments reserve the right to meet in a closed session for consultation with
attorney on any agenda item should the need arise and if applicable pursuant to authorization
by Title 5, Chapter 551, of the Texas Government Code.

2.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on
any matter other than personnel matters or matters under litigation, for length of time not to
