The Council meeting was called to order by Mayor Gretchen Fagan. Other members present

5.0 Presentations:
● Mayor Fagan presented Proclamations declaring the following:
○ April 23, 2012 – “Rochelle Cook – Heritage Tea Award Recipient for 2012” Day
○ May 2012 – “Motorcycle Safety Awareness Month”
○ May 5, 2012 – “Billie Ann Dio Day”; the Mayor also announced Tomball High
School Student Council’s receipt of the 2012 National Gold Council of Excellence
Award and the Texas Association of Student Council’s Top 10 Projects in Texas
Award. The THSSC members requested Council’s approval of the 4th Annual
Homecoming Rally and Parade, to be held on October 24, 2012; item will be placed
on the May 21, 2012 agenda.
○ May 14, 2012 – “Tomball Renewal Center Day” was not presented
○ May 15, 2012 and May 13-19, 2012 – “2012 Peace Officers Memorial Day and
Police Week” will be presented on May 15, 2012 during the memorial ceremony

7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the
Minutes of the April 16, 2012 Regular City Council Meeting.
Motion carried unanimously.
8.0 Old Business:
8.1 Motion was made by Councilman Dodson, second by Councilman Townsend, to adopt on
Second Reading, Ordinance No. 2012-05, an Ordinance of the City of Tomball, Texas,
Amending its Comprehensive Zoning Ordinance by changing the Zoning District
Classification of approximately 10 acres of land, Legally described as Lots 330 and 333,
Tomball Outlots, Within the City of Tomball, Harris County, Texas, from the
Agricultural District to the Light Industrial District; Said property being generally located
easterly of South Persimmon Road, southerly of F.M. 2920; Providing for the
Amendment of the Official Zoning Map of the City; Providing for severability; Providing
for a penalty of an amount not to exceed $2,000 for each day of violation of any
provision hereof, Making findings of fact; and providing for other related matters. Vote
was as follows:

8.2 Motion was made by Councilman Brown, second by Councilman Townsend, to adopt,
on Second Reading, Ordinance No. 2012-06, an Ordinance of the City of Tomball, Texas,
Adopting Homestead Exemptions for Property Owners Sixty-Five Years of Age and
Over, and for Property Owners Who Qualify for Disability Benefits Under the Federal
Old Age, Survivors, and Disability Insurance Program for the Year 2012 and Future
Years, Unless Revised, on All Taxable Real and Personal Property Located in the City of
Tomball, Texas; Providing for Penalty, Interest, and Additional Penalty on Taxes Not
Timely Paid; Providing for Severability; and Providing Other Matters Relating to the
Subject. Vote was as follows:

8.3 Motion was made by Councilman Dodson, second by Councilman Stoll, to adopt,
on Second Reading, Ordinance No. 2012-07, an Ordinance of the City of Tomball, Texas,
Amending the Code of Ordinances of the City of Tomball by Amending Chapter 60,
Signs, to Add a New Subsection (b)(6) to Section 60-9, Off-Premises Sign Provisions, to
Allow the Addition of an LED Clock Display to Off-Premise Sign. Vote was as follows:

9.0 New Business:
9.1 Mayor Fagan opened the Public Hearing on the Proposal to create City of Tomball
Reinvestment Zone No. 3 at 6:57 p.m.
No public comments being received, Mayor Fagan closed the public hearing at 6:58 p.m.
9.2 Motion was made by Councilman Brown, second by Councilman Dodson, to read
Ordinance No. 2012-08 by caption only on First Reading.
Motion carried unanimously.
Motion was made by Councilman Stoll, second by Councilman Dodson, to adopt, on
First Reading, Ordinance No. 2012-08, an Ordinance Creating City of Tomball, Texas
Reinvestment Zone No. 3; an Approximately 7.2854-Acre Tract of Land, Located at 915
Cherry Street within the City of Tomball, Harris County, Texas; Making Certain Findings;
Repealing Ordinances Inconsistent or in Conflict Herewith; and Providing for Severability.

9.3 Motion was made by Councilman Dodson, second by Councilman Brown, to approve
Resolution No. 2012-09, a Resolution of the City Council of the City of Tomball, Texas
Authorizing the Purchase of Property from Harkins and Bartlett Investments, Ltd. and
Arbor Quercus Delta, Ltd. for Use in the Medical Complex Drive Expansion Project; and
Authorizing the City Manager to Execute all Documents Related Thereto, in the Amount
of $1,185.00.
Motion carried unanimously.
9.4 Motion was made by Councilman Townsend, second by Councilman Dodson, to approve
Resolution No. 2012-10, a Resolution of the City Council of the City of Tomball, Texas
Authorizing the Purchase of Property from Harkins and Bartlett Investments, Ltd. for Use
in the Medical Complex Drive Expansion Project; and Authorizing the City Manager to
Execute all Documents Related Thereto, in the Amount of $18,505.00.
Motion carried unanimously.
9.5 Motion was made by Councilman Brown, second by Councilman Townsend, to approve
Resolution No. 2012-11, a Resolution of the City Council of the City of Tomball, Texas,
Authorizing the Purchase of Property from Harkins and Bartlett Investments, Ltd. for Use
in the Medical Complex Drive Expansion Project; and Authorizing the City Manager to
Execute all Documents Related Thereto, in the Amount of $19,603.00.
Motion carried unanimously.
9.6 Motion was made by Councilman Dodson, second by Councilman Townsend, to award
Contract to Reliable Commercial Roofing, for RFP No. 2012-05 - Police Department/Jail
Roof Replacement, in the Amount of $139,000.00.
Motion carried unanimously.
10.0 Motion was made by Councilman Dodson, second by Councilman Stoll, to adjourn.
Motion carried unanimously.
