MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, APRIL 13, 2017 6:00 P.M. 1.0 The meeting was called to order by Chairman Brett Tynes at 6:10 p.m. Other members present were: Board Member Billy Hemby Alternate Board Member Robert Maxwell Board Member April Gray Board Member Jarmon Wolfe Others present: Community Development Director– Craig Meyers Planner – Amelia Lindley City Attorney – Loren Smith 2.0 No Public Comments were received. 3.0 Amelia Lindley, Planner, announced there is a BOA Case scheduled for the April 27th Meeting at 6:00 p.m. 4.0 Motion was made by Board Member Hemby, second by Board Member Wolfe, to approve the Minutes of Special Board of Adjustments Meeting of March 9, 2017. Motion carried unanimously. 5.0 New Business: 5.1 Consideration to approve BOA Case P17-0020: Request by Naphtali Carlson, for a variance from Section 50-115(d) (Fences in residential areas) of the Code of Ordinances to allow an eight foot front yard fence where a maximum four foot fence is allowed. The project site is approximately 0.93 acres, generally located at the southwest corner of Evergreen and Ulrich Road, is zoned Single-family 20 Estate District and legally described as Lot 1 Evergreen Estates U/R. The Public Hearing on was opened by Chairman Tynes at 6:13 p.m. Amelia Lindley, Planner, presented the staff report and recommendation of approval with condition.  Minutes Special Board of Adjustments Meeting April 13, 2017 Page 2 of 3 Naphtali Carlson, Applicant (30733 Ulrich Road, Tomball, Texas 77375), spoke on behalf of the request. Hearing no comments, The Public Hearing was closed at 6:34 p.m. Motion was made by Alternate Board Member Maxwell, second by Board Member Gray, to approve BOA Case P17-0020 with the condition as recommended by Staff. Vote was as follows: Chairman Brett Tynes Aye Board Member Bill Hemby Aye Alternate Board Member Robert Maxwell Aye Board Member April Gray Aye Board Member Jarmon Wolfe Aye Motion carried unanimously. 5.2 Consideration to approve BOA Case P17-0027: Request by Jerry Laird, for a variance from Section 50-71(d)(2) (Size of yards) of the Code of Ordinances to allow a five foot front yard setback where a minimum 20 foot setback is required for a proposed attached carport. The project site is approximately 0.07 acres, generally located on the south side of Barbara Street, between Raymond Street and Lawrence Street at 1003 Barbara Street, is zoned Single-family 6 District and legally described as Tract 1A Block 8, west 60 feet of Lot 1 & 2 Main Street Addition – Tomball. The Public Hearing on was opened by Chairman Tynes at 6:39 p.m. Amelia Lindley, Planner, presented the staff report and recommendation of approval. Jerry Laird, Applicant (405 Florence Street, Tomball, Texas 77375), spoke on behalf of the request. Hearing no comments, The Public Hearing was closed at 6:44 p.m. Motion was made by Board Member Wolfe, second by Board Member Gray, to approve BOA Case P17-0027.
